<ul><li>WhatsApp and Facebook filed a plea in the <keyword id="6355014" type="COMPANY" weightage="20" keywordseo="delhi-high-court">Delhi High Court</keyword> for a stay on the <keyword id="97393" type="COMPANY" weightage="20" keywordseo="Competition-Commission-of-India">Competition Commission of India</keyword>’s (<keyword id="47183" type="COMPANY" weightage="20" keywordseo="CCI">CCI</keyword>) plans to conduct an antitrust investigation.</li><li>The tech giants argue that the issue of data sharing is one of privacy, and does not fall under the purview of India’s competition watchdog.</li><li>However, India's solicitor general undercut their argument saying the issue is not whether or not data is being collected — the issue is how it is being used.</li><li>He argued that changes to WhatsApp's privacy policy could give the companies an unfair advantage and ammunition to push competitors out of the market.</li></ul>India’s competition watchdog doesn’t want WhatsApp sharing user data with its parent company, Facebook. But, the tech giants don’t believe that is the CCI’s place to have an opinion on the matter. While the Delhi High Court has reserved its order on WhatsApp and Facebook’s challenge to the probe by the Competition Commission of India (CCI), the two sides had some scathing exchanges during the arguments. <div type="Article" hostid="261" msid="81673084" title="WhatsApp faces a fresh antitrust investigation in India over its new privacy policy that shares users’ data with Facebook" mstype="2" mssubtype="0"></div> The plea filed by WhatsApp and its parent company asserted that since there is already an ongoing case in the <keyword id="6354977" type="COMPANY" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> over the policy update, the CCI does not need to conduct its own investigation. The messaging platform’s 2021 update states that WhatsApp will be sharing user data with Facebook in order to optimise recommendations for their users. The CCI contends that WhatsApp is using its dominant position in the market to force users to share information with its parent company. India’s competition watchdog believes that ‘excessive’ data collection is getting in the way of creating a healthy competitive environment. Harish Salve, who argued on behalf of the tech giants, asserted that the issue of whether excessive data collection has any anti-competitive implications is something for the Indian government to decide, not the CCI. <cmsannotation type="cmsannotation" annotationid="Is the WhatsApp-Facebook connection a matter of privacy or data use?" comment="subhead" text="Is the WhatsApp-Facebook connection a matter of privacy or data use?">Is the WhatsApp-Facebook connection a matter of privacy or data use?</cmsannotation> According to Salve, the CCI’s probe into Facebook and WhatsApp is not a matter of competition but of protection and privacy — which would fall under the government’s purview since they are constitutional issues. He also argued that since the privacy policy under question is with respect to WhatsApp, there is no point in dragging Facebook into the picture. However, assistant solicitor general (ASG) Aman Lekhi, hit back saying that the analysis of the data collected by WhatsApp will give even more information about an individual than actual physical stalking. The company can then use this data to either buy out the competition or make it irrelevant over time. “Facebook comes into the picture because of the privacy policy through which data collection is happening,” Lekhi explained. According to him, the purpose of data sharing is targeted advertising and customer profiling. So, when it comes to the issue of privacy versus access to data, the issue is that the data will have exclusionary effects. “The problem is that <a href="https://twitter.com/LiveLawIndia/status/1381887150371696645">nomenclature</a> is ‘privacy policy’ but the issues arising are to do with the competition aspect,” Lekhi told the High Court. Simply put, India's argument is that these changes to WhatsApp's privacy policy could give both the messaging app, as well as Facebook and Instagram, an unfair advantage over its competitors and may drive them out of business. The Delhi High Court has not issued a verdict on the matter and reserved its judgement. The date for the next hearing has not been announced yet. What WhatsApp and Facebook want to do is worse than stalking, India's solicitor general tells court

