The Centre on Tuesday again urged the <keyword id="6354977" type="General" weightage="80" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> to urgently hear the matter connected with the validity of <keyword id="11939755" type="General" weightage="100" keywordseo="ews" source="Orion">EWS</keyword> quota in postgraduate courses in medical colleges. Solicitor General Tushar Mehta, after failing to get the matter listed on Tuesday, requested a bench headed by Chief Justice N.V. Ramana to list the matter for hearing. Mehta emphasized that the matter needs to be considered on priority since resident doctors are protesting. The Chief Justice told Mehta that he has to constitute a special bench. Justice Ramana said: "Let me see tomorrow. This entire week is a miscellaneous week..." Mehta said the resident doctors are protesting and their concerns are genuine. The bench said: "If it is a three-judge bench matter, then it will be listed before a three-judge bench tomorrow". On Monday, Mehta asked a bench led by Justice D.Y. Chandrachud to advance the hearing on the matter to Tuesday from January 6. The Centre has told the top court that Rs 8 lakh income criterion for determining the EWS is much more stringent than the one for the OBC creamy layer. The Centre has accepted the report of a three-member panel constituted to revisit the EWS criteria. The panel, in its report, said: "Firstly, the EWS's criteria relates to the financial year prior to the year of application whereas the income criterion for the creamy layer in OBC category is applicable to gross annual income for three consecutive years." The panel added, "Secondly, in case of deciding the OBC creamy layer, income from salaries, agriculture and traditional artisanal professions are excluded from the consideration whereas the Rs 8 lakh criteria for EWS includes that from all sources, including farming. So, despite being the same cut-off number, their composition is different and hence, the two cannot be equated". The panel comprised Ajay Bhushan Pandey, former finance secretary; Prof V.K. Malhotra of ICSSR; and Sanjeev Sanyal, principal economic advisor to the government. The panel was set up on November 30. On November 25, the Centre informed the Supreme Court that it has taken a decision to revisit the criteria of Rs 8 lakh annual income limit for EWS criteria and added that a fresh decision will be taken within a period of 4 weeks. On October 21, the Supreme Court had questioned the Centre over adopting the criteria of OBC creamy layer of Rs 8 lakh annual income for granting reservations under the economic weaker section (EWS), despite the latter not suffering from social and educational backwardness. The top court told the Centre's counsel "You just cannot pull out eight lakh from thin air. You are making unequal equal by applying the Rs eight lakh limit". In an affidavit, the Centre had told the Supreme Court that its decision to fix Rs 8 Lakh income limit for OBC and economically weaker section (EWS) is not arbitrary in the <keyword id="6361994" type="General" weightage="20" keywordseo="neet" source="Orion">NEET</keyword> All India Quota, and it was finalised after considering diverse economic factors in different states. Supreme Court agrees to hear Centre's plea on EWS quota for NEET-PG admissions

The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday cleared the decks for postgraduate medical counselling and admissions, including the Other Backward Classes (<keyword id="45661" type="General" weightage="80" keywordseo="obc" source="Orion">OBC</keyword>) and economically weaker sections (<keyword id="11939755" type="General" weightage="100" keywordseo="ews" source="Orion">EWS</keyword>) reservations for the current academic year, 2021-22. A bench headed by <keyword id="3360108" type="General" weightage="20" keywordseo="Justice-D-Y-Chandrachud" source="Orion">Justice D.Y. Chandrachud</keyword> and A.S. Bopanna upheld the constitutional validity of 27 per cent reservation for OBC and 10 per cent EWS for the NEET-UG and NEET-PG. However, the top court added that it would decide on the rationale of criteria of Rs 8 lakh income for EWS category in March this year. On Thursday, after conducting a day-long hearing on petitions challenging the validity of EWS quota in postgraduate medical admissions and the Centre's argument favouring the quota, the court said there is a situation, where in national interest, the counselling has to begin, which was also a key demand of protesting resident doctors. A bench comprising Justices D.Y. Chandrachud and A.S. Bopanna said: "We are in a situation, where in the national interest the counselling has to begin." Solicitor General Tushar Mehta, representing the Centre, argued that all candidates eligible for the EWS quota, as per existing criteria, have got their certificates for registration and added that seats in all the government colleges have been increased to accommodate the EWS quota. "So, this will not harm the chances of general category students...", he added. Mehta also clarified that super-speciality courses have no reservation and none of the judgments remotely suggests that there cannot be reservation in PG courses. On the aspect of the EWS quota, he said there was a study, application of mind, and wide consultation when the government decided to fix the Rs 8 lakh income limit. NEET-PG admissions: Supreme Court allows counselling with 27% OBC and 10% EWS quota

