You have till 31 December to push for a new payment plan As per the RBI’s circular, resolution under the new mechanism has to be invoked by 31 December 2020. Once invoked, it must be implemented within 90 days. However, RBI suggests that banks and other lending institutions should try and kick off their plans earlier than the due dates. If you have a bank loan that you are unable to pay, restructuring is on its way

<ul><li>The Reserve Bank of India’s (RBI) Monetary Policy Meeting (MPC) is currently underway and it has some tough decisions to make.</li><li>It needs to decide between meeting its inflation-targeting mandate and making sure there’s still liquidity in the market. </li><li>The RBI also needs to figure out where another moratorium or a one-time restructuring of loans across all sectors will be better for businesses.</li></ul>The Reserve Bank of India (RBI) is set to announce its policy rate decision tomorrow, and this time around, the situation is more uncertain than usual. From meeting its inflation mandate to keeping money circulating in the economy to dealing with loans — RBI’s policy decision could set the tone for how the apex bank expects the next few months to go. The moratorium conundrum Many banks and industry experts are of the opinion that another moratorium on loan repayments is not required going forward. The RBI first announced a three-month moratorium from March to May then extended the limit to August 31 leading to a lot of uncertainty when it comes to a bank’s balance sheets. Private and public sector banks alike have been shoring up provisions to deal specifically with COVID related accounts, over and above the RBI’s mandate. <div type="image" title="Provisions in Q1" msid="77365771" hostid="261" caption="&amp;lt;p&amp;gt;Provisions across major Indian banks in Q1&amp;lt;/p&amp;gt;"></div> SBI chairman Rajnish Kumar told the <a href="https://economictimes.indiatimes.com/news/economy/policy/government-and-corporates-need-to-invest-more-for-recovery-sbi-chairman-rajnish-kumar/articleshow/77358404.cms">Economic Times</a> that the moratorium has achieved its limited purpose and can now be done away with. “What the RBI can do is if the bank is satisfied with the intent of the borrower and normalisation in cash flows, it can give some relief,” he said. The call for one-time restructuring Rather than delay payments further, Indian industry leaders are suggesting that a one-time restructuring of all loans should be put on the table. Certain segments were already struggling before the coronavirus pandemic hit and others are wondering how to crack the ‘new normal’. <div type="Article" hostid="261" msid="77328145" title="One-time loan restructuring dilemma - RBI won’t commit, and India Inc won’t stop asking for it" mstype="2" mssubtype="0"></div> The RBI’s issue with restructuring loans has always been that it amounts to ‘deceptive banks’ — in the words of the former RBI governor Raghuram Rajan. Businesses, on the other hand, don’t want to be declared NPA in order to be restructured since that blocks incremental funding. For any of this to happen, banks need to be incentivized to pump more money into loans on the verge of collapse. RBI’s inflation-targeting mandate Former RBI Deputy Governor Viral Acharya <a href="https://www.moneycontrol.com/news/trends/current-affairs-trends/focus-on-inflation-over-growth-at-next-policy-review-meet-viral-acharya-to-rbi-5631091.html">believes</a> that the apex bank should ‘respect’ its core mandate and get inflation in India under control. But, it’s not a simple choice because of the relationship inflation shares with the repo rate. The RBI has slashed the repo rate twice in the last 4 months — once during the March MPC by 75 basis points (bps) and again in an off-cycle meeting in May by another 40 bps. 100 bps make up one percent and the repo rate is one of the instruments that the RBI has on hand to control inflation and spur growth. The rate currently stands at 4%. The repo rate and inflation share an inverse relationship. While dipping the repo rate further could make inflation worse, increasing it would make it more expensive for banks to borrow. The RBI is required to keep inflation in India between 2% to 6% as per its inflation targeting mechanism — or core mandate as Acharya put it. Three things the RBI will have to mull over as it gets ready to announce its monetary policy decision

