<ul><li>Scammers on the internet use identical logos and website layouts of established e-commerce platforms to cheat people. </li><li>They ask for advance payment through Paytm. </li><li>Flipkart is aware and has been working on taking legal action against such websites. </li><li>Today, Snapdeal has secured a Delhi High Court order that has led to nearly fraudulent 1200 links being removed from Twitter. </li></ul>Tech expert Kartic Rakhra’s twenty something attendant came to him with a simple problem – Flipkart was insisting that he pays only through Paytm. Curious, Rakhra decided to look into it only to see that it was a fake site. The elaborate scam was using <keyword id="8602207" type="UNKNOWN" weightage="20" keywordseo="fake-flipkart-logos">fake Flipkart logos</keyword> to sell products like phones and electronics with deep discounts. And, they are demanding an advance via Paytm. Through ads on UC Browser, scammers were offering Samsung, Redmi and Oppo smartphones for as low as ₹1,599 calling them ‘deals of the day’. For India’s rural consumers, it might come across as an attractive deal – only that they are asked to pay the amount through Paytm in advance. <a href="https://twitter.com/karticrakhra/status/1218814433364865026?s=19">https://twitter.com/karticrakhra/status/1218814433364865026?s=19</a> Many victims of the scam Rakhra pointed out that while Paytm issues a warning against making any advance payments, it does so in English which many ‘Bharat’ users fail to understand. “These ads are targeted at people who are new to the internet economy. So these are the people who think that having an ad on television legitimises the brand. When I told my grandfather's attendant, he put it out as a WhatsApp status that this is a scam and several others replied too that they have been scammed like that,” said Rakhra, who works as the product head at Blockchain powered company Somish Labs. Discounts and deals have been the not-so-secret sauce for Indian e-commerce sites. That’s exactly what fake sites use to lure people. Flipkart initiates a takedown Flipkart too is aware of the problem and has been working on. It also published <a href="https://stories.flipkart.com/fake-offers-fraudulent-sites-2/">a blog</a> in July 2018 to spread awareness. “We have a stringent process to check for fake and phishing sites. At Flipkart, a large part of our efforts are directed towards ensuring our customers are educated and well-informed. We have a robust continuous process in place to monitor, identify and take legal action against fake/lookalike domains, phishing sites and fraudulent websites, apps and social media pages that attempt to bring disrepute to Flipkart by impersonating our brand and thereby cheating and defrauding our customers and the public at large,” said a Flipkart spokesperson. Within Flipkart, the company also has a Brand Protection Council which assesses, monitors, reports and takes legal action against such fraudulent websites. “In the past year, we have reported and taken down a number of such fraudulent online sites,” said the spokesperson. E-commerce sites in India have often been subject to fraudulent links and scams where people misuse their name. Today, India’s third largest e-commerce player Snapdeal has secured a Delhi High Court order that has led to nearly fraudulent 1200 links being removed from Twitter. These entities were faking Snapdeal. “These were in violation of the copyright and registered trademarks of Snapdeal and also sought to represent that they are the official twitter handles of Snapdeal. The court’s interim order came in a suit filed by Snapdeal. In the suit, Snapdeal has also impeded various unidentified defendants who are the owners of the aforesaid URLs/links,” said Snapdeal. Here’s how scammers are using fake Flipkart websites and Paytm to dupe people

One of the biggest beneficiaries of the <keyword id="6362150" type="UNKNOWN" weightage="100" keywordseo="demonetization">demonetization</keyword> exercise, <keyword id="6357120" type="UNKNOWN" weightage="100" keywordseo="PayTM">Paytm</keyword> has been slapped with a notice of opposition against the registration of a <keyword id="6388866" type="UNKNOWN" weightage="100" keywordseo="trademark">trademark</keyword> for its two-tone blue colour scheme by its global counterpart, <keyword id="6357940" type="CITY" weightage="100" keywordseo="Paypal">PayPal</keyword>. 
 PayPal has raised the objection to <keyword id="3974547" type="UNKNOWN" weightage="100" keywordseo="Paytms-logo">Paytm’s logo</keyword> for being deceptively similar to its ‘earlier trademark’. 
 Section 21 of the <keyword id="3974548" type="UNKNOWN" weightage="100" keywordseo="Indian-Trademarks-Act-of-1999">Indian Trademarks Act of 1999</keyword> (Act) provides for a time frame of four months, for any person to oppose the advertised application of a trademark. It is under this provision that PayPal has filed the notice of opposition. 
 