The Directorate General of Health Services (<keyword id="6430867" type="General" weightage="100" keywordseo="dghs" source="Orion">DGHS</keyword>) has informed the <keyword id="6354977" type="General" weightage="20" keywordseo="Supreme-Court" source="Orion">Supreme Court</keyword> that four rounds of online counselling for <keyword id="11196228" type="General" weightage="20" keywordseo="NEET-PG-2021" source="Orion">NEET-PG 2021</keyword> have been already conducted and 1,456 medical seats have remained vacant, as the software stands closed. The DGHS said since the software is closed, further rounds of counselling could not be conducted to fill up the medical seats. The DGHS in an affidavit, submitted the software, which was used for online counselling of NEET-PG 2021, is closed and refund of security deposit for participating in PG counselling has been initiated. It also added that the petitioner has made the plea at a belated stage and it may impact the whole process for upcoming counselling session for <keyword id="12826212" type="General" weightage="20" keywordseo="NEET-PG-2022" source="Orion">NEET-PG 2022</keyword>, and it is also difficult to run concurrently counselling for two academic sessions. A vacation bench comprising Justices M.R. Shah and Aniruddha Bose on Wednesday sought response from the Central government on petitions seeking a special stray round of counselling for the 1,456 vacant seats. The DGHS said it has acted in a bonafide manner and complied with the direction of the apex court in full letter and spirit, and no further rounds apart from four online rounds of counselling could be conducted. It added that NEET-PG 2021 counselling was delayed due to third wave of the Covid-19 pandemic. The DGHS said as per the direction of the top court it conducted four rounds of online counselling for the PG course and the last date of admissions for the PG course was May 7. These rounds of counselling also included an additional online special round for 146 seats, following March 31 order of the apex court, it added. The Supreme Court is scheduled to take up the matter on Thursday. The Supreme Court on Wednesday slammed the <keyword id="1873824" type="General" weightage="50" keywordseo="medical-counselling-committee" source="Orion">Medical Counselling Committee</keyword> (MCC) on the 1,456 vacant medical seats in NEET PG-2021, saying if students are not given admission, then it will pass orders and also grant them compensation. The vacation bench told the MCC Counsel, "Even if a single course has remained vacant.....It's your duty to see that they don't remain vacant." The bench got angry to see that 1,456 seats have remained vacant in medical colleges during the 2021-22 session. It said the MCC and the Central government are playing with the life of students by not conducting a mop up round of counselling for students. "You're playing with the future of students....," said the bench, adding that in May, the authorities learnt that seats were vacant, why didn't they conduct a mop up round? The MCC Counsel submitted that orders in the matter would lead to cascading effect and requested the court to allow him to place an affidavit on record to explain the matter. The top court allowed the Central government to file a response in the matter. NEET PG 2021: Here’s how you can check your result

