New Delhi, Legal doyen and veteran advocate Fali S <keyword id="20668460" type="General" weightage="20" keywordseo="nariman" source="keywords">Nariman</keyword> died here on Wednesday at the age of 95. He was suffering from multiple ailments, including cardiac issues. Born on January 10, 1929, Nariman was enrolled as an advocate at the Bombay High Court in November 1950 and was designated a senior advocate in 1961. Nariman was born in Rangoon (now Yangon) to a well-off business executive. The Nariman family fled to India in the face of the Japanese invasion in 1942 when Fali was 12. He practised law for more than 70 years, initially in the Bombay High Court and since 1972, in the Supreme Court. Nariman was appointed as the additional solicitor general of India in May 1972. He resigned from the post a day after the imposition of Emergency on June 26, 1975. In his long and illustrious legal career, Nariman argued in several landmark cases, including the Bhopal gas tragedy case, TMA Pai case, Jayalalithaa disproportionate assets case and the famous case of the National Judicial Appointments Commission, which was struck down by the Supreme Court. Nariman, who was often referred to as the "Bhishma Pitamah" of the Indian judiciary, authored books, including "Before the Memory Fades", "The State of the Nation", "India's Legal System: Can it be Saved?" and "God Save the Hon'ble Supreme Court". Nariman received the Padma Bhushan in January 1991 and in 2007, he was awarded the Padma Vibhushan. He was also nominated as a member of the Rajya Sabha in November 1999. Reacting to the news of his death, senior advocate Abhishek Singhvi took to X and wrote: "End of an era' #falinariman passes away, a living legend who will forever be in hearts and minds of those in law and public life. Above all his diverse achievements, he stuck to his principles unwaveringly and called a spade a spade, a quality shared by his brilliant son #Rohinton." Solicitor General <keyword id="20038814" type="General" weightage="20" keywordseo="tushar-mehta" source="keywords">Tushar Mehta</keyword> said not only the legal fraternity, but the country has lost a towering figure of intellect and wisdom. "The country has lost an epitome of what righteousness stood for. A doyen, paragon and a legend in his own lifetime has left us, leaving the jurisprudence enriched by his immense contribution. I have always learnt something new by merely appearing even against him," the law officer said in his message. Activist-lawyer <keyword id="20027334" type="General" weightage="20" keywordseo="prashant-bhushan" source="keywords">Prashant Bhushan</keyword> said Nariman's death was an enormous loss to the country. In a post on X, Bhushan wrote: "Very sad news. Eminent Jurist Fali S Nariman Passes Away. He was also regarded as the Bhishma Pitamah of the lawyer community. A great lawyer and close friend of our family. His passing away at this critical juncture is an enormous loss for our country." Fali Nariman's son, <keyword id="20668461" type="General" weightage="20" keywordseo="rohinton-nariman" source="keywords">Rohinton Nariman</keyword>, was a Supreme Court judge.

