This ruling significantly expands the scope of the law to address the evolving challenges posed by digital platforms. <h2>A wider net</h2>In its ruling, a bench comprising Chief Justice D.Y. Chandrachud and Justice J.B. Pardiwala stated, "Any act of viewing, distributing, or displaying child pornographic material by a person over the internet without any actual or physical possession or storage of such material in any device or in any form or manner would also amount to 'possession' in terms of Section 15 of POCSO Act." This interpretation effectively settled conflicting verdicts from various high courts, notably overturning a Madras High Court decision that had quashed a POCSO case against an individual who had viewed child pornography but had not circulated it. The Supreme Court, in agreeing with senior advocate H.S. Phoolka's arguments, deemed the earlier judgement "egregiously erroneous." <h2>Crimes categorised</h2>In a further clarification, the Supreme Court divided crimes related to child pornography under Section 15 of the POCSO Act into three distinct categories. The decision emphasised that law enforcement and courts must carefully assess each case to determine the specific category under which an offence falls. One critical insight from the judgement is that an offender cannot escape prosecution by simply deleting illegal content before an FIR is registered. To address this, the court created a safeguard for those unaware of the offensive material stored on their devices. If a person discovers such material on their device through automatic downloads, they will not be prosecuted if they take immediate steps to delete it and report it to the authorities. However, the onus is on the device owner to act swiftly. Failure to delete or report the offensive material after becoming aware of it would constitute an offence under the law. To avoid the automatic downloading of problematic material, there are several proactive measures you can take. First, adjust your browser settings to disable automatic downloads and pop-ups, ensuring you have to approve any file before it is downloaded to your device. Lastly, routinely monitor your device for any unfamiliar files and promptly delete anything that looks suspicious to minimise your risk of unknowingly storing problematic content. <h2>What this means for the future</h2>This judgement sends a clear message: India is taking a zero-tolerance approach toward child pornography in all its forms, whether stored, distributed, or merely viewed. The ruling adapts the legal framework to modern challenges, ensuring that perpetrators can no longer hide behind technicalities such as the absence of physical possession. The Supreme Court’s interpretation also places a burden on individuals to exercise responsibility in the digital world. In her letter, dated August 30, Banerjee emphasised the gravity of the situation and urged for prompt central intervention, highlighting the inadequacy of the reply received from the Union Minister of <keyword id="20086338" type="General" weightage="20" keywordseo="Women-and-Child-Development" source="keywords">Women and Child Development</keyword>. The letter reads, "No reply was received from your end on such a sensitive issue. However, a reply has been received from the Minister of Women and Child Development, Government of India (vide their No. 1/RESC/HMWCD/2024 dated 25th August 2024), which barely addresses the gravity of the issue raised in my letter. I am of the view that the seriousness of the subject and its relevance to society have not been adequately appreciated in this generic reply." The letter was posted on her social media handle, X. In response to Union Minister Annapurna Devi's allegations regarding the state government's failure to implement essential safety measures for women and children, including Fast Track Special Courts (FTSCs), CM Mamata stated that the state government has approved 10 exclusive POCSO FTSCs, while 88 FTSCs and 62 POCSO-designated Courts are functioning with complete state funding. The letter mentioned, "Moreover, I would also refer to some of the initiatives in this area that our State has already undertaken, which appear to have been overlooked in the reply. Regarding Fast Track Special Courts (FTSCs), 10 exclusive POCSO Courts have been approved by the State Government. In addition to this, 88 FTSCs and 62 POCSO-designated Courts are functioning throughout the State with complete State funding. Monitoring and disposal of cases are entirely in the hands of the Courts." Highlighting the issue of appointing Presiding Officers in FTSCs, she further stated that this process requires examination and action from the Government of India, which, according to her, needs PM Modi's intervention. "As per Central Government guidelines, only retired Judicial Officers can be posted as Presiding Officers