The Bar Council of India has issued directives and cease and desist notices in compliance with a judgment pronounced on July 3, 2024 by the <keyword id="19900621" type="General" weightage="20" keywordseo="Madras-High-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Madras High Court" meta.hostid="261" meta.entityid="Madras High Court">Madras High Court</keyword>. The judgment underscores that the legal profession is a noble service to society and not a business driven by profit motives. In this regard, BCI directs the online platform to remove all listings, profiles, and advertisements related to <keyword id="22033472" type="General" weightage="20" keywordseo="legal-practice" source="keywords">legal practice</keyword>s by advocates immediately and no later than four weeks from the date of the notice. Cease and desist any operations enabling the advertisement or solicitation of legal practice by advocates. Submit a detailed compliance report outlining the actions taken to the BCI by August 10, 2024 Failure to comply with these directives will result in the BCI initiating legal proceedings and seeking appropriate penalties against the non-compliant organizations, stated BCI. All portals, <keyword id="19984289" type="General" weightage="20" keywordseo="online-platforms" source="keywords">online platforms</keyword>, and advocates found in violation of Rule-36 of the Bar Council of India Rules are hereby issued a public notice to ensure strict compliance with these Rules immediately. Any advertisements contravening the aforementioned Rule must be withdrawn forthwith, stated BCI. Practices of online platforms offering lawyer services were examined and found to be in violation of the <keyword id="22332742" type="General" weightage="20" keywordseo="BCI-Rules" source="keywords">BCI Rules</keyword>. The permissibility of <keyword id="22332740" type="General" weightage="100" keywordseo="lawyers-advertising" source="keywords">lawyers advertising</keyword> and soliciting work was scrutinized and deemed inappropriate. The involvement of online intermediaries in facilitating lawyer services was assessed and found to be in breach of professional conduct standards. The court ruled that online platforms cannot seek protection under Section 79 of the Information Technology Act for activities illegal under the Advocates Act and BCI Rules, added Bar Council of India's statement. Recently Madras High Court directed BCI to issue Circulars/Instructions/Guidelines to the State Bar Councils to initiate disciplinary proceedings for misconduct against the Advocate's advertising, soliciting works directly or indirectly, whether by circulars, advertisements, touts, personal communication, interviews not warranted by personal relations, furnishing or inspiring newspaper comments or producing his photographs to be published in connection with the case where he is engaged or concerned.

BCI directs State Bar Councils to take action against lawyers advertising, seeking work through online portals

In a landmark judgement, the <keyword id="19900742" type="General" weightage="20" keywordseo="Supreme-Court-of-India" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court of India" meta.hostid="261" meta.entityid="Supreme Court of India">Supreme Court of India</keyword> has broadened the definition of crimes under the Protection of Children from Sexual Offences (POCSO) Act. The court ruled that simply viewing <keyword id="20456028" type="General" weightage="100" keywordseo="child-pornography" source="keywords">child pornography</keyword> on the internet, without physically possessing or storing the material, is now a criminal offence under Section 15 of the <keyword id="19920672" type="General" weightage="20" keywordseo="POCSO-Act" source="keywords">POCSO Act</keyword> and provisions of the <keyword id="19930099" type="General" weightage="20" keywordseo="information-technology" source="keywords">Information Technology</keyword> (IT) Act. This ruling significantly expands the scope of the law to address the evolving challenges posed by digital platforms. <h2>A wider net</h2>In its ruling, a bench comprising Chief Justice D.Y. Chandrachud and Justice J.B. Pardiwala stated, "Any act of viewing, distributing, or displaying child pornographic material by a person over the internet without any actual or physical possession or storage of such material in any device or in any form or manner would also amount to 'possession' in terms of Section 15 of POCSO Act." This interpretation effectively settled conflicting verdicts from various high courts, notably overturning a Madras High Court decision that had quashed a POCSO case against an individual who had viewed child pornography but had not circulated it. The Supreme Court, in agreeing with senior advocate H.S. Phoolka's arguments, deemed the earlier judgement "egregiously erroneous." <h2>Crimes categorised</h2>In a further clarification, the Supreme Court divided crimes related to child pornography