<keyword id="6358777" type="LOCATION" weightage="20" keywordseo="New-Delhi">New Delhi</keyword>, The Centre on Tuesday informed the Supreme Court that no <keyword id="1773298" type="PERSON" weightage="20" keywordseo="coercive-steps">coercive steps</keyword> will be taken against the slum dwellers, until a decision is taken by the government on the issue of removal of 48,000 <keyword id="6367743" type="UNKNOWN" weightage="20" keywordseo="slums">slums</keyword> along the railway tracks in Delhi. <keyword id="6954728" type="UNKNOWN" weightage="20" keywordseo="Solicitor-General-Tushar-Mehta">Solicitor General Tushar Mehta</keyword>, representing the Centre, submitted before a bench headed by Chief Justice S. A. Bobde that the government is still deliberating on the issue and assured that until a decision is taken, there will be no coercive steps. After a brief hearing in the matter, the bench, which also comprised Justices A.S. Bopanna and V. Ramasubramanian, adjourned the matter for four weeks after taking on record the Centre's submissions. During a brief hearing, the Chief Justice inquired as to the number of residents in these slums along the railway tracks, and senior advocate Collin Gonsalves responded that it runs into lakhs. On September 14, Mehta had informed the top court that for the time being, there will be no removal of 48,000 slums along the railway tracks in Delhi. Mehta had submitted that the Ministry of Railways, Ministry of Housing and Urban Affairs, and the Delhi government are going to take a decision on the issue raised in the <keyword id="10326177" type="UNKNOWN" weightage="20" keywordseo="instant-interlocutory-applications">instant interlocutory applications</keyword> and "till then they will not take any coercive action against the slum dwellers". Senior advocate Abhishek Manu Singhvi, appearing for senior Congress leader Ajay Maken, had submitted before the bench that the court should order a status quo. To this the bench said that it will not, as the Centre has already stated that there will be status quo till a decision is taken. He argued that demolitions have taken place on Friday and Monday, therefore the instructions need to be given to stop it. Senior advocate Salman Khurshid had submitted before the bench that he appeared on behalf of the applicants who are directly affected as they are 'jhuggi' dwellers. Khurshid emphasised that they need to be heard and urged the court to make them a party in the case. Delhi government counsel had contended before the court that the government will fully co-operate in regard to the laws and rules in place for rehabilitation. The top court, in its order, said: "Stand over for four weeks. Put up along with the interlocutory application(s) for impleadment as prayed for by Salman Khurshid, senior counsel assisted by Lubna Naaz, Advocate-on-Record for the applicant(s)." Maken had moved the Supreme Court challenging its order to remove nearly 48,000 jhuggis along the railway tracks in Delhi. On August 31, the Supreme Court had ordered removal of these slum dwellings within three months and said that no political interference will be entertained in the matter. Maken, in an intervention application, said the agencies - Ministry of Railways, Delhi government etc, - have already initiated the process identification and removal of jhuggis and have issued demolition notices in various slums in Delhi. "Further, while doing so they have circumvented the established procedure by law with respect to rehabilitation of the slum dwellers prior to eviction/demolition of their jhuggis and ignorance of the procedure enshrined in the Delhi Slum &amp; JJ Rehabilitation and Relocation Policy, 2015 and the Protocol (for removal of jhuggis)," said the application.

The Supreme Court on Monday asked the Centre to file status report on extradition of fugitive businessman Vijay Mallya within six weeks. <keyword id="6954728" type="UNKNOWN" weightage="20" keywordseo="Solicitor-General-Tushar-Mehta">Solicitor General Tushar Mehta</keyword>, representing the Centre, submitted before a bench headed by Justice U.U. Lalit that some legal proceedings are still pending in the UK, which is delaying Mallya's extradition. The top court after a brief hearing in the matter adjourned the case to the third week of January. Justice Lalit noted that the order dated August 31, cites MEA report that certain legal proceedings by contemnor (Mallya) is pending in the UK. The top court had asked the counsel for Mallya to respond on the nature of these proceedings. The bench noted that an intervention application has been filed by E.C. Agrawala, counsel for Mallya seeks discharge from the case. Justice Lalit said this application seeking discharge is rejected and Agrawala shall continue to be the counsel for the contemnor. Justice Lalit queried Mehta, "When will the Mallya's extradition process will be completed? Any time time frame?" Mehta replied that no information from Indian High Commission in London yet. On October 6, the Ministry of Home Affairs (MHA) has told the Supreme Court that the UK Home Office has intimated, there is a further legal issue which needs to be resolved before Vijay Mallya's extradition takes place and this issue is outside and apart from the extradition process having effect under the UK law. The affidavit had said that Vijay Mallya's surrender to India should, in principle, have been completed within 28 days after he lost the appeal against extradition. However, the UK Home Office intimated that there is further legal issue which needs to be resolved before Mallya's extradition takes place. "The UK side further said that this issue is outside and apart from the extradition process, but it has the effect that under the UK law, extradition cannot take place until it is resolved," said the affidavit. The MHA said the UK has informed it that this separate legal issue is judicial and confidential in nature. On May 14, in a major setback Mallya lost his application seeking leave to appeal in the UK Supreme Court, after <keyword id="9625522" type="COMPANY" weightage="20" keywordseo="the-london-high-court">the London High Court</keyword> declined to entertain his appeal challenging the extradition order to India on charges of fraud and <keyword id="6355008" type="UNKNOWN" weightage="20" keywordseo="Money-laundering">money laundering</keyword> in connection with unrecovered loans to his now-defunct Kingfisher Airlines. "The UK side emphasized that neither they can provide any more details nor intervene in the process. They have also indicated that through the designated channel, the UK Home Office has received a request to serve summons on Vijay Mallya for his hearing before the Supreme Court (India)," said the MHA. The UK side said it has informed the Indian High Commission that the issue is confidential and cannot be disclosed. The British Home Office also forwarded the Supreme Court order through Hertfordshire Police on September 17, for serving it to Mallya. "It is also submitted that during the course of processing of request of service of notice upon Vijay Mallya, an interim report from the UK authorities has been received through <keyword id="9255042" type="COMPANY" weightage="20" keywordseo="the-high-commission-of-india">the High Commission of India</keyword>, London," the affidavit said. Supreme Court seeks status report on Mallya's extradition within 6 weeks