<ul><li>The Reserve Bank of India (RBI) is bringing in <keyword id="396965" type="ORGANIZATION" weightage="20" keywordseo="KV-Kamath">KV Kamath</keyword> to head up a new committee that will look into the one-time restructuring of loans. </li><li>The committee will look into the financial parameters that need to be factored into resolution plans. </li><li><keyword id="4124197" type="PERSON" weightage="20" keywordseo="loan-resolution">Loan resolution</keyword> beyond a certain amount will also be validated by the committee before implementation.</li></ul>The Reserve Bank of India (RBI) has taken heed to the call of industry leaders and is open to the idea of the one-time restructuring of loans — with its own terms and conditions, of course. It will set up a new mechanism for stressed assets that need rescuing and the existing scheme for restructuring MSMEs has been extended. <div type="Article" hostid="261" msid="77387591" title="‘Watchful’ RBI leaves repo rate unchanged to keep inflation in check" mstype="2" mssubtype="0"></div> Governor <keyword id="6359111" type="UNKNOWN" weightage="20" keywordseo="Shaktikanta-Das">Shaktikanta Das</keyword> said that the Reserve Bank of India will set up a committee under KV Kamath ⁠— the former chairman of BRICS Bank and ICICI Bank ⁠— to set the parameters and benchmarks for this programme aimed at the resolution of stressed loans. The existing scheme for restructuring MSMEs is being extended to cover loans that were classified as standard as of March 1. Das said that for any new borrowers coming into the fold that the restructuring has to be implemented before 31 March 2021. <div type="Article" hostid="261" msid="77328145" title="One-time loan restructuring dilemma - RBI won’t commit, and India Inc won’t stop asking for it" mstype="2" mssubtype="0"></div> “The underlying theme of this resolution window is the preservation of the soundness of the Indian banking sector,” said Das highlighting that safeguards will be put in place like prudent entry norms, clearly defined boundary conditions, specific binding covenants, independent validation and strict post-implementation performance monitoring. The one-time restructuring of loans or resolution window will be implemented under the Prudential Framework dated 7 June 2019. Prudent entry norms Banks and other lending institutions can only extend this facility to borrowers that are facing stress on account of COVID 19. But when it comes to types of loans, everyone is fair game — from big corporate loans to personal loans. Banks will also need to make sure that any resolution plan adheres to the eligibility criteria put forward by the RBI. For instance, MSME borrowers with aggregate exposure of ₹25,000 crore or less as of March 1 will not be eligible. Financial service providers, credit societies, and government loans will not be eligible either. The Expert Committee headed by Kamath will also bring in sector specific benchmark ranges for the financial parameters that need to be taken into account. Clearly defined boundary norms In addition to the financial parameters that will cover aspects of leverage, liquidity, and debt serviceability among other things, the Expert Committee will also be called on to vet resolution plans for loans where the amount is ₹1,500 crore or more. The Confederation of Indian Industry (CII) has suggested that business should only be given enough money to survive, not grow and the money should be given on priority — it will have precedence over all other obligations of the company. The CII had also recommended that loans not be classified as non-performing assets (NPAs) as a part of the restructuring. RBI seems to agree provided the resturcturing of loans is carried out within the stipulated timlines. This means that banks will still have to set aside 15% of the loan value to cover the default risk. Which means the levels of provisioning will continue to remain high and the demand for capital is unlikely to subside if bad loans grow. Constant monitoring Considering the uncertainty brought on by the coronavirus pandemic, borrowers are likely to be more conservative in their estimates for recovery. The difference could be as much as a borrower needing one year to recover in a pre-COVID world versus five years to recover post-COVID, according to EY analyst Abizer Diwanji. The RBI is only allowing banks to give up to two years for borrowers to pay back the pending amount of their loans. RBI brings in KV Kamath to set the boundaries for a one-time restructuring of loans