under Section 15 of the POCSO Act into three distinct categories. The decision emphasised that law enforcement and courts must carefully assess each case to determine the specific category under which an offence falls. One critical insight from the judgement is that an offender cannot escape prosecution by simply deleting illegal content before an FIR is registered. To address this, the court created a safeguard for those unaware of the offensive material stored on their devices. If a person discovers such material on their device through automatic downloads, they will not be prosecuted if they take immediate steps to delete it and report it to the authorities. However, the onus is on the device owner to act swiftly. Failure to delete or report the offensive material after becoming aware of it would constitute an offence under the law. To avoid the automatic downloading of problematic material, there are several proactive measures you can take. First, adjust your browser settings to disable automatic downloads and pop-ups, ensuring you have to approve any file before it is downloaded to your device. Lastly, routinely monitor your device for any unfamiliar files and promptly delete anything that looks suspicious to minimise your risk of unknowingly storing problematic content. <h2>What this means for the future</h2>This judgement sends a clear message: India is taking a zero-tolerance approach toward child pornography in all its forms, whether stored, distributed, or merely viewed. The ruling adapts the legal framework to modern challenges, ensuring that perpetrators can no longer hide behind technicalities such as the absence of physical possession. The Supreme Court’s interpretation also places a burden on individuals to exercise responsibility in the digital world. Audikesavulu passed the order on two petitions that were filed challenging the validity of the <keyword id="645424" type="General" weightage="20" keywordseo="it-rules" source="Orion">IT Rules</keyword>. Carnatic musician T.M. Krishna had filed a public interest litigation, while the Digital News Publishers Association, and journalist Mukund Padmanabhan had also filed a writ petition in the matter. "There is a substantial basis to the petitioners' assertion that there may be a violation of Article 19 (1)(a) (of the Constitution) in how the Rules may be coercively applied to intermediaries....," the court observed. Earlier, the same sub-section of Rule 9 had been stayed by the Bombay High Court on August 14. With the Supreme Court scheduled to take up transfer petitions next month, the Madras High Court posted further hearing of the case to October 27. Madras High Court stays 2 sub-sections of the new IT Rules

<ul><li><keyword id="6360667" type="General" weightage="20" keywordseo="madras-high-court" source="Orion">Madras High Court</keyword> reiterated that <keyword id="790242" type="General" weightage="20" keywordseo="whatsapp" source="Orion">WhatsApp</keyword> <keyword id="4484267" type="General" weightage="20" keywordseo="group-admin" source="Orion">group admin</keyword> are not liable for member’s posts.</li><li>Justice GR Swaminathan referred to a similar judgement given by the <keyword id="48485" type="General" weightage="20" keywordseo="bombay-high-court" source="Orion">Bombay High Court</keyword> before giving his orders.</li><li>The Court asked the respondent to bear in mind the ruling of the Bombay High Court.</li></ul>The Madurai bench of the Madras High Court reiterated the Bombay High Court’s finding of a previous case that a <keyword id="6407380" type="General" weightage="20" keywordseo="whatsapp-group" source="Orion">WhatsApp group</keyword> administrator cannot be held liable for objectionable content posted by members of the groups. Justice GR Swaminathan referred to the <a href="https://www.barandbench.com/news/litigation/whatsapp-group-administrator-no-vicarious-liability-content-group-member-bombay-high-court">Kishore v. State Maharashtra</a> of the Bombay High Court which ruled that a WhatsApp group admin must be deleted from the list of accused if he did not play any part in the crime committed by group members other than being an admin. However, the Court also held that if another material is gathered that shows the admin being involved in the crime, he may be tried according to the law. The order was given on a plea that seeks to cancel a First Information Report (FIR) against the group admin in which offensive messages were circulated by a member that could cause animosity between communities. The petition claimed that the petitioner was only the administrator of the WhatsApp group and he could not be held responsible for the messages sent by the group members. As per the complainant, the petitioner lacked honesty, claiming that there was a conspiracy between the group admin and the member since the member was first removed from the group and then re-added. The Court disposed of the complaint and asked the respondent to bear