The Centre assured the <keyword id="6354977" type="General" weightage="20" keywordseo="Supreme-Court" source="Orion">Supreme Court</keyword> on Monday that the counselling process of NEET-PG will not commence till the top court decides the challenge to 27 per cent reservation for <keyword id="45661" type="General" weightage="20" keywordseo="OBC" source="Orion">OBC</keyword> and 10 per cent for <keyword id="11939755" type="General" weightage="100" keywordseo="ews" source="Orion">EWS</keyword> category in PG All India Quota seats (MBBS/BDS and MD/MS/MDS) from the current academic session. A bench of Justices D Y Chandrachud and B V Nagarathna recorded the assurance given by Additional Solicitor General (ASG) K M Nataraj, appearing for the Centre, and observed that students will be in serious problem if the counselling process goes ahead as scheduled. The assurance by Nataraj was given after senior advocate Arvind Dattar, appearing for some NEET candidates, mentioned that as per the schedule announced by the Director General of Health Services, the counselling process for the NEET-PG is to commence from October 25. He said that by the time the court decides the pending batch of petitions, challenging the July 29 notification, introducing the reservation from academic year, the entire process of admission will be over and serious prejudice would be caused to the students. Nataraj said the communication which counsel for petitioner is referring to was sent only to the medical colleges for verification of seats and one more clarificatory notification has been issued on Monday. The counselling process will not begin till the court decides the pending batch of petitions, the ASG submitted. The bench said that it is taking the word on record. We will take your word on record that counselling process will not start till we decide the batch of petitions one way or the other. You know, students will be in serious problem, if the process continues, the bench said. Nataraj agreed with the observation of the court and said that if there is any problem at all in the future, the petitioner's counsel can contact him directly. On October 21, the top court had asked the Centre whether it would like to revisit the limit of rupees eight lakh annual income, fixed for determining the Economically Weaker Sections (EWS) category for reservation in NEET admissions for medical courses. The top court had clarified that it is not embarking into the policy domain but is only trying to ascertain whether constitutional principles have adhered or not. It had asked the Ministry of Social Justice and Empowerment and the Department of Personnel and Training (DOPT) to file their affidavits in a week's time and had formulated questions to be answered by the Centre. The top court had said, Tell us if you want to revisit the criteria or not. If you want us to discharge our duties, then we are ready to do so. We are formulating questions which you need to answer them . It had added, We may stay the government notification fixing rupees eight lakh criteria for determining the EWS and you can keep filing the affidavits . The top court was hearing a batch of pleas challenging the Centre and Medical Counselling Committee (MCC) July 29 notice providing 27 per cent reservation for Other Backward Class (OBC) and 10 per cent for EWS category in the National Eligibility cum Entrance Test (NEET) admissions for medical courses. It had asked searching questions from Centre, and asked whether any exercise was undertaken before fixing a limit of Rs 8 lakh annual income for determining the EWS category. It had said the court is not going to tell the government as to what should be the limit whether it should be rupees four lakh or rupees six lakh because it is for the executive to decide but all it wants to know is on what basis Rs. 8 lakh criteria was fixed. For determining creamy layer in Other Backward Classes (OBC) category the limit was fixed as Rs 8 lakh annual income and they were considered progressed class among OBCs and they were excluded from reservation benefits. Here, for the EWS category, the limit is the same Rs 8 lakh annual income but it was for inclusion in the reservation benefits, the top court had said. On October 7, the top court had posed searching questions to the Centre on its decision to fix a limit of rupees eight lakh annual income for determining the EWS category for reservation in NEET admissions. The Centre had then said fixing a limit of Rs eight lakh annual income for the EWS category is a matter of policy based on the National Cost of Living Index. NEET-PG counselling not to commence till Supreme Court decides on OBC, EWS quota, says Centre

In a bid to have uniformity across institutions, the bill also seeks to rope in All India Institute of Medical Sciences (AIIMS) and Institute of National Importance (INIs) into the given criteria. “At present, we have NEET and entrance exams for AIIMS. The NMC, which will substitute the Medical Council of India(MCI), will be set up to take over the responsibilities of conducting common entrances for MBBS, streamlining the course and fees. Under this, the government will introduce fee relaxation for students enrolling in private institutions. “The Medical Assessment and Rating Board will grant permission for new medical colleges, starting PG courses and increasing seats based on the standards set by the UG and PG boards,” the Cabinet noted. The NMC will constitute three autonomous bodies — Under-Graduate Medical Education Board, Post-Graduate Medical Education Board, and Ethics and Medical Registration Board — which will focus on ensuring global standards of education. Every year, 80,000 students take admission in MBBS courses across the country. While 150,000 take the entrance examination to enroll in 50,000 seats for PG courses. Now, MBBS doctors need not take extra exams for licences, PG admissions

