"But whatever role the 140 X accounts in question in Brazil may have played in threatening Brazil's democracy, they cannot have threatened it more than silencing the 20 million or so Brazilians who have been using it regularly."<h2 id="14d73b7e-374a-4bfd-a770-e6b7627cd912">Musk's questionable free speech record</h2>After he purchased Twitter in 2022, Musk quickly reduced moderation on the platform and restored accounts once banned for spreading false information, like those of <a target="_blank" class="" href="https://www.businessinsider.com/elon-musk-said-donald-trumps-twitter-account-will-be-reinstated-2022-11">former President Donald Trump</a> and <a target="_blank" class="" href="https://www.businessinsider.com/elon-musk-restores-alex-jones-account-5-years-after-ban-2023-12">conspiracy theorist Alex Jones</a>, in the name of free speech.More recently, he was one of the first social media moguls to <a target="_blank" class="" href="https://www.businessinsider.com/elon-musk-telegram-ceo-pavel-durov-arrest-france-free-speech-2024-8">defend Telegraph founder Pavel Durov</a> when last month <a target="_blank" class="" href="https://www.businessinsider.com/telegram-ceo-pavel-durov-arrested-french-airport-2024-8">French police arrested Durov</a>, in part due to his <a target="_blank" class="" href="https://www.businessinsider.com/telegram-ceo-pavel-durov-charges-questions-free-speech-censorship-2024-8">refusal to moderate content</a> more strictly on his messaging app.Musk's commitment to the issue of free speech, however, is otherwise spotty, if not outright hypocritical.The <a target="_blank" class="" href="https://www.businessinsider.com/tesla-ceo-elon-musk">Tesla CEO</a> has banned <a target="_blank" class="" href="https://www.businessinsider.com/musk-said-comedy-now-legal-twitter-jokes-getting-users-suspended-2022-11">parody accounts</a> that impersonated him and threatened to sue bloggers critical of him and his companies. He has also <a target="_blank" class="" href="https://www.businessinsider.com/free-speech-absolutist-elon-musk-censors-employees-critics-2022-3">fired employees who disagreed with him</a>.Perhaps even more egregious, at least in the context of his battle in Brazil, Musk said last year he had <a target="_blank" class="" href="https://www.businessinsider.com/musk-twitter-no-actual-choice-censorship-governmental-request-free-speech-2023-5">no "actual choice"</a> but to comply with government requests to restrict content in Turkey and India — both large democracies that have, in recent years, become more autocratic. One analysis by El Pais estimated that, under his leadership, X complied with 83% of requests from authoritarian governments to remove content.Though his history on the issue is inconsistent, Musk has made himself central to the conversation about censorship, content moderation, and free speech worldwide in part by picking fights like the one he has in Brazil.<h2 id="a4f17cb4-b06a-458e-9258-a98ac7bd5985">The battle in Brazil</h2>In Brazil, the battle got real for Musk.In addition to slapping X with more than $3 million in fines and threatening to jail the company's employees, prompting the <a target="_blank" class="" href="https://www.businessinsider.com/x-closes-brazil-office-elon-musk-alexandre-de-moraes-2024-8">closure of X's Brazilian office</a>, de Moraes also targeted Musk's other business ventures in the country.The Brazilian judge briefly froze the financial accounts for Starlink — a subsidiary of Musk's company SpaceX that provides internet connectivity through its constellation of satellites — in order to collect the fines on X.When Starlink refused to comply with orders to block access to X in the country, Brazilian telecom regulators weighed slapping the company with sanctions and <a target="_blank" class="" href="https://www.businessinsider.com/brazil-starlink-sanctions-amid-feud-elon-musk-x-2024-9">revoking the company's license to operate</a>.Starlink backed down, eventually complying with legal demands to block X in Brazil, but Musk hasn't given up.<h2 id="5f8a4d7c-bd6f-4f1f-8964-e222c474bfdf">Musk argues in memes</h2>For now, Musk seems to be defending free speech (and X's presence in Brazil) by publicly attacking de Moraes.In a series of recent posts on X, Musk questioned de Moraes' credibility and political motives, calling him "an evil dictator cosplaying as a judge" and accusing the justice of being "engaged in serious, repeated &amp; deliberate interference" in Brazil's most recent presidential election, during which voters elected leftist Luiz Inácio Lula da Silva over Bolsonaro.He has also shared images of de Moraes alongside Lord Voldemort from the "Harry Potter" franchise and suggested the judge belongs behind bars.These attacks may ultimately work against Musk and his companies.His decision not to appeal de Moraes' orders in court (and instead turn the topic into a battle of memes online) has scattered about 20 million active Brazillian X users to new platforms, including Bluesky and Threads."Where this is heading from here will really depend on Elon Musk. I think if Elon Musk decides to start to comply, as he eventually did in India, for example, it might