in mind the ruling of the Bombay High Court in Kishore vs. State Maharashtra, where a similar case on the liability of a WhatsApp group admin was discussed. In that ruling, the Bombay High Court had held, “a group administrator cannot be held vicariously liable for an act of a member of the group, who posts objectionable content unless it is shown that there was a common intention or pre-arranged plan acting in concert pursuant to such plan by such member of a Whatsapp group and the administrator.” The Bombay High Court also stated that the group admin had limited powers of adding and deleting members and cannot be expected to have advanced knowledge of what the members of the group may post. In light of the above order, the Madras High Court judge declared that if the petitioner's only role in the case was that of a group admin, then the name must be deleted from the chargesheet. Madras High Court reaffirms that WhatsApp group admin isn’t liable for a member’s posts

<keyword id="28423" type="General" weightage="80" keywordseo="vedanta" source="Orion">Vedanta</keyword> Ltd has decided to put its 4,00,000 ton per annum (tpa) <keyword id="437023" type="General" weightage="100" keywordseo="copper-smelter" source="Orion">copper smelter</keyword> plant and refining complex at <keyword id="6354388" type="General" weightage="80" keywordseo="tuticorin" source="Orion">Tuticorin</keyword> for sale. The copper smelter plant complex is known as <keyword id="1622540" type="General" weightage="50" keywordseo="sterlite-copper" source="Orion">Sterlite Copper</keyword>. The company along with Axis Capital has called for Expression of Interest (EoI) for its smelter complex (primary and secondary), sulphuric acid plant, copper refinery, continuous copper rod plant, phosphoric acid plant, effluent treatment plant, 160 MW captive power plant, reverse osmosis units, oxygen generation unit and residential complex with amenities. However, an environmental activist, who is against the Copper Smelter plant, wondered whether the company can sell the plant when a case is pending in the <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword>. The decision came as a surprise to many as the company was saying that it would reopen the plant. According to Vedanta, the plant produces about 40 per cent of the country's demand for copper and contributes about Rs 2,500 crore per annum to the exchequer and 12 per cent of Tuticorin Port's revenue. Curiously last March, Vedanta came out with an EoI about its decision to set up a 500,000 tpa copper smelter plant in a coastal region in India. The company has sought expression of interest from coastal states wishing to partner in the project that would have an investment potential of about Rs 10,000 crore through a newspaper advertisement. According to Vedanta, the proposed project would need about 1,000 acre in proximity to port along with logistics connectivity with conveyor/corridor of rail and road to handle five million tpa material movement on both in-bound and out-bound sides. The company said the project has a potential to provide direct and indirect employment to 10,000 people and will contribute about Rs 3,000 crore to the government treasury as taxes and others. Senior officials were not available to reply IANS query whether the company is exiting Tuticorin. Later in a statement, the company said India's copper requirements are set to grow exponentially in the coming years. Having ample supplies of copper is critical to ensuring successful implementation of new-gen technologies such as electric vehicles, rapid automated transport and clean energy, the company said. "We are, therefore, actively on the lookout for a suitable partner state to help take forward the vision of an Atmanirbhar Bharat and ensure that our nation enjoys unfettered access to copper, through a state-of-the-art copper manufacturing plant, the operational and environmental parameters of which are comparable to the best in the world," Vedanta said. According to Vedanta, the closure of Tuticorin copper smelter plant has had a ripple effect in terms of imports and livelihoods. "Post closure, India has become a net importer of copper for the first time in 18 years, with copper imports growing 3X while exports have plunged by 90 per cent. We are continuing to explore all legal avenues towards achieving a sustainable solution to the closure," the company had said. The <keyword id="20154" type="General" weightage="50" keywordseo="tamil-nadu" source="Orion">Tamil Nadu</keyword> government had ordered the copper smelter plant to be shut down in 2018 following a violent protest that led to the death of 13 persons in police firing. The 4,00,000 ton Sterlite Copper smelter plant that has been operating in Tuticorin for over 25 years with a cumulative investment of about Rs 3,000 crore. However, from the start, Sterlite Copper smelter plant has been facing protests by the local people alleging that it pollutes the environment. Originally, the