PayPal, in its notice, has taken recourse to the following two sections for denial of registration: 
 
Section 9(2)(a) of the Act which provides for deception or confusion as an absolute ground of refusal against registration of the trademark; 
 
Section 11 of the Act which provides for similarity with an ‘earlier trademark’ as a ‘relative’ ground for refusal to grant registration. 
 
While Paypal has several trademarks registered in its name, this one in particular has by itself been ‘objected’ by the Registrar. PayPal has, therefore, ‘opposed’ Paytm’s trademark on the virtue of its ‘earlier trademark’ being ‘well-known’ under Section 2(1)(zg) of the Act. 
 
Singh &amp; Singh Lall &amp; Sethi are representing PayPal while Sigma Legal Services have been representing Paytm before the Registrar, as per online records available with the Trademarks Registry.

Logicserve Digital dons new identity after seeing 102% CAGR in the last 5 years; hopes to become a ₹180 crore agency by March 2020

The mobile marketplace <keyword id="6357120" type="UNKNOWN" weightage="100" keywordseo="PayTM">Paytm</keyword>, which had landed into <a href="http://www.businessinsider.in/Paytm-drags-Snapdeal-to-court/articleshow/51925332.cms">a legal battle</a> with Snapdeal-owned <keyword id="2646256" type="UNKNOWN" weightage="100" keywordseo="Unicommerce">Unicommerce</keyword>, has been granted relief from the High Court. As per the stay, Snapdeal has been barred from using any information derived from sellers transacting on the Paytm platform. 
 
Alibaba-backed Paytm, which had <a href="http://www.businessinsider.in/Paytm-joins-hands-with-Flipkart-for-timely-deliveries/articleshow/51696229.cms">joined hands with Flipkart</a>, had filed a suit against Unicommerce, alleging that it had been using Paytm’s confidential data without any authorities, an allegation that Snapdeal-owned Unicommerce had denied. 
 
Along with the stay order on the use of data, the court has also directed Unicommerce to pull down its YouTube advertisement and/or modify it so that Paytm’s logo, which carries the Paytm logo. 
 
Unicommerce claims that the "reliefs sought (by Paytm) have not been granted. We welcome the honourable court's interim order. While the matter is sub-judice, we believe that the allegations made are clearly unfounded and speculative." 
 
The next hearing has been set on July 11. 
 
In the recent past, there have been many such battles between leading e-commerce companies of India, including the online banter between Snapdeal and Flipkart. Increasing pressure from the investors can be cited as the reason why these companies are forced to up their sleeves for profits. 
 
It was only last month that <a href="http://www.businessinsider.in/The-Ola-Uber-rivalry-in-India-when-competition-became-ridiculous/articleshow/51714596.cms">Uber had sued arch rival Ola</a>, accusing it of using dirty tricks to undermine Uber’s business.

Huge breather for PayTM as Delhi HC restrains Snapdeal-owned Unicommerce from using its seller data

A few days back, we told you how intense pressure of competition and profitability has led to an <a href="http://www.businessinsider.in/Flipkart-vs-Snapdeal-E-commerce-giants-tremble-under-investors-pressure/articleshow/51581261.cms">online battle</a> between Flipkart and <keyword id="541988" type="COMPANY" weightage="100" keywordseo="SnapDeal">Snapdeal</keyword>. However, moving away from the online battle, Snapdeal has now found itself amidst a legal battle, with another one of India’s leading e-commerce firms. 
 Noida-based e-commerce platform <keyword id="6357120" type="UNKNOWN" weightage="100" keywordseo="PayTM">Paytm</keyword> that has <a href="http://www.businessinsider.in/Paytm-joins-hands-with-Flipkart/articleshow/51696229.cms">joined hands with Flipkart</a> for faster deliveries, has filed a lawsuit against Unicommerce, e-commerce management software and fulfilment solutions provider that Snapdeal acquired last year. 
 
Paytm has accused Unicommerce of accessing confidential business data from its commerce platform through its sellers. A lot of sellers who use Paytm also use Unicommerce for managing orders and inventory across multiple marketplaces and carts. Not only this, Paytm has also alleged that Unicommerce for using its logo and name without being authorized to do so. 
 
No one from Paytm, Snapdeal or Unicommerce commented on the matter, calling it subjudice. 
 
This is not the first time that Indian <a href="http://www.businessinsider.in/E-commerce-companies-lowering-cash-burn-rate/articleshow/51681289.cms">consumer internet companies</a> have landed in legal battles. Only about a month ago, cab aggregator service provider Uber had sued arch rival Ola accusing it to be involved in false bookings and creating fake rider accounts on Uber’s platform.

