Kaness, Lucky Brand interim CEO and executive chairman, said in a press statement that the filing and closures are in part due to the impact of the coronavirus on performance. </p><p>"The COVID-19 pandemic has severely impacted sales across all channels," Kaness said. "While we are optimistic about the reopening of stores and our customers' return, the business has yet to recover fully. His first <a href="http://www.businessinsider.com/the-cia-made-larry-ellison-a-billionaire-2014-9">customer for Oracle was the CIA</a>.</p><p>When hackers master changing data they could do things like change air traffic control data (which he says has never been done) or "change bank balances so they all slightly different," he warned.</p><p>Naturally, he wasn't just trying to scare the world. He thinks Oracle has solved that problem with the new thing called  <a href="https://www.oracle.com/corporate/pressrelease/sparc-m7-102615.html">"Always-on Security in Silicon."</a></p><p>That means that products built with <a href="https://www.oracle.com/corporate/pressrelease/sparc-m7-102615.html">Oracle's latest M7 SPARC chips</a> released this week, will have a bunch of security features built-into the chip and always turned on. IT professionals cannot turn these features off.</p><p>For instance, with these chips, hackers won't be able to hack into a computer's memory, which is their treasure trove for stealing data and also for changing it. And all data will also be encrypted, with encryption and decryption working nearly instantaneously with no drag on a computer's overall performance, he promised.</p><p>Oracle needs to keep investing in its SPARC chips, making them extra special. That's how Oracle will convince IT professionals to buy its most expensive servers instead of buying industry standard Intel servers, which run Windows and every kind of software.</p><p>Meanwhile, Oracle these days is all about the cloud. And Oracle is using all of its latest and greatest hardware in its own cloud, including computers servers running the M7. Ellison is very proud of that fact.</p><p>We're our own biggest customer," he said. Larry Ellison just painted a frightening picture of what hackers could do next

Again.</p>
<p>On Thursday, one of the advertising industry's self-regulation bodies, the National Advertising Division,  asked the Federal Trade Commission to step in and investigate Oracle's ads for "possible law enforcement action," it said.</p>

<p>"Now, IBM has brought NAD’s attention to a fourth Oracle advertising campaign," NAD said in a press release it sent us.</p>
<p>In this one Oracle <a href="http://www.businessinsider.com/ellison-trash-talks-ibm-2013-3">says its new SPARC T5</a> has “2.6x Better Performance” as compared to IBM’s Power7+ AIX server."</p>
<p>NAD says, "the advertising in question features the same stark, overbroad IBM-versus-Oracle comparison that NAD recommended against in the three previous cases."</p>
<p>So instead of arguing with Oracle about it, NAD wants to get the feds involved.</p>
<p>Oracle stands by its ad. An Oracle spokesperson told us:</p>
<p style="padding-left: 30px;"> "Oracle disagrees with the decision and believes the ad is fair and accurate. The ad provides a clear and objective comparison between an IBM Power7+ AIX system and an Oracle SPARC T5 system using industry standard benchmark results that legitimately show 2.6x better performance by the Oracle system. NAD has failed to take into account the sophistication of the ad's target audience, namely businesses that purchase <keyword id="6356323" type="UNKNOWN" weightage="100" keywordseo="Enterprise">enterprise</keyword> hardware systems."</p>
<p>We reached out to IBM for comment.</p>