plant was planned in Goa, but it faced severe opposition from the state's people. However, the AIADMK regime under J. Jayalalithaa gave a warm welcome to the project and allotted land at Tuticorin. Ever since then the plant was in the eye of a storm with MDMK leader Vaiko leading a protest against the project and later filing a case. The major political parties in Tamil Nadu -- AIADMK and DMK -- are against Vedanta's copper smelter plant in Tuticorin. The Supreme Court is hearing the case on an appeal filed by the company against the Madras High Court's refusal to reopen the Sterlite Copper smelter plant in Tuticorin. Reacting to the latest advertisement Fatima Babu, one of the persons who had filed a case against Sterlite Copper told IANS: "It has to be seen whether the company can sell the plant when a case is pending in the Supreme Court. There seems to be a hidden agenda in the advertisement as it makes several claims like state-of-the-art plant and others." "Our stand is clear. The copper smelter plant should not be in Tuticorin whether under the name Sterlite Copper owned by Vedanta or by any other owner," she said. She added that if Vedanta wants to set up a new copper smelter then it can do so by complying with the law anywhere else. Vedanta puts its copper smelter plant in Tuticorin on sale

<keyword id="6354742" type="General" weightage="20" keywordseo="Flipkart" source="Orion">Flipkart</keyword> co-founder <keyword id="225032" type="General" weightage="20" keywordseo="Sachin-Bansal" source="Orion">Sachin Bansal</keyword> has moved the Madras High Court challenging a show cause notice (SCN) dated July 1 this year issued by the Enforcement Directorate (ED), which held that he and another individual were personally responsible for the alleged violation of FDI policy involving a staggering amount of approximately ₹23,000 crore. Justice R Mahadevan, before whom the writ petition from Bansal came up for hearing on Friday, pulled up the authorities for the delay of 12 years in issuing the notice and adjourned the matter by three weeks, after directing the ED and its officials to file the counters. The petition sought to quash the notice as illegal and arbitrary, insofar as he is concerned. The interim prayer is to stay its operation. The SCN was issued on the basis of a complaint filed by the Deputy Director of Enforcement in Bengaluru, for instituting adjudication proceedings under Sec.16 of the Foreign Exchange Maintenance Act (FEMA) against the petitioner, another co-founder Binny Bansal of the e-commerce giant, Accel, Tiger Global, Subrata Mitra (nominee director of Accel) and Lee Fixel (nominee director of Tiger Global) on the alleged contravention of the various provisions of the FEMA. The notice was issued pursuant to an alleged non-compliance with a condition prescribed vide the Consolidated Foreign Direct Investment Policy of 2010 dated April 1, 2010 in respect of issuance of shares of certain Flipkart group companies to foreign investors during 2009-14. According to Bansal, he ceased to have any association with Flipkart and its group of companies, pursuant to his unanticipated exit following the acquisition of Flipkart by Wal-mart International Holding, Inc. on August 17, 2018. Among other things, he contended that issuance of the SCN was arbitrary, unreasonable and patently a perverse one, as it was issued after 12 years. The complaint followed an investigation by the Directorate of Enforcement in New Delhi, which commenced in 2012, i.e. 9 years ago. He had proactively participated and cooperated in the investigation undertaken by the ED. Given the substantial lapse of time following the inquiry, the petitioner has conducted himself under the bonafide belief that after due study of the materials obtained during the course of the probe, the ED had concluded that no action was warranted in the matter. And, he had effected bonafide transfers to third parties in the intervening period and had completely exited from the Flipkart group in August 2018. However, to the utter shock and dismay, the ED issued the notices, he contended. Specifically, there is no statutory period prescribed under FEMA within which the authorities concerned were required to file the complaint for initiating the adjudication proceedings. In the absence of any period of limitation under the statute, it has been settled by the <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> in various judgments that the Constitution requires every authority, including the ED, to exercise its power to file a complaint within a reasonable time, failing which the actions taken by the statutory authority will be amenable to the writ jurisdiction of constitutional courts, petitioner said. Flipkart's Sachin Bansal  moves Madras High Court challenging ED notice

