The petition, filed through advocate Sunil Fernandes, contends the petitioners have moved the top court to "secure the safety, security and right to life of the students -candidates appearing for the NEET/JEE exams". What does the petition say - <ul><li>The petitioners contended that if the August 17 order is not reviewed, then grave and irreparable harm and injury would befall the student community of the country and it will impact health, welfare and safety of the students/candidates appearing for the NEET/JEE examinations.</li><li>The petition argues that the top court has ignored the logistical difficulties in conducting the examinations at the proposed dates.</li><li>"Failed to balance the competing but equally important aspects of conducting the examination and securing safety of the student. Fails to ensure that mandatory safeguards are put in place during the conduct of the examinations," said the petition challenging the August 17 order.</li><li>"The advice of 'Life Must Go On' may have very sound philosophical underpinnings but cannot be a substitute for valid legal reasoning and logical analysis of the various aspects involved in the conduct of the NEET UG and JEE exams," the petitioners argued.</li><li>They said the apex court failed to appreciate that the Centre had adequate time to establish at least one centre for every district for NEET (UG) and JEE (Mains) rather than having several centres in one district.</li><li>"With regards to the second reason of losing a year, it is most respectfully submitted that this would be tantamount to putting the cart before the horse, as the submissions hereinabove have revealed. JEE-NEET 2020 to be held as scheduled — Supreme Court dismisses review petition filed by six ministers

After being pushed by the Supreme Court, the <keyword id="6356303" type="General" weightage="20" keywordseo="Centre" source="Orion">Centre</keyword> on Wednesday told the top court that NEET-Super Speciality exam scheduled in November this year will be held as per the old question pattern. Additional Solicitor General Aishwarya Bhati, representing the Centre, submitted before a bench headed by Justice D.Y. Chandrachud that in the larger interest of students, the government has decided that the revised <keyword id="12191324" type="General" weightage="20" keywordseo="NEET-SS-exam" source="Orion">NEET-SS exam</keyword> syllabus will be introduced from 2022 -- the new question pattern will be applicable from next year. The bench replied that the "government has been very fair". Bhati said the exam scheduled this year will be held as per the old pattern. Advocate <keyword id="6368850" type="General" weightage="20" keywordseo="prashant-bhushan" source="Orion">Prashant Bhushan</keyword>, representing a petitioner, submitted that this should not in any way imply that the court is accepting the revised pattern exam for the next year. The bench recorded that the Centre states that decision has been taken in consultation with the National Medical Commission (NMC) and National Board of Examinations (NBE) and taking note of students' interest who would have commenced preparation for NEET-SS, before the change of pattern was notified. The bench said the Centre has stated that the modified pattern will be in effect from academic year 2022-23. "Since the grievance addressed under Article 32, and in these circumstances petitions under Article 32 are disposed of", said the bench. On Tuesday, the Supreme Court pulling up the Centre on the changes in the National Eligibility-cum-Entrance Test-Super Specialty (NEET-SS) 2021 pattern, said the impression and message which will go out is that the medical education and medical regulation in the country has become a business and it appears the entire haste is for filling the vacant seats. On the aspect of syllabus change, the bench told the NBE counsel, "What was the hurry. You have an examination pattern which had been going on from 2018 to 2020." The top court said: "The impression we get is that the medical education has become a business and medical regulation has also become a business". The bench also comprising Justices Vikram Nath and B.V. Nagarathna said this would become a tragedy for the medical education in the country. Defending the pattern change, the Centre had proposed deferring the National Eligibility cum Entrance Test (<keyword id="6361994" type="General" weightage="100" keywordseo="neet" source="Orion">NEET</keyword>) Super Speciality exam for 2021 by a period of two months. NEET-Super Speciality exam to be held as per old question pattern, Centre tells Supreme Court

