The 81 year old invested his private wealth in 30 startups, and is constantly adding to the list. His latest investment is into <a href="https://economictimes.indiatimes.com/small-biz/startups/newsbuzz/ratan-tata-to-invest-in-tork-motors/articleshow/71580081.cms">Tork Motors </a>— an electric vehicle startup. Tork Motors will introduce its flagship motorcycle, T6X in the coming months. Tata is among the world’s most influential industrialists. He set up a RNT Associate in 2009, three years before retiring from Tata Sons. Since then, Tata invested in taxi aggregators, e-vehicle makers to jewellery lines. And, he has made good bets too, as the valuations of all the startups he backed, have zoomed. "The thing that I am intrigued by first is a start-up that has an interesting concept which excites me. If it doesn’t excite me, I really don’t need to make an investment in that company," said Tata. New Delhi, Jan 3 () Ratan Tata on Friday filed a petition in the Supreme Court seeking to quash a company law appellate court order directing Tata Sons to rehire the chairman it had fired in 2016, saying the judgment was "wrong, erroneous and contrary to the record of the case".
His petition is separate from the one filed by Tata Sons Ltd, the holding company of the USD 110 billion salt-to-software conglomerate, in the Supreme Court on Thursday that sought a stay on the National Company Law Appellate Tribunal's December 18, 2019 order to reinstate Cyrus Mistry as the chairman.
Ratan Tata, who is chairman emeritus and a shareholder of Tata Sons, in the petition said the NCLAT judgment was wrong as it treats Tata Sons as a two-group company.
Mistry, he contended, was made the Executive Chairman of Tata Sons in a purely professional capacity and not as a representative of the Shapoorji Pallonji Group, which holds 18.4 per cent in Tata Sons.
Tata Trusts, of whom Ratan Tata had been a chairman for many years, holds 65.89 per cent of Tata Sons.
The petition said the NCLAT order wrongly suggests that "someone from the SP Group had been a director because of some entrenched right or convention".
"This is untrue and contrary to the records and the articles of association of Tata Sons, which are undisputed and binding on the shareholders including the SP Group," he contended.
He said Mistry's leadership "was lacking" in "his reluctance to timely and meaningfully disassociate himself from his family business after he became the Chairman of Tata Sons and address any conflict in this regard, which was a condition precedent to his appointment as Chairman of Tata Sons".
Mistry, he alleged, "concentrated power and authority in his own hands" and "board members were being alienated on matters relating to Tata Operating Companies where Tata Sons had huge financial exposure and the Board of Tata Sons had to contend with such decisions being cast upon it as fait accompli".
The chairman emeritus targeted Mistry for the handling of the failed partnership with Japan's DoCoMo saying it showed his "complete obstinacy" as he attempted to resist complying with the legal obligations further. "This is not what the Tata Sons brand stands for. Quite to the contrary, honouring its commitments is one of Tata Sons' highest virtues it takes great pride in. Spat with DoCoMo brought ill-repute and reputational losses to Tata Sons."
Ratan Tata said the NCLAT reached a judgment based on "a contrived and self-serving reading of certain correspondence from which it derives erroneous findings which kaleidoscopically portray the larger theme of the judgment on purported oppression and prejudice to the Shapoorji Pallonji Group (SP Group)".
"The Impugned Judgment is also infirm because it blatantly indulges in propagating a selective narrative where relevant facts and records have been glossed over," he said. "The pretense of reasoning and judicial approach is betrayed by omission to consider the record itself."
He said there are no 550 mails between him and Cyrus Mistry as mentioned in the NCLAT judgment. "These mails were between Chairman Emeritus and Chairman Cyrus Mistry and not by entities in Court."
"The whole case of oppression and prejudice is based entirely on words and statements contained in correspondence without there being an iota of evidence to buttress any actual loss/injury being caused to Tata Sons as a result of Cyrus Mistry being forced to act on such interference/interdiction against his wishes," the petition said.
It went on to state that it was "very unfortunate and distressing" that the NCLAT judgment without providing any proper evidence has passed adverse remarks against Ratan Tata who has spent more than half of his life in building the name of the Tata Sons and other Tata operating companies to one of the top global companies.
The judgment creates a wrong legal precedent that is vulnerable to being misused against several companies, including the public sector and government companies, it said. KRH ANZ BAL

The database is said to be of 20 million Big Basket users, which was first <a href="https://www.businessinsider.in/business/startups/news/bigbasket-the-e-grocery-startup-which-tata-group-is-eyeing-admits-a-data-breach-of-over-20-million-users/articleshow/79122791.cms">confirmed</a> by the Indian grocery delivery startup on November 7, 2020. The database includes email IDs, home addresses, phone numbers, password hashes (potentially hashed OTPs), IP addresses, date of birth and also the user-aggregator interactions done on the <keyword id="235499" type="COMPANY" weightage="20" keywordseo="APP">app</keyword>. The hacker who is said to have published the alleged Big Basket database goes by the name ShinyHunters. The database was made available for anyone to download over the weekend on a well-known cybercrime forum. ShinyHunters is the same hacking group that has started to flood a dark web hacking marketplace with databases containing a combined total of 73.2 million user records over 11 different companies, according to threat intelligence SaaS provider Cyble. According to <a href="https://cybleinc.com/2020/11/07/bigbasket-indias-leading-online-supermarket-shopping-allegedly-breached-personal-details-of-over-20-million-people-sold-in-darkweb/">Cyble</a>, which was the first to make the details of the potential breach public, the first breach occurred on October 14 and it found out about it on October 30, later disclosing it to Big Basket on November 1. You simply need to go to these sites, enter your email used to register the account and hit enter. In the former’s case, you will be informed about the number of breaches. Scrolling down, you will be able to see the platforms that were hit by a breach, compromising your data. I checked mine, and unfortunately, my data has been compromised in 11 breaches (image above) including Big Basket, Zomato, Dunzo, Zoomcar and more.