be that X comes back," Mariana Valente, a law professor and the director of Brazil's InternetLab, a think tank, told Bloomberg. MPs and MLAs taking bribes to vote or make a speech in the <keyword id="19910021" type="General" weightage="20" keywordseo="house" source="keywords">House</keyword> are not immune from prosecution, the Supreme Court said on Monday in a landmark, unanimous verdict that overrules its 1998 judgment protecting such lawmakers. Observing that bribery is not protected by parliamentary privileges, a seven-judge constitution bench headed by Chief Justice D Y <keyword id="19985698" type="General" weightage="20" keywordseo="chandrachud" source="keywords">Chandrachud</keyword> held that a five-judge bench's interpretation in the 1998 verdict in the JMM bribery case was contrary to Articles 105 and 194 of the Constitution. Describing the judgment as "great", Prime Minister <keyword id="19895781" type="General" weightage="20" keywordseo="narendra-modi" source="keywords">Narendra Modi</keyword> said in a post on X that it would "ensure clean politics and deepen people's faith in the system". Articles 105 and 194 deal with the powers and privileges of MPs and MLAs in the Parliament and the legislative assemblies. "Corruption and bribery by members of the legislatures erode probity in public life," the CJI, who read the operative part of the verdict, said while pronouncing the verdict today. The bench also comprised Justices A S Bopanna, M M Sundresh, P S Narasimha, J B Pardiwala, <keyword id="19931190" type="General" weightage="20" keywordseo="sanjay-kumar" source="keywords">Sanjay Kumar</keyword> and Manoj Misra. In 1998, the five-judge constitution bench held in its majority verdict on the Narasimha Rao versus CBI case that parliamentarians have immunity against criminal prosecution for any speech made and vote cast inside the House under Articles 105(2) and 194(2). The seven-judge bench was reconsidering the 1998 judgement. While pronouncing the verdict, the CJI said Article 105 of the Constitution seeks to sustain an environment to have deliberations by the lawmakers in the House and this atmosphere is vitiated when a member is bribed to deliver a speech. Justice Chandrachud said the privileges claimed must have a nexus to the collective functioning of the House and must have a relationship with the essential functions of a legislator which he or she has to discharge. The seven-judge bench had reserved its judgement in the matter on October 5 last year. During the arguments, the Centre had submitted that bribery can never be a subject matter of immunity and a parliamentary privilege is not meant to place a lawmaker above law. The top court, in the course of the hearing, had said it will examine whether the immunity granted to lawmakers from prosecution for taking bribes to make a speech or vote in Parliament and state legislatures extends to them even if criminality is attached to their actions. On September 20, 2023, the <keyword id="19936355" type="General" weightage="20" keywordseo="apex-court" source="keywords">apex court</keyword> had agreed to reconsider its 1998 judgement, saying it was an important issue having a significant bearing on "morality of polity". The issue came under the apex court's lens in 2019, when a bench headed by then Chief Justice Ranjan Gogoi was hearing an appeal filed by <keyword id="20405400" type="General" weightage="20" keywordseo="sita-soren" source="keywords">Sita Soren</keyword>, JMM MLA from Jama and daughter-in-law of party chief Shibu <keyword id="19968807" type="General" weightage="20" keywordseo="soren" source="keywords">Soren</keyword>. She was an accused in the JMM bribery scandal. The Gogoi-led bench had referred to a five-judge bench the matter, noting it had "wide ramification" and was of "substantial public importance". Sita Soren was accused of taking bribes to vote for a particular candidate in the Rajya Sabha election in 2012. She contended that the constitutional provision granting lawmakers immunity from prosecution, which saw her father-in-law being let off the hook in the JMM bribery scandal, be applied to her. She moved the apex court against the Jharkhand High Court order of February 17, 2014 refusing to quash the criminal case lodged against her. The three-judge bench had then said it will revisit the apex court verdict in the JMM bribery case involving Shibu Soren, a former Jharkhand chief minister and ex-union minister, and four other party MPs who had accepted bribes to vote against the no-confidence motion threatening the survival of the P V Narasimha Rao government in 1993. The Narasimha Rao government, which was in a minority, survived the no-confidence vote with their support. The CBI registered a case against Soren and four other JMM Lok Sabha MPs but the Supreme Court quashed it citing immunity from prosecution they enjoyed under Article 105(2) of the Constitution. As per established tradition, the finance minister met the President at the Rashtrapati Bhavan before heading to Parliament. President Murmu offered 'dahi-chini' (curd-sugar), considered auspicious, to Sitharaman before she left for Parliament to present the Union