New Delhi, Jan 29 () Markets regulator Sebi has disposed of adjudicating proceedings against Abhijit Rajan, former chairman of Gammon Infrastructure Projects, in an alleged insider trading case.
 It was alleged that Rajan violated the code of corporate disclosure practices under prevention of insider trading norms.
 "I conclude the allegations levelled in the said SCN (show cause notice) against the noticee i.e Abhijit Rajan does not stand established," Sebi Adjudicating Officer Sangeeta Rathod said in an order passed on Tuesday.
 The regulator undertook a probe in the scrip of Gammon Infrastructure Projects Ltd (GIPL) during July-September 2013 following an input from the NSE concerning the possibility of certain entities having traded in the company's shares on the basis of unpublished price sensitive information (UPSI).
 The matter pertains to Gammon Infra's board decision to approve termination of tie up with Simplex Infrastructure. It was alleged that the termination decision should have been intimated to exchanges immediately, but it was done with a delay of 26 days.
 Rajan, being director of GIPL during the relevant period attended the board meeting, and was alleged to have violated the code of corporate disclosure practices under insider trading norms.
 He contended that GIPL's investment in the Simplex project in the financial year represented only 0.05 per cent of the GIPL's order book value at the end of August 2013, which cannot be construed as price sensitive.
 "It cannot be concluded that the said information is UPSI and that the disclosure of the same to the exchange on a particular date was relevant at that juncture. With regards to the code of conduct followed by the GIPL, I do not observe any deviation of MCC (model code of conduct) from the insider trading code of the GIPL as available on record," Rathod said.
 Accordingly, the Securities and Exchange Board of India (Sebi) disposed of the adjudication proceedings initiated against Rajan.
 Earlier, the Securities Appellate Tribunal (SAT) in November 2014 had set aside a Sebi order that banned Rajan from the capital markets for alleged insider trading.
 In July 2014, the regulator had barred Rajan after finding him guilty of trading in shares on the basis of unpublished price sensitive information. It had also directed him to disgorge an amount of Rs 1.09 crore, which was already deposited by him in an escrow account. This direction was further confirmed by the regulator through a confirmatory order passed in March 2015.
 This was one of the few cases where the CMD of a company came under the scanner in an insider trading case.
 A Sebi probe had found that Rajan had traded on the basis of unpublished price sensitive information pertaining to cancellation of two shareholder agreements of Gammon Infra with Simplex Infrastructure.
 The tribunal had set aside the Sebi's order saying the information in itself was not price sensitive.
 "Considering the minor proportion of the transaction to the turnover of GIPL (Gammon Infra), in our view the information cannot be termed as price sensitive information. Simplex had not even disclosed the said information to the stock exchanges," the tribunal had said.
 Further, the tribunal had said that even if it is assumed that the information is price sensitive, "still the appellant cannot be blamed of insider trading for the reasons that he did not trade on the basis of the information".
 The tribunal had noted that Rajan was able to show that he needed the money that he garnered from sale of shares for infusing capital in one of his firms that was undergoing corporate debt restructuring (CDR) during the time.
 Besides, he was even required to sell his agricultural land and flat.
 "The appellant was able to show his dire need to infuse fund in the entity under the master restructuring agreement to implement a CDR package," the tribunal had said, adding that the amount was deposited in the account of CDR scheme. SP ABM

Moreover, Damani net worth stood $16.4billion on April 10, up from $13.8 on March 18, according to Forbes real time net worth index. Coronavirus also cast a shadow on D-Mart’s supply chain which could suffer due to a shortage of products in its stores in the coming future. However, given its position as one of the top players, it may be better placed to fend off the crisis compared to most of its peers. However, Damani’s portfolio is not restricted to just D-Mart. He owns six other listed stocks with at least a 1% stake in the company including Delta Corp and Simplex Infrastructure. India’s second richest man added $2.7 billion to his wealth beating slowdown and coronacrisis

<a href="http://www.businessinsider.in/searchresult.cms?query=%E2%80%8BIndian+stocks">Indian stocks</a> had a tepid start on Monday as traders turned sellers after the fifth weekly rise in a row on major benchmarks. Weak earnings from some blue chips also hurt sentiment on <a href="http://www.businessinsider.in/searchresult.cms?query=Dalal+Street">Dalal Street</a> where negative moves were seen on Banking, Infrastructure and Pharma companies. 
 The Nifty traded 4 points higher at 8,300 at the start of play with Bajaj Auto, Hindalco, HCL Tech, Tata Power and Hero Motor gaining traction in the first half hour of trade. Slippages were seen on Asian Paints, Coal India, Yes Bank, HDFC Bank and Cipla. The Advance-Decline Ratio stood at 30/20 on the Nifty and Dr. Reddy's, Asian Paints, and Axis Bank were the top traded counters on the <keyword id="53581" type="CITY" weightage="80" keywordseo="NATIONAL-STOCK-EXCHANGE">National Stock Exchange</keyword>. 
 
