Rajnath Singh proposes Narendra Modi as NDA parliamentary party leader, top NDA leaders support

<ul class="summary-list"><li>A judge is weighing whether to void an NDA that Tiger Woods ex Erica Herman purportedly signed.</li><li>Herman alleges sexual harassment in their relationship, which could invalidate the agreement.</li></ul>STUART, Florida — An attorney representing Erica Herman in her lawsuit to void or clarify a nondisclosure agreement she purportedly signed with Tiger Woods said in circuit court Tuesday that his client had more, not-yet-revealed details of sexual harassment allegations against the golf champion. Herman's attorney, Benjamin Hodas, said he couldn't share the "facts that involve the sexual harassment problem" because of the NDA, even though he said his client did not remember signing the document and contested whether it was real.Most of Tuesday's 45-minute hearing in court centered over the validity of the NDA. Herman's team wanted the judge to allow them to determine whether the document was authentic and to clarify what she was allowed to say about Woods publicly. They also allege, however, that the NDA should be invalidated because of the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, or the "Speak Out" Act.Under the federal law, judges can rule NDAs unenforceable in instances of sexual harassment or assault. Herman has alleged sexual harassment occurred during her relationship with Woods, both in how it started and how it ended.Hodas indicated in court Tuesday that more details about the allegations existed, after the judge presiding over the case, Elizabeth Metzger, said she needed more information. "We are not going to put into writing any details of those disputes until we have clarity" on the scope of the NDA, Hodas said.Metzger declined to issue a ruling over the validity of the NDA from the bench but could still decide the case as soon as Tuesday afternoon. She warned the Herman legal team that the federal law in question wouldn't apply retroactively — meaning if the incidents of sexual misconduct happened before 2022. "Certainly, events that occurred subsequent there too, would be covered by it," Hodas replied.Metzger appeared to be leaning toward sending the dispute into private arbitration, as the NDA specifies. That would mean the remainder of the former couple's legal proceedings would be private rather than take place in what could potentially be a messy public trial before a judge or jury. "I know you disagree with it being valid on its face, but when I look at the plain language of the agreement it seems as if the arbitration is very broad," Metzger said.Woods' legal team, led by JB Murray, argued that the NDA was valid and called Herman a "jilted ex-girlfriend" in court documents. They've asked for the lawsuit to be dismissed and called the sexual harassment claims "utterly meritless."Ahead of the hearing they provided the judge with an unredacted version of the NDA, as well as emails that showed a back-and-both negotiation in 2017 between Herman and Woods' team when the NDA was originally being written. In the emails, Herman expressed concern that she would be "heartbroken and jobless" if forced to sign the documents. Rob McNamara, vice president for TGR Ventures and Woods' right-hand man, also attested in a court document that he'd seen the signed NDA.The NDA would prohibit Herman from disclosing "private and confidential information which is not generally known to the public" regarding Woods' sexual matters, medical information, hobbies, and personal relationships.Hodas didn't provide any evidence in court that the NDA wasn't valid, saying his team needed more time to analyze the document and couldn't definitively say Herman didn't sign it. The team asked to be able to uncover more evidence that Herman was involved in negotiating the terms of the agreement, and disputed McNamara's conclusion that he'd seen the full agreement rather than just Herman's signature. Herman separately has sued a trust for Woods for $30 million after the golfer locked her out of the home where he was living in Jupiter Island, Florida. Woods invoked the NDA following the lawsuit to argue that the couple had to litigate the issue privately. Neither Woods, 47, nor Herman, 38, were present for the court hearing. Woods recently underwent surgery on his ankle, taking him away from the golf course for several months. He hasn't commented publicly on the breakup. Both Hodas and Murray declined to comment when reporters attempted to question them outside the courtroom. <div type="image" title="Tiger Woods and Erica Herman" height="667" width="889" msid="100109828" hostid="261"></div><h2>Herman alleges that the start and end of the relationship constituted sexual harassment</h2>Herman <a href="https://www.insider.com/tiger-woods-erica-herman-ex-girlfriend-sexual-harassment-court-lawsuit-2023-5">accused Woods of sexual harassment</a> in a court filing Friday, alleging that the two started a sexual relationship when Herman was still working for Woods at his restaurant and that he threatened to fire her in 2017 unless she signed the NDA."A boss imposing different work conditions on his employee because of their sexual relationship is sexual harassment," Herman's attorneys argue in the court filing.Herman also alleged that their breakup amounted to sexual harrassment, saying Woods tricked her to get out of his home where she was living, and then locked her out.According to court documents, Herman thought in October 2022 that she was going on a weekend trip to the Bahamas, only to find out at the airport that it wasn't true and to have one of Wood's attorneys inform her the relationship was over and then try to force her to sign another NDA. She was then locked out of the house, away from her personal property and pets, court documents allege. Herman and her lawyers described Woods actions as sexual harrassment, saying Woods verbally promised she could live at the home for another five years while she provided "valuable services." "The landlord made the availability of her housing conditional on her having sexual relationship with a co-tenant," Herman's attorneys wrote in court documents. "That conduct amounts to sexual harassment under federal and Florida fair housing laws."Woods' team counters that Herman was a guest in his home.The couple first met over six years ago when Herman was working on the launch of Woods' restaurant, the Woods Jupiter. She stayed on as director of operations, and she says she and Wood started dating in 2015. The two went public in 2017, after Herman moved in with Woods. Herman said in court documents that Woods pressured her to quit her job to focus on their relationship, and she did so in 2020. Woods, one of the most recognizable athletes in the world, has had a comeback on the golf course following a 2009 sex scandal, in which numerous women came out to say they'd had an affair with him when he was married to ex-wife Elin Nordegren. Woods since has undergone several surgeries to treat lower-back pain and faced a DUI arrest in 2017, when painkillers were detected in his system. He was also in <a href="https://www.businessinsider.com/tiger-woods-lucky-to-be-alive-police-say-car-crash-2021-2">serious car crash</a> in Los Angeles in 2021, in which he broke both of his legs.