Non-residents undertaking <keyword id="96567" type="COUNTRY" weightage="20" keywordseo="Transactions">transactions</keyword> with Indian parties will trigger taxability under the domestic law in India even if they do not have physical presence in the country and operate digitised businesses. The <keyword id="121964" type="COMPANY" weightage="20" keywordseo="Central-Board-of-Direct-Taxes">Central Board of Direct Taxes</keyword> has notified new rules for operation of business by non-residents under which any transaction over ₹2 crore (apex $27,100) in respect of any goods, services or property carried out by them with any person in India including provision of download of data or software in India, will attract tax in India. The provisions of <keyword id="6704918" type="COMPANY" weightage="20" keywordseo="Significant-Economic-Presence">Significant Economic Presence</keyword> (SEP) that becomes the base for taxability of non-residents in India will also apply if the number of users with whom systematic and <keyword id="11211538" type="UNKNOWN" weightage="20" keywordseo="continuous-business-activities">continuous business activities</keyword> are solicited (or who are engaged in interactions) exceeds 3 lakhs. The provisions of Significant Economic Presence (SEP) were introduced in the legislation in 2018 with an intent to tax non-residents operating digitised businesses which function without a physical presence. It meant that SEP of a non-resident in India shall constitute a 'business connection' in India. These provisions were further amended vide Finance Act, 2020 which defined SEP as transaction in respect of any goods, services or property carried out by a non-resident with any person in India including provision of download of data or software in India, if the aggregate of payments arising from such transaction or transactions during the year exceeds a threshold or systematic and continuous soliciting of business activities or engaging in interaction with a defined number of users in India. The new provisions are applicable with effect from Financial Year 2021-22. It had become fully functional now with <keyword id="128665" type="COMPANY" weightage="20" keywordseo="CBDT">CBDT</keyword> notifying the thresholds for triggering SEP and consequently tax liability in India. According to PwC, the Central government has now made it clear that economic presence in India by non-residents is not limited only to the physical presence in India but also includes a virtual establishment. But non-residents could offset the taxability under these provisions by exploring taking relief under Double Taxation Avoidance Agreements. <ul><li>The <keyword id="6360667" type="UNKNOWN" weightage="20" keywordseo="madras-high-court">Madras High Court</keyword> on Monday directed the Central government to constitute a committee to decide on the issue of providing OBC reservation in all-India seats (AIQ) surrendered by Tamil Nadu for medical admission.</li><li>Such a committee comprising representatives from Centre, state and Medical Council of India should be constituted within three months, the court said.</li><li>The first bench of Chief Justice AP Sahi and Justice Senthilkumar Ramamoorthy also made it clear that any decision made by the committee shall be applicable only from the next academic year. </li></ul> The Madras High Court on Monday directed the Central government to constitute a committee to decide on the issue of providing OBC reservation in all-India seats (AIQ) surrendered by Tamil Nadu for medical admission. The bench passed the order on the batch of petitions moved by the Tamil Nadu government, the DMK, AIADMK, PMK and other political parties challenging the decision of the Centre not to provide OBC reservation in AIQ seats for medical admission. Disposing of the petitions, the court also observed that it is open for the Centre to pass any legislation to provide OBC reservation in AIQ seats for medical admission. And now, a professor at the Indian Institute of Technology Madras (IIT-M), V. Kamakoti, has outlined two by methods by which WhatsApp can backtrack messages to determine where they came from. He has submitted his report to Madras High Court, according to the <a href="https://economictimes.indiatimes.com/tech/internet/whatsapp-can-trace-message-origin-says-iit-m-professor/articleshow/70580443.cms">Economic Times</a>. One way or another The first way to trace messages back to their sender on WhatsApp is to embed the first sender’s information with the message making it easy to identify at a glance, where the message originated from. This information will be visible to everyone who receives the message. The second method at WhatsApp’s disposal is to encrypt the sender’s information with the message when it is sent, it won’t be visible to everyone but can be accessed by law enforcement when needed. Kamakoti also suggested that if someone makes a change or alters the forwarded message in some form, then he also becomes the one of the original senders. These changes could be anything from just changing to the text of the message or even adding audio or video files as an attachment.