The <keyword id="83655" type="General" weightage="20" keywordseo="union-health-ministry" source="Orion">Union Health Ministry</keyword> has asked the National Board of Examinations (NBE) to postpone NEET PG 2022 by six to eight weeks since it clashes with the NEET PG 2021 counselling. On January 25, six <keyword id="48426" type="General" weightage="20" keywordseo="MBBS" source="Orion">MBBS</keyword> graduates had filed a plea in the Supreme Court seeking postponement of the National Eligibility-cum-Entrance Test (NEET) scheduled on March 12 for admissions in postgraduate medical courses, claiming that many MBBS graduates would not be able to take up the examination due to non-completion of the mandatory internship period. Dr B Srinivas, Assistant Director General (Medical Education) and Member Secretary of the <keyword id="1873824" type="General" weightage="20" keywordseo="medical-counselling-committee" source="Orion">Medical Counselling Committee</keyword>, in a communication sent to Dr M Bajpai, executive director of NBE, said that a lot of representations were being received from medical doctors requesting to postpone the NEET-PG 2022 examination as it was clashing with the NEET PG 2021 counselling. Also, many of the interns would not be able to participate in the PG counselling 2022 in May-June, Srinivas said. "Keeping the above facts in view, the HFM (ministry of health and family welfare) has taken the decision to postpone NEET PG 2022 by 6-8 weeks or suitably. Hence, the decision made by HFM may be complied with," the communication sent on February 3 stated. Health Ministry postpones NEET Postgraduate exam 2022 by 6-8 weeks

Like every year, lakhs of Indian students are preparing for medical entrance examinations conducted separately by state governments and private colleges. However, they would be breathing a sigh of relief because the Supreme Court of India has ruled that multiple tests should be replaced with the National Eligibility Entrance Test (<keyword id="6361994" type="UNKNOWN" weightage="100" keywordseo="NEET">NEET</keyword>) from this very session (2016-17). 
 
The decision has come just a few days before the test season starts from May 1, when CBSE conducts the All India Pre-Medical and Pre-Dental Entrance Test. This is to be followed by Maharashtra CET on May 5, after which private medical colleges of Karnataka will conduct a test on May 8. Apart from these, five more entrance tests are scheduled for the next month. 
 
The test in question, NEET, had been declared illegal and unconstitutional by SC in 2013, but was restored on April 11. 
 Even after the revival when the authorities failed to implement it, <keyword id="3341279" type="UNKNOWN" weightage="100" keywordseo="NGO-Sankalp-Charitable-Trust">NGO Sankalp Charitable Trust</keyword> approached the SC for enforcing the mechanism for a common test for admission in MBBS, BDS and PG courses in all colleges. 
 
"A student seeking admission in a medical college has to shell out lakhs of rupees in taking an examination and most of the tests are not conducted in a fair manner. There is no impediment in way of implementing NEET after the Constitution bench verdict and the Centre should be directed to enforce the order in association with MCI and CBSE," Advocate Amit Kumar, appearing for the petitioner NGO Sankalp Charitable Trust, told the bench. This prompted the bench to rule that NEET must be implemented from the coming academic session itself.

It wants to drop NEET (National Eligibility cum Entrance Examination) for admission into MD (Doctor of Medicine) and MS (Master of Science) courses. If the draft National Medical Commission (NMC) bill goes through, students can be admitted based on score in the MBBS final examination and National Exit Test (NEXT), PTI<a href="https://www.thehindu.com/education/health-ministry-bill-proposes-to-axe-neet-pg/article28430886.ece"> reported</a>. They will also not be required to go through a separate examination to secure a licence to practice medicine, according to the proposed draft. The draft excludes All Indian Institute of Medical Sciences (AIIMS) from the given criteria. The candidates wanting to enroll in PG courses in AIIMS will still have to go through the mandatory entrance exam. In addition to this, the NEET Super Speciality exam will also be mandatory to study Master of Surgery (Mch). The draft NMC Bill was tabled in the Parliament in 2017. It focussed at introducing a ‘bridge course’ that will enable medical practitioners of alternative medicine to pursue allopathy. However, it faced criticism from medical professionals and health associations in India. The bill was later revised with several amendments including aggressive punishments for unauthorised practice of medicine — a year long imprisonment or a fine of up to ₹500,000. However, to address the shortage of medical professionals, the government has <a href="https://indianexpress.com/article/education/4800-mbbs-seats-reserved-for-economically-weaker-students-5826733/">allocated 26% more seats</a> for MBBS aspirants in the last two years — reserving nearly 5,000 seats for economically weaker sections. Overall, nearly 80,000 students take admission in MBBS courses every year in 480 institutes across the country. Of this, 150,000 take the entrance examination to enroll in PG courses. MBBS doctors can skip entrance exams for MD and MS courses, if Health Ministry has its way