<p>Maybe it's just us, but it seems like this press release just oozes NAD's frustration at Oracle.</p>
<p style="padding-left: 30px;">NAD Refers Advertising by Oracle to FTC After Company Repeatedly Fails to Comply with NAD Recommendations</p>
<p style="padding-left: 30px;">New York, NY – Aug. 1, 2013 – The National Advertising Division has referred advertising claims made by Oracle Corporation to the Federal Trade Commission, following NAD’s determination that the company has not made a good faith effort to comply with the recommendations of previous NAD decisions.</p>
<p style="padding-left: 30px;">NAD is an investigative unit of the advertising industry’s system of self-regulation. It is administered by the Council of Better Business Bureaus.</p>
<p style="padding-left: 30px;">NAD has reviewed three separate Oracle advertising campaigns in 2012, each featuring an overbroad and unsupported comparison between one Oracle product and one IBM product. Each campaign was reviewed by NAD following a challenge by International Business Machines (IBM).</p>
<p style="padding-left: 30px;">In response to each challenge, Oracle sought to support broad implied claims that the Oracle line of products was superior to the IBM line by relying on the results of testing of one specific Oracle configuration against one specific IBM configuration. In each instance, NAD rejected the advertiser’s substantiation and recommended that the claim be discontinued.</p>
<p style="padding-left: 30px;">NAD published its first decision regarding Oracle’s advertising in April 2012, and the second in July 2012. Oracle appealed NAD’s July 2012 findings to the National Advertising Review Board (NARB), which affirmed NAD’s decision. NAD examined a third Oracle campaign in October 2012.</p>
<p style="padding-left: 30px;">Now, IBM has brought NAD’s attention to a fourth Oracle advertising campaign, featuring the claim that Oracle’s SPARC T5 has “2.6x Better Performance” as compared to IBM’s Power7+ AIX server.</p>
<p style="padding-left: 30px;">The advertisement contrasts IBM’s with Oracle’s server and relies on the results of testing one particular configuration of the Oracle SPARC T5 against one particular configuration of IBM’s Power7+ AIX server to support an overall superiority claim for the Oracle line of products.</p>

Oracle Lands In More Hot Water Over Its Ads Slamming IBM - And Now The FTC May Investigate

<p>The company is <a href="http://www.businessinsider.com/ellison-trash-talks-ibm-2013-3">standing by its claims</a> that Oracle's brand new servers are both faster and cheaper than IBM's.</p>
<p>"IBM customers are being wildly over-charged for the performance they're getting," said John Fowler, Oracle's executive vice president of systems, in a statement emailed to Business Insider.</p>
<p>Oracle announced two new servers this week, its biggest, fastest computer, the M5, and a new mid-range server, the T5. During the presentation, Ellison made a lot of comparisons between these new servers and IBM's products.</p>
<p>At one point, he quipped: "You can go faster, but only if you are willing to pay 80% less" than what IBM charges.</p>
<p>IBM responded yesterday, <a href="http://www.businessinsider.com/ibm-oracle-ceo-2013-3">hotly refuting Oracle's claims</a>. It pointed out that IBM has successfully forced Oracle to stop making similar claims about IBM products in Oracle's ads.</p>
<p>It didn't take long for Oracle to shoot back. Here's the full statement Oracle sent us, from  Fowler.</p>

Against IBM’s best published results, using independently confirmed industry-standard public benchmarks, Oracle delivered 5x, 7x, even 12x better cost performance. Oracle To IBM: Your 'Customers Are Being Wildly Overcharged'

The schedule I classification means it's hard for researchers to get their hands on pot grown to the exacting standards that are necessary for medical research, even in states where it's legal. Plus, no researcher can even try to make an FDA-approved cannabis product while it has that DEA classification, which removes some motivation to study the plant.</p><p>More research would identify health benefits more clearly and would also help clarify potential dangers - like with any psychoactive substance, there are <a href="http://www.businessinsider.com/physical-and-mental-effects-of-marijuana-2013-4">risks associated with abuse</a>, including dependency and emotional issues. And many doctors want to understand marijuana's effects better before deciding whether to recommend it or not.</p><p>With that caveat about research in mind, here are 21 of the medical benefits - or potential benefits - of marijuana.</p>

Hurd and Krzanich also said they started another new partnership - this one to target Oracle's database and software customers to ditch their IBM computer servers and buy Oracle/Intel servers instead.</p><p>What's interesting is that, like IBM, Oracle also competes with Intel. </p><p>Oracle's fastest, most expensive computer servers use Oracle's own chips, the SPARC chips technology that it gained when it bought Sun Micrososystems.</p><p>But the enemy of my enemy is my friend. So Intel and Oracle are getting cozier these days going after IBM.</p><p>Oracle CEO Mark Hurd says they have already convinced thousands of customers to drop IBM for Oracle when running Oracle software. Intel and Oracle setup a secret team to take on cloud computing, IBM