in FTSCs, but the Hon'ble High Court has observed that, in view of the severity of the cases, permanent Judicial Officers need to be appointed. This requires examination at the level of the Government of India and appropriate action thereafter, for which your intervention would be necessary. Moreover, Helpline Nos. 112 and 1098 are functioning satisfactorily in the State. Additionally, Dial 100 is also extensively used in emergency situations," the letter added. On August 26, Union Women and Child Development Minister Annapurna Devi criticised the West Bengal government for its failure to implement essential safety measures for women and children in the state. In a letter written to West Bengal CM Mamata Banerjee, the Union Minister stated that 123 Fast Track Special Courts (FTSCs) were allocated to the state, but none of them are functional yet. Earlier, on August 22, West Bengal CM Mamata Banerjee wrote a letter to Prime Minister Narendra Modi urging the central government to bring in central legislation and set up fast-track courts for "sensitive" issues to ensure a speedy trial. Mamata, in the letter, mentioned that such "sensitive" issues need to be addressed comprehensively through stringent central legislation prescribing exemplary punishment against the perpetrators of such heinous crimes. The Bengal Chief Minister suggested the setting up of "fast-track special courts" to deal with such cases, which require a speedy trial. This development comes after the trainee doctor was found dead in the seminar hall of RG Kar Medical College and Hospital in Kolkata on August 9.

This is despite the fact that India is estimated to have merely 11.9 per 1,000 internet users — which is way less than Iraq and Thailand. The other countries which rank high in CSAI are Mexico, Bangladesh, United States, Brazil, Vietnam, Algeria and Pakistan. However, India, Indonesia and Thailand constitute of more than a third (37%) of the cases reported. Overall, of the 23 million cases, nearly two in every five reports (40%) were filed in 2017. The NCMEC received 5.7 lakh reports during the first ten years of operation. “The data shows that ten years ago, 70% of CSAI reports reflected abuse in the Americas. Today, 68% of reports are related to abuse in Asia, 19% in the Americas, 6% in Europe, and 7% in Africa. A third of the world’s child porn is flagged off in India, Indonesia and Thailand

Bhopal, Jul 15 () Porn CDs, high-end cars, liquor bottles and bones of wild animals were seized by police during raids conducted at various places of Bhopal-based newspaper owner Pyare Miyan who has been on the run since he was booked for raping minor girls, police said on Wednesday. Five girls and a woman have filed complaints of rape against Miyan (68) so far. "CDs, DVDs, pen drives and hard disks containing pornographic material have been seized from five properties of Miyan in Bhopal and Indore during raids conducted in the last two days. These also include some child pornographic content," Superintendent of Police, Bhopal, Sai Krishna Thota told . Thota heads the Special Investigation Team (SIT) investigating this case. He said the victims had told the police that Miyan used to show them porn videos. "Police have also seized an antler and bones of wild animals besides expensive liquor during the raids. The seized vehicles included an Audi and a Pajero," the SP said. These vehicles were used to ferry girls to flats of Miyan, he said. "Four minor girls and a woman had filed complaints of rape against Miyan. The latest complaint was lodged by a minor girl at Koh-e-Fiza police station on Tuesday," Thota said. Police have booked Miyan on charges of rape under the Indian Penal Code and under the Protection of Children from Sexual Offences Act (POCSO). "Sections of Excise Act and the Wildlife Act were also added against him following seizure of an antler and bones of wild animals. Sections of SC/ST Act have also been invoked as two of the minor girls belonged to these communities," the SP said. According to police sources, Miyan used to take girls to his flats, located in posh areas of Bhopal, from where the pornographic material and liquor bottles were seized. Police found a dance floor and a large bar in one of these flats, they said. During the last two days, Bhopal administration had razed two illegal properties--a marriage hall and an apartment- which were built on a government land by Miyan. Police on Sunday booked Miyan's accomplice Sweety Vishwakarma (21) after five girls were found roaming around in Ratibad area in a drunken state. These girls had told Childline that Miyan had invited them to a birthday party on the intervening night of Saturday and Sunday in a flat in Shahpura area, police had said. The girls had alleged that Miyan had raped them on several occasions in the past, an official had said. Unnao rape case: Delhi Court convicts ex-BJP MLA Kuldeep Singh Sengar