Lawyer for Tiger Woods' ex-girlfriend, Erica Herman, alleges in court she has more details about sexual harassment claims against the golfer but says NDA is keeping her silent

NEW DELHI: For the first time in the 2014 Lok Sabha elections, a poll on Monday predicted a clear majority for any pre-poll alliance with NDTV projecting that NDA would get 275 seats in the 543-member House. This is 16 seats more than the poll had predicted last month. 
 BJP on its own would win 226 seats — the highest tally ever for the party and the best by any party since 1991, the poll done by Hansa Research estimated. UPA would win just 111 seats, with <keyword id="1575" type="ORGANIZATION" weightage="60" keywordseo="Congress">Congress</keyword> sinking to its lowest-ever tally of 92 seats, it said. 
 NDA’s projected win is based on impressive gains over 2009 in UP (an increase of 41 seats), Maharashtra (17), Rajasthan (17), Bihar (12), <keyword id="37102" type="COMPANY" weightage="40" keywordseo="Andhra-Pradesh">Andhra Pradesh</keyword> (12) and Madhya Pradesh (10). In these six states, it stands to gain 109 seats. In most other states too, NDA is projected to gain, though by more modest numbers. 
 
‘TMC will be largest party after BJP, Cong’ 
 The only major states in which the NDA could do worse than five years ago are Karnataka (a loss of seven seats), Chhattisgarh (two) and <keyword id="6357783" type="CITY" weightage="40" keywordseo="West-Bengal">West Bengal</keyword> (one), according to the latest NDTV poll. 
 
In contrast, the UPA is predicted to lose seats vis-a-vis 2009 in almost every major state, with Andhra Pradesh being the worst case, where the Congress tally could drop from 33 five years ago to just six this time. 
 