New Delhi [India], November 24 (ANI): Hearing the Adani-Hindenburg matter, the <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday remarked that it is easy to make allegations against anyone and opined the petitioners to show some responsibility while levelling charges against any party. A bench of Chief Justice of India DY Chandrachud, also comprising justices JB Pardiwala and Manoj Misra passed the remarks when one of the petitioners raised questions over members of the expert committee. Advocate Prashant Bhushan, appearing for one of the petitioners, told the court about one of the members of the expert committee Somashekhar Sundaresan, noting that he has been a lawyer representing Adin various forums including in the SEBI Board. CJI DY Chandrachud raised an objection to the petitioner's submission and remarked that if one goes with the theory that a lawyer who appeared 17 years ago can now not be appointed to the committee and like this, no lawyer who has appeared for an accused should become a High Court judge. CJI DY Chandrachud remarked that he is not an in-house counsel he was a lawyer and he appeared in 2006 and this conflict arose 17 years later. There has to be some responsibility for the allegations being levelled, SC remarked. During the hearing, the court also remarked that it is easy to make allegations and one must be also very careful. "We are not giving a character certificate to anyone," SC noted. When the hearing commenced today, Solicitor General Tushar Mehta told the top court that SEBI is not seeking an extension of further investigation matters relating to the Hindenburg report. Out of 24 cases in the Adani-Hindenburg matter, investigations in 22 cases are over For the remaining two cases, they need information from foreign regulators and others and they have been in consultation with them, SG Mehta informed the court. The court then said that it had intervened in the matter due to the extreme volatility of the stock market and sought to know what is SEBI planning to do for such kind of volatility and planning to protect investors in cases like short selling. SG Tushar Mehta took the court through the recommendations of the Expert Committee which SEBI has agreed with in principle. Advocate Prashant Bhushan, appearing for the petitioner, told the SC that there were many factual revelations in the Hindenburg report. He raised doubts about SEBI's role in the matter and says a lot of information was available to it in 2014. Bhushan informed the SC about a letter written in 2014 by the Directorate of Revenue Intelligence regarding substantial money siphoned to Mauritius. SG Mehta questioned Bhushan over this and said that DRI concluded the proceedings in 2017. The court remarked that to advocate Bhushan, appearing for the petitioner, it is easy to make allegations and one must be also very careful. SG Tushar Mehta urged the top court to stop these kinds of allegations. The court remarked that SEBI, a statutory body looks into stock market frauds. SG Tushar Mehta said that there is a growing tendency to plant stories outside India to influence decisions within India. After hearing the matter in length, the court reserved the order on various aspects related to the issue. Earlier, the <keyword id="6355630" type="General" weightage="50" keywordseo="securities-and-exchange-board-of-india" source="Orion">Securities and Exchange Board of India</keyword> (SEBI) filed a status report before the Supreme Court apprising it that out of 24 investigations arising out of the Hindenburg report, 22 are final in nature and 2 are interim in nature. The investigation was carried out in compliance with the directions of the top court's order dated March 2, 2023, SEBI has investigated 24 matters. In the mid of May, the top court gave three months more time to the Securities and Exchange Board of India (SEBI) to conduct a probe into the Hindenburg report SEBI was granted time till 14th August 2023 to conduct the probe. On March 2, the <keyword id="6356229" type="General" weightage="80" keywordseo="apex-court" source="Orion">apex court</keyword> directed the capital market regulator SEBI to investigate any violations of securities law by the <keyword id="6367820" type="General" weightage="80" keywordseo="adani-group" source="Orion">Adani Group</keyword> in the wake of the Hindenburg report, which led to a massive wipeout of more than USD140 billion of the Adani Group's market value. Supreme Court, on March 2, set up an expert committee on the issue arising from the <keyword id="9916845" type="General" weightage="50" keywordseo="hindenburg-research" source="Orion">Hindenburg Research</keyword> report on Adani Group companies. The committee will consist of six members, headed by former apex court judge Justice AM Sapre. The top court had then asked SEBI to file a status report within two months. The apex court was then hearing petitions pertaining to the Hindenburg report, including the constitution of a committee relating to regulatory mechanisms to protect investors' interests. The January 24 Hindenburg report alleged stock manipulation and fraud by the conglomerate. The Adani Group has attacked Hindenburg as "an unethical short seller", stating that the report by the New York-based entity was "nothing but a lie". Senior Meta India executive Manish Chopra quits; fourth major exit in 6 months

The <keyword id="6354977" type="ORGANIZATION" weightage="80" keywordseo="Supreme-Court">Supreme Court</keyword> asked Reliance ADAG's power distribution company, BSES Yamuna to pay up its dues to electricity generating utilities totaling Rs 257 crore by July 15. Currently, the company has 13.5 lakh customers in central and east Delhi.
 As per the records till June 30, the power distribution company owes Rs 60 crore to central generating and transmission utilities, including <keyword id="75753" type="COMPANY" weightage="40" keywordseo="Damodar-Valley-Corporation">Damodar Valley Corporation</keyword>, <keyword id="105181" type="COMPANY" weightage="40" keywordseo="Power-Grid-Corporation">Power Grid Corporation</keyword> and <keyword id="2402471" type="UNKNOWN" weightage="40" keywordseo="Aravali-Power-Company-Ltd-">Aravali Power Company Ltd.</keyword> <keyword id="75796" type="COMPANY" weightage="80" keywordseo="BSES-Yamuna">BSES Yamuna</keyword> also owes Rs 195 crore to Delhi-based power generating units Indraprastha, Delhi Transco and <keyword id="301258" type="COMPANY" weightage="40" keywordseo="Pragati-Power-Corporation">Pragati Power Corporation</keyword>. 