IDFC First Bank on Sunday said it will make an equity investment of Rs 250 crore in beleaguered Yes Bank to acquire 25 crore equity shares. "...duly authorized committee of the Board of Directors of IDFC FIRST Bank Ltd had at its meeting held on March 14, 2020 accorded approval for an equity investment of upto Rs 250 crores comprising upto 25 crore equity shares at a price of Rs 10 each and face value of Rs 2 each, under the proposed Scheme of Reconstruction of Yes Bank Ltd under the Banking Regulation Act, 1949, subject to regulatory and government approval(s), if any," the bank said in a BSE filing. Earlier on Saturday, Federal Bank had committed to investing Rs 300 crore in Yes Bank for subscription of its 30 crore shares. The Centre on Saturday notified the YES Bank Limited Reconstruction Scheme, 2020, a day after the Union Cabinet approved a reconstruction plan proposed by the RBI for bailing out fund-starved Yes Bank. The authorised capital of Yes Bank has been increased to Rs 6,200 crore, Finance Minister Nirmala Sitharaman said on Friday. As per the reconstruction scheme, moratorium on the troubled lender will be lifted on March 18. Under the plan, state-run SBI will infuse Rs 7,250 crore in the crisis-ridden bank and take 49 per cent equity. As per the rescue plan, ICICI Bank will invest Rs 1,000 crore, mortgage lender HDFC Rs 1,000 crore, Axis Bank Rs 600 crore, Kotak Mahindra Bank Rs 500 crore, Bandhan Bank and Federal Bank Rs 300 crore each. There will be a three year lock-in period for all the investors. However, the lock-in period for SBI would be only for 26 per cent of shareholding. It would be 75 per cent in case of other investors. New Delhi, Jul 6 () Punjab National Bank Managing Director S S Mallikarjuna Rao on Monday expressed hope that the Reserve Bank will unveil by October its loan restructuring mechanism for some sectors severely hit by the COVID-19 pandemic. Rao also said that the normalcy is still too far which is making it difficult to assess the situation of companies in terms of cash-flows. "We have requested RBI to permit restructuring. Bankers together have requested, through Indian Banks' Association (IBA), to RBI that you need to look at a one-time restructuring in all these accounts so that bankers will undertake the restructuring properly by analysing the cash flow. However, the account should not become NPA," he said during a webinar organised by CII. Citing an example of the US Federal Reserve, Rao said, the Fed has decided to directly lend corporates with two years' installment moratorium and one-year interest moratorium, besides offering longer durations for repayment. It, he stressed, indicates normalcy restoration by some of the industries is going to take longer. As per norms, Rao said, an account is treated as an NPA (non-performing asset) if it is restructured and provisions have to me made accordingly. Therefore, banks through IBA have requested the RBI for forbearance with regard to restructuring norms. "I believe in the recent board meeting they (RBI) have discussed. However, things may come out after some time. We can wait and see because as on today still we are unable to assess the cash flow of any unit because they have not come to normalcy. "So probably in the month of September and October you will have a better visibility in understanding about the cash flow, by which time, I am expecting that some decision in this regard could come from RBI," he said. The Reserve Bank in its 583rd board meeting on June 26 discussed current macroeconomic situation and evolving challenges being posed by the COVID-19 pandemic. In February, the RBI decided to extend the benefit of one-time restructuring without an asset classification downgrade to standard accounts of GST-registered micro, small and medium enterprises (MSMEs) that were in default as on January 1, 2020, in line with the Budget announcement. "More than five lakh MSMEs have benefitted from restructuring of debt permitted by the RBI in the last year. The restructuring window was to end on March 31, 2020. The government has asked the RBI to consider extending this window till March 31, 2021," Finance Minister Nirmala Sitharaman had said in the Budget Speech. Last month, the finance minister said the government is in talks with the RBI for a one-time restructuring of loans to help stressed companies. In 2008 also, when the world was hit by the global financial crisis, the RBI had announced a one-time loan restructuring for several sectors to help them tide over the economic woes. However, the benefit was misused by many corporate borrowers and