New Delhi, The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Monday allowed the Centre to go ahead with the proposed foundation stone-laying ceremony for the Central Vista project after the government assured it that no construction or demolition work would commence till the apex court decides the pending pleas on the issue. Solicitor General Tushar Mehta told a bench headed by Justice A M Khanwilkar that there would be only foundation stone-laying ceremony, and no construction, demolition or felling of trees would be done for the project as of now. The revamp, which was announced in September last year, envisages a new triangular Parliament building, with seating capacity for 900 to 1,200 MPs, that is targeted to be constructed by August, 2022 when the country will be celebrating its 75th Independence Day. The common Central Secretariat is likely to be built by 2024. Prime Minister Narendra Modi will lay the foundation stone on December 10 for the new Parliament building and the construction is expected to be completed by 2022 at an estimated cost of Rs 971 crore, Lok Sabha Speaker Om Birla had said on December 5. The top court is seized of pleas which have raised questions over several aspects, including the environmental clearance granted to the project. During the hearing conducted on Monday through video-conferencing, the bench asked Mehta to apprise it within five minutes about the government's view on the issue of construction work for the project. The bench observed that it would not allow construction or demolition till its decision on the pending pleas opposing the project. The top court said the Centre can proceed with the requisite paperwork in the meantime. On November 5, the apex court had reserved its verdict on a batch of pleas which have raised questions over the Centre's ambitious Central Vista project, which covers three km stretch from Rashtrapati Bhavan to India Gate in Lutyens' Delhi. The solicitor general had earlier argued in the top court that the project would "save money" which is paid as rent for housing central government ministries in the national capital. Mehta had submitted that the decision to have a new parliament building has not been taken in a haste and no law or norms have been violated in any manner for the project. The Centre had also said there was no arbitrariness or favouritism in selecting consultant for the project and the argument that the government could have adopted a better process cannot be a ground to scrap the project. Gujarat-based architecture firm HCP Designs has won the consultancy bid for the project to redevelop the Central Vista. The top court is hearing several pleas on the issue, including the one filed by activist Rajeev Suri, against various permissions given to the project by authorities including the nod to change of land use. Earlier, the apex court had said that any change at the ground level made by authorities for the Central Vista project will be "at their own risk". It had made it clear that the fate of the project, which includes several new government buildings and a new Parliament House, will depend on its decision. The pleas have also challenged the grant of a no-objection certificate by the Central Vista Committee (CVC) and also the environmental clearances for the construction of a new parliament house building. One of the pleas was filed against a Delhi High Court order which had said the Delhi Development Authority (DDA) was not required to apprise it before notifying changes in the Master Plan to allow the Central Vista project. The division bench of the Delhi High Court had on February 28 stayed an order of its single judge bench which had asked the DDA to approach the court before notifying any change in the Master Plan for going forth with the Centre's ambitious project to redevelop the Central Vista. The stay order of the high court on the single judge bench's February 11 direction had come on the intra-court appeal of the DDA and the Centre. The petitioners before the high court had opposed the Central Vista project on the ground that it involves a change in land use of the green area adjoining <keyword id="100735" type="CITY" weightage="20" keywordseo="Rajpath">Rajpath</keyword> and Vijay Chowk for building new Parliament and government offices. Central Vista project: Supreme Court allows Centre to go ahead with foundation stone-laying ceremony