New Delhi, May 22 () The Delhi High Court Friday directed the Registrar General to file an urgent report on the number of sexual offences cases dealt with by the trial courts where bail pleas were heard without hearing the complainant. Justice Prathiba M Singh, who conducted the hearing through video conferencing, said a detailed report be filed after collecting data from the district judges of Delhi. The high court has said that victims of sexual offences have an obligatory say in the hearing of bail pleas of accused and ordered re-circulation of practice directions on it. The high court was informed that trial courts are violating the directions earlier issued by the high court by passing bail orders without adhering to mandatory requirement of issuance of notice to the complainant or authorised person on the bail plea of accused of sexual offences. "It is deemed appropriate that an urgent report be called from the Registrar General, as to the number of such matters which have been dealt with by the criminal/POCSO courts without notice to the complainant and the number of matters in which the complainant was not present or not heard before disposal of bail applications. "A detailed report be filed with this court after collecting the data from the various District Judges of all the District Courts in Delhi. The Practice Directions ought to be completely adhered to, as they are meant to ensure that the complainants'/victims' rights are adequately safeguarded," the judge said. The high court was hearing a plea by the mother of a minor rape victim challenging the interim bail granted to the accused by a trial court without giving them a hearing or notice. Advocate Tara Narula, representing the victim, said the trial court's order granting interim bail to the accused on May 5 was passed in a routine manner and was not only bad in law but it also suffered from procedural lapse on the part of the sessions court. She said the order was passed without issuance of notice to the complainant of FIR and denied the opportunity of hearing. The counsel said there are more than 80 cases which have been heard in this manner by the trial courts. The high court was informed by the counsel for the accused that his interim bail should not be cancelled as his wife is unwell. It said that his wife's medical report be placed before it within a week and listed the matter for June 4. The victim's counsel submitted that with effect from April 21, 2018 there was an amendment in the law by which it has been mandated that the presence of the informant or any person authorised, shall be obligatory at the time of hearing of the application for bail to the person, accused of sexual offences. Earlier, the high court had said, "Since it is submitted by the counsel for the petitioner that number of courts are not following the above directions, let the Registrar General of this court once again circulate the Practice Directions" of September 24, 2019 and high court's orders of November 25, 2019 and January 27 this year to all the District and Session Judges in Delhi. The District and Sessions Judges will bring the directions to the notice of the criminal courts dealing with matters of sexual offences under the IPC and the Protection of Children from Sexual Offences (POCSO) Act under their respective jurisdiction, the high court had said. The high court, in its last year's orders, directed circulating the practice directions on it among the district judges and later, the directions were extended to the cases lodged under the POCSO Act. Narula submitted that a direction was issued to the District Judges, National Commission for Protection of Children Rights (NCPCR) and State Commission for Protection of Children Rights (SCPCR) to strictly comply with the same. The high court was informed by the lawyer that the victim and her family live in the vicinity of the accused and enlarging him on interim bail is a threat to their lives. Kochi, Jun 30 () BSNL has served a notice asking controversial activist and its dismissed employee Rehana Fathima to vacate from its residential quarters here, citing the recent police raid on her house and registration of a POCSO case over a video posted by her on social media. The police action has 'tarnished' its image, the state- owned telecom major said. Fathima, who made a vain bid to enter the Lord Ayyappa temple at Sabarimala in 2018, was booked last week after she posed semi-nude in front of her minor children, allowing them to paint on her bare body and sharing the video on social media. Police on June 25 had carried out a search at her house in the BSNL quarters at Panampilly Nagar as part of the probe in the case registered under various sections of POCSO Act and the IT Act by the city police. The case was filed based on a report filed by Cyberdom, the cyber