Big Basket data breach: email IDs, phone numbers, home addresses of two crore Indians allegedly leaked on the web

The tussle between <keyword id="6360722" type="PERSON" weightage="20" keywordseo="ratan-tata">Ratan Tata</keyword> and <keyword id="6356895" type="PERSON" weightage="100" keywordseo="Cyrus-Mistry">Cyrus Mistry</keyword> will be taught in B-schools as it covers every aspect of management and crisis. 
 
From removal of Mistry, boardroom war to e-mail wars that went in public, every detail of the tussle has now become a valuable lesson to be taught in the management schools. 
 
As per experts, one can learn about corporate governance, conflict management, etc from the tiff between the Tatas and Mistry. 
 
"In the case under development - the ouster of Cyrus Mistry - we plan to focus on the issues related to ownership rights and managerial rights; in a listed firm, the former does not automatically afford the latter,” Ramachandran J, who teaches corporate strategy and policy at IIM-Bangalore, told ET. 
 
The matter will also be taught at IIM-Calcutta. Anirvan Pant, associate professor of strategic management, told ET the point of discussion would be whether it was enough to engage as a chairman just on the strategy dimension or should one look at both strategy and creating an identity for the group. 
 
Among the many takeaways from this saga, said the professors ET spoke to, is how family-managed businesses should handle succession successfully. The selection of a successor, his induction and the clarity that a non-family CEO should get will also be talked about with students. 
 
"When a case is written on this, it can be used brilliantly to illustrate the problem of governance, succession planning, economic value added, ethics versus efficiency and the role of culture in organisations,” Ajit Prasad, the director at IIM-Lucknow, told ET.

In a para¬by ¬para response to the petition filed by investment firms associated with Mistry's family against his removal, Tata Sons — the holding company of the $103 billion salt-¬to-¬steel conglomerate — told the National Company Law Tribunal (NCLT) that Mistry was removed as Chairman on October 24 last year after "little or no signs of improvement" in his leadership. Seven out of the nine directors of Tata Sons voted for his replacement after <keyword id="2789990" type="UNKNOWN" weightage="20" keywordseo="Farida-Khambata">Farida Khambata</keyword> abstained and Mistry was declared ineligible to vote as he was an interest director. "Before the commencement of the board meeting of Tata Sons on October 24, 2016, Ratan N Tata and (director) Nitin Nohria personally spoke to <keyword id="6356895" type="PERSON" weightage="100" keywordseo="Cyrus-Mistry">Cyrus Mistry</keyword> and offered Cyrus Mistry an opportunity to resign voluntarily as Executive Chairman. However, Cyrus Mistry refused to do so," Tata Sons said in 204¬page affidavit. Stating that the decision was not taken suddenly or in haste, it said the removal "was the result of a chain of events that led to a growing trust and confidence deficit that had to be addressed without delay". During his four years at the helm, "several disturbing facts" emerged about his leadership including insufficient details and discipline on capital allocation decisions, slow execution on problems, strategic Plan and Business Plan lacking specificity and follow ¬through, no meaningful steps to enter new growth businesses and weak top management team. 
 
For 4 years, the directors of Tata Sons supported Mistry and exercised caution, restraint and patience, according to the affidavit. "It was Mistry himself who invited Ratan Tata to be the Chairman Emeritus of Tata Sons and in that capacity, Ratan Tata had the right to participate in the meetings of the Board of Directors of Tata Sons," it said. Prior to October 24, 2016, in his capacity as Chairman Emeritus, Tata never attended any board meeting of Tata Sons and used to render advice only if warranted, as a person interested in the welfare of the Tata Group and in most cases, if not all, only when Mistry reached out to him. "Ratan Tata personally advised and counselled Mistry on several matters, when time and again Mistry reached out to Ratan Tata for guidance on business related matters," it said. It said although the Nominations and Remunerations Committee of Tata Sons, in its meeting held on June 28, 2016, made positive comments on Mistry's performance, it also stressed upon "the need for greater clarity on the functioning of the Board of Tata Sons Ltd in relation to the Tata Trusts, as well as its role vis¬a¬vis Group Companies". Further, the Committee "did not sufficiently factor his ability to lead the Tata Group in the future". "It was felt that Mistry's leadership was lacking on numerous fronts and did not match up to his promises made at the time of his selection. Mistry's leadership was not aligned to the long term goals and targets of Tata Sons as a company and the Tata Group as a whole," it added