Barring Karnataka and Chhattisgarh, the only states where the UPA stands to gain are Assam (a gain of two seats) and Bihar, where a gain of six is really only because RJD is now part of the alliance, unlike in 2009. 
 The largest parties after BJP and Congress would be Trinamool with 30 seats, AIADMK with 22, SP with 14 and BJD with 13. DMK, with its allies, is likely to win 14 seats and the Left 22. <keyword id="6356115" type="CITY" weightage="40" keywordseo="AAP">AAP</keyword> is projected to win just one seat in Delhi and none elsewhere, at least in the states for which details were available, which included all those with seven seats or more. 
 None of these parties, however, will be of much significance if the poll’s predictions come true, since the NDA will not need any post-poll allies to form the government and anoint Modi the <keyword id="71" type="POSITION" weightage="40" keywordseo="Prime-Minister">prime minister</keyword>.

Herman filed suit against Woods in the Martin County Florida Court Monday, alleging that Woods had her sign an NDA in 2017, during a period of time when she was working for him. She now claims the NDA is null, arguing she should be freed by the Speak Out Act, a congressional bill signed into law in December 2022 that prohibits NDAs to be enforced in cases of sexual harassment or assault. "The Plaintiff believes that the Woods NDA is invalid and unenforceable," Herman's complaint reads, adding that the "uncertainty" of whether it is enforceable "is acute and important," the complaint states.Herman claims the NDA is not enforceable, whereas Woods claims that it is. According to the complaint, Herman is not clear on what she can talk about, including "various legal claims she believes she has."Herman is asking the court to determine the enforceability of the NDA.If it is enforceable, she has requested the court lay out clear guidelines on what she can and cannot disclose. Herman claimed that Jupiter Island Irrevocable Homestead Trust violated tenancy laws. She said in the suit that there was an oral tenancy agreement for the 6 years <a href="https://www.insider.com/tiger-woods-girlfriend-erica-herman-2022-4">she worked for and lived with Woods</a>, alleging that there were 5 more years left in the agreement. "By trickery, agents of the Defendant convinced the Plaintiff to pack a suitcase for a short vacation and, when she arrived at the airport, they told her she had been locked out of her residence, in violation of the oral tenancy agreement and in violation of Florida law," Herman's attorneys wrote in the complaint. The tenancy suit seeks $30 million, citing the property's rental value.Herman and Woods' relationship first became public in 2017, when <a href="https://www.insider.com/tiger-woods-girlfriend-erica-herman-2022-4">she appeared with Woods at the Presidents' Cup</a>, where Woods was serving as an assistant captain for Team USA. The Bihar assembly election results appeared to belie predictions made by most exit polls which had given a clear edge to the Rashtriya Janata Dal-led Mahagathbandhan. The ABP-CVoter exit poll prediction was the closest among all. It had projected 104-128 seats for the NDA and 108-131 seats for the opposition grand alliance. According to the Election Commission's website, as of 10.30 pm, the NDA was ahead with a slender margin. It had either won or was leading in 122 seats while the Mahagathbandhan's tally stood at 113. The majority mark in the 243-member Bihar assembly is 122. Counting in a few seats is still underway. The RJD, however, was ahead of all parties it had either won or was ahead in 77 seats. The BJP was close behind at 72. The JD(U) was a distant third and had either won or was ahead in 42 seats, the Congress in 19 seats. The Left parties tally stood at 17. Chanakya-CNN News18 on Tuesday projected 180 seats for the RJD-led grand alliance, 55 for the NDA and eight for others. India Today-Axis My India poll showed the RJD-led opposition was likely to win 139-161 seats, as against 69-91 for the NDA. It predicted three to five seats for the LJP and others. The ABP-CVoter exit poll predicted 104-128 seats for the NDA and 108-131 seats for the opposition grand alliance. It projected Chirag Paswan-led LJP to get one to three seats. A similar trend was predicted by Times Now-CVoter, which projected 116 seats for the NDA, 120 for the opposition alliance and a single seat for the LJP. It predicted six seats for others. Republic TV-Jan Ki Baat exit poll also gave a clear majority to the RJD-led alliance with 128 seats, while it projected 104 seats for the ruling NDA, seven seats for the LJP and four for others. TV9 Bharatvarsh projected NDA to win 115 seats, the grand alliance 120 and four each for LJP and others. The NDA comprises the JD(U), BJP, Vikassheel Insaan Party (VIP) and Hindustan Awam Morcha (Secular). The BJP contested 110 seats, leaving 11 to the VIP, while the JD(U) fielded candidates on 115 seats. It had given seven seats to the HAM. On the other hand, the RJD contested 144 seats, the Congress 70 and the three Left parties fielded candidates on 29 seats. The three-phase Bihar Assembly election ended on Saturday. Bihar Election 2020: Most exit polls miss the mark

