In a landmark judgement, the <keyword id="17605" type="PERSON" weightage="20" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword> <keyword id="6355392" type="ORGANIZATION" weightage="20" keywordseo="High-Court">High Court</keyword> on Friday declared the controversial <keyword id="7083033" type="UNKNOWN" weightage="20" keywordseo="Roshni-Act">Roshni Act</keyword> "unconstitutional" and directed that investigation into the Rs 25,000 crore land allotment scheme under it be transferred to the <keyword id="6354572" type="ORGANIZATION" weightage="20" keywordseo="CBI">CBI</keyword>. A division bench of Chief Justice Gita Mittal and Justice Rajesh Bindal allowed a petition that sought transfer of the Rs 25,000 land allotment scam under the Roshni Act from the Anti-Corruption Bureau (ACB) to the CBI. The act, enacted by the state legislature in November 2001 and enforced in March 2002, envisaged raising funds for hydro power generation in the state by transferring state land into private ownership to collect Rs 25,000 crore. A CAG report estimated that against the targeted Rs 25,000 crore, only Rs 76 crore had been realised from the transfer of land into private ownership. Politicians, businessmen and bureaucrats had come under severe criticism for transferring state land into their ownership and that of their favourites at arbitrarily fixed rates, which ultimately deprived the state of land worth several thousand crores and also defeated the purpose of the act. In its judgement, the high court, declared the law unconstitutional, held all allotments made under the act void ab initio. It ordered that the investigation of the land scam be transferred to the CBI which will file the status report within eight weeks. The court also said that J&amp;K Chief Secretary will ensure uninterrupted investigation which will also be directed against those officers in whose tenures the encroachments had happened. The court said all Deputy Commissioners and Divisional Commissioners will be held for contempt of court if they do not cooperate with the investigation. J&K High Court calls on CBI to probe Roshni Act — calling it 'unconstitutional'

<ul><li><keyword id="8883506" type="UNKNOWN" weightage="20" keywordseo="yes-bank-founder-rana-kapoor">Yes Bank founder Rana Kapoor</keyword> was arrested by the Enforcement Directorate (ED) early today, March 8.</li><li>He has been arrested under the provision of the <keyword id="6355007" type="UNKNOWN" weightage="20" keywordseo="Prevention-of-Money-Laundering-Act">Prevention of Money Laundering Act</keyword> (PMLA).</li><li>Authorities claim he was not cooperating with the probe.</li></ul> The Enforcement Directorate arrested Yes Bank founder Rana Kapoor under money laundering charges here in the early hours of Sunday, officials said. The banker was held under the provision of the Prevention of Money Laundering Act (PMLA) around 3 am as he was allegedly not cooperating in the probe, they said. Kapoor's arrest at the ED office in Ballard Estate followed over 20 hours of questioning by the central agency after it raided his residence on Friday night. The arrest comes after charges of alleged financial irregularities and mismanagement in the operations of the private bank surfaced and the RBI and Union government initiated action to control its affairs. Officials said Kapoor, 62, will be produced before a local court during the day to obtain custody. The investigating officer of the case had recorded Kapoor's statement under the PMLA when he was first interrogated on Friday night at his upscale residence in 'Samudra Mahal' complex in Worli area here. He was brought to the ED office on Saturday noon for a fresh round of questioning. On Saturday, the agency widened its probe in the case as the premises of Kapoor's three daughters in Delhi and Mumbai were searched to gather more information and evidence. According to officials, Kapoor's wife Bindu and daughters -- Rakhee Kapoor Tandon, Roshni Kapoor and Radha Kapoor -- are allegedly linked to some companies to which the suspected "proceeds of crime" have been traced. The case against Kapoor is linked to the scam-hit DHFL as the loans lent by the bank to the company allegedly turned NPAs, they said. A Rs 600 crore worth loan extended by the DHFL to an entity is also at the centre of the ED probe, officials said. The central agency is also probing Kapoor's role in connection with the disbursal of loans to some corporate entities and the subsequent alleged kickbacks reportedly received in his wife's accounts. Other alleged irregularities are also under the agency's scanner including the one related to the alleged PF fraud in the Uttar Pradesh power corporation, they added. The CBI has recently taken over investigation into the Rs 2,267-crore Employees' Provident Fund fraud in Uttar Pradesh, where hard-earned savings of power sector employees were invested in Dewan Housing Finance Corporation (DHFL). The ED action came after the Reserve Bank of India (RBI) on Thursday imposed a moratorium on the capital-starved Yes Bank, capping withdrawals at Rs 50,000 per account, and superseded the board of the private sector lender with immediate effect. A special CBI court in Mumbai on Saturday denied bail to the wife and two daughters of <keyword id="45660" type="General" weightage="20" keywordseo="yes-bank" source="Orion">Yes