This ruling significantly expands the scope of the law to address the evolving challenges posed by digital platforms. <h2>A wider net</h2>In its ruling, a bench comprising Chief Justice D.Y. Chandrachud and Justice J.B. Pardiwala stated, "Any act of viewing, distributing, or displaying child pornographic material by a person over the internet without any actual or physical possession or storage of such material in any device or in any form or manner would also amount to 'possession' in terms of Section 15 of POCSO Act." This interpretation effectively settled conflicting verdicts from various high courts, notably overturning a Madras High Court decision that had quashed a POCSO case against an individual who had viewed child pornography but had not circulated it. The Supreme Court, in agreeing with senior advocate H.S. Phoolka's arguments, deemed the earlier judgement "egregiously erroneous." <h2>Crimes categorised</h2>In a further clarification, the Supreme Court divided crimes related to child pornography under Section 15 of the POCSO Act into three distinct categories. The decision emphasised that law enforcement and courts must carefully assess each case to determine the specific category under which an offence falls. One critical insight from the judgement is that an offender cannot escape prosecution by simply deleting illegal content before an FIR is registered. To address this, the court created a safeguard for those unaware of the offensive material stored on their devices. If a person discovers such material on their device through automatic downloads, they will not be prosecuted if they take immediate steps to delete it and report it to the authorities. However, the onus is on the device owner to act swiftly. Failure to delete or report the offensive material after becoming aware of it would constitute an offence under the law. To avoid the automatic downloading of problematic material, there are several proactive measures you can take. First, adjust your browser settings to disable automatic downloads and pop-ups, ensuring you have to approve any file before it is downloaded to your device. Lastly, routinely monitor your device for any unfamiliar files and promptly delete anything that looks suspicious to minimise your risk of unknowingly storing problematic content. <h2>What this means for the future</h2>This judgement sends a clear message: India is taking a zero-tolerance approach toward child pornography in all its forms, whether stored, distributed, or merely viewed. The ruling adapts the legal framework to modern challenges, ensuring that perpetrators can no longer hide behind technicalities such as the absence of physical possession. The Supreme Court’s interpretation also places a burden on individuals to exercise responsibility in the digital world. Kochi, Jun 30 () BSNL has served a notice asking controversial activist and its dismissed employee Rehana Fathima to vacate from its residential quarters here, citing the recent police raid on her house and registration of a POCSO case over a video posted by her on social media. The police action has 'tarnished' its image, the state- owned telecom major said. Fathima, who made a vain bid to enter the Lord Ayyappa temple at Sabarimala in 2018, was booked last week after she posed semi-nude in front of her minor children, allowing them to paint on her bare body and sharing the video on social media. Police on June 25 had carried out a search at her house in the BSNL quarters at Panampilly Nagar as part of the probe in the case registered under various sections of POCSO Act and the IT Act by the city police. The case was filed based on a report filed by Cyberdom, the cyber wing of Kerala police, for posting an "offensive" video titled "Body and Politics" on social media. "The above event tarnished the image of BSNL. Hence you are instructed to vacate the quarters within 30 days from the date of receipt of this notice, failing which further proceedings will be initiated for eviction", said the June 27 notice, copy of which has been made available to media. As she ceased to be a BSNL employee, Fathima was ineligible to occupy the company quarters, it said. Fathima was sacked from employment by the BSNL in May this year for her intentional act of outraging the religious feelings of devotees through social media posts. The Kerala State Commission for Protection of Child Rights had earlier sought a report from police on the video matter and said case should be registered against the woman under various sections of the Protection of Children from Sexual Offences (POCSO) Act. The activist has last week moved the Kerala High Court seeking anticipatory bail, apprehending arrest in the POCSO case. After the Supreme Court allowed women in traditionally barred age groups of 10-50 into the Sabarimala temple in September 