NEW DELHI: The Supreme Court on Friday referred to a larger constitutional bench the case related to the release of those convicted of the murder of former <keyword id="71" type="POSITION" weightage="60" keywordseo="Prime-Minister">Prime Minister</keyword> <keyword id="12596" type="PERSON" weightage="40" keywordseo="Rajiv-Gandhi">Rajiv Gandhi</keyword>. The convicts will not be released from prison till further orders, the court said. 
 A bench headed by <keyword id="42759" type="POSITION" weightage="60" keywordseo="Chief-Justice">Chief Justice</keyword> P Sathasivam delivered the judgment at 10.30am on Friday. The apex court bench framed several questions to be addressed by the five-judge constitution bench, including after commutation of the death sentence into life imprisonment whether the government can further grant them remission by releasing them. 
 
The Supreme Court said that the constitution bench will also address which government has the power to exercise remission for condemned prisoners under the code of criminal procedure; whether it is the state government or the central government or both. 
Former Prime Minister Rajiv Gandhi was assassinated at Sriperumpudur near Chennai in Tamil Nadu on May 21, 1991. A special court for Terrorist and Disruptive Activities (Prevention) Act (POTA) found all the 26 persons guilty of the offence and awarded them death sentence in January 1998. On a referred appeal before the Supreme Court, the death penalties of only four, Nalini, Murugan, Santhan and Perarivalan, were confirmed. Later, on the recommendation of the Tamil Nadu cabinet, the state's governor commuted the death penalty of Nalini alone into imprisonment for life. 
 Meanwhile, the mercy pleas of the three condemned persons pending before the <keyword id="2540" type="POSITION" weightage="40" keywordseo="President">President</keyword> for more than 11 years were rejected, and their hanging was scheduled to be held in September 2011. It was, however, stayed by the Madras high court. 
 
On February 18 this year, the apex court commuted their death sentence into imprisonment for life, saying inordinate and unexplained delay in disposing of their mercy pleas by the President would be a valid ground for commuting their sentence. 
 On February 19, Tamil Nadu <keyword id="5269" type="POSITION" weightage="40" keywordseo="Chief-Minister">chief minister</keyword>, J Jayalalithaa, announced their immediate release from prison prematurely by invoking provisions of the Code of Criminal Procedure. Assailing the decision, the Centre rushed to the Supreme Court, which stayed their release on February 20. 
 
Last week, Chief Justice of India P Sathasivam, on a visit to Coimbatore, had told a group of reporters there that verdict on the validity of their premature release will be given before his retirement, which is on April 26. Taking exception to the announcement and apprehending a motive at the timing of such a disclosure, former chief minister M Karuananidhi had said the CJI ought not to have discussed such a thing in public, that too while the elections in the state were round the corner.

NEW DELHI: In perhaps the strongest push yet for bringing <keyword id="12587" type="PERSON" weightage="40" keywordseo="Priyanka-Gandhi">Priyanka Gandhi</keyword> to the forefront of the <keyword id="1575" type="ORGANIZATION" weightage="80" keywordseo="Congress">Congress</keyword>, senior party general secretary Janardan Dwivedi has said that <keyword id="12596" type="PERSON" weightage="40" keywordseo="Rajiv-Gandhi">Rajiv Gandhi</keyword> spoke to him about his daughter's political aptitude way back in 1990. 
 
While promising to reveal details in due course, Dwivedi said, "As far as I know, her (Priyanka) interest in politics started at an early age. She was keen to understand political developments and the language of politics from the very start. I even have proof of this but I don't want to discuss it now. All I'll say is that Rajiv Gandhi told me something about this in 1990. That's all for the moment." 
 
While there was complete silence from the party, the comment immediately led a group of Congress leaders to claim, off the record, that there were plans afoot to bring Priyanka into active politics. 
 