The Union Ministry of Health and Family Welfare on Friday deputed high level Central teams to Kerala, <keyword id="6354780" type="ENTERTAINMENT" weightage="20" keywordseo="Karnataka">Karnataka</keyword>, Rajasthan, Chhattisgarh and <keyword id="6357783" type="UNKNOWN" weightage="20" keywordseo="West-bengal">West Bengal</keyword>. These States have been reporting a surge in the number of new Covid cases in the recent days. Each team comprises of a Joint Secretary, who is the nodal officer for the respective state, one public health expert to look after the public health aspects, one clinician to look after infection prevention practices, clinical management protocol being followed by the state. The teams will support the state efforts towards strengthening containment, surveillance, testing, infection prevention and control measures, and efficient clinical management of the positive cases. The Central teams shall also guide in effectively managing the challenges related to timely diagnosis and follow up. The total cases in Kerala are 3,17,929 which form 4.3 per cent of the total cases. The Cases per million stand at 8,906. Total number of recovered cases is 2,22,231 accounting for recovery rate of 69.90 per cent. The active Cases are 94,609, comprising 11.8 per cent of the total national figure. Total deaths in the state are 1,089 with case fatality rate of 0.34 per cent and deaths per million of 31. The TPM of Kerala stand at 53,518 and the positivity rate is 16.6 per cent. Karnataka has 7,43,848 total cases accounting for 10.1 per cent of the national figure. It has 11,010 cases per million population. 6,20,008 patients have recovered in the state resulting in a recovery rate of 83.35 per cent. The active cases are 1,13,557, 14.1 per cent of the national figure. The state has reported total of 10,283 fatalities, CFR of 1.38 per cent and 152 deaths per million population. The TPM is 95,674 and positivity rate is pegged at 11.5 per cent. Rajasthan has registered 1,67,279 total cases, 2,064 Cases per million and 1,43,984 total number of recoveries with recovery rate of 86.07 per cent. The active cases as on date are 21,587, 2.7 per cent share in the national numbers. The numbers of fatalities in the state is 1,708; case fatality rate is 1.02 per cent; and deaths per million stands at 21. TPM is 38,605 with positivity rate of 5.3 per cent. West Bengal has 3,09,417 total cases, 4.2 per cent of the national cases amounting to 3,106 cases per million population. Total recovered are 2,71,563 and the recovery rate is 87.77 per cent. With 31,984 active cases, the state accounts for 4.0 per cent of the total pie. Total deaths are 5,870; case fatality rate is 1.90 per cent whereas the deaths per million population are 59. With 37,872 TPM, the positivity rate is 8.2 per cent. Chhattisgarh is reporting 1,53,515 total cases, 5,215 cases per million, 1,23,943 total recovered and 80.74 per cent recovery rate. It has 28,187 active cases comprising 3.5 per cent of the national figure. There have been 1,385 total deaths in the state accounting for the case fatality rate of 0.90 per cent and 47 deaths Per million. The TPM are 50,191 and the positivity rate is 10.4 per cent. As an ongoing effort to strengthen efforts of various State and UT governments for Covid management, the Central government has been deputing Central teams from time to time to visit various States and UTs. These teams interact with the the authorities and get a first hand understanding of the challenges and issues being faced by them so as to strengthen their ongoing activities and remove bottlenecks, if any. Health Ministry rushes expert teams to 5 states reporting high COVID-19 cases

Recent cases of <keyword id="6356238" type="General" weightage="20" keywordseo="suicide" source="Orion">suicide</keyword> by students aspiring for career in Medicine or Engineering in <keyword id="77357" type="General" weightage="50" keywordseo="kota" source="Orion">Kota</keyword> (Rajasthan) - the coaching hub of the country - may have triggered debates over the tough competition and the unending pressure, but, these are not isolated incidents. There are numerous instances from across the country where young students, having desire to excel in their academic career, have succumbed for different reasons and decided to end their lives. Centralised data on suicide released by the National Crime Records Bureau (NCRB) showed that the number of students' deaths by suicide has increased in the recent years. With a total of 13,089 cases of suicide by students, the