Asian Paints was the top loser on the Nifty after its quarterly earnings disappointed. 
 
Broader markets were flat with major indices trading sideways. The trend was mixed in the sectoral space with modest gains observed on the Auto, Metals and IT sectors. 
 
The Sensex gained 61 points, or 0.2 percent, to 27,532 points on the <a href="http://www.businessinsider.in/searchresult.cms?query=Bombay+Stock+Exchange">Bombay Stock Exchange</a>. Tata Steel, Vedanta, Maruti and Wipro were among the gainers on the Index while TCS, ITC and NTPC showed slippages. The Advance-Decline Ratio stood at 24/6 and Axis Bank, Lupin and Sun Pharma were the three top traded stocks on the Index. 
 Bulls slipped on <keyword id="6355178" type="UNKNOWN" weightage="80" keywordseo="Dalal-Street">Dalal Street</keyword> with 957 shares falling compared with just 920 that gained ground on the BSE. 
 
Mid Cap gainers dominated trade in the derivatives segment with futures of IGL, Exide and Dabur gaining strongly. Slippages were seen on Bharat Forge, Strides Arcolabs and Cadila Health's futures. 
 
Simplex Projects, Rane Brake Lining and Maharashtra Scooters were some stocks figuring on the volume buzzers list on the <a href="http://www.businessinsider.in/searchresult.cms?query=National+Stock+Exchange">National Stock Exchange</a>.

<keyword id="35169" type="ORGANIZATION" weightage="100" keywordseo="indian-stocks">Indian stocks</keyword> had a dream start to the week on Monday as a 2 percent surge on the <keyword id="6354813" type="COMPANY" weightage="100" keywordseo="nifty">Nifty</keyword> saw it closing at a 6-week high as investors bought into beaten down blue chips and traders pressed long positions in frontline momentum stocks. 
 
A strong close in Asia and an equally robust opening in Europe also helped local sentiment on <a href="http://www.businessinsider.in/searchresult.cms?query=Dalaal+Street">Dalaal Street</a>. 
 
The <a href="http://www.businessinsider.in/searchresult.cms?query=Nifty">Nifty</a> surged 169 points, or 2.1 percent, to 8,119 points, its highest level since August 24th. Tata Motors, Tata Steel, HDFC, Bosch and Adani Ports gained more than 4.5 percent each on the index while Maruti, Dr. Reddy's, Lupin and Hindustan Unilever posted losses. The Nifty's Advance-Decline Ratio stood at 45/5. 
 
Maruti, TCS and HCL Tech were the 3 most actively traded stocks on the <a href="http://www.businessinsider.in/searchresult.cms?query=National+Stock+Exchange">National Stock Exchange</a>. 
 
Strong gains were also seen on broader indices with CNX 100, CNX 200 and CNX 500 benchmarks rising more than 2 percent each. The CNX Mid Cap and Small Cap indices gained substantially as well. The best was reserved for the banking sector where banks jumped sharply. As a consequence, the Bank Nifty surged 3.1 percent. The CNX PSU Bank index added 2.5 percent and the CNX Finance Index leapt 3.5 percent as traders also covered existing short positions in the sector. Benchmarks representing the Metals and Energy spaces rose smartly too. 
 The mood was equally buoyant on the <keyword id="43628" type="CITY" weightage="100" keywordseo="Bombay-stock-exchange">Bombay Stock Exchange</keyword> where the Sensex jumped a whopping 564 points, or 2.2 percent, to 26,786 points. Hindalco, Larsen, Axis Bank, NTPC and BHEL added to their tally whereas Maruti, Lupin, Dr. Reddy's and Hindustan Unilever fell in trade. The Sensex's Advance-Decline Ratio stood at 26/4. 
 
Maruti, Larsen and Tata Motors were the 3 top traded stocks on the <a href="http://www.businessinsider.in/searchresult.cms?query=Bombay+Stock+Exchange">Bombay Stock Exchange</a>. 
 
Sentiment was bullish in the derivatives space as well with 150 futures gaining compared with 14 that fell. Jindal Steel, Power Finance and Rural Electrification Futures were top gainers while Amtek Auto, Dabur and Cadila dropped in trade. 
 
Bulls dominated trade in the wider market as well with 1,998 stocks gaining compared with 793 that fell below their Thursday's closing prices. 
 
Kewal Kiran Clothing, Simplex Infrastructure, Bombay Rayon Fashions and ITD Cementation were on the volume buzzers list on the <a href="http://www.businessinsider.in/searchresult.cms?query=National+Stock+Exchange">National Stock Exchange</a>.