Visakhapatnam (<keyword id="37102" type="General" weightage="80" keywordseo="andhra-pradesh" source="Orion">Andhra Pradesh</keyword>) [India], August 16 (ANI): As there is a buzz about Telugu Desam Party (<keyword id="42372" type="General" weightage="80" keywordseo="tdp" source="Orion">TDP</keyword>) joining the National Democratic Alliance (NDA) once again, Former Chief Minister of Andhra Pradesh and the party President <keyword id="6354350" type="General" weightage="20" keywordseo="Chandrababu-Naidu" source="Orion">Chandrababu Naidu</keyword> on Tuesday said that he will talk about it at the 'right time'. On being asked about his plan to join the NDA, Naidu said 'it is not the right time'. "It's not the time to talk about joining the NDA government. I will talk about this at the right time," he said while talking to ANI. Naidu was speaking to ANI, after releasing the Vision-2047 document at a programme organised in this Port City on Tuesday evening. One of the founders of the National Democratic Alliance (NDA) - the <keyword id="79886" type="General" weightage="80" keywordseo="chandrababu" source="Orion">Chandrababu</keyword> Naidu-led Telugu Desam Party (TDP) had left in protest against the Centre's refusal to give special status to Andhra Pradesh. Naidu further said that his role is very clear for national politics in 2024. "My priority is Andhra Pradesh. It's my big agenda. I will prepare for the rebuilding and reconstruction of the state," the TDP chief said. Responding to the Amaravati capital issue, Naidu said, "You (CM Jagan <keyword id="85706" type="General" weightage="80" keywordseo="mohan-reddy" source="Orion">Mohan Reddy</keyword>) are sitting in assembly. You are sitting in the secretariat. Where are you conducting the cabinet meeting? Is it temporary? Notably, the unified state of Andhra Pradesh was bifurcated into Andhra Pradesh and Telangana in June 2014. As per the AP Reorganisation Act, Hyderabad became the capital of Telangana, and Andhra Pradesh had to find itself a new capital within ten years; until then, Hyderabad would serve as the capital for both states. In January this year, Jagan Mohan had announced that Visakhapatnam is going to be the capital with no mention of it in any state assembly discussion or on any official documents. Later, the YS Jagan Mohan Reddy-led government had decided to make three capitals in different cities of the State in order to ensure development in all parts of the state. Earlier on Tuesday evening, Chandrababu paid tribute to the statue of the former chief minister, the late NT Rama Rao, on Beach Road. (ANI)

