Dhaka: As the situation in <keyword id="19919639" type="General" weightage="20" keywordseo="Bangladesh" source="keywords">Bangladesh</keyword> deteriorates following <keyword id="20024637" type="General" weightage="100" keywordseo="Sheikh-Hasina" source="keywords">Sheikh Hasina</keyword>'s resignation, the <keyword id="19967845" type="General" weightage="20" keywordseo="Supreme-Court-Bar-Association" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court Bar Association" meta.hostid="153" meta.entityid="Supreme Court Bar Association">Supreme Court Bar Association</keyword> (SCBA) President, AM Mahbub Uddin Khokon, has urged India to arrest the former Prime Minister and her sister, Sheikh Rehana, and return them to Bangladesh, as reported by Dhaka Tribune. At a press conference held at the SCBA auditorium, Khokon said, "We want to maintain a positive relationship with the people of India. Please arrest Sheikh Hasina and Sheikh Rehana, who fled the country, and send them back to Bangladesh." He also accused Hasina of causing numerous deaths in Bangladesh, adding, "Sheikh Hasina has killed many people in Bangladesh." Several pro-BNP lawyers were present at the conference. Khokon, who is also a joint secretary general of the Bangladesh Nationalist Party (BNP), urged against declaring a state of emergency and demanded the resignation of Supreme Court judges involved in political activities and corruption within a week, Dhaka Tribune reported. He also called for the resignation of state law officers, including Attorney General AM Amin Uddin, and the heads and officials of the Anti-Corruption Commission (ACC) and National Human Rights Commission (NHRC), as they were appointed by the Hasina-led government. Additionally, Khokon demanded the release of political prisoners. Bangladesh is facing a fluid political situation with Sheikh Hasina, on August 5, tendering her resignation from her post in the wake of mounting protests. The protests, led majorly by students demanding an end to a quota system for government jobs, took the shape of anti-government protests. Earlier in the day, President Mohammed Shahabuddin, announced the dissolution of the country's parliament to make way for the formation of an interim administration, Dhaka Tribune reported. In another major development, BNP chairperson and former Prime Minister Khaleda Zia was also released. Hasina arrived in India on Monday evening and it is not clear if she will stay in Delhi or move to another location. Meanwhile, in Dhaka, leaders of the Anti-Discrimination Student Movement have proposed an interim government led by Nobel Laureate Muhammad Yunus, in a bid to address Bangladesh's ongoing challenge.

Bangladesh SCBA President urges India to arrest and return Sheikh Hasina and Sheikh Rehana

New Delhi [India], March 18 (ANI): The <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> on Monday directed the <keyword id="19934368" type="General" weightage="20" keywordseo="state-bank-of-india" source="keywords">State Bank of India</keyword> (SBI) to disclose all details to the Election Commission of India which are in its possession, including the <keyword id="4127459" type="General" weightage="20" keywordseo="electoral-bonds" source="Orion">Electoral Bonds</keyword>' unique alphanumeric numbers corresponding to each bond. A five-judge Constitution bench of Chief Justice of India DY Chandrachud and Justices Sanjiv Khanna, BR Gavai, JB Pardiwala and Manoj Misra asked SBI's Chairman to file a compliance affidavit 5 pm of March 21. The Chairman has to file affidavit indicating that SBI has disclosed all details of Electoral Bonds which were in its possession and custody and no details have been withheld, the court said. It further asked the Election Commission of India to upload the details on its website forthwith upon receipt of information from the SBI. There is no manner of doubt that SBI was required to disclose all details available with it. This, we clarify, will include the alphanumeric number and serial number, if any, of the bonds purchased," the bench ordered. It added, "In order to avoid any controversy in the future, the Chairperson of the bank should file an affidavit by 5 pm on Thursday that it has disclosed all details in its custody and that no details have been withheld." The bench said that its February 15 judgment mandated the SBI to disclose all details including the date of purchase/redemption, name of purchaser/recipient, and the denomination of Electoral Bonds. The use of the word including means that the details specified in the judgment are illustrative and not exhaustive, the <keyword id="19936355" type="General" weightage="20" keywordseo="apex-court" source="keywords">apex court</keyword> said. The bench, during the hearing, observed that