2018, Fathima made an attempt to enter the hill shrine, but had to retreat following protests by Hindu activists and devotees. Bilaspur, Jul 3 () A 7-year-old girl was raped allegedly by two minor boys who kidnapped her on the pretext of providing coronavirus treatment in Chhattisgarh's Gaurela- Pendra-Marwahi (GPM) district, police said on Friday. The incident took place on July 1 and the two boys were detained on Thursday, said Marwahi Station House Officer Sunil Kumar. "When the girl returned home after collecting wood from the forest, the two boys reached there and told her she had contracted coronavirus infection and took her along on the pretext of providing treatment," he said. "The girl was taken to the house of one of the accused, which was empty, where she was raped. She reached home and told her kin about the incident after which a case was registered," he added. The boys were booked under sections 363 (kidnapping) and 376D (gangrape) of IPC and provisions of the Protection of Children from Sexual Offences (POCSO) Act have also been invoked, he said. Congress accuses Twitter of ‘double standards’ for allegedly locking 5000 accounts of party leaders and workers

Mumbai, Jul 7 () A 13-year-old girl from Agripada in central Mumbai was allegedly kidnapped and raped by her Facebook friend, police said on Tuesday. The police on Monday arrested the 22-year-old main accused and four of his aides in separate raids at Rajasthan and Madhya Pradesh and rescued the victim, an official said. The victim went missing from her home on July 1, following which her mother lodged a complaint, the official said. Investigations revealed that the minor was in touch with the main accused on Facebook and police teams were dispatched to Jhalwad in Rajasthan and Rajgarh in Madhya Pradesh to track them down, he said. Acting on a tip-off, the police raided both the places and arrested five persons and rescued the victim, he said. On interrogation, the main accused revealed that he had taken the help of his aides to kidnap the victim and take her to Rajasthan amid the COVID-19 lockdown, the official said. Incidentally, the vehicle used by the accused was not intercepted anywhere along the way despite the lockdown norms, he added. The main accused had also allegedly raped the victim, the official said. The arrested accused have been charged under relevant sections of the Indian Penal Code and Protection of Children from Sexual Offences (POCSO) Act and further probe was underway, he added. New Delhi, May 22 () The Delhi High Court Friday directed the Registrar General to file an urgent report on the number of sexual offences cases dealt with by the trial courts where bail pleas were heard without hearing the complainant. Justice Prathiba M Singh, who conducted the hearing through video conferencing, said a detailed report be filed after collecting data from the district judges of Delhi. The high court has said that victims of sexual offences have an obligatory say in the hearing of bail pleas of accused and ordered re-circulation of practice directions on it. The high court was informed that trial courts are violating the directions earlier issued by the high court by passing bail orders without adhering to mandatory requirement of issuance of notice to the complainant or authorised person on the bail plea of accused of sexual offences. "It is deemed appropriate that an urgent report be called from the Registrar General, as to the number of such matters which have been dealt with by the criminal/POCSO courts without notice to the complainant and the number of matters in which the complainant was not present or not heard before disposal of bail applications. "A detailed report be filed with this court after collecting the data from the various District Judges of all the District Courts in Delhi. The Practice Directions ought to be completely adhered to, as they are meant to ensure that the complainants'/victims' rights are adequately safeguarded," the judge said. The high court was hearing a plea by the mother of a minor rape victim challenging the interim bail granted to the accused by a trial court without giving them a hearing or notice. Advocate Tara Narula, representing the victim, said the trial court's order granting interim bail to the accused on May 5 was passed in a routine manner and was not only bad in law but it also suffered from procedural lapse on the part of the sessions court. She said the order was passed without issuance of notice to the complainant of FIR and denied the opportunity of hearing. The counsel said there are more than 80 cases which have been heard in this manner by the trial courts. The high court was informed by the counsel for the accused that his interim bail should not be cancelled as his wife is unwell. It said that his wife's medical report be placed before it within