The Department of Space on Thursday said it has signed a non-disclosure agreement (NDA) with Chennai-based small rocket company <keyword id="7122982" type="UNKNOWN" weightage="20" keywordseo="agnikul-cosmos">Agnikul Cosmos</keyword> Pvt Ltd to access the facilities and technical expertise available in <keyword id="116095" type="ORGANIZATION" weightage="20" keywordseo="Indian-Space-Research-Organisation">Indian Space Research Organisation</keyword> (<keyword id="6358064" type="UNKNOWN" weightage="20" keywordseo="isro">ISRO</keyword>) centres. According to DoS, this is the first NDA to be signed after the establishment of IN-SPACe, the authorization and regulatory body for enabling private players to undertake space activities in India. Under the NDA, Agnikul Cosmos will be enabled to access the facilities and technical expertise available in ISRO centres to proceed with their launch vehicle development programme. The start-up company is located in the National Centre for Combustion Research and Development, Indian Institute of Technology, Madras. The NDA was signed in the presence of Space Secretary and ISRO Chairman Dr. K Sivan, and IIT-Madras Director Prof. Bhaskar Ramamurthi. R. Umamaheswaran, Scientific Secretary, ISRO, was the signatory on behalf of Department of Space for the NDA and Agnikul Cosmos CEO Srinath Ravichandran on behalf of the company. The votes are in, the election commission is armed, and tallies are finally being made. As lakhs of viewers tune into their news to update themselves, many are coming away shocked at the current standings. Despite confident promises of capturing 400 of the 543 Indian seats, the Bharatiya Janata Party (<keyword id="19894848" type="General" weightage="20" keywordseo="BJP" source="keywords">BJP</keyword>) has barely won a dozen or two seats more than the halfway mark of 272, as per the initial few rounds of counting. This is still an impressive position to be in, and certainly enough to help the BJP-led <keyword id="105903" type="General" weightage="20" keywordseo="national-democratic-alliance" source="Orion">National Democratic Alliance</keyword> (<keyword id="19938590" type="General" weightage="20" keywordseo="NDA" source="keywords">NDA</keyword>) make another term. However, the overwhelming, yet lukewarm, support has inadvertently deflated the ‘Abki baar 400 paar’ chant echoed by the party throughout its campaigning. However, Congress leaders staunchly dismissed these findings, asserting that the <keyword id="3658" type="General" weightage="20" keywordseo="india" source="Orion">INDIA</keyword> alliance will achieve at least over 250 seats this election. While exit polls have exercised a notoriously patchy reputation for delivering inaccurate findings in the past, the surveys might have gotten it wrong far more than usual this time around. If this trend holds, a majority government will form with BJP-led NDA acquiring slightly below 300 seats, almost mirroring exact forecasts by on-ground reporters and some political experts. However, this is quite in contrast with almost all exit polls this election season. If the scorecard settles at the current mark, this will end up becoming the poorest performance for NDA since their historic win in 2014. The alliance came to power after winning an overwhelming 336 seats in 2014, and 353 seats in 2019. However, the main point of shock has come from the performance of Congress and the INDIA bloc, who have maintained a steadfast 200+ seats since the initial polling rounds. Out of the nine odd exit polls that came out with results recently, none had predicted the INDIA bloc to win over 150-170 seats. As the tallying moves into its final phases, let’s look at how exit polls performed in the previous election cycles. <cmsannotation type="cmsannotation" annotationid="2014 elections" comment="subhead" text="2014 elections">2014 elections</cmsannotation> In 2014, 834 million voters participated in the largest-ever elections worldwide — only to be surpassed by the 2019 <keyword id="19895394" type="General" weightage="100" keywordseo="lok-sabha" source="keywords">Lok Sabha</keyword> elections. An average of eight exit polls had indicated that the BJP would see a 283-seat victory, while the opposition would have had to settle for 105 seats. Just as predicted, the BJP saw a landslide victory and swooped in 282 of the 543 seats, with a vote percentage of 31.3%. This win was a huge blow to the INC, which only won 44 seats compared to the 206 in 2009. Since a party must win at least 55 seats to become an official opposition party in India, the Congress’s defeat meant that there was no official opposition party for India. <cmsannotation type="cmsannotation" annotationid="2019 elections" comment="subhead" text="2019 elections">2019 elections</cmsannotation> The previous Lok Sabha elections turned out to be an even bigger win for the BJP! In 2019, exit polls had predicted that the BJP-led National Democratic Alliance would peak at 306 and that the INC-led United Progressive Alliance (UPA) would win just 120. However, the post-poll statistics turned out to be underwhelming. The BJP won a whopping 37.36% of the vote — the highest by a political party since the 1989 general elections. It won 303 seats, while the NDA collectively won 352 seats. It was another crushing defeat for the Congress, which won just 52 seats, failing to claim the post of Leader of the Opposition once again.

