The <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword> on Monday modified the sentences of <keyword id="46447" type="PERSON" weightage="100" keywordseo="Nitish-Katara">Nitish Katara</keyword> murder case convicts <keyword id="46445" type="PERSON" weightage="20" keywordseo="Vikas-Yadav">Vikas Yadav</keyword> and his cousin <keyword id="46446" type="PERSON" weightage="20" keywordseo="Vishal-Yadav">Vishal Yadav</keyword> and reduced their jail terms to 25 years. 
 The <keyword id="6356229" type="ORGANIZATION" weightage="20" keywordseo="apex-court">Apex Court</keyword> sentenced another accused <keyword id="2180588" type="UNKNOWN" weightage="20" keywordseo="Sukhdev-Yadav">Sukhdev Yadav</keyword> alias Pehelwan to 20 years in prison. 
 
An Apex Court division bench headed by Justice Dipak Misra passed the order after hearing a detailed argument from both sides - the prosecution as well as the defence. 
 
The Apex Court had on August 17, 2015, upheld the conviction of Vikas, Vishal and Sukhdev, saying 'only criminals are crying for justice' in this country. 
 The three convicts were serving a life-term awarded by the lower court in May 2008 for abducting and killing <keyword id="6414390" type="PERSON" weightage="20" keywordseo="Katara">Katara</keyword>, a business executive and the son of a railway officer, on the night of February 16-17, 2002, as they opposed the victim's relationship with Bharti, Vikas' sister and the daughter of Uttar Pradesh politician D.P. Yadav. 
 The <keyword id="6355014" type="ORGANIZATION" weightage="20" keywordseo="Delhi-High-Court">Delhi High Court</keyword> had on April 2, 2014, upheld the verdict of the lower court in the case and described the offence as "honour killing" stemming from a "deeply-entrenched belief" in the caste system.

New Delhi, Apr 20 () Vishal Yadav, serving life term for the murder of Nitish Katara, has moved the Delhi High Court seeking parole citing risk of COVID-19 or TB infection due to overcrowding and poor sanitation in the prison.Vishal claimed he suffered from tuberculosis (TB) earlier and if he gets infected again it could be fatal.His plea stated that due to his prolonged TB infection, his immune system is weak and coupled with the poor sanitation facilities in prison, he would be vulnerable to coronavirus.The matter came up for hearing before Justice V Kameswar Rao on Monday and he listed it for Wednesday so that the victim's mother, Neelam Katara, and a witness in the case - Ajay Katara - can be served with the petition, Delhi government additional standing counsel Rajesh Mahajan said.Mahajan also said that the state opposed the parole plea of Vishal during the brief hearing held via video conferencing.On October 3, 2016, the Supreme Court had awarded a 25-year jail term without any benefit of remission to Vikas Yadav and his cousin Vishal for their role in the sensational kidnapping and killing of Katara. Another co-convict Sukhdev Pehalwan was also handed down a 20-year jail term in the case.Prior to this, the Delhi High Court, while upholding the life imprisonment awarded to Vikas and Vishal Yadav by the trial court, had specified a 30-year sentence, without any remission, to both of them. It had awarded a 25-year jail term to third convict Pehalwan.All three were convicted and sentenced for kidnapping Nitish Katara from a marriage party on the intervening night of February 16-17, 2002 and then killing him for his alleged affair with Bharti Yadav, the sister of Vikas.Bharti is the daughter of Uttar Pradesh politician D P Yadav who is in jail in connection with another murder case.Katara was murdered as Vishal and Vikas did not approve of his affair with Bharti because they belonged to different castes. Katara case: Vishal Yadav moves HC for 8-week parole citing COVID-19 risk in prison

New Delhi, Jun 9 () The Delhi High Court on Tuesday sought response of the AAP government on the parole plea of Vishal Yadav, who is serving life term for killing business executive Nitish Katara in 2002. Justice V K Rao issued notice to the Delhi government and Katara's mother Neelam Katara asking them to file their replies by the next date of hearing on June 11. Delhi government was represented by its additional standing counsel Rajesh Mahajan. Yadav has sought eight weeks emergency parole on the ground that he could get infected by COVID-19 or tuberculosis due to overcrowding and poor sanitation facilities in the prison. He had in April moved a similar plea which was disposed of on May 2 by the high court by asking the "competent authority", which under the prison rules is the Lt Governor, to treat the petition as a representation and take a decision within 15 days. On May 16, the competent authority rejected Yadav's plea for parole and against that order he has moved the high court. The competent authority had rejected the plea on the ground that he has been awarded 25 years imprisonment without any remission. Yadav has sought quashing of the May 16 order. He has contended that numbers of coronavirus cases was increasing at a high rate and there was a risk of infection to him inside the prison, especially since he was a tuberculosis (TB) patient in the past. Katara case convict Vishal Yadav seeks parole citing COVID-19 infection risk: HC seeks govt stand

New Delhi, Apr 23 () The police has opposed in the Delhi High Court the parole plea of Vishal Yadav, serving life term for the murder of Nitish Katara, saying there is no risk of coronavirus infection to him.Vishal sought parole on the ground that he could get infected by coronavirus or tuberculosis as he had earlier suffered from TB in view of overcrowding and poor sanitation facilities in the prison.In its status report placed before Justice V Kameswar Rao, Delhi Police has said that the prison records indicate the convict's medical condition to be stable and he is not suffering from TB.The report, filed through additional standing counsel (criminal) Rajesh Mahajan, also said that medical reports filed with the petition are of 2004, 2008, 2009 and 2010 and there is no material on record to show he is suffering from TB now.It further said that material filed with the petition indicating vulnerability of TB patients to coronavirus or COVID-19 relates to patients currently suffering from TB and not those who suffered from it in the past.Under the prison rules, grant of eight weeks 'emergency' parole during the coronavirus pandemic amounts to a remission of sentence, it said.However, in this case, the High Court while sending Vishal to jail in February 2015 had directed that he be not considered for any remission till he completes 25 years of actual imprisonment."Consequently, he would not be entitled to grant of emergency parole as it amounts to grant of remission," the report said.Another reason cited in the report for dismissing Vishal's plea was that he moved the court without first moving the competent authority for grant of parole in accordance with the rules.The status report also said that there was a threat to the life of the victim's mother -- Neelam Katara -- and witness -- Ajay Katara -- and, therefore, Vishal does not deserve to be released on paroleThe petition is listed for hearing on Friday.Vishal has contended in his plea that due to his prolonged TB infection, his immune system is weak and coupled with the poor sanitation facilities in prison, he would be vulnerable to coronavirus.On October 3, 2016, the Supreme Court had awarded 25-year jail term without any benefit of remission to Vikas Yadav and his cousin Vishal for their role in the sensational kidnapping and killing of Nitish Katara.