wing of Kerala police, for posting an "offensive" video titled "Body and Politics" on social media. "The above event tarnished the image of BSNL. Hence you are instructed to vacate the quarters within 30 days from the date of receipt of this notice, failing which further proceedings will be initiated for eviction", said the June 27 notice, copy of which has been made available to media. As she ceased to be a BSNL employee, Fathima was ineligible to occupy the company quarters, it said. Fathima was sacked from employment by the BSNL in May this year for her intentional act of outraging the religious feelings of devotees through social media posts. The Kerala State Commission for Protection of Child Rights had earlier sought a report from police on the video matter and said case should be registered against the woman under various sections of the Protection of Children from Sexual Offences (POCSO) Act. The activist has last week moved the Kerala High Court seeking anticipatory bail, apprehending arrest in the POCSO case. After the Supreme Court allowed women in traditionally barred age groups of 10-50 into the Sabarimala temple in September 2018, Fathima made an attempt to enter the hill shrine, but had to retreat following protests by Hindu activists and devotees. Tandon had lodged two FIRs against a group of lawyers, including <keyword id="7418" type="ORGANIZATION" weightage="20" keywordseo="Members">members</keyword> and office-bearers of the Unnao Bar association, for allegedly attacking him twice last week. The Unnao Bar Association has issued a show cause notice to the lawyers involved in the incident while the Bar Council of Uttar Pradesh has set up a two-member committee, comprising Prashant Singh Atal and Ajay Yadav to probe the incident. Unnao Bar Association president Ram Shankar Yadav is named in both the cases lodged at the City Kotwali police station. Apart from him, former Unnao Bar Council presidents, Satish Shukla and Girish Mishra, and former government counsel Vinod Pathak, are among those named in the FIRs. Superintendent of Police, Sureshrao A Kulkarni, said no one had been arrested so far but the police had started investigating the case and provided additional security to judge Prahlad Tandon. The police said the first FIR was lodged against Ram Shankar Yadav, advocate Harsingh Bahadur and an unidentified lawyer for allegedly abusing the judge in a courtroom on March 23. According to the complainant, the three entered his court room and started abusing him in front of the court staff after he rejected the bail application of a person. Tandon, who is a special judge in a POCSO court, alleged that Ram Shankar Yadav and 150-200 unidentified advocates raised slogans against him, threw furniture and abused him. The complainant told the police that the lawyers climbed on the dais where he was sitting, and when he tried to go to his chamber, they surrounded him, pushed him around and slapped him. They also snatched his cell phone. According to the police, the accused chased Tandon to an adjoining gallery and damaged windows in the chambers of the judge and his stenographer. The SP said the matter was referred to a grievance committee. The complainant and the members of the Bar appeared before the committee but the matter could not be resolved. Circle Officer Gaurav Tripathi said Tandon's statement had been recorded and the investigators were collecting evidence at present. Unnao Bar Association suspends eight lawyers for attacking on district judge

Bilaspur, Jul 3 () A 7-year-old girl was raped allegedly by two minor boys who kidnapped her on the pretext of providing coronavirus treatment in Chhattisgarh's Gaurela- Pendra-Marwahi (GPM) district, police said on Friday. The incident took place on July 1 and the two boys were detained on Thursday, said Marwahi Station House Officer Sunil Kumar. "When the girl returned home after collecting wood from the forest, the two boys reached there and told her she had contracted coronavirus infection and took her along on the pretext of providing treatment," he said. "The girl was taken to the house of one of the accused, which was empty, where she was raped. She reached home and told her kin about the incident after which a case was registered," he added. The boys were booked under sections 363 (kidnapping) and 376D (gangrape) of IPC and provisions of the Protection of Children from Sexual Offences (POCSO) Act have also been invoked, he said. New Delhi, Apr 23 () Sharing of location through Google Maps and marking presence on video call are some of the bail conditions put up by the Delhi High Court to keep track of prisoners who are being released during the coronavirus pandemic to decongest jails.In three separate orders granting interim suspension of sentences, Justice Anup J Bhambhani has directed the three convicts to make a video call every