Trends indicate INDIA maintaining 200+ seats, defying all exit poll predictions; how accurate have these surveys been since 2014?

NDA is likely to get between 212 and 232 seats if the <keyword id="6355187" type="ORGANIZATION" weightage="40" keywordseo="Lok-Sabha">Lok Sabha</keyword> elections were held today, with BJP alone winning between 193 and 213, according to an opinion poll done for a TV channel. The poll, based on a survey of six states, puts the UPA a distant second with 119 to 139 seats, of which <keyword id="1575" type="ORGANIZATION" weightage="80" keywordseo="Congress">Congress</keyword> was projected to win between 94 and 110. 
 The CNN-IBN poll, conducted by CSDS and Lokniti, made these projections based on surveys in Uttar Pradesh, <keyword id="30033" type="COMPANY" weightage="40" keywordseo="Bihar">Bihar</keyword>, Maharashtra, <keyword id="37102" type="COMPANY" weightage="40" keywordseo="Andhra-Pradesh">Andhra Pradesh</keyword>, <keyword id="20154" type="ORGANIZATION" weightage="40" keywordseo="tamil-nadu">Tamil Nadu</keyword> and Delhi. While the seat figures are more or less the same as the projections done by the same pollsters in January, the popularity rating of <keyword id="6354477" type="PERSON" weightage="40" keywordseo="Narendra-Modi">Narendra Modi</keyword> has dipped significantly. 
 In January, 36% of respondents to the survey had chosen Modi as their preferred PM. That figure is now down to 31%. In contrast, there has been an uptick of one percentage point each in those picking <keyword id="5268" type="PERSON" weightage="40" keywordseo="Rahul-Gandhi">Rahul Gandhi</keyword> (now 13%), <keyword id="689" type="PERSON" weightage="40" keywordseo="Sonia-Gandhi">Sonia Gandhi</keyword>, <keyword id="6357690" type="PERSON" weightage="40" keywordseo="mayawati">Mayawati</keyword>, Mulayam Singh and <keyword id="6359397" type="PERSON" weightage="40" keywordseo="Manmohan-Singh">Manmohan Singh</keyword>. 
 
The poll also shows BJP’s projected vote share down marginally from the January estimate and the Congress vote share too down marginally. The saffron party continues to enjoy a significant lead with 33% compared to Congress’ 26%. 
 Apart from the NDA and UPA, the <keyword id="43826" type="ORGANIZATION" weightage="40" keywordseo="Trinamool-Congress">Trinamool Congress</keyword> is likely to be the biggest party winning between 20 and 28 seats, according to the survey. <keyword id="120271" type="ORGANIZATION" weightage="40" keywordseo="The-Left">The Left</keyword> with 15-23, AIADMK with 14-20, YSR Congress and <keyword id="6355032" type="ORGANIZATION" weightage="40" keywordseo="SP">SP</keyword> with 11-17 seats each, BJD, TDP and DMK with 10-16 each and BSP with 8-14 could be the other significant players in the 16th Lok Sabha, it projected. 
 
If these projections turn out right, it would almost certainly mean that the next government in New Delhi would be headed by Modi and would be cobbled together by the existing NDA joining hands with smaller regional parties. Neither Congress nor the ill-defined Third Front/Federal Front would really be in a position to take a meaningful shot at forming a government in such a scenario.