a week and listed the matter for June 4. The victim's counsel submitted that with effect from April 21, 2018 there was an amendment in the law by which it has been mandated that the presence of the informant or any person authorised, shall be obligatory at the time of hearing of the application for bail to the person, accused of sexual offences. Earlier, the high court had said, "Since it is submitted by the counsel for the petitioner that number of courts are not following the above directions, let the Registrar General of this court once again circulate the Practice Directions" of September 24, 2019 and high court's orders of November 25, 2019 and January 27 this year to all the District and Session Judges in Delhi. The District and Sessions Judges will bring the directions to the notice of the criminal courts dealing with matters of sexual offences under the IPC and the Protection of Children from Sexual Offences (POCSO) Act under their respective jurisdiction, the high court had said. The high court, in its last year's orders, directed circulating the practice directions on it among the district judges and later, the directions were extended to the cases lodged under the POCSO Act. Narula submitted that a direction was issued to the District Judges, National Commission for Protection of Children Rights (NCPCR) and State Commission for Protection of Children Rights (SCPCR) to strictly comply with the same. The high court was informed by the lawyer that the victim and her family live in the vicinity of the accused and enlarging him on interim bail is a threat to their lives. HC directs registrar to file report on number of sexual offence cases heard without victim's say

Chandigarh, May 17 () In the first case of COVID-19 at a Punjab prison, a 48-year-old woman inmate at the Ludhiana jail has tested positive for coronavirus, officials said on Sunday. The woman, who tested positive for COVID-19 on May 1, is facing charges under the Narcotic Drugs and Psychotropic Substances Act. She was brought to the prison by the Sangrur Police on April 28. The Punjab government has so far released 9,773 inmates from all the jails in order to decongest state prisons in the wake of the COVID-19 outbreak, the officials. There were around 24,000 prisoners lodged in 24 jails across the state against an authorised capacity of 23,488, they said. The state government had decided to release convicts on parole and undertrial prisoners on interim bails. The decision to release prisoners was taken to protect their health and restrict transmission of COVID-19 by decongestion of prisons. Those convicted or charged under the Protection of Children from Sexual Offences (POCSO) Act, the Explosives Act and acid attacks were not considered for release, the officials said. The Punjab government had also announced to turn two jails -- Barnala and Patti prions -- into quarantine centres for new inmates to check the spread of the coronavirus outbreak. CHS VSD SNE

New Delhi, Apr 23 () Sharing of location through Google Maps and marking presence on video call are some of the bail conditions put up by the Delhi High Court to keep track of prisoners who are being released during the coronavirus pandemic to decongest jails.In three separate orders granting interim suspension of sentences, Justice Anup J Bhambhani has directed the three convicts to make a video call every Friday to the police officer concerned and also 'drop-a-pin' on Google Maps so that the officer can verify the prisoner's presence and location.The court passed the orders keeping in view the "unprecedented circumstances of a public health emergency" that prevail today and the consequent need to "decongest prisons for the overall medical safety of all prisoners".Those who were released are a 73-year-old retired school teacher, a 21-year-old man and an ATM van driver in cases of a minor's rape, rash and negligent driving and defalcation of Rs 51 lakh cash respectively."The appellant (convict) will make a video-call every Friday between 11 am and 11:30 am to the Investigating Officer, and in case the Investigating Officer is no longer in service or is otherwise unavailable, then to the SHO of the Police Station where the case was registered and also 'drop-a-pin' on Google maps, so that the IO/SHO can verify the appellant's presence and location."Counsel for the appellant has confirmed that the appellant has the wherewithal to comply with this condition," the judge said in the three orders.The court also asked the convicts to furnish their mobile number with the jail superintendent and ensure that the number is kept active and switched on at all times.The retired teacher sought suspension of his sentence on health grounds, including diabetes, hypertension and asthma, and said his past medical condition puts him in a vulnerable category that makes it