Budget. The Union Cabinet met thereafter to clear the Budget. Before the actual presentation in Parliament, the Cabinet headed by Prime Minister Narendra Modi will approve the Budget for fiscal 2024-25 (April 2024 to March 2025). Expectations are running high as Sitharaman presents her seventh Budget in the Lok Sabha on Tuesday. The Budget would give a glimpse of the Modi government's performance in the past 10 years while outlining the roadmap to make India a developed nation. Sitharaman continued with the tradition she set in 2019, carrying the budget speech in a 'bahi-khata', which she used after dropping the briefcase tradition. She keeps a digital tablet in a red 'bahi khata' style pouch. The economy is projected to expand by 6.5-7 per cent in the current fiscal, as per the Economic Survey tabled in Parliament on Monday. Finance Minister Nirmala Sitharaman meets President ahead of Budget speech

Prime Minister Narendra <keyword id="19899684" type="General" weightage="20" keywordseo="Modi" source="keywords">Modi</keyword> on Friday said the government is making necessary <keyword id="20861068" type="General" weightage="20" keywordseo="policy-changes" source="keywords">policy changes</keyword>, like removal of <keyword id="20279287" type="General" weightage="20" keywordseo="Angel-Tax" source="keywords">Angel Tax</keyword>, to promote the <keyword id="19945816" type="General" weightage="100" keywordseo="fintech" source="keywords">fintech</keyword> sector, even as he asked the <keyword id="19962476" type="General" weightage="20" keywordseo="regulators" source="keywords">regulators</keyword> to take additional measures to check cyber frauds which can have a crippling impact on startups. Lauding the fintechs for democratising <keyword id="19976433" type="General" weightage="20" keywordseo="financial-services" source="keywords">financial services</keyword>, Modi said the sector, which has attracted USD 31-billion investment in the last 10 years, has played a key role in denting the parallel economy. The Prime Minister was addressing the Global Fintech Fest (GFF) 2024, jointly organised by the Payments Council of India, the National Payments Corporation of India and the Fintech Convergence Council. He said the domestic economy and the capital market are in a celebratory mood at a time when the nation is also going through a festive period. Modi underlined that the government is making all necessary changes on the policy level to assist the fintech sector and gave examples of doing away with Angel Tax, allocating Rs 1 lakh crore to encourage research and innovation in the country and implementing the Digital Personal Data Protection Act. Broadly, fintech refers to entities utilising technologies for providing financial services. Expressing the need to put an end to <keyword id="19901142" type="General" weightage="20" keywordseo="cyber-fraud" source="keywords">cyber fraud</keyword>, he urged the regulators to take major initiatives to boost digital literacy. It is equally important to ensure cyber fraud does not come in the way of the growth of fintech and startups in the country, Modi said. In his speech, the Prime Minister also cautioned about the dangers of a parallel economy for the world. Fintech, he said, has played an impactful role in denting such a system and credited the emergence of transparency. He said that digital technology has introduced transparency in India and gave the example of the implementation of Direct Benefit Transfer used in hundreds of government schemes that has prevented leakages in the system. "Today, people can see the benefits of aligning with the formal banking system," he said. Modi further said the trinity of Jan Dhan, Aadhaar and Mobile have broken down the mentality of 'Cash is King' and made way for approximately half of the <keyword id="20004116" type="General" weightage="20" keywordseo="digital-transactions" source="keywords">digital transactions</keyword> in the world taking place in India. "India's <keyword id="19900911" type="General" weightage="20" keywordseo="upi" source="keywords">UPI</keyword> has become a major example of fintech in the world," he said, adding that it has enabled 24X7 banking services in every village and city in all weather conditions. Underlining the role of fintech in democratising financial services, the Prime Minister gave examples of readily available loans, credit cards, investments and insurance. He said that fintech has made access to credit easy and inclusive, and gave the example of PM SVANidhi scheme that has enabled street vendors to avail collateral-free loans and further expand their business with the help of digital transactions. "Sustainable <keyword id="19900794" type="General" weightage="20" keywordseo="economic-growth" source="keywords">economic growth</keyword> is India's priority today," he said and emphasised that the government is creating robust, transparent and efficient systems to strengthen financial markets with advanced technologies and regulatory frameworks. About 800 speakers, including policymakers, regulators, senior bankers, industry captains, and academicians, from India and other countries are participating in the fest.
