(Eds: Adds details) New Delhi, Dec 30 () The last date for the mandatory linking of the <keyword id="134255" type="COMPANY" weightage="20" keywordseo="permanent-account-number">Permanent Account Number</keyword> (PAN) with Aadhaar has been extended till March next year, the CBDT said on Monday. The earlier deadline was Tuesday, December 31. "The due date for linking of PAN with Aadhaar as specified under sub-section 2 of section 139AA of the Income-tax Act, 1961 has been extended from December 31, 2019 to March 31, 2020," the department said on its official Twitter handle. This is the eighth time that the Central Board of Direct Taxes (CBDT) has extended the deadline for individuals to link their PAN with Aadhaar. The Supreme Court, in September last year, had declared the Centre's flagship Aadhaar scheme as constitutionally valid and held that the biometric ID would remain mandatory for the filing of I-T returns and allotment of the PAN. Section 139 AA (2) of the Income Tax Act says that every person having PAN as on July 1, 2017, and is eligible to obtain Aadhaar, must intimate his Aadhaar number to tax authorities. Aadhaar is issued by the Unique Identification Authority of India (UIDAI) to a resident of India and PAN is a 10-digit alphanumeric number allotted by the I-T department to a person, firm or entity. PAN-Aadhaar linking deadline extended for the 8th time, now till March, 2020

Telecom Regulatory Authority of India (<keyword id="6356988" type="PERSON" weightage="100" keywordseo="TRAI">TRAI</keyword>), on Wednesday, amended its <keyword id="50781" type="UNKNOWN" weightage="20" keywordseo="Mobile-number-portability">Mobile Number Portability</keyword> regulation. Starting May 3, mobile subscribers would be able to port their numbers through different operators even when they relocate to different cities. 
 
Apart from facilitating Pan-India portability, a few other changes have been made as well, which are: 
 
1. In case a post-paid subscriber has some pending bills to pay to the donor operator (previous service provider), the donor operator would have to give a notice within 30 days of the due date of the bill. After a lapse of 60 days, the donor operator wouldn’t be entitled to raise any non-payment disconnection requests with the recipient operator (new service provider). 
 
2. In case a post-paid subscriber defaults payment, the donor operator will request the recipient operator to disconnect the ported number, after which the recipient operator would give the subscriber a 15–day notice to the subscriber. If the subscriber defaults this period, the outgoing services will be barred from his number. If the subscriber doesn’t make the payment in another 15 days, his number would be permanently disconnected by the recipient operator. 
 
3. The disconnected subscribers can return to their original service provider within a period of 60 days; this time-period was 90 days before this amendment. 
 
This is to be noted that India is divided into 22 telecom circles. These are mostly bound by state; however, in some cases, one state has two different circles (like UP East and UP west) and two states are combined in one circle (like Madhya Pradesh and Chhattisgarh). 
 
At present, mobile subscribers can port their numbers only when they switch subscribers within their own circle. This was a result of MNP issues in India in January 2011. However, with this new change being implemented from May 3, subscribers would have the ease of retaining their number even when they move to a zone with a new telecom circle.