The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Friday asked the <keyword id="6362695" type="ORGANIZATION" weightage="20" keywordseo="uttar-pradesh-government">Uttar Pradesh government</keyword> to apprise it by July 19 on whether it would reconsider its decision to hold a symbolic <keyword id="6472944" type="LOCATION" weightage="20" keywordseo="kanwar-yatra">Kanwar Yatra</keyword> in the state, saying the right to life is paramount. A bench of Justices <keyword id="1547576" type="PERSON" weightage="20" keywordseo="RF-Nariman">RF Nariman</keyword> and B R Gavai said that it is of the prima face view that all kinds of sentiments are subservient to Article 21 of the Constitution. It said the Uttar Pradesh government cannot be allowed to hold Kanwar Yatra in view of Covid . The top court's direction came after the Uttar Pradesh government told the bench that it has decided after relevant discussions to hold a symbolic Kanwar Yatra with appropriate Covid restrictions. Solicitor General <keyword id="243257" type="PERSON" weightage="20" keywordseo="Tushar-Mehta">Tushar Mehta</keyword> for the Centre told the top court that states shall not be allowed to hold Kanwar Yatra in view of Covid and arrangements for Ganga water should be made by tankers at specified places. The counsel for Uttarakhand told the top court that it has by its notification has decided to ban Kanwar Yatra for this year due to COVID-19. On July 14, the top court had had taken suo motu cognisance of media reports on the Uttar Pradesh government's decision to allow 'Kanwar Yatra' amidst the COVID-19 pandemic and sought responses from the state as well as the Centre "given the disparate political voices" on the matter. It had referred to the statement of Prime Minister <keyword id="6354477" type="PERSON" weightage="20" keywordseo="Narendra-Modi">Narendra Modi</keyword> that not even a bit of compromise can be made on COVID-19 containment and said the citizens were perplexed about the happenings in view of the fact that the UP government has allowed the religious 'yatra' commencing from July 25. Supreme Court asks UP government  to reconsider its stand to hold symbolic Kanwar Yatra

The <keyword id="6354977" type="ORGANIZATION" weightage="80" keywordseo="Supreme-Court">Supreme Court</keyword> asked Reliance ADAG's power distribution company, BSES Yamuna to pay up its dues to electricity generating utilities totaling Rs 257 crore by July 15. Currently, the company has 13.5 lakh customers in central and east Delhi.
 As per the records till June 30, the power distribution company owes Rs 60 crore to central generating and transmission utilities, including <keyword id="75753" type="COMPANY" weightage="40" keywordseo="Damodar-Valley-Corporation">Damodar Valley Corporation</keyword>, <keyword id="105181" type="COMPANY" weightage="40" keywordseo="Power-Grid-Corporation">Power Grid Corporation</keyword> and <keyword id="2402471" type="UNKNOWN" weightage="40" keywordseo="Aravali-Power-Company-Ltd-">Aravali Power Company Ltd.</keyword> <keyword id="75796" type="COMPANY" weightage="80" keywordseo="BSES-Yamuna">BSES Yamuna</keyword> also owes Rs 195 crore to Delhi-based power generating units Indraprastha, Delhi Transco and <keyword id="301258" type="COMPANY" weightage="40" keywordseo="Pragati-Power-Corporation">Pragati Power Corporation</keyword>. 

	BSES Yamuna also clarified that the government subsidy, which was promised but not factored in, was to the tune of Rs 96 crore and hence its total liability would be Rs 161 crore.
 Appearing for Delhi Transco and Indraprastha, <keyword id="132134" type="POSITION" weightage="40" keywordseo="Additional-Solicitor-General">additional solicitor general</keyword> <keyword id="243257" type="PERSON" weightage="40" keywordseo="Tushar-Mehta">Tushar Mehta</keyword> said the total dues as per their calculation was Rs 370 crore. However, <keyword id="45179" type="CITY" weightage="40" keywordseo="NTPC">NTPC</keyword>, which was the first to approach the court with a threat to disconnect power supply to the national capital because of mounting arrears from BSES Yamuna, informed the court that it had been fully paid by the discom. BSES’s <keyword id="2117" type="POSITION" weightage="40" keywordseo="senior-advocate">senior advocate</keyword> K V Vishwanathan attempted to put forth the discom's grievance. He said the state had not kept its promise of giving proper return on the Rs 15,000 crore investment made by the company. However, a bench headed by Chief Justice R M Lodha and Justice <keyword id="135052" type="PERSON" weightage="40" keywordseo="Madan-B-Lokur">Madan B Lokur</keyword> and Justice <keyword id="108280" type="PERSON" weightage="40" keywordseo="Kurian-Joseph">Kurian Joseph</keyword> said the apex court would decide about BSES Yamuna's grievances against the <keyword id="6354952" type="ORGANIZATION" weightage="40" keywordseo="Delhi-Government">Delhi government</keyword> later. 

	“We are directing you only to pay current dues. Power generation and transmission companies are no baniya shops. You must clear all dues since January 2014 if you want electricity. You can’t continue like this. You are in arrears, arrears, arrears... This isn’t our headache,” observed the court.