latest data shows that compared to 2020, the number increased by nearly 4.5 per cent in 2021. Nearly half of them were reported from the five states -- Maharashtra, <keyword id="6355554" type="General" weightage="80" keywordseo="madhya-pradesh" source="Orion">Madhya Pradesh</keyword>, <keyword id="20154" type="General" weightage="80" keywordseo="tamil-nadu" source="Orion">Tamil Nadu</keyword>, Karnataka and Odisha. According to the data, of total suicides committed by students, 14.0 per cent were reported in Maharashtra (1,834) followed by 10.0 per cent in Madhya Pradesh (1,308), 9.5 per cent in Tamil Nadu (1,246) and 6.5 per cent in Karnataka (855). While the report doesn't mention any specific reasons behind suicides, it said that 'failure in examination' was one of the reasons. On September 8, a 22-year-old medical aspirant ended her life by jumping from the nineteenth floor of a tower in her society as she could not clear the National Eligibility Entrance Test (NEET)-UG examination. The incident was reported from at Greater Noida's JP Aman Society in Sector 151. As per reports, an initial investigation revealed that the girl was unhappy after the declaration of her NEET result. In a similar incident, a 19-year-old Chennai girl allegedly died by suicide in Tamil Nadu's Ambattur after she failed to clear the NEET exam. The girl took the extreme step just hours after the results were declared. On June 30, a medical aspirant allegedly died by suicide over the fear of NEET. The 19-year-old from Choolaimedu (Tamil Nadu) was preparing for the medical entrance examination. Similarly, on April 30, two 17-year-old girls allegedly committed suicide in separate incidents after failing to clear Class 12 board examination in Balaghat and Tikamgarh districts of Madhya Pradesh. As per the Union Ministry of Education, the government and the <keyword id="44171" type="General" weightage="80" keywordseo="ugc" source="Orion">UGC</keyword> have taken several initiatives to check the incidents of harassment and discrimination of students. University Grants Commission (Redressal of Grievances of Students) Regulations, 2019 have been formulated to safeguard the interests of the students. The UGC has also notified 'UGC Regulations on Curbing the Menace of Ragging in Higher Educational Institutions, 2009' and issued circular for strict compliance of the Regulations. Further, the ministry has undertaken various steps such as peer assisted learning, introduction of technical education in regional languages for students in order to ease the academic stress. The government's Manodarpan initiative, covers a wide range of activities to provide psychological support to students, teachers and families for mental and emotional well-being during the Covid outbreak and beyond. In addition, institutions conduct workshops/seminars on Happiness and Wellness, regular sessions on Yoga, induction programmes, extracurricular activities including sports and cultural activities and appointment of Student Counsellors for overall personality development and de-stressing students. Further, students, wardens and caretakers are sensitised to bring to notice the signs of depression in fellow students to the authorities so that timely clinical consultation may be provided.

Fear of failure drove 13,089 students to suicide in 2021; Maha tops list

The Supreme Court Thursday refused to entertain pleas of various political parties challenging the Centre's decision not to grant 50 per cent reservation to OBCs as per Tamil Nadu law in <keyword id="6386019" type="UNKNOWN" weightage="20" keywordseo="medical-seats">medical seats</keyword> surrendered by the state in the all India quota for under graduate, post graduate and dental courses in 2020-21, saying "the right to reservation is not a fundamental right". The top court asked the political parties, Dravida Munnetra Kazhagam (DMK), All India Anna Dravida Munnetra Kazhagam (AIADMK), CPI (M), Vaiko, Anubmani <keyword id="42761" type="PERSON" weightage="20" keywordseo="Ramadoss">Ramadoss</keyword>, <keyword id="458412" type="COMPANY" weightage="20" keywordseo="Tamil-Nadu-Congress-Committee">Tamil Nadu Congress Committee</keyword> and CPI, to approach the Madras High Court with their pleas for grant of <keyword id="45661" type="DOMAIN" weightage="20" keywordseo="OBC">OBC</keyword> quota in medical admissions. "The senior counsel for the petitioners seek permission to withdraw these <keyword id="1700892" type="PERSON" weightage="20" keywordseo="writ-petitions">Writ Petitions</keyword> with liberty to approach the High Court