TRAI Amends Mobile Number Portability Regulation

<ul><li><keyword id="3489555" type="PERSON" weightage="20" keywordseo="upstox">Upstox</keyword>, the second largest stock broker in India, has suffered a massive data breach.</li><li>This breach has exposed user data like Aadhaar, PAN, bank account numbers and more.</li><li>While Upstox did not comment on the data leak, it said it has upgraded its security systems ‘manifold’ on the recommendations of a global cyber-security firm.</li></ul> Popular discount broker Upstox has suffered a massive data breach that has exposed some important data like Aadhaar, PAN and bank account numbers, apart from other personally identifiable information like mobile numbers and email addresses. Upstox is a Delhi-based discount stock broker that allows its customers to buy and sell shares. It is backed by Tiger Global and has over <a href="https://economictimes.indiatimes.com/markets/stocks/news/what-made-upstox-indias-second-largest-stockbroker-after-zerodha/articleshow/78745921.cms">1 million customers</a>. “We have upgraded our security systems manifold recently, on the recommendations of a global cyber-security firm. We brought in the expertise of this globally renowned firm after we received emails claiming unauthorised access into our database,” Upstox <a href="https://upstox.com/announcements/customer-support/security-measures/">said</a> on its website, reacting to reports of the data breach. The company said that despite the data breach, the funds and shares of its customers are safe. This is for two reasons – funds in your Upstox account can only be withdrawn to the linked bank account, and the shares are held with the depositories – either Central Depositories Services India Ltd (CDSL) or National Securities Depository Ltd (NSDL) – and not with Upstox. With that being said, Upstox users have other things to be worried about. Security researcher Rajshekhar Rajaharia, who <a href="https://www.businessinsider.in/tech/news/over-100-million-debit-and-credit-card-users-data-has-been-leaked-online-from-payments-processor-juspay-amazon-and-swiggy/articleshow/80096472.cms">had earlier tipped Business Insider about Juspay</a> and MobiKwik data breaches, told us that the <keyword id="11082460" type="UNKNOWN" weightage="20" keywordseo="Upstox-data-breach">Upstox data breach</keyword> includes Aadhaar, PAN, passport, bank account numbers, mobile numbers and even the photos of signatures. This data could be used by hackers or malicious parties to impersonate users and transact on their behalf without the users’ knowledge. According to Rajaharia, the Upstox data breach was executed due to a compromised Amazon Web Service (AWS) key used by the company. He says that the same AWS key vulnerability was exploited in the MobiKwik data breach as well. Rajaharia shared a data sample with us – the sample revealed user details as reported in the breach. However, we could not verify the authenticity of the sample. The hacking group, ShinyHunter, has taken down the data for now. <keyword id="74488" type="ORGANIZATION" weightage="20" keywordseo="PAN-card">PAN card</keyword>, expanded as Permanent Account Number can be described as a nationalized identity card. PAN card is necessary to carry out any financial transaction in India. PAN number is a unique 10-digit alphanumeric and identity number allotted to the tax-paying person, company or HUF. The Indian Income Tax Department is the authority issuing the PAN card. The validity of a PAN card for individuals and enterprises is for a lifetime. Before applying for PAN card, you must ensure that you do not have a PAN card already. As per the Section 272B of the Income Tax Act 1961, possessing more than one PAN card is punishable with a penalty of Rs.10,000. If you have your PAN number but have lost the PAN card, you can apply for lost PAN card. For making any changes in the PAN card details, you need to apply for changes in PAN card. Steps to apply for PAN Card in India

Non-resident companies will now be able to claim benefits of tax treaty, only by providing personal details like name, address and tax residency certificate; they would not have to provide their <keyword id="764765" type="UNKNOWN" weightage="100" keywordseo="Permanent-Account-Numbers">permanent account numbers</keyword> (PAN). 
 The <keyword id="121964" type="ORGANIZATION" weightage="100" keywordseo="Central-Board-of-Direct-Taxes">Central Board of Direct Taxes</keyword> (<keyword id="128665" type="ORGANIZATION" weightage="100" keywordseo="CBDT">CBDT</keyword>) has brought Rule 37BC, relaxing non-residents from furnishing PAN number in India in order to claim TDS benefits. These ‘non-resident’ entities include foreign partnership, foreign body corporate and foreign companies. 
 
Earlier, non-residents who didn’t provide PAN details were subject to higher rate of withholding tax on payments that Indian companies made in form of interest, royalty, fees for technical services. 
 
Now, non-residents will be able to claim the beneficial provisions of the tax treaty by providing some details like name, email-id, address, Tax Residency Certificate (TRC) and Tax Identification Number (TIN) or any similar Unique Identification number that they must have obtained from their country of residence. 
 
As per Section 206AA of IT Act, in absence of PAN, the payer was liable to withhold taxes at the rate of 20% or the rate of tax as per the Act or that as per tax treaty (whichever is higher) while making payment to a non-resident. This made PAN mandatory for every non-resident, which was not an easy process. The new rule removes this need for PAN details.

CBDT eases TDS claims rules for non-resident investors

A digital signature certificate based application will allow companies to get PAN or TAN registration within a day, said the <keyword id="65338" type="ORGANIZATION" weightage="100" keywordseo="Income-Tax-Department">Income Tax department</keyword>. The portals that will provide these services are NSDL eGov and UTIITSL. 
 
"Under the new process PAN and TAN will be allotted within one day after completion of valid on-line application," a tax department statement said. 
 
For individuals, a new PAN number can be obtained through Aadhaar-based e-signature facility, thus reducing the effective time that the procedure takes. 
 
"Introduction of Aadhaar based e-Signature through NSDL eGov in PAN application not only ensures paperless hassle free PAN application process but also seeding of Aadhaar in PAN which will curb the problem of duplicate PAN to a great extent," said the statement.