medically unsafe for him to remain in prison in the present circumstances of the prevalent public health emergency.The prosecutor opposed the plea saying the man was convicted under the POCSO Act for raping a minor and was sentenced to 10 years in jail.The court, while noting that he has only been in jail since February 24 and that he has been convicted of heinous offences under the POCSO Act, suspended his sentence for three months considering the prevailing unprecedented circumstances of a public health emergency that is coronavirus.In the second case where the man was sentenced to six months imprisonment for offences of rash and negligent driving and causing death by rash or negligent act, the high court suspended his sentence till July 14. While driving a car, he had hit a two-wheeler causing grievous injuries to the scooterist and death of a woman pillion rider.He was directed by the trial court to pay Rs one lakh to the family of the deceased and Rs 50,000 to the injured.He had sought bail suspension of his sentence saying that in view of the prevalent serious public health emergency, he being a young man, would be exposed to avoidable and grave health risk in prison.The van driver, serving eight years jail term for robbery and causing grievous hurt to other persons who were accompanying him in the van by administering intoxicating food, had sought suspension of his sentence by two months.He sought to be released saying his family consisting of his wife and three minor children were in dire circumstances and they were facing financial issues in his absence.The high court suspended his sentence for 45 days noting that he has served almost half his punishment in prison and in view of the dire need of decongesting prisons due to the COVID-19 pandemic.The court directed the three convicts not to indulge in any act that would prejudice the proceedings in the appeal and asked them to surrender before the concerned jail superintendent on expiry of the period of interim suspension of sentence. Noida (UP), May 27 () A man was arrested here on Wednesday for allegedly raping a teenager for a year and then circulating her objectionable videos on WhatsApp that were recorded by his friend, who too has been nabbed, police said. The key accused, 26, had spiked the girl's soft drink last year and then raped her at her rented accommodation while his friend, 21, recorded the video of the episode, they said. "The key accused used the video to blackmail the 17-and-half-year-old girl and pressured her into having sex with him for the past one year," a police spokesperson said. The girl left for her native village at the onset of the coronavirus lockdown after which the accused men shared her objectionable videos on WhatsApp groups, he said. "The accused also threatened the girl that he would kill her and her family members if she approached police to report the matter," the spokesperson said. Police were alerted about the matter on Tuesday and an FIR was registered at the Sector 49 police station. The accused duo was tracked down and arrested on Wednesday, he said. The FIR has been filed under Indian Penal Code sections 376 (rape), 328 (causing hurt using poison), 120B (criminal conspiracy), 506 (criminal intimidation), police said. Charges have also been pressed against them under provisions of the Protection of Children from Sexual Offence (POCSO) Act, the Scheduled Castes and Tribes (Prevention of Atrocities) Act, and the Information Technology (IT) Act, they added. Unnao rape case: Delhi Court convicts ex-BJP MLA Kuldeep Singh Sengar

<ul><li>A Delhi court convicted former BJP MLA <keyword id="6413701" type="PERSON" weightage="20" keywordseo="kuldeep-singh-sengar">Kuldeep Singh Sengar</keyword> over the <keyword id="6355424" type="LOCATION" weightage="20" keywordseo="unnao">Unnao</keyword> rape victim’s father’s death. </li><li>The <keyword id="6355014" type="UNKNOWN" weightage="20" keywordseo="delhi-high-court">Delhi High Court</keyword> has already convicted Sengar for kidnapping and raping the minor girl in 2017. </li><li>He was also found guilty of plotting the rape of the minor along with co-accused <keyword id="291630" type="PERSON" weightage="20" keywordseo="Shashi-Singh">Shashi Singh</keyword>. </li></ul>A Delhi court convicted former BJP MLA Kuldeep Singh Sengar for the custodial death of the father of Unnao rape victim. Earlier, the Delhi High Court convicted Sengar for kidnapping and raping a minor girl in Unnao in 2017. The rape survivor's father died in police custody on April 9, 2018. This is one of the many cases that were filed on Sengar for an array of unfortunate incidents that took place, after the minor girl reported the rape. Sengar is already convicted under IPC, POCSO Act for offence of public servant committing penetrative sexual assault on child. He was also found