<p><a href="http://www.businessinsider.com/ellison-trash-talks-ibm-2013-3">As we previously reported</a>, Ellison introduced two new servers and a new microprocessor yesterday by making a lot of bold claims about how much faster and cheaper they were than IBM's.</p>
<p>We knew IBM would be skeptical about Oracle's claims, as we noted in our story yesterday.  Three times in the last seven months, IBM has successfully <a href="http://www.asrcreviews.org/2012/04/nad-recommends-oracle-discontinue-certain-comparative-pricing-claims-against-ibm/">forced Oracle to stop making advertising</a> claims saying that its hardware systems were faster than IBM's.</p>
<p>Here's what Ellison got wrong yesterday, according to Sibley:</p>
<p style="padding-left: 30px;">1. Oracle's benchmark tests were made against three-to-five-year-old IBM servers, not more recent models.</p>
<p style="padding-left: 30px;">2. Oracle sometimes stacked the deck in its tests, using servers with up to twice as many CPU cores—hence more raw processing power—than the IBM systems it used.</p>
<p style="padding-left: 30px;">3. Oracle's price claims were just plain wild, Sibley says. In <a href="http://www.businessinsider.com/ellison-trash-talks-ibm-2013-3">one of Ellison's slides</a>, he claimed that an Oracle $270,000 T58 was faster than a $1.9 million IBM P780. Those were not comparable setups, Sibley says. For similarly configured machines, IBM servers are priced about the same as Oracle's new servers, he says.</p>
<p>Plus, IBM's servers help save <keyword id="6356323" type="UNKNOWN" weightage="100" keywordseo="Enterprise">enterprise</keyword>s money on software licenses, he says. That's because IBM servers will run more apps on a single server, he says. For enterprise software that's priced per server, companies can pay less for software licenses.</p>
<p>IBM says it's winning a lot of business away from Oracle and HP. It brought in $335 million of new server business in its last quarter and $1 billion over the whole year, half from Oracle and half from HP customers, <a href="http://www.ibm.com/investor/4q12/presentation/4q12prepared.pdf">it told analysts in its quarterly conference call.</a></p>
<p>We'll take that with a grain of salt. IBM's revenues from Power Systems—its high-end servers—decreased 19 percent last quarter, compared to the same period a year ago.</p>
<p>UPDATE: Oracle isn't backing down from its claims. The company just sent us this statement, from John Fowler, executive vice president, Systems, Oracle:</p>

IBM To Larry Ellison: Your New Servers Aren't Faster Or Cheaper Than Ours

<p class="p2"><span style="line-height: 1.5em;"><strong>9. <a href="%20http://www.thedrum.com/news/2014/11/25/7up-overhauls-brand-identity-global-feels-good-be-you-campaign">7up, the second largest PepsiCo drink brand, has undergone a global brand refresh, The Drum reports.</a></strong> The transformation is being accompanied by a campaign that aims to celebrate people who fit the brand's "original and refreshing" identity.</span></p>
<p class="p2"><span style="line-height: 1.5em;"><strong>10. <a href="http://www.telegraph.co.uk/news/worldnews/europe/france/11250670/Grenoble-to-replace-street-advertising-with-trees-and-community-spaces.html">French city Grenoble plans to ban all outdoor ads and replace them with trees and "community spaces," The Telegraph reports.</a></strong> The city's 326 advertising signs will be removed between January and April next year and its contract with JCDecaux will be terminated as they no longer "correspond to the expectations of the inhabitants who want to reclaim public space," the the city's mayor's office said. </span></p>

<p>This is the fastest computer Oracle has ever produced. Oracle also introduced a new mid-range computer, the T5.</p>
<p>Both of these products are built with a new Oracle-designed microprocessor, the SPARC T5.</p>
<p>Ellison had IBM in his sights as he talked about the M5 and T5. Ellison said that in some of its tests, the M5 was 8-times faster than IBM's 795 and cost 80 percent less.</p>
<p>"You can go faster, but only if you are willing to pay 80% less," he joked.</p>
<p>He also said that Oracle's new mid-range server, the T5, is 9 times faster than IBM's P780. Oracle published these statistics on its <a href="http://www.oracle.com/us/solutions/performance-scalability/sparc-t5-8-single-system-1925151.html">website</a> and showed this slide during today's press conference:</p>