Paytm drags Snapdeal-owned firm to court for stealing business data

I’m sure you’ll know about the on-going lawsuit between <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a> and <keyword id="541988" type="COMPANY" weightage="80" keywordseo="SnapDeal">Snapdeal</keyword> owned <a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a>. Between allegations, counter allegations, blog posts and official statements issued, it’s a bit messy. 
 
What happened is, <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a> dragged Snapdeal-owned <a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a> to court for accessing confidential business data on its platform via sellers. 
 <keyword id="6357120" type="UNKNOWN" weightage="100" keywordseo="PayTM">Paytm</keyword> also claimed <a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a> was using Paytm’s logo and name without any authorization whatsoever. This <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a>-<a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a> tussle might remind you of the recent Uber-Ola case where Uber sued rival Ola of creating over 90,000 rider accounts on Uber’s platform and claimed over 20,000drivers left the company and claimed damages worth a whopping $7 million from its competitor. Interestingly, <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a> hasn’t asked <keyword id="2646256" type="UNKNOWN" weightage="80" keywordseo="Unicommerce">Unicommerce</keyword> for any damages till now. 
 
Anyway, here’s the breakdown of where things stand now. 
 
Point 1: Unicommerce shouldn’t use Paytm’s logo 
Court says: Unicommerce has stopped using Paytm’s trademark, i.e. its logo. It’s using the name ‘<a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a>’ in ‘normal font’ (whatever that means) to ‘describe’ Paytm and for no other purpose. <a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a>, don’t use Paytm’s logo. 
 
Paytm says: That what the Court said. They’ve (<a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a>) agreed not to use our logo. 
 
Snapdeal’s Unicommerce says: We’re no longer using <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a>’s logo, and won’t in the future. 
 
However, Paytm’s plea for an injunction (legal restraint order) against us using the logo failed, because we accepted we haven’t been using the logo since December 2015. 
 
Paytm’s plea to stop <a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a> from using the word “<a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">PayTM</a>” also failed. The Court said we’re free to use the word PayTM in normal font. 
 
Point 2: Unicommerce will pull down YouTube Video with Paytm logo: 
Court says: Pull down the YouTube video and use a ‘suitable modified’ version. Do it in a week. 
 
Paytm says: That what the Court said. 
 
Snapdeal’s Unicommerce says: An old <a href="http://www.businessinsider.in/searchresult.cms?query=YouTube&amp;sortorder=effectivedate">YouTube</a> video with their logo was cited by <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a>. We’ve removed the logo from the said old video. 
 
Point 3: Unicommerce shouldn’t access data from Paytm sellers: 
Court says: <a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a> shouldn’t use the data derived for Paytm sellers who are registered with both Paytm and Unicommerce. 
 
Paytm says: The Court told ‘em (Unicommerce) not to use any customers’ data ot sellers’ data that was being used to sign up sellers. 
This is important as our competition (Ummmm….<a href="http://www.businessinsider.in/searchresult.cms?query=Snapdeal&amp;sortorder=effectivedate">Snapdeal</a>?) might unduly use it. 
 
Snapdeal’s Unicommerce says: <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a> tried to stop <a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a> from accessing its seller data. That failed. We’ve clarified that the seller data was being accessed with their (the sellers’) consent and to help them (the sellers). We aren’t benefiting from it. 
 
Data Will Be Available Exclusively To Paytm Sellers 
Court says: Data will be available exclusively to <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a> sellers. This can be accessed on Paytm’s site. 
 
Paytm says: The order clearly states that sellers can only view this information and they cannot submit anything back such as catalogue information, inventory, pricing or create any order processing changes or catalogue changes in our systems. This effectively prevents any changes from happening into <a href="http://www.businessinsider.in/searchresult.cms?query=Paytm&amp;sortorder=effectivedate">Paytm</a> data and systems. 
 
Snapdeal’s Unicommerce says: The Court found no reason to change the status quo of <a href="http://www.businessinsider.in/searchresult.cms?query=Unicommerce&amp;sortorder=effectivedate">Unicommerce</a> accessing the seller data as a representative of the seller and making such data available back to them.

The company plans to use this capital to reach out to 10 million users across 100 cities by the end of this year. However, the eight-year-old company currently has 700,000 customers across 29 Indian cities. Excitel will also use a part of the capital to enhance its technology and customer experience as well as onboard talent to strengthen its operational and technical capabilities. “This year we are fixated on establishing ourselves in newer geographies, extending futuristic tech solutions while at the same time working towards hiring our next rung of leaders to create an ecosystem that sales rapidly,” Vivek Raina, chief executive officer (CEO) and co-founder of Excitel, said in a statement. Excitel is an internet service provider (ISP) which aims to offer low-cost high-speed broadband internet services across India, majorly in the Tier 2 and Tier 3 regions.