SBI should not be selective on disclosing the details. Last week, the apex court took exception to SBI for not furnishings Electoral Bonds data with unique alphanumeric numbers, which help identify the bond, and issued notice to it. It had said that the SBI has not fully complied with its March 11 order in which it had ordered the bank to disclose all details concerning Electoral Bonds. During today's hearing, the top court also expressed displeasure on SCBA President Adhish Aggarwala writing letter to CJI DY Chandrachud for suo motu review of Electoral Bonds judgement, and CJI said these are all publicity related issue and we will not get into this. CJI told Aggarwala, "Apart from being a senior counsel, you are president of SCBA. You have written a letter invoking my suo Motu powers. These are all publicity related... and we will not get into this. Do not make me say anything more. It will be distasteful." Solicitor General Tushar Mehta, appearing for Centre, told the apex court that ultimate aim was to curb black money and top court must be aware of how this judgment is being played outside the court. "Now the witch hunting has started on another level and not at the level of the Central government. Those before the court started giving press interviews and deliberately embarrassing the court. A series of social media posts, at least intended to cause embarrassment, started," Solicitor General said and asked it to consider issuing some direction in this regard. To this, CJI DY Chandrachud said that as judges we are only on the rule of law and work as per the Constitution. "Our court is only to work for the governance of rule of law in this polity. As judges we are also discussed in social media but our shoulders are broad enough to take this. We are only on enforcing our directions of the judgment," said the CJI. The Supreme Court by its February verdict had struck down the Electoral Bonds Scheme which allowed for anonymous funding to political parties, and ordered the SBI to stop issuing Electoral Bonds immediately. It had unanimously quashed the Electoral Bonds scheme as well as amendments made to the Income Tax Act and the Representation of People Act which had made the donations anonymous. It had asked SBI to furnish the details about each Electoral Bonds encashed by the political parties, which shall include the date of encashment and the denomination of electoral bond. An Electoral Bond is an instrument in the nature of a promissory note or bearer bond which can be purchased by any individual, company, firm or association of persons provided the person or body is a citizen of India or incorporated or established in India. The bonds are issued specifically for the purpose of contribution of funds to political parties. Various petitions were filed before the top court challenging amendments made to different statutes through Finance Act 2017 and Finance Act 2016 on the ground that they have opened doors to unlimited, unchecked funding of political parties. At the outset of the proceedings, the CJI said, "We wish to share some happy news. Here in the back row (in the courtroom), we have 75 judges from the civil judge junior division from Maharashtra. Out of a batch of 75 judges, 42 are women and 33 men." "This is a trend happening across the country. There are more women judges in numbers," the CJI, who was sitting on a bench with Justices J B Pardiwala and Manoj Misra, said. Justice Chandrachud said he would meet the judicial officers, including the women judges, during the lunch hour. Some lawyers, including senior advocate <keyword id="276004" type="General" weightage="50" keywordseo="dushyant-dave" source="Orion">Dushyant Dave</keyword>, asked the CJI to take steps to raise the number of women judges in the apex court. "The appointments made today are a reflection of the bar 15 years ago," the CJI said. Recently, former Supreme Court Bar Association (SCBA) president and senior lawyer Vikas Singh wrote a letter to the CJI, underscoring the need for allocating one-third of the judges' positions to women in higher judiciary. He referred to the passage of a Bill in Parliament, reserving one-third seats for women in the <keyword id="6355187" type="General" weightage="50" keywordseo="lok-sabha" source="Orion">Lok Sabha</keyword> and state assemblies. The high courts of Patna, Uttarakhand, <keyword id="6356054" type="General" weightage="50" keywordseo="tripura" source="Orion">Tripura</keyword>, <keyword id="6355772" type="General" weightage="50" keywordseo="meghalaya" source="Orion">Meghalaya</keyword> and Manipur do not have a single woman judge and there are 103 women judges in the 20 remaining high courts as against 670 male judges, Singh, a three-time president of the SCBA, wrote in his letter to the CJI.

