The government has relaxed provisions of <keyword id="19948097" type="General" weightage="20" keywordseo="tds" source="keywords">TDS</keyword>/<keyword id="19950203" type="General" weightage="20" keywordseo="tcs" source="keywords">TCS</keyword> in the event of the death of the deductee/collectee before the linkage of PAN and <keyword id="19898107" type="General" weightage="20" keywordseo="aadhaar" source="keywords">Aadhaar</keyword> card. TDS is Tax Deducted at Source and TCS is Tax Collected at Source in India. The Central Board of Direct Taxes (CBDT), has issued a circular dated August 5, in view of genuine difficulties being faced by taxpayers. Through the circular, the government said it has relaxed the provisions of TDS/TCS, as per the Income-tax Act, in the event of death of deductee/collectee before linking of PAN and Aadhaar. In order to redress the grievances of the taxpayers wherein instances have been cited, of demise of the deductee/collectee on or before May 31, 2024 and before the option to link PAN and Aadhaar could have been exercised, the circular provides that there shall be no liability on the deductor/collector to deduct/collect the tax under the relevant section of <keyword id="19936187" type="General" weightage="20" keywordseo="income-tax-act" source="keywords">income tax act</keyword>, pertaining to the transactions entered into up to March 31, 2024. On April 23, 2024, CBDT extended the date for linking of PAN and Aadhaar May for the taxpayers (for the transactions entered into up to March 2024) to avoid higher TDS/ TCS, as per the income tax act. Under the provisions of the Income-tax Act, 1961, every person who has been allotted a PAN as on July 1, 2017 and is eligible to obtain <keyword id="20030312" type="General" weightage="20" keywordseo="Aadhaar-Number" source="keywords">Aadhaar Number</keyword>, is required to intimate his Aadhaar to the prescribed authority, on payment of a prescribed fee. Failure to do so shall attract certain repercussions under the income tax act. As per government, the PAN of taxpayers who have failed to intimate their Aadhaar, as required, shall become inoperative and the consequences during the period that PAN remains inoperative will be as follows: 1. No refund shall be made against such PANs 2. Interest shall not be payable on such refund for the period during which PAN remains inoperative 3. TDS and TCS shall be deducted /collected at higher rate, as provided in the income tax act.

The Delhi High Court Monday declined to order linking of social media accounts with Aadhaar, PAN or voter ID card for weeding out fake accounts, saying it would lead to data of genuine account holders, who are much more in number, going "unnecessarily" to foreign countries. A bench of Chief Justice D N Patel and Justice C Hari Shankar said linking of accounts with social media platforms like Twitter, Facebook and WhatsApp, with Aadhaar, PAN or any other identity document requires framing of policies or amendment in existing laws by the central government and this exercise cannot be done by the court. "Role of courts is to interpret the law as it is. We are not concerned with what the law ought to be," it said, adding that in exceptional cases where there is a gap in the law, the courts can step in. It said that in the instant case, linking of social media accounts with identity data like Aadhaar or PAN was a "crucial matter" which has to be appreciated by the central government and it cannot be treated as a "gap" which needs to be plugged by the court as it "would have far reaching consequences regarding data of genuine account holders". The bench said it was not inclined to issue any direction to the government as it is already deliberating on the Law Commission reports on the issue and disposed of the PIL seeking directions to the Centre to take steps for linking social media accounts with Aadhaar, PAN or voter ID card to weed out fake accounts. It however told the government to keep in mind that identity data of genuine account holders was also at stake and a "proper balance" has to be struck by it while taking a decision on the issue. In its order, the bench noted that according to BJP leader Ashwini Kumar Upadhyay, who had moved the plea, 20 per cent of the social media accounts were "fake, ghost or duplicate". "To weed out 20 per cent fake accounts all the data, including that of genuine account holders, will go to a foreign country. Majority of account holders are genuine. Therefore, if linkage is ordered by this court, there maybe a situation where data of genuine account holders will also go to foreign country, maybe unnecessarily," the court said. During the hearing, Upadhyay said something has to be done as anyone can create a fake account on social media of any person, including the judges, and through that medium wrong or controversial information can be spread. He had also alleged in his petition that fake social media accounts are used to propagate "fake and paid news" during elections. HMP SKV SA

This is predominantly a result of its work from anywhere (WFA) flexibility and salary structures that have not been revised for decades now, and are out of sync with inflation and the cost of living. Nonetheless, moonlighting became a swift and easy choice for most employees to supplement their incomes with the rising inflation. With the pandemic, hybrid work policies, WFA mannerisms, quiet quitting, quiet firing, and moonlighting picked up momentum. According to HR experts, the incidence of moonlighting has increased in the wake of the Covid-19 pandemic in 2020, with people wanting to earn more money in the face of job losses, inflation or having more time as a result of working from home. However, <keyword id="115437" type="General" weightage="20" keywordseo="india-inc-" source="Orion">India Inc.</keyword> did not anticipate moonlighting to attain such a gigantic proportion so quickly. Other reasons could be the entrepreneurial bug that has bitten all tech employees alike, the need for higher incomes and lastly the demand for flexibility in workplaces. As per some unofficial estimates, despite a return-to-office mandate, less than 15% of the employees turn up to work, especially at the junior level. This impacts mid-level managers as they have a lesser incentive to return to office. However, there is no clarity on what level the laid-off employees involved in moonlighting fell under - entry, middle or senior. If it were at the entry level, it may just be possible that the salaries were lower compared to the cost of living in major cities. That made staying at home and working for two jobs a better proposition for them. While for mid- and senior-level employees, it could be that they got more exciting projects, helping them enhance their skill sets and of course supplementing their income. From a broader lens, for organisations, it is an ethical and moral issue concerning intellectual property. It might just affect productivity due to increasing fatigue and stress. From a legal standpoint, if the contract forbids moonlighting, it is a strict NO. A person may work more than one job in India without breaking the law unless prohibited by the employment contract. However, section 60 of the Factories Act bars dual employment for an adult worker. All in all, moonlighting is an ethical issue. It becomes a logical thing to do in India, where overtime pay is an alien concept and plentiful employees are underpaid on full-time jobs. The war of talent is real and is deeply impacting employers. Employees who are part of the skilled working population are spoilt for choice with an ‘abundance mindset’. Moonlighting in today’s world is going to stay. What is needed is not confrontation but collaboration between employer and employee. After all, human capital investments define a company and its culture!