Bank</keyword> founder Rana Kapoor in a quid-pro-quo case involving private sector lender <keyword id="127124" type="General" weightage="80" keywordseo="dhfl" source="Orion">DHFL</keyword> stating that they had, prima facie, caused loss of Rs 4,000 crore to the bank through illegal acts. The court, which remanded them in 14-day judicial custody, said the the three did not deserve sympathy for being women or the mother of small kids. Kapoor's wife Bindu and daughters <keyword id="12123852" type="General" weightage="20" keywordseo="radha-khanna" source="Orion">Radha Khanna</keyword> and Roshini were named as accused in charge sheets filed by the probe agency in the case, and the court, after taking cognizance of the charge sheet, had summoned the trio. The three appeared in court and filed for bail through their legal team comprising <keyword id="370519" type="General" weightage="20" keywordseo="vijay-agarwal" source="Orion">Vijay Agarwal</keyword> and Rahul Agarwal, who argued that the charge sheet was filed without Bindu, Radha and Roshni being arrested, and, therefore, as per a <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> judgement, they deserve to be granted bail. Vijay Agarwal further argued that the court had already exercised the discretion of issuing summons to his clients, which clearly shows there is no need for their arrests. However, Special Judge S U Wadgaonkar rejected their bail applications and sent them to judicial custody till September 23. After the prosecution submitted that the jail superintendent wouldn't accept the custody of the accused without an RTPCR report, the court allowed the probe agency to keep the three in judicial custody till it was received. The court observed that fact and circumstances presented before it as accusations against the accused prima facie show their complicity with other co-accused, more particularly Rana Kapoor, in the conspiracy. The court said Kapoor and family had received "fraudulently and dishonestly" illegal amounts, pretending to be a corporate loan, by allowing wrongful loss to Yes Bank to the tune of Rs 4,000 crore. The judge said several lakh depositors, shareholders of Yes Bank and DHFL were duped, due to which the banking credibility of the nation had received a serious setback. "So the accused involved in grave offence affecting the economy of the country and who continue to reap the benefits of the crime committed by them do not deserve any indulgence and any sympathy for being women or the mother of small kids," the court said. Prima facie evidence against the accused is forthcoming, and these factors are sufficient to reject their bail, the court said. As per the Central Bureau of Investigation, Kapoor, who is in jail in a related case being probed by the Enforcement Directorate, entered into a criminal conspiracy with DHFL's <keyword id="152129" type="General" weightage="20" keywordseo="kapil-wadhawan" source="Orion">Kapil Wadhawan</keyword>. The CBI on Monday carried out searches at seven locations here in connection with a corruption case registered against Yes Bank founder <keyword id="128581" type="PERSON" weightage="20" keywordseo="Rana-Kapoor">Rana Kapoor</keyword>, Dewan Housing Finance Limited (DHFL) as well as its promoter Kapil Wadhawan. Primarily, the exact locations searched by the <keyword id="6354889" type="COMPANY" weightage="20" keywordseo="central-bureau-of-investigation">Central Bureau of Investigation</keyword> (CBI) teams were not known yet but agency sources confirmed that the places belonged to the accused named in the First Information Report (FIR). The CBI move came after the Enforcement Directorate arrested Kapoor on Sunday morning after over 30 hours of questioning in connection with a probe into a money laundering case involving DHFL. He was later sent in three-day ED custody by a Mumbai court. The CBI had registered a case of corruption, criminal conspiracy and cheating against Kapoor, a former MD and CEO of Yes Bank, DHFL and Wadhawan, on Sunday. The agency also named Doit Urban Ventures (India) Limited in its FIR registered under the Indian Penal Code and the Prevention of Corruption Act. The FIR mentions that Kapoor extended financial assistance to DHFL to get "substantial undue benefits" for himself and his family members through companies held by them. The case is being handled by the CBI's BS&amp;FC unit -- a specialised unit which looks into bank fraud cases across the country. The CBI has begun a probe into the short-term debentures of DHFL for which Yes Bank invested Rs 3,700 crore from April to June 2018. The probe is part of another investigation pertaining to Yes Bank's purchase of debentures from DHFL against which the company was granted loans totalling Rs 600 crore against a collateral security of around Rs 40 crore only. The loan amount later turned into <keyword id="463915" type="PERSON" weightage="20" keywordseo="non-performing-asset">non-performing asset</keyword>. It was alleged that DHFL's Wadhawan simultaneously paid kickbacks totalling Rs 600 crore to the Kapoors in the form of a loan of a similar amount to Doit Urban Ventures, a venture owned by his daughters -- Rakhee Kapoor Tandon, Roshni Kapoor and Radha Kapoor. It was also alleged that Yes Bank did not initiate action to recover the loans extended to DHFL.