The counsel then sought to mention the case before another bench. To which the CJI asked the counsel, "Your date is 17th, you want to mention it before another bench to get a date of 14th?" The counsel then told the bench that a similar matter was taken up on Monday by the court and some fresh matters were also mentioned. "If it is listed for 17th it will come on 17th. Don't mess around with my authority," said the CJI. The CJI further told him, "Do not play these tricks with me. You can't mention it here and then elsewhere for an earlier date." SCBA President Vikas Singh apprised the court that they are struggling to get the matter listed for the last six months. When the SCBA President urged for listing the matter, he also said that they have to take it to the judge's residence if the matter did not get listed. CJI Chandrachud lost his temper and asked the senior lawyer, "Is this the way to behave?" "I will not be cowered down by you," CJI DY Chandrachud said adding that he has been in this profession for 22 years and never allowed himself to be browbeaten by a member of the Bar, litigant or anyone else and will not let that happen in the last two years of his profession. SCBA President also refused to maintain silence. Thereafter, the court said that it will list the matter on March 17 but not as item 1 in the cause list. During the mentioning of cases, the SCBA president urged the court to list the matter early as the matter is not listed for six months. Senior Advocate said that the Appu Ghar land came under the Apex court premise on the petition by the SCBA but the Bar got only one block. The <keyword id="6354977" type="General" weightage="80" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday said it would take up the issue of allotment of land for lawyers' chambers with the government. The top court was hearing a plea moved by the Supreme Court Bar Association (SCBA) to convert a land measuring 1.33 acres allotted to the top court for the construction of lawyers' chambers. A three-judge bench headed by Chief Justice DY Chandrachud asked SCBA president <keyword id="169804" type="General" weightage="80" keywordseo="vikas-singh" source="Orion">Vikas Singh</keyword> how can a judicial order be passed to take over the land for allotment of chambers. "Lawyers are part of us... But can we use our own judicial powers to safeguard our own people? It seems like the Supreme Court is exercising its own judicial powers to meet its own needs..." "We must trust the court to take it up on the administrative side with the government. A signal must not go to the government that we can bulldoze their authority by passing judicial orders," the bench, also comprising justices <keyword id="843782" type="General" weightage="80" keywordseo="sk-kaul" source="Orion">SK Kaul</keyword> and PS Narasimha said. The CJI said the government engages with the top court on the administrative side and the issue can be put to it. "For example, for the e-courts project, the government allotted us Rs 7,000 crore because they said that we need it," the bench said. Singh thanked the bench on behalf of the entire bar. "We are extremely grateful. The entire bar is with the institution and we will not do anything to undermine the majesty of the institution irrespective of whatever happens in this case," he said. The SCBA president, however, said his reservation is that the bar and other stakeholders will not be a part of such administrative consultation. Referring to the Delhi High Court, Singh said it had taken over some land for its expansion and urged the top court to adopt a similar approach. The Supreme Court Advocate on Record Association (SCAORA) also sought to be a part of the proceedings and intervene in the issue. Senior advocate <keyword id="254333" type="General" weightage="80" keywordseo="meenakshi-arora" source="Orion">Meenakshi Arora</keyword>, appearing for the SCAORA, said several advocates on record are in need of chambers. Attorney General R Venkataramani said the flexibility of the administrative side will be beneficial for the issue. "The administrative side discussions can go a long way. Will take up issue of land allotment for lawyers' chambers with govt: SC

New Delhi, Apr 8 () Two lawyers have written to Chief Justice S A Bobde and the Bar Council of India (BCI) seeking creation of an emergency fund for young practising advocates who are in "dire need" of financial help following the nationwide lockdown due to COVID-19 pandemic.The letter, while highlighting the "tough time" being faced by young practising lawyers whose source of income is limited to litigation only, said that such advocates are facing financial crunch due to lockdown which, if extended further, would pose a serious threat to their life and liberty."It is time that the protector of fundamental and legal rights take care of this responsibility as a one class (bar and bench), rather than waiting for state or union relief fund as they have to take care of other professions and citizens at large," said the letter, written by advocates Pawan Prakash Pathak and Alok Singh.Their letter, also addressed to the presidents of the Supreme Court Bar Association (SCBA) and Delhi High Court Bar Association (DHCBA), said that they are practising independently as lawyers since one year in Delhi and hail from different parts of India. "It is humbly submitted that we are not advocating for the 'financial aid' as our 'fundamental right' during the current pandemic. Through the instant letter, we are only sharing the plight of young independent advocates who are facing the wrath of time," the letter said.It claimed that various state bar associations are coming up with financial aid schemes for advocates but there is "no uniformity or equality" in those policies and there is "grey area" regarding lawyers who are not registered with any associations like SCBA and DHCBA."The objective of the instant letter is not to discourage the efforts of the respective state bar associations and their intention to fight the crisis of COVID-19. It is humbly submitted that the instant letter only try to convey the plight of young independent advocates who are not associated with any court bar association and still in dire need of financial help from the state bar or BCI," it said.Referring to the Advocates Act, 1961, the letter said it provides for creation of financial fund for lawyers to protect their rights, privileges and interest.It urged that an emergency fund should be created for young independent advocates who are in need of financial assistance during COVID-19.The letter has also suggested several measures, including creation of dedicated single emergency pool fund with the help of bar and bench. COVID-19: Lawyers urge CJI, BCI to create emergency funds for advocates in dire need of help