	BSES Yamuna also clarified that the government subsidy, which was promised but not factored in, was to the tune of Rs 96 crore and hence its total liability would be Rs 161 crore.
 Appearing for Delhi Transco and Indraprastha, <keyword id="132134" type="POSITION" weightage="40" keywordseo="Additional-Solicitor-General">additional solicitor general</keyword> <keyword id="243257" type="PERSON" weightage="40" keywordseo="Tushar-Mehta">Tushar Mehta</keyword> said the total dues as per their calculation was Rs 370 crore. However, <keyword id="45179" type="CITY" weightage="40" keywordseo="NTPC">NTPC</keyword>, which was the first to approach the court with a threat to disconnect power supply to the national capital because of mounting arrears from BSES Yamuna, informed the court that it had been fully paid by the discom. BSES’s <keyword id="2117" type="POSITION" weightage="40" keywordseo="senior-advocate">senior advocate</keyword> K V Vishwanathan attempted to put forth the discom's grievance. He said the state had not kept its promise of giving proper return on the Rs 15,000 crore investment made by the company. However, a bench headed by Chief Justice R M Lodha and Justice <keyword id="135052" type="PERSON" weightage="40" keywordseo="Madan-B-Lokur">Madan B Lokur</keyword> and Justice <keyword id="108280" type="PERSON" weightage="40" keywordseo="Kurian-Joseph">Kurian Joseph</keyword> said the apex court would decide about BSES Yamuna's grievances against the <keyword id="6354952" type="ORGANIZATION" weightage="40" keywordseo="Delhi-Government">Delhi government</keyword> later. 

	“We are directing you only to pay current dues. Power generation and transmission companies are no baniya shops. You must clear all dues since January 2014 if you want electricity. You can’t continue like this. You are in arrears, arrears, arrears... This isn’t our headache,” observed the court.

Nagaprasanna, on Friday, though dismissed the petition, upheld its maintainability.</li></ul><keyword id="6354321" type="General" weightage="50" keywordseo="bengaluru" source="Orion">Bengaluru</keyword>, Karnataka High Court has rejected Chinese firm Xiaomi's plea against the seizure of Rs 5,551.27 crore from its bank accounts by the Enforcement Directorate (ED). A single-judge bench of Justice M. Nagaprasanna, on Friday, though dismissed the petition, upheld its maintainability. The Chinese technology company is facing charges of violations of the provisions of the Foreign Exchange Management Act (FEMA). The bench observed that challenge to the Constitutional validity of Section 37A of the Act by the petitioner is held to be maintainable, on the fulcrum of the allegation that it is violative of Article 14 of the Constitution. As Article 14 is person centric whereas Fundamental Rights under Article 19 are citizen centric. Appearing for the central government and the ED, Additional Solicitor General M.B. Nargund Amaintained that Xiaomi is a foreign entity and can not maintain writ petition. Earlier, counsels for <keyword id="2210169" type="General" weightage="50" keywordseo="xiaomi-india" source="Orion">Xiaomi India</keyword> had argued that the firm was being targetted as it is a Chinese company and other companies are allowed to make payments of technology royalty. They have also brought to the notice of the court that banks are not allowing Xiaomi to make remittances in foreign exchange for imports. They argued that the company is required to make payments for foreign companies in connection with manufacturing and marketing smartphones. Contesting this Additional Solicitor General Nargund had explained that the authorities had no complaints if Xiaomi is agreeable to keep the seized amount in the bank and use remaining amount. He brought to the notice of the court that on April 24 and 29, before the ED passed the order to seize Xiaomi's bank accounts, there was a transfer of around Rs 1,500 crore from the company's bank accounts as per the available information. However, <keyword id="2402890" type="General" weightage="50" keywordseo="xiomi" source="Orion">Xiomi</keyword> is maintaining that royalty payments made to three companies abroad would not violate the FEMA Act. The company further maintained that the IT department itself had allowed it as a value added activity.