by filing Writ Petitions under Article 226 of the Constitution. Permission granted. "The Writ Petitions are, accordingly, dismissed as withdrawn with the aforesaid liberty," a bench of justices L Nageswara Rao, Krishna Murari and S Ravindra Bhat said in its order. The bench said during the hearing that a plea under Article 32 (filing of Writ petition in SC) of the Constitution can be filed only in case of violation of fundamental rights and no such rights of political parties have been violated. "Right to reservation is not a fundamental right," the court said. The counsel for political parties said they were not seeking any addition in existing quota and were alleging that the OBC reservation policy was not being implemented. "You should withdraw this and go to the Madras High Court," the bench said, adding that the liberty was granted to the political parties to do that. The political parties have challenged the Centre's decision not to grant 50 per cent reservation to OBCs in medical seats surrendered by Tamil Nadu in the all India quota for under graduate, post graduate and dental courses in current academic session. DMK had said in its plea that it was opposing the denial of implementation of 50 per cent OBC policy of the state, other than in central government institutions. It said the Medical Council of India (MCI) regulations clearly contemplate adherence to state reservation laws while filling up of the seats. The party said that the All India Quota seats are contributed by states surrendering seats in the government and private medical and dental colleges as per the MCI regulations. DMK had sought ad-interim injunction restraining the Respondents from proceeding further with All India Counselling for PG seats pursuant to the NEET-PG 2020 results without following the 50 per cent reservation for OBC quota in Tamil Nadu pending disposal of the plea. The party also sought direction for calling of the records of the Respondent pertaining to the Result of NEET-PG, 2020 published on May 9, 2020 by the National Board of Examinations relating to the filling up of the All India Quota and quashing of the same. "The Petitioner (CPIM) is constrained to approach this court as the Respondents (Centre, MCI and others) herein have grossly failed to provide the statutory reservations for Other Backward Classes (OBC) i.e. Backward Classes (BC) and Most Backward Classes (MBC) and anomaly in granting reservation to SC-STs students in admissions to the Under graduate and Post Graduate medical courses in all medical colleges in Tamil Nadu in the category of 'state surrendered seats to the All India Quota' in Government and private medical colleges other than the Central Government institutions," the plea of CPI(M) had said. Ruling AIADMK had alleged that there was no rational basis for not extending the benefit of 50 per cent reservation for OBCs, as envisaged under the State laws of Tamil Nadu, to the State-captured seats in the All India Quota. The AIADMK party said that in all past academic years since the inception of the All India Quota system, OBCs have been grossly under represented in the All-India-Quota seats in undergraduate, diploma, PG diploma and postgraduate medical colleges across the country. Under this Hero will sell and service Harley motorcycles in the country. “Hero MotoCorp will sell and service Harley-Davidson motorcycles and sell parts and accessories and general merchandise riding gear and apparel through a network of brand-exclusive Harley-Davidson dealers and Hero’s existing dealership network in India. As part of a Licensing agreement, Hero MotoCorp will develop and sell a range of premium motorcycles under the Harley-Davidson brand name,” the Pawan Munjal-led <a href="https://www.bseindia.com/xml-data/corpfiling/AttachLive/9861361c-6dcd-41b5-9ea4-de3fa5e4cde6.pdf">company said in a regulatory filing today</a>. The company said “this arrangement is mutually beneficial for both companies and riders in India, as it brings together the iconic Harley-Davidson brand with the strong distribution network and customer service of Hero MotoCorp.” <div type="Article" hostid="261" msid="74338802" title="The rise and fall of Harley-Davidson" mstype="2" mssubtype="0"></div> Harley’s exit from India Harley-Davidson recently announced its exit from India, after it turned out to be one of the worst international markets for the company. On September 24, the company said that it would shut down the manufacturing facility in Bawal and significantly reduce the size of its sales office in Gurgaon in<a