New Delhi, Apr 6 () Court hearing in congregation must become an "exception" during the "extraordinary outbreak" of COVID-19 pandemic and it is necessary that all courts respond to the call of social distancing to ensure they do not contribute to the spread of virus, the Supreme Court said on Monday.Passing a slew of directions for all courts across India, it said that the apex court and all the high courts are authorised to adopt measures required to ensure robust functioning of judicial system through the use of video conferencing.Observing that "technology is here to stay", the top court passed the directions by exercising its plenary power under Article 142 of the Constitution and said that all the measures which shall be taken by the courts to reduce physical presence of stakeholders within its premises "shall be deemed to be lawful".A bench headed by Chief Justice S A Bobde said, "consistent with the peculiarities of the judicial system in every state and the dynamically developing public health situation", every high court would be authorised to determine the modalities suitable to the temporary transition to the use of video conferencing technologies."All measures that have been and shall be taken by this court and by the high courts, to reduce the need for the physical presence of all stakeholders within court premises and to secure the functioning of courts in consonance with social distancing guidelines and best public health practices shall be deemed to be lawful," said the bench, also comprising Justices D Y Chandrachud and L Nageswara Rao.The bench said the outbreak of coronavirus or COVID-19 in several countries including India has necessitated immediate adoption of measures to ensure social distancing to prevent transmission of the virus, and the apex court as well as the high courts have adopted measures to reduce physical presence."Access to justice is fundamental to preserve the rule of law in the democracy envisaged by the Constitution of India. The challenges occasioned by the outbreak of COVID-19 have to be addressed while preserving the constitutional commitment to ensuring the delivery of and access to justice to those who seek it," the bench said, adding, "Court hearings in congregation must necessarily become an exception during this period."The top court directed that district courts in each states shall adopt the mode of video-conferencing prescribed by the concerned high court."The concerned courts shall maintain a helpline to ensure that any complaint in regard to the quality or audibility of feed shall be communicated during the proceeding or immediately after its conclusion failing which no grievance in regard to it shall be entertained thereafter," it said.The bench directed that courts shall duly notify and make available the facilities for video-conferencing for such litigants who do not have the means or access to such facilities. "If necessary, in appropriate cases courts may appoint an amicus-curiae and make video conferencing facilities available to such an advocate," it said, adding, "Until appropriate rules are framed by the high courts, video conferencing shall be mainly employed for hearing arguments whether at the trial stage or at the appellate stage."The apex court made it clear that in "no case shall evidence be recorded without the mutual consent of both the parties by video-conferencing".The bench said if it is necessary to record evidence in a courtroom, the presiding officer shall ensure that appropriate distance is maintained between any two individuals in the court.It directed that the presiding officer shall have the power to restrict entry of persons into the courtroom or the points from which the arguments are addressed by the advocates. "No presiding officer shall prevent the entry of a party to the case unless such party is suffering from any infectious illness. However, where the number of litigants are many the presiding officer shall have the power to restrict the numbers. The presiding officer shall in his discretion adjourn the proceedings where it is not possible to restrict the number," the bench said.While making it clear that "these directions shall operate until further orders", the top court said that these directives have been issued in "furtherance of the commitment to the delivery of justice."It said that cooperation of all the concerned stakeholders, like judges, lawyers and litigants, is indispensable in successful implementation of these directions to ensure that the judiciary rises to face the unique challenge presented by the outbreak of COVID-19. The bench has listed the matter for hearing after four weeks.It said that every individual and institution is expected to cooperate in the implementation of measures designed to reduce the transmission of coronavirus and the scaling down of conventional operations within the precincts of courts is a measure in that direction. It said that modern technology has enabled courts to enhance the quality and effectiveness of the administration of justice and Indian courts have been "proactive in embracing advancement in technology in judicial proceedings".It has taken suo motu (on its own) cognizance of a letter written by senior advocate and former Supreme Court Bar Association (SCBA) president Vikas Singh, who has suggested measures for use of technology for conducting hearings in the courts.
