The Delhi <keyword id="6355392" type="ORGANIZATION" weightage="20" keywordseo="High-Court">High Court</keyword> Monday declined to lift stay at this stage its order on the decision of the AAP Government asking 12 Delhi University colleges, which are fully funded by it to pay outstanding salaries of staffers from the students' fund. It said it will decide the application seeking vacation of stay only after hearing all the parties and sought replies of 12 colleges.. Justice Jyoti Singh issued notices to the 12 colleges and Delhi University Students Union (DUSU) on the Delhi government's application to vacate the stay order. The court also granted three weeks time to the colleges to file their replies to the petition filed by DUSU, which has challenged the October 16 order of Delhi government asking the institutes to pay the salaries of over 1500 staff-- both teaching and non-teaching-- from the students fund. The high court listed the matter for further hearing on December 15. During the hearing, the counsel appearing for Delhi government urged the high court to vacate the October 23 order by which stay was granted on its decision asking the colleges to pay pending salaries of staffers from the <keyword id="753950" type="ORGANIZATION" weightage="20" keywordseo="Students-Welfare-Fund">Students Welfare Fund</keyword> (SSF). "Delhi government is forced to release funds despite the fact that the colleges are sitting over huge amount of money," he argued. The high court said the October 23 interim stay order will continue till further orders. The 12 colleges which are affiliated with the Delhi University and are fully funded by the Delhi government are <keyword id="674173" type="ORGANIZATION" weightage="20" keywordseo="Acharya-Narendra-Dev-College">Acharya Narendra Dev College</keyword>, <keyword id="7382749" type="UNKNOWN" weightage="20" keywordseo="dr-bhim-rao-ambedkar-college">Dr Bhim Rao Ambedkar College</keyword>, Bhaskaracharya College of Applied Sciences, Bhagini Nivedita College, <keyword id="9974515" type="COMPANY" weightage="20" keywordseo="deendayal-upadhyaya-college">DeenDayal Upadhyaya College</keyword>, Aditi Mahavidyalaya Women's College, Indira Gandhi Institute of Physical Education &amp; Sports Sciences, Keshav Mahavidyalaya, Maharaja Agrasen College (DU), <keyword id="9944129" type="COMPANY" weightage="20" keywordseo="maharshi-valmiki-college-of-education">Maharshi Valmiki College of Education</keyword>, Shaheed Rajguru College of Applied Sciences for Women and Shaheed Sukhdev College of Business Studies. The high court had earlier issued notice to the Directorate of Higher Education, Delhi University and Delhi government and sought their replies on the petition by DUSU. DUSU, in its plea, has said "Such arbitrary and illegal usage of the money raised by the students for their academic welfare has forced the petitioner who represents the students of the university as a union, to come to this court for quashing of such illegal, unjust and arbitrary order that is unjust and violative of the rights of the students as a whole." Delhi University's counsel had said the varsity is supporting the students' petition and added that the students fund cannot be used for paying teachers salaries and it will amount to cheating the students. The college staff are not paid for the last three months. The plea said the Directorate of Higher Education has directed the 12 colleges, which are 100 per cent funded by the Delhi government, to exhaust and utilise the funds gathered by the students with respect to the <keyword id="10247085" type="UNKNOWN" weightage="20" keywordseo="students-society-fund">Students Society Fund</keyword> (SSF) maintained by the respective colleges for and by the students. "...the impugned actions are bad in law and violate the rights of each and every student that has contributed to such SSF and usage of the such Funds for the payment of salaries will be highly objectionable as their lies no reason or precedent for the usage of such student funds for payment of salaries from colleges which are 100 per cent funded by the respondent no.3 (Delhi government)," it said. The government order has said, "Having taken notice that salaries of teaching and non-teaching staff of colleges, affiliated to Delhi University and fully funded by the GNCT of Delhi, are outstanding/not being paid due to ongoing Special Audit/non-release of Grant-in-Aid, the Hon'ble Dy CM has ordered/permitted : outstanding salaries to the Teaching and Non-Teaching staff be released immediately from the SSF as has been done in the past, till the process of Special Audit is completed/further installments of GIA (under the Salary Head) are released." For the purpose, requisite permission for utilising the Students Society Fund(SSF) for payment of salaries to the teaching and non-teaching staff is hereby accorded, the order has said. "If any salaries remain unpaid after the SSF has been exhausted, the remaining amount will be paid by the Directorate of Higher Education after receipt of formal request from the concerned college(s)," it added. Delhi University vs Aam Aadmi Party — High Court declines to lift stay on payment of salaries