guilty of plotting the rape of the minor along with co-accused Shashi Singh. The rape survivor, who was 17 years old at the time of the incident, told the CBI that Singh took her inside Senghar's residence, and gang-raped her. The CBI <a href="https://www.businessinsider.in/timeline-of-events-for-unnao-rape-case/articleshow/70466622.cms">also accused Senghar</a> of engineering an accident that took place on 28 July which killed both her aunts. She and her lawyer were also critically injured. On August 6, the victim <a href="https://www.ndtv.com/india-news/unnao-rape-survivor-her-lawyer-to-be-shifted-from-up-to-aiims-in-delhi-for-treatment-says-supreme-co-2080443">was taken</a> off the ventilator and airlifted to <keyword id="6365231" type="COMPANY" weightage="20" keywordseo="all-india-institute-of-medical-sciences">All India Institute of Medical Sciences</keyword> (AIIMS). Chandigarh, Jun 22 () The Punjab Cabinet on Monday gave its nod to set up four new COVID-19 testing laboratories in the state to scale up capacity to up to 13,000 tests a day. The decision was taken in a meeting chaired by Chief Minister Amarinder Singh. The new labs will be set up in Ludhiana, Jalandhar and Mohali, to help scale up testing capacity from the current 9,000 a day, in three government medical colleges at Patiala, Amritsar and Faridkot, to 13,000 tests per day, according to an official release. The new laboratories would be established at the Guru Angad Dev Veterinary and Animal Sciences University in Ludhiana; the Punjab State Forensic Sciences Laboratory in Mohali; the Northern Regional Diseases Diagnostic Laboratory in Jalandhar; and the Punjab Biotechnology Incubator in Mohali, it said. The cabinet also gave nod for appointing 131 essential staff needed for these labs, besides clearing the proposal for creating and filling up four posts of assistant professor (microbiology) on adhoc basis in these four testing laboratories. The release said that all the appointments will be made through outsourcing from the Baba Farid University of Health Sciences in Faridkot. The 131 staff positions positions would include research scientists (non-medical), research assistants, lab technicians, data entry operators, lab attendants and sweepers. The Cabinet has also given its nod to re-employment of the medical, ayurvedic and dental faculty after their retirement at 62 years. The re-employment will be done at the government medical and dental colleges in Patiala and Amritsar as well as the government ayurvedic college in Patiala. While re-employment will be up to the age of 70 years for medical and ayurvedic teachers, for dental faculty, it will be till the age of 65, ]the release said. To ensure expeditious disposal of cases related to the Protection of Children from Sexual Offences (POCSO) Act and crime against women, the cabinet also gave go ahead to the creation of 35 posts for setting up of new units of DNA, cyber forensic and audio and voice analysis in the Forensic Science Laboratory at Mohali, with an annual outlay of Rs 1.56 crore. The amended Section 173 of CrPC requires that trials of sexual offences cases should be completed within two months. DNA sampling and testing has also been made mandatory for all cases of sexual offences, said the release. To ensure effective implementation of these mandates, the cabinet cleared a proposal of the home department to strengthen the DNA unit in the state's forensic lab by increasing the number of units from one to two. The release said at present, cases of cyber forensic and audio and voice analysis are sent to other scientific laboratories for examination, since there is no facility for their examination in the state forensic lab. Under this, those convicted relating to <keyword id="24545" type="PERSON" weightage="20" keywordseo="Child-pornography">child pornography</keyword> will receive a five-year jail term. The other countries which rank high in CSAI are Mexico, Bangladesh, United States, Brazil, Vietnam, Algeria and Pakistan. However, India, Indonesia and Thailand constitute of more than a third (37%) of the cases reported. Overall, of the 23 million cases, nearly two in every five reports (40%) were filed in 2017. The NCMEC received 5.7 lakh reports during the first ten years of operation. “The data shows that ten years ago, 70% of CSAI reports reflected abuse in the Americas. Today, 68% of reports are related to abuse in Asia, 19% in the Americas, 6% in Europe, and 7% in Africa. Also, 84% of the detected CSAI images and 91% of the videos are reported only once,” TOI <a href="https://timesofindia.indiatimes.com/india/india-tops-list-on-reported-child-sexual-abuse-imagery/articleshow/71383544.cms">reported</a> citing the findings from the report. The countries are flagged on the basis of the locations of the IP addresses of such abuse, and victims.