banks, compelling the regulator to tighten the rules in 2015. The RBI also initiated asset quality review in December 2015 to put an end to the concept of evergreening of accounts to keep them standard and avoid provisioning. Overall, the gap between the average cost of debt and RBI’s repo rate has also come down drastically – from nearly 550 basis points in Q4 FY20, to 224 basis points at the end of Q2 FY23, reflecting the improved credit profile of realty companies even though interest rates have spiked. Robust topline performance was a key driver for pushing down the average cost of debt for these eight listed companies, namely – <keyword id="139366" type="General" weightage="50" keywordseo="sobha" source="Orion">Sobha</keyword>, Puravankara, Prestige Estates, Brigade Enterprises, Mahindra Lifespace Developers, Godrej Properties, DLF, and <keyword id="6473062" type="General" weightage="50" keywordseo="lodha-developers" source="Orion">Lodha Developers</keyword> (Macrotech). Their strong revenue growth during these ten quarters, and the low interest rates – between Q4 FY20 to Q2 FY23 – allowed these firms to obtain new debt and refinance existing debt at lower rates, the report added. “These [measures] included a reduction in repo rate, loan restructuring, stamp duty cuts, and a relief package to boost the economy. Housing sales gathered momentum on the back of record low home loan rates and stamp duty reductions in some states,” said <keyword id="6420759" type="General" weightage="50" keywordseo="anuj-puri" source="Orion">Anuj Puri</keyword>, chairman, Anarock Group. The net debt of the aforementioned eight listed companies has come down to ₹20,800 crore at the end of Q2 FY23, from ₹24,500 crore at the end of Q4 FY20, and ₹42,900 crore at the end of Q3 FY21. The increase in revenue of these listed realty companies is a reflection of their rising market share in real estate sales – which went from 16% in FY20 to 23% as of FY21. Average debt cost for top eight listed realty players lowest since pandemic, says Anarock

New Delhi, Feb 10 () The RBI extending the MSME loan restructuring scheme and allowing relaxation in asset classification for certain real-estate projects signify a gradual shift away from the regulator's earlier effort to enhance quality and transparency of asset classification by banks, Fitch Ratings said on Monday. There is a risk that such regulatory forbearance will perpetuate moral hazard, as it follows aggressive lending growth and risk-taking in certain sectors in five years to the financial year ended March 2019, the ratings agency said. "The Reserve Bank of India's (RBI) announcement of forbearance towards stressed sectors signifies a gradual shift away from the regulator's earlier effort to enhance the quality and transparency of asset classification in Indian banking system," Fitch Ratings said. Last week the RBI allowed restructuring of the borrower account of MSME by one more year till March 31, 2021. Finance Minister Nirmala Sitharaman in her budget speech had urged the RBI to extend the recast for small businesses and had also taken measures like a Rs 25,000 crore fund for stuck realty projects in her budget. Micro, small and medium enterprises contribute more than 28 per cent to the total GDP, more than 40 per cent to exports and employ about 11 crore people. Considering the importance of MSMEs in the Indian economy and for creating an enabling environment for the sector, a one-time restructuring of loans to MSMEs that were in default but 'standard' as on January 1, 2019, was permitted without an asset classification downgrade. Fitch said the RBI's move mark a further dilution of the regulator's drive to enhance loan recognition. "It is not clear at the moment whether this forbearance will be extended to non-bank financial institutions (NBFIs) as well, but we believe that the probability of this is high, considering the impact that the NBFI liquidity squeeze and a slowing economy have had on the MSME and real-estate sectors," it said. Fitch said in recent years, banks have preferred to lend to NBFIs, which lend heavily to the real estate and MSME sectors, as a way to deploy their excess liquidity, while limiting their own direct exposure to these areas. "Fitch believes that these extensions are only likely to defer asset-quality pressures unless there is a sustained improvement in macroeconomic conditions. Although we expect India's economic growth to pick up in the coming months, to 5.6 per cent in FY21 from 4.6 per cent in