One of the biggest beneficiaries of the <keyword id="6362150" type="UNKNOWN" weightage="100" keywordseo="demonetization">demonetization</keyword> exercise, <keyword id="6357120" type="UNKNOWN" weightage="100" keywordseo="PayTM">Paytm</keyword> has been slapped with a notice of opposition against the registration of a <keyword id="6388866" type="UNKNOWN" weightage="100" keywordseo="trademark">trademark</keyword> for its two-tone blue colour scheme by its global counterpart, <keyword id="6357940" type="CITY" weightage="100" keywordseo="Paypal">PayPal</keyword>. 
 PayPal has raised the objection to <keyword id="3974547" type="UNKNOWN" weightage="100" keywordseo="Paytms-logo">Paytm’s logo</keyword> for being deceptively similar to its ‘earlier trademark’. 
 Section 21 of the <keyword id="3974548" type="UNKNOWN" weightage="100" keywordseo="Indian-Trademarks-Act-of-1999">Indian Trademarks Act of 1999</keyword> (Act) provides for a time frame of four months, for any person to oppose the advertised application of a trademark. It is under this provision that PayPal has filed the notice of opposition. 
 
PayPal, in its notice, has taken recourse to the following two sections for denial of registration: 
 
Section 9(2)(a) of the Act which provides for deception or confusion as an absolute ground of refusal against registration of the trademark; 
 
Section 11 of the Act which provides for similarity with an ‘earlier trademark’ as a ‘relative’ ground for refusal to grant registration. 
 
While Paypal has several trademarks registered in its name, this one in particular has by itself been ‘objected’ by the Registrar. PayPal has, therefore, ‘opposed’ Paytm’s trademark on the virtue of its ‘earlier trademark’ being ‘well-known’ under Section 2(1)(zg) of the Act. 
 
Singh &amp; Singh Lall &amp; Sethi are representing PayPal while Sigma Legal Services have been representing Paytm before the Registrar, as per online records available with the Trademarks Registry.

A coach walks up to a boy in the crowd and asks him "Tera match khatam ho gaya…?” The boy informs that he has skipped his practice to cheer for the team, and gets slapped by the trainer who sternly opines, "Life mein khelna hai ya cheer karna hai?” Perplexed, the boy spends the entire night wondering if he should switch to a new coach. However, he visits the same coach the other day and firmly replies “…life mein khelna hai…” In the next shot, the coach is seen teaching the trademark high-elbow straight drive to the boy and is followed by the scene of Sachin playing the same shot in an ODI in real footage. In an interesting sequence, this real-life event is depicted as a photograph with Sachin standing next to it. Reminiscing the entire episode, he says 'It’s all about the choices you make.' The video concludes with the Paytm First Games' app interface depicting fantasy sports and the logo of the company. These films will be released across broadcast, online and mobile channels over the next few weeks.  Standing Out in the Clutter Shejale says the reason for this smooth-sailing is because the agency provides 360-degree digital solutions and is quick to latch on to new trends. “We are one of the early trend-catchers. When people were talking about programmatic, we immediately built a programmatic division and that’s why we picked up a lot of programmatic buyers in this country. Right now, digital is so much beyond media. It has four different skill sets and we have to weave them together to give an integrated solution to the customers. And there are very few agencies who can take an integrated approach properly,” says Shejale. Way Forward for Digital Media Shejale says high internet penetration, low price of data, and increased internet accessibility has helped the digital industry boom exponentially. Telling us the reason behind digital’s growth, Shejale says, “We stand at an important juncture where the rising adoption of digital platforms by consumers is encouraging brands to reach out to masses not only in Tier I cities but also in Tier II and Tier III through digital channels. The company plans to use this capital to reach out to 10 million users across 100 cities by the end of this year. However, the eight-year-old company currently has 700,000 customers across 29 Indian cities. Excitel will also use a part of the capital to enhance its technology and customer experience as well as onboard talent to strengthen its operational and technical capabilities. “This year we are fixated on establishing ourselves in newer geographies, extending futuristic tech solutions while at the same time working towards hiring our next rung of leaders to create an ecosystem that sales rapidly,” Vivek Raina, chief executive officer (CEO) and co-founder of Excitel, said in a statement. Excitel is an internet service provider (ISP) which aims to offer low-cost high-speed broadband internet services across India, majorly in the Tier 2 and Tier 3 regions. The company also offers over-the-top (OTT) subscriptions with broadband plans. The company offers its services in cities like Delhi, Hyderabad and Bengaluru to name a few. It started its services in Mumbai last quarter, piloting a 400 Mbps speed data plan starting at ₹499 per month for people opting for a 12 months plan. It competes with the likes of Jio Fiber, Airtel, Tikona, The Sky Internet, Hathway, Den Network and others. According to data released by Telecom Regulatory Authority of India (TRAI), India had 24.52 million wireline subscribers at the end of February 2022. Majority or 92.07% of these wireline users were from urban areas, whereas the remaining 7.93% were from rural areas.