The renewed speculation could unsettle the Congress since any talk of Priyanka's coming into politics undercuts Rahul's fledgling leadership. Dwivedi is seen to be representing a significant group in the top and middle rungs of the party management who would prefer 42-year-old Priyanka as political legatee of the Nehru-Gandhi dynasty in place of her one-year-older brother. 
 His remarks are being seen in certain sections of the party as a vote of low-confidence in <keyword id="5268" type="PERSON" weightage="40" keywordseo="Rahul-Gandhi">Rahul Gandhi</keyword>, who is leading the Congress charge in a difficult national election. Rahul was elevated to the No 2 position in Congress last year but is still far from succeeding his mother <keyword id="689" type="PERSON" weightage="40" keywordseo="Sonia-Gandhi">Sonia Gandhi</keyword> at the top. In the past few weeks, the much-discussed transformation of Congress in Rahul's image — the emergence of a Congress (R), as it were — appears to be have been put on hold as the party's primary focus has shifted to avoiding its lowest-ever tally (114 seats in 1999). 
 
 
 A section of the party has for some time been pushing for a larger role for Priyanka. But she has confined herself to managing the family fief of <keyword id="43068" type="PERSON" weightage="40" keywordseo="Rae-Bareli">Rae Bareli</keyword> and Amethi since her mother came into electoral politics in 1999; of late, though, she has been active in the planning of her brother's political affairs. 
 
The invocation of Rajiv Gandhi's name by Dwivedi is being seen as significant. If the former PM did reveal details about Priyanka's interest in politics dating back to as early as 1990, it would appear that it developed at a very young age; she would have been about 18 at the time. Party veterans recall at least one interview that Rajiv gave in the late 1980s where he seemed to suggest that his daughter had a greater interest in politics than his son did. 
 
Dwivedi has indirectly hinted that Rajiv did not speak about Rahul, raising the sensitive question as to whether the late leader had a different plan of succession in mind. 
 
Congress leaders are now waiting for a second instalment from Dwivedi: the details of what Rajiv reportedly told him. Party sources say it may come if Congress performs dismally in the elections, which would be an opportune time for insiders to raise questions about the leadership skills of Rahul Gandhi.

Rohit Sharma, Vinesh Phogat among four recommended for Rajiv Gandhi Khel Ratna Award

It was in the early 1980s, under <keyword id="6354478" type="PERSON" weightage="100" keywordseo="Indira-Gandhi">Indira Gandhi</keyword>’s regime as the PM, that her son Rajiv Gandhi once sat with his parents-in-law, explaining them the features of a new navy ship. In what was an extended chit-chat session for the Gandhis, <keyword id="104005" type="PERSON" weightage="100" keywordseo="Ashok-Pandey">Ashok Pandey</keyword>, the defence ministry bureaucrat present there got nervous and thought that he might be late for an official event that night. 
 
Mr Pandey was the then special assistant to the Minister of State for defence Shivraj Patil, and he must have breathed a sigh of relief after Rajiv Gandhi finished his briefing, because of which he and the Gandhis were able to attend the dinner with naval officers. 
 
Mr Pandey had served in Assam and Meghalaya as a young IAS officer when he started his career, and then proceeded to handle crucial responsibilities at the Centre and in Bihar. He has now come out with a book, called <keyword id="3377995" type="UNKNOWN" weightage="100" keywordseo="From-Inside-the-Steel-Frame">From Inside the Steel Frame</keyword>, and the book recounts his insights into how India grew and changed when he was in service, along with snippets of memories from his service in various districts, state capitals and the national capital. 
 
The book has been published by Palimpsest, and contains several of such incidents that Mr Pandey recalls, the one mentioned being from a trip to Bombay that he took with PM Indira Gandhi when India had launched a new ship on the Navy Day, along with Rajiv Gandhi. 
 
The book emphasises on the importance of India’s steel frame, as the name suggests. 
 He also mentions the temperamental, biased and whimsical <keyword id="134281" type="PERSON" weightage="100" keywordseo="Sanjay-Gandhi">Sanjay Gandhi</keyword>, who got many government officials fired because of his special interest in the affairs of the civil aviation ministry.