New Delhi, Oct 31 (PTI) The 12 Delhi University colleges funded by the city government are facing a fund crunch as their allocated budgets have been slashed, alleged officials of some of these institutions. Due to this, these institutions are also facing difficulties in paying salaries of teachers, they claimed. DU registrar Vikas Gupta said they will take up the issue of non-release of funds with the AAP government. The issue was also raised at the Executive Council meeting of the university held on October 29. A senior faculty member of Majaraja Agrasen College, claimed, "Teachers have not been paid their salaries for five months. The government has slashed the allocated budget by half. Not only salaries, the teachers are not getting their pension and other allowances." Explaining the situation, Subodh Kumar, president of staff association of the Maharaja Agrasen College and coordinator of all the 12 colleges, said teachers want the teaching learning process to continue but the government is not letting it happen. "The government has an issue with the Delhi University. The issue has been going on before the Covid pandemic. There was a tussle over the formation of governing bodies but they were formed. "Then they (govt) alleged corruption in colleges and despite various audits, they did not find anything. After the pandemic, they said they don't have money and slashed the budget. Earlier we (the college) were getting Rs 28 crore which has been brought down to Rs 16 crore," he claimed. Terming it 'inhuman treatment', Kumar said teachers will be forced to protest to resist this arm-twisting by the government. Such is the crisis that teachers have been forced to quit jobs, he said. Hem Chand Jain, principal of Deen Dayal Upadhyaya College, said, "Last year, the government had released 42 crore (to the college) but this year they reduced it to Rs 28 crore. We have received two instalments but looking at the situation, this money will only allow us to pay salaries of six months," he claimed. The dearness allowance and other allowances have increased under the seventh pay commission and 80 teachers have received promotions along with non staffers, he said. Before Covid pandemic, the college had 122 teachers, but now we have 115 teachers, Jain said. "Seven teachers have left the job, including six ad-hoc teachers. One of the ad-hoc teachers is working in a school since she said she would at least get her salary on time," Jain added. According to the <keyword id="165568" type="ORGANIZATION" weightage="20" keywordseo="Delhi-University-Teachers-Association">Delhi University Teachers Association</keyword> (DUTA), the problem goes beyond just the payment of salaries — it’s about control. The latest stone on the mountain of controversy The Delhi University Teachers Association (DUTA) announced an action plan, which included a university-wide shut down, against the delay in release of grands on March 11. Within a day, the Delhi government released ₹82.79 crore under salary heads and ₹9.5 crore as the fourth quarter installment. However, this was not enough to appease the frustrated faculty. According to them, they <a href="https://indianexpress.com/article/cities/delhi/duta-protest-arvind-kejriwal-7230004/">should not have to beg</a> for their salaries using threats and other means. The release of funds does not solve the sphere of problems that the colleges now have with the government. The protestors who marched towards Kejriwal’s home weren’t able to reach the gates, but did hand over a memorandum addressed to him at the barricades where they were stopped. The Delhi government’s move to divest While these 12 colleges — which includes Maharaja Agrasen College, Shaheed Sukhdev College of Business Studies, and Deen Dayal Upadhyaya College — get their funding from the Delhi government, they are still governed by the rules of the University Grants Commission (UGC). And, the Delhi government is asking these colleges to adopt the ‘Pattern of Assistance’. The document refers to these colleges as ‘affiliated’ to Delhi University even though they are constituent colleges. “The change in manner of referencing clearly strengthens the apprehension that the Delhi government, earlier tasked with maintaining these educational institutions, is now redefining itself as the sponsor of edu-business units to find ways of disaffiliating them from Delhi University,” said the <a href="http://www.duta-du.info/2021/03/duta-letter-to-vc-reg-12-colleges-100.html">letter from DUTA</a> to the Delhi University Vice Chancellor. <div type="image" title="delhi university VC_edited" msid="81529871" hostid="261" caption="&amp;lt;p&amp;gt;Delhi University Vice Chancellor PC Joshi&amp;lt;/p&amp;gt;"></div> According to DUTA, the ‘Draconian’ document is designed to redefine the association of the colleges in question.