FY20, there are still risks to the country's economic outlook," Fitch said. It said Indian banks have a poor track record with restructuring and the RBI's asset-quality reviews in FY2016 and FY2018 found that a dominant share of loans restructured post-FY2012 had degraded into non-performing loans (NPLs). On the RBI's move to exempt cash reserve ratio cut against lending to specific sectors like auto, small businesses and housing, the agency said the move is aimed at improving monetary transmission as interest rates on the three products go down, but flagged concers on the same. "Most of these sectors have had above-average lending growth in the last few years, either directly or indirectly via non-banks, and could be at risk were the economy to slow," it said. The measure is unlikely to support sustainable credit growth until capitalisation improves meaningfully across banks, in particular among state-owned banks, which account for nearly two-thirds of the sector's assets, it added. Mumbai, May 5 () Non-banking financial companies (NBFCs) have asked the Reserve Bank of India to allow them one-time restructuring of all loans till March 2021, as their borrowers are facing funding issues amid the coronavirus pandemic and the subsequent lockdown. NBFCs have also demanded for extension of the Reserve Bank of India's moratorium to them, relaxation on provisioning norms and additional funding from Small industrial Development Bank of India (SIDBI) and National Bank for Agriculture and Rural Development (NABARD) through refinance mechanism. These suggestions were made by the industry players in their meeting with the Reserve Bank of India (RBI) held on Monday, according to the Finance Industry Development Council (FIDC), a representative body of lending NBFCs. The industry body said all their customers are facing disruptions in cash flow cycles, which is likely to be there for the major part of this fiscal. The most affected segments include transport operators, contractors and Micro, Small &amp; Medium Enterprises (MSMEs). "A one-time restructuring window should be allowed till March 2021 for amending the loan repayment schedules and/or extending loan tenures or restructuring the EMIs, without affecting the asset classification, in line with the revised expectation of cash flows of our customers," FIDC said in a statement. Currently, RBI has allowed banks and NBFCs for a one-time restructuring of existing loans to MSMEs till December 2020. NBFCs want that the one-time restructuring should be allowed for all other borrowers as well. While the three-months moratorium has provided some relief to borrowers, they may not be in a position to commence loan servicing from the fourth month on account of the disruption, FIDC said. It said the experience of targeted long term repo operations (TLTRO 2.0) clearly indicates risk aversion on the part of banks. In the first auction of TLTRO 2.0, RBI had received Rs 12,850 crore worth of bids, as against the notified amount of Rs 25,000 crore. "RBI should consider providing funds to a refinance mechanism through SIDBI, NABARD and their associate institutions which can provide long-term loans to NBFCs for their on-lending operations," the sector has requested the RBI. Also, the central bank should consider allocating the unsubscribed part of TLTRO 2.0 to SIDBI and NABARD. RBI, on April 17, announced to provide special refinance facilities for a total amount of Rs 50,000 crore to NABARD, SIDBI and National Housing Bank (NHB) to enable them to meet sectoral credit needs. NBFC players have also requested RBI that they should be given moratorium on their liabilities as well to ensure financial and liquidity stability to the sector. Last month, RBI had asked banks and NBFCs to maintain provisions of up to 10 per cent on all accounts that are at least 1 day past due and where a moratorium has been granted. The provision will be spread over two quarters - March, 2020 and June, 2020. NBFCs said given the nature of their borrowers and their businesses, it is routine for them to pay the EMIs a few days later. This usually happens due to various local factors (such as a truck operator's prolonged absence from home while driving the truck) and is not to be seen as a sign of credit risk, they said. A very substantial number of such customers service the loans before they become 30 days past due, the industry said while requesting a permission to make provisions, where moratorium has been given, only on loans that are 30 or more days past due.