The Supreme Court Thursday refused to entertain pleas of various political parties challenging the Centre's decision not to grant 50 per cent reservation to OBCs as per Tamil Nadu law in <keyword id="6386019" type="UNKNOWN" weightage="20" keywordseo="medical-seats">medical seats</keyword> surrendered by the state in the all India quota for under graduate, post graduate and dental courses in 2020-21, saying "the right to reservation is not a fundamental right". The top court asked the political parties, Dravida Munnetra Kazhagam (DMK), All India Anna Dravida Munnetra Kazhagam (AIADMK), CPI (M), Vaiko, Anubmani <keyword id="42761" type="PERSON" weightage="20" keywordseo="Ramadoss">Ramadoss</keyword>, <keyword id="458412" type="COMPANY" weightage="20" keywordseo="Tamil-Nadu-Congress-Committee">Tamil Nadu Congress Committee</keyword> and CPI, to approach the Madras High Court with their pleas for grant of <keyword id="45661" type="DOMAIN" weightage="20" keywordseo="OBC">OBC</keyword> quota in medical admissions. "The senior counsel for the petitioners seek permission to withdraw these <keyword id="1700892" type="PERSON" weightage="20" keywordseo="writ-petitions">Writ Petitions</keyword> with liberty to approach the High Court by filing Writ Petitions under Article 226 of the Constitution. Permission granted. "The Writ Petitions are, accordingly, dismissed as withdrawn with the aforesaid liberty," a bench of justices L Nageswara Rao, Krishna Murari and S Ravindra Bhat said in its order. The bench said during the hearing that a plea under Article 32 (filing of Writ petition in SC) of the Constitution can be filed only in case of violation of fundamental rights and no such rights of political parties have been violated. "Right to reservation is not a fundamental right," the court said. The counsel for political parties said they were not seeking any addition in existing quota and were alleging that the OBC reservation policy was not being implemented. "You should withdraw this and go to the Madras High Court," the bench said, adding that the liberty was granted to the political parties to do that. The political parties have challenged the Centre's decision not to grant 50 per cent reservation to OBCs in medical seats surrendered by Tamil Nadu in the all India quota for under graduate, post graduate and dental courses in current academic session. DMK had said in its plea that it was opposing the denial of implementation of 50 per cent OBC policy of the state, other than in central government institutions. It said the Medical Council of India (MCI) regulations clearly contemplate adherence to state reservation laws while filling up of the seats. The party said that the All India Quota seats are contributed by states surrendering seats in the government and private medical and dental colleges as per the MCI regulations. DMK had sought ad-interim injunction restraining the Respondents from proceeding further with All India Counselling for PG seats pursuant to the NEET-PG 2020 results without following the 50 per cent reservation for OBC quota in Tamil Nadu pending disposal of the plea. The party also sought direction for calling of the records of the Respondent pertaining to the Result of NEET-PG, 2020 published on May 9, 2020 by the National Board of Examinations relating to the filling up of the All India Quota and quashing of the same. "The Petitioner (CPIM) is constrained to approach this court as the Respondents (Centre, MCI and others) herein have grossly failed to provide the statutory reservations for Other Backward Classes (OBC) i.e. Backward Classes (BC) and Most Backward Classes (MBC) and anomaly in granting reservation to SC-STs students in admissions to the Under graduate and Post Graduate medical courses in all medical colleges in Tamil Nadu in the category of 'state surrendered seats to the All India Quota' in Government and private medical colleges other than the Central Government institutions," the plea of CPI(M) had said. Ruling AIADMK had alleged that there was no rational basis for not extending the benefit of 50 per cent reservation for OBCs, as envisaged under the State laws of Tamil Nadu, to the State-captured seats in the All India Quota. The AIADMK party said that in all past academic years since the inception of the All India Quota system, OBCs have been grossly under represented in the All-India-Quota seats in undergraduate, diploma, PG diploma and postgraduate medical colleges across the country.