Friday to the police officer concerned and also 'drop-a-pin' on Google Maps so that the officer can verify the prisoner's presence and location.The court passed the orders keeping in view the "unprecedented circumstances of a public health emergency" that prevail today and the consequent need to "decongest prisons for the overall medical safety of all prisoners".Those who were released are a 73-year-old retired school teacher, a 21-year-old man and an ATM van driver in cases of a minor's rape, rash and negligent driving and defalcation of Rs 51 lakh cash respectively."The appellant (convict) will make a video-call every Friday between 11 am and 11:30 am to the Investigating Officer, and in case the Investigating Officer is no longer in service or is otherwise unavailable, then to the SHO of the Police Station where the case was registered and also 'drop-a-pin' on Google maps, so that the IO/SHO can verify the appellant's presence and location."Counsel for the appellant has confirmed that the appellant has the wherewithal to comply with this condition," the judge said in the three orders.The court also asked the convicts to furnish their mobile number with the jail superintendent and ensure that the number is kept active and switched on at all times.The retired teacher sought suspension of his sentence on health grounds, including diabetes, hypertension and asthma, and said his past medical condition puts him in a vulnerable category that makes it medically unsafe for him to remain in prison in the present circumstances of the prevalent public health emergency.The prosecutor opposed the plea saying the man was convicted under the POCSO Act for raping a minor and was sentenced to 10 years in jail.The court, while noting that he has only been in jail since February 24 and that he has been convicted of heinous offences under the POCSO Act, suspended his sentence for three months considering the prevailing unprecedented circumstances of a public health emergency that is coronavirus.In the second case where the man was sentenced to six months imprisonment for offences of rash and negligent driving and causing death by rash or negligent act, the high court suspended his sentence till July 14. While driving a car, he had hit a two-wheeler causing grievous injuries to the scooterist and death of a woman pillion rider.He was directed by the trial court to pay Rs one lakh to the family of the deceased and Rs 50,000 to the injured.He had sought bail suspension of his sentence saying that in view of the prevalent serious public health emergency, he being a young man, would be exposed to avoidable and grave health risk in prison.The van driver, serving eight years jail term for robbery and causing grievous hurt to other persons who were accompanying him in the van by administering intoxicating food, had sought suspension of his sentence by two months.He sought to be released saying his family consisting of his wife and three minor children were in dire circumstances and they were facing financial issues in his absence.The high court suspended his sentence for 45 days noting that he has served almost half his punishment in prison and in view of the dire need of decongesting prisons due to the COVID-19 pandemic.The court directed the three convicts not to indulge in any act that would prejudice the proceedings in the appeal and asked them to surrender before the concerned jail superintendent on expiry of the period of interim suspension of sentence. Congress accuses Twitter of ‘double standards’ for allegedly locking 5000 accounts of party leaders and workers

Chandigarh, May 17 () In the first case of COVID-19 at a Punjab prison, a 48-year-old woman inmate at the Ludhiana jail has tested positive for coronavirus, officials said on Sunday. The woman, who tested positive for COVID-19 on May 1, is facing charges under the Narcotic Drugs and Psychotropic Substances Act. She was brought to the prison by the Sangrur Police on April 28. The Punjab government has so far released 9,773 inmates from all the jails in order to decongest state prisons in the wake of the COVID-19 outbreak, the officials. There were around 24,000 prisoners lodged in 24 jails across the state against an authorised capacity of 23,488, they said. The state government had decided to release convicts on parole and undertrial prisoners on interim bails. The decision to release prisoners was taken to protect their health and restrict transmission of COVID-19 by decongestion of prisons. Those convicted or charged under the Protection of Children from Sexual Offences (POCSO) Act, the Explosives Act and acid attacks were not considered for release, the officials said. The Punjab government had also announced to turn two jails -- Barnala and Patti prions -- into quarantine centres for new inmates to check the spread of the coronavirus outbreak. CHS VSD SNE