href="https://www.sec.gov/ix?doc=/Archives/edgar/data/793952/000079395220000097/hog-20200923.htm"> its filing to the United States Securities and Exchange Commission</a> (SEC). With India being one of the world’s largest price-sensitive markets, Harley’s premium bikes suffered tepid sales, and this pandemic just made it worse. There are 7,25,991 active cases of coronavirus infection in the country which comprises 21.93 per cent of the total caseload, the data stated. India's COVID-19 tally had crossed the 20-lakh mark on August 7 and went past 30 lakh on August 23. According to the ICMR, a cumulative total of 3,85,76,510 samples have been tested up to August 26 with 9,24,998 samples being tested on Wednesday. Of the 1,023 fresh deaths, 295 are from Maharashtra, 133 from Karnataka, 118 from Tamil Nadu, 90 from Uttar Pradesh, 81 from Andhra Pradesh, 55 from West Bengal, 41 from Punjab, 19 from Jammu and Kashmir, 17 each from Madhya Pradesh, Delhi and Gujarat, 15 from Jharkhand, 14 from Assam, 13 each from Odisha and Kerala, 12 from Rajasthan and 11 each from Bihar and Haryana. Ten fatalities have been reported from Chhattisgarh, eight each from Goa, Puducherry and Telangana, six from Uttarakhand, four from Andaman and Nicobar Islands, two each from Tripura and Himachal Pradesh while Chandigarh, Ladakh and Manipur have registered one fatality each. Of the total 60,472 deaths, Maharashtra has reported the maximum at 23,089 followed by 6,839 in Tamil Nadu, 5,091 in Karnataka, 4,347 in Delhi, 3,541 in Andhra Pradesh, 3,149 in Uttar Pradesh, 2,964 in West Bengal, 2,945 in Gujarat,and 1,282 in Madhya Pradesh. So far, 1,219 people have died of COVID-19 in Punjab, 992 in Rajasthan, 788 in Telangana, 657 in Jammu and Kashmir, 634 in Haryana, 530 in Bihar, 441 in Odisha, 362 in Jharkhand, 274 in Assam, 257 in Kerala and 219 in Uttarakhand. Chhattisgarh has registered 231 deaths, Puducherry 180, Goa 165, Tripura 85, Chandigarh and Andaman and Nicobar Islands 41 each, Himachal Pradesh 32, Ladakh and Manipur 25 each, Nagaland nine, Meghalaya eight, Arunachal Pradesh five, Sikkim three and Dadra and Nagar Haveli and Daman and Diu two. The health ministry stressed that more than 70 per cent of the deaths occurred due to comorbidities. "Our figures are being reconciled with the Indian Council of Medical Research," the ministry said on its website, adding that state-wise distribution of figures is subject to further verification and reconciliation. India reports 75,760 COVID-19 cases in a day — highest single day spike yet

UK's <keyword id="128650" type="COMPANY" weightage="20" keywordseo="Cairn-Energy">Cairn Energy</keyword> has identified USD 70 billion of Indian assets overseas for potential seizure to collect USD 1.72 billion due from the government -- a move if successful will put India in league with Pakistan and Venezuela which faced similar enforcement action over failure to pay arbitration awards. The assets identified range from <keyword id="2573" type="COMPANY" weightage="20" keywordseo="Air-India">Air India</keyword>'s planes to vessels belonging to the Shipping Corporation of India, and properties owned by state-owned banks to oil and gas cargoes of PSUs, three people familiar with the matter said. These assets are across several jurisdictions, they said without giving further details. <keyword id="64469" type="COMPANY" weightage="20" keywordseo="Cairn">Cairn</keyword> plans to move courts in the US to Singapore for seizure of the assets in absence of Indian government's refusal to honour an international arbitration award. "The Indian government naturally will challenge such seizure but to save the assets it may have to pawn money equivalent to the value of assets in some financial security such as bank guarantee. The court will return such a guarantee to India if it does not find merit in Cairn's case. But the surety will be passed on to Cairn if the court finds that India had failed to honour its obligation," a source said. Cairn has got an international arbitration award -- which overturned levy of retrospective taxes and ordered New Delhi to return the value of shares it had sold, dividends seized and tax refunds withheld to recover such taxes -- registered in the US, UK, France, the Netherlands, Singapore, Mauritius, Canada's Quebec province, Japan and UAE. Now it has started moving courts to get a declaration that state-owned entities are alter egos of India and they should be held liable for discharge of the arbitration award in absence of the government making payments. Cairn on May 14 filed a lawsuit in a New York court to get