The income tax department has launched an online facility to correct errors in names and other details in permanent account number (PAN) and <keyword id="144117" type="ORGANIZATION" weightage="20" keywordseo="AADHAAR">Aadhaar</keyword> document, according to news agency <keyword id="6367495" type="COMPANY" weightage="20" keywordseo="PTI">PTI</keyword>. Alongside the facility to link biometric identifier Aadhaar with PAN, the department has also put two separate hyperlinks on its e-filing website -- one to update changes in existing PAN data or for application of new PAN by an Indian or a foreign citizen. The second hyperlink is for individuals who want to update Aadhaar details by logging into 'Aadhaar Self Service Update Portal' using the unique identity number. The individual can then upload scanned documents as proof for data update request. Over 1.22 crore assessees already have Aadhaar-linked PAN but the number is abysmally low as there are over 25 crore PAN card holders in the country, while Aadhaar has been issued to 111 crore people. As per statistics with the tax department, only 6 crore people file income tax returns at present. <keyword id="6355261" type="POSITION" weightage="20" keywordseo="Finance-minister">Finance Minister</keyword> <keyword id="42575" type="PERSON" weightage="20" keywordseo="Arun-Jaitley">Arun Jaitley</keyword>, through an amendment to the <keyword id="123776" type="ORGANIZATION" weightage="20" keywordseo="Finance-Bill">Finance Bill</keyword> for 2017-18, had made Aadhaar mandatory for filing income tax returns and provided for linking of PAN with Aadhaar to curb tax evasion through use of multiple PAN cards. Last week, the income tax department launched a facility to enable a taxpayer to link his Aadhaar and PAN. It required a person to put in PAN and Aadhaar number along with his name as per the <keyword id="86474" type="ORGANIZATION" weightage="20" keywordseo="Unique-Identification-Authority-of-India">Unique Identification Authority of India</keyword> (UIDAI) data. After verification from the UIDAI, the linking will be confirmed. In case of any minor mismatch in Aadhaar name provided, Aadhaar OTP will be sent to the mobile number registered with the UIDAI. Additionally, the income tax department has now launched a facility to correct anomalies in PAN or Aadhaar document.

In case you are eligible to obtain an <keyword id="144117" type="ORGANIZATION" weightage="100" keywordseo="AADHAAR">Aadhaar</keyword> number, you would need to quote your Aadhaar number when you apply for a permanent account number (PAN) and in your <keyword id="104359" type="UNKNOWN" weightage="100" keywordseo="income-tax-return">income tax return</keyword> from July onwards. As per the government, Aadhaar-enabled biometric identification will ensure that nobody can obtain multiple PANs; it would also help the government in keeping an eye on tax evaders. Even if your income is below the tax limit and you are not required to file returns, you would need to link your PAN and Aadhaar number. In case that’s not done, your PAN will be liable to become invalid from a date that the government would soon announce, as per section 139AA of the Act. However, the recent order from <keyword id="6354977" type="ORGANIZATION" weightage="100" keywordseo="Supreme-Court">Supreme Court</keyword> is a relief for people who possess a PAN but do not have an Aadhaar and have not even applied for one. In order to ease the process of linking PAN and Aadhaar, the IT department has announced the process on its e-filing portal. You can visit the income tax e-filing portal at https://incometaxindiaefiling.gov.in/ and enter your user id and password so that you can access your profile. If you don’t have a profile there, you can register on the portal by entering basic registration details such as PAN, name and date of birth. After logging in, go to the "Profile Settings" tab and click on ‘Link Aadhaar’ in the drop down menu. This would open a new form where you’d need to enter your name, date of birth, gender as per PAN records, your Aadhaar number and your name as per Aadhaar records. After submitting these details and entering the text in the captcha code, a success message would be displayed confirming the linking of Aadhaar with PAN. You would also receive a confirmation email on your registered ID. New Delhi, Mar 16 () The Income Tax Department on Monday issued a public message saying it was "mandatory" to link PAN with Aadhaar and advised people not to "miss" the stipulated deadline of March 31. The department had last month said Permanent Account Number (PAN) will become "inoperative" if it is not linked with Aadhaar by this date. "Don't miss the deadline!" "It is mandatory to link your PAN and Aadhaar before 31st March, 2020. You can do it through Biometric Aadhaar authentication &amp; also by visiting the PAN service centers of NSDL and UTITSL," the department said in the latest post on social media. In a video, attached with the message on its Twitter handle @IncomeTaxIndia, it said such a linking is for a "beneficial tomorrow". The video described that there are two ways to complete this task: 1. Send SMS to 567678 or 56161 in the format: UIDPAN12digit Aadhaar&gt;10digitPAN&gt; 2. Through e-filing portal of the department: www.incometaxindiaefiling.gov.in.