<p>We'll see how well these claims sit with IBM.</p>
<p>In 2012, IBM <a href="http://www.businessinsider.com/oracles-hardware-biz-didnt-grow-2013-3">forced Oracle to pull ads that</a> claimed Oracle's Exadata computers were 20x faster than IBM's products.</p>
<p>Even if IBM doesn't buy the claims, Oracle needs its customers to believe them.</p>
<p>For months, Ellison promised that the hardware business would stop shrinking by February and start growing by May.</p>
<p>But when Oracle announced its latest quarter last week that didn't happen. It had another big year-over-year decline in revenue for the hardware business, <a href="http://www.businessinsider.com/oracles-hardware-biz-didnt-grow-2013-3">down by 23 percent</a>.</p>
<p>One reason for the decline was that Oracle's customers were waiting for the new products  announced today, Ellison told Wall Street analysts on a conference call.</p>
<p>Now the products are out and we'll see if Oracle can make them – and its whole hardware business – a success.</p>

<p>Earnings per share missed estimates by a penny, coming in at $0.65.</p>
<p>Revenues, however, came up shorter, at $8.97 billion versus the $9.37 billion expected by analysts.</p>
<p>New software licenses and cloud software subscription revenues were down 2 percent to $2.3 billion.</p>
<p>Software license updates and product support revenue was up 7 percent to $4.3 billion.</p>
<p>Adjusted operating margin was 47 percent.</p>

<p class="first" style="padding-left: 30px;">REDWOOD SHORES, CA--(Marketwire - Mar 20, 2013) - <strong></strong>Oracle Corporation ( NASDAQ : ORCL ) today announced that fiscal 2013 Q3 total revenues were down 1% to $9.0 billion. New software licenses and cloud software subscriptions revenues were down 2% to $2.3 billion. Software license updates and product support revenues were up 7% to $4.3 billion. Hardware systems products revenues were $671 million. GAAP operating income was up 1% to $3.3 billion, and GAAP operating margin was 37%. Non-GAAP operating income was down 1% to $4.2 billion, and non-GAAP operating margin was 47%. GAAP net income was unchanged at $2.5 billion, while non-GAAP net income was down 1% to $3.1 billion. GAAP earnings per share were $0.52, up 6% compared to last year while non-GAAP earnings per share were up 5% to $0.65. GAAP operating cash flow on a trailing twelve-month basis was $13.7 billion.</p>
<p style="padding-left: 30px;">Without the impact of the US dollar strengthening compared to foreign currencies, Oracle's reported Q3 GAAP earnings per share would have been $0.01 higher at $0.53, up 8%, and Q3 non-GAAP earnings per share would have been approximately $0.01 higher. Total revenues also would have been 1% higher and new software licenses and cloud software subscription revenues would have been 2% higher than reported.</p>
<p style="padding-left: 30px;">"Our non-GAAP operating margin increased to a Q3 record of 47%, and we expect it to reach an all-time high for the fiscal year," said Oracle President and CFO, Safra Catz. "Both operating cash flow and free cash flow were at record levels for a Q3, with operating cash flow of $13.7 billion over the last twelve months."</p>
<p style="padding-left: 30px;">"The Oracle Cloud is the most robust and comprehensive cloud platform available with services at the infrastructure (IaaS), platform (PaaS) and application (SaaS) level," said Oracle President, Mark Hurd. "In Q3, our SaaS revenue alone grew well over 100% as lots of new customers adopted our Sales, Service, Marketing and Human Capital Management applications in the Cloud."</p>
<p style="padding-left: 30px;">"This month we will begin deliveries of servers based on our new SPARC T5 microprocessor: the fastest microprocessor in the world," said Oracle CEO, Larry Ellison. "The new T5 servers can have up to eight microprocessors while our new M5 system can be configured with up to thirty-two microprocessors.