Air India recognised as the alter ego of India and that "it should be held jointly and severally responsible for India's debts, including from any judgment resulting from recognition of the award". Once a court recognises Air India as the alter ego of the Indian government, Cairn can seek attachment or seizure of its assets in the US such as airplanes, immovable assets and bank accounts to recover the amount it was awarded by the arbitration tribunal. The move is similar to a court in the British Virgin Islands ordering in December last year that <keyword id="6368036" type="COMPANY" weightage="20" keywordseo="hotels">hotels</keyword> in New York and Paris owned by Pakistan International Airlines would be used to settle a claim against Pakistan's government by a Canadian-Chilean copper company. Crystallex International Corp had brought a similar lawsuit to attach property of Petroleos de Venezuela, S.A (PDVSA), the state-owned oil company of Venezuela, in Delaware couple of years back after the Latin American country failed to pay the firm USD 1.2 billion that an arbitration tribunal had ordered to pay in lieu of the 2011 seizing gold deposits held and developed by the firm. In 2012, Elliott Management, a buccaneering American hedge fund which held distressed Argentine bonds, seized a handsome tall ship belonging to Argentina's navy. Recently, French courts ruled that a stifled creditor could seize a business jet belonging to the government of Congo-Brazzaville while it was being serviced at a French airport, as well as USD 30 million from a bank account of the country's state oil company. While the finance ministry has so far not commented on the Cairn move, sources said India will take all necessary steps to defend against any such "illegal enforcement action". India, they said, will contest the move on grounds that the government has challenged the arbitration award in the appropriate court in The Hague and it is confident that the award will be set aside. Sources said the government has also engaged a counsel team which is ready to defend against any enforcement action. While they maintained that neither the government nor any PSU has received any such notice, people aware of the Cairn lawsuit said the case has been brought only on Friday and notices in due course will come to the concerned authorities. The sources said as and when any such notice is received, the government/ concerned organisation shall take all necessary steps to defend against "any such illegal enforcement action". "Cairn is taking the necessary legal steps to protect shareholders' interest in the absence of a resolution of the arbitral award," a company spokesperson said commenting on the issue. "Cairn remains open to continuing constructive dialogue with the <keyword id="6377129" type="COMPANY" weightage="20" keywordseo="government-of-india">Government of India</keyword> to arrive at a satisfactory outcome to this long-running issue." The Scottish firm invested in the oil and gas sector in India in 1994 and a decade later it made a huge oil discovery in Rajasthan. In 2006 it listed its Indian assets on the BSE. Five years after that the government passed a retroactive tax law and billed Cairn ₹10,247 crore plus interest and penalty for the reorganisation tied to the flotation. The state then expropriated and liquidated Cairn's remaining shares in the Indian entity, seized dividends and withheld tax refunds to recover a part of the demand. Cairn challenged the move before an arbitration tribunal in The Hague, which in December awarded it USD 1.2 billion (over ₹8,800 crore) plus costs and interest, which totals USD 1.725 million (₹12,600 crore) as of December 2020. The company, which previously said the ruling was binding and enforceable under international treaty law, has been since then courting Indian government officials to get the money paid. But the government has not agreed to pay. Finance Minister Nirmala Sitharaman had last month reiterated that international arbitration ruling on India's sovereign right to taxation sets wrong precedent, but had said that the government is looking at how best it can sort out the issue. The government, which participated in an international arbitration brought by the Scottish firm against being taxed retrospectively, has appealed against The Hague based tribunal's ruling. Sources said the appeal does not inhibit the company from seeking seizure of Indian assets. "It may not go for seizure of assets in the Netherlands during pendency of the appeal, but it can go after assets elsewhere," a source said.
