<keyword id="6358821" type="General" weightage="20" keywordseo="shiv-sena" source="Orion">Shiv Sena</keyword> chief whip Sunil Prabhu Wednesday alleged in the Supreme Court that Maharashtra Governor's direction to the Uddhav Thackeray-led Maha Vikas Aghadi (MVA) government to take a floor test in the Assembly on Thursday was "malafide, unconstitutional, and illegal." The plea challenging the Governor's direction was mentioned before a vacation bench of Justices Surya Kant and J B Pardiwala who took note of submissions of senior advocate A M Singhvi that an urgent hearing was needed and is scheduled to hear the matter at 5 pm. The petition contended that Governor Bhagat Singh Koshyari vide communication dated June 28, 2022 (which was received today i.e., on June 29 at about 9:00 am) has decided to hold a floor test in complete defiance of the fact that this court is seized of the issue of the disqualification proceedings. "Such undue haste is manifestly arbitrary and therefore violative of Article 14," said the plea and sought directions seeking setting aside of the impugned communication sent by the Governor to the Chief Minister as well as to the secretary of the Assembly. "It is submitted that this Court is considering the validity of the disqualification proceedings and has kept the matter for hearing on July 11, 2022. The issue of disqualification is directly connected/interlinked with the issue of floor tests. "It is submitted that the impugned communications are entirely based on media reports with no concrete material whatsoever. None of the 39 MLAs, it appears, have individually or collectively written to the Hon'ble Governor about their decision to withdraw support from the MVA-led government," the plea said. Prabhu submitted in his plea that the impugned directions ought not to have been issued without the aid and advice of the council of the ministers led by the Chief Minister. "It is surprising that the leader of the opposition admittedly meets the Governor at 10:00 pm on June 28, 2022, and the impugned communications are also of the same date. This only shows the undue haste with which the Hon'ble Governor has acted without even asking the CM for his views in respect of the political scenario in the State. "The impugned directions, it seems, have been issued on the 'aid and advice of the leader of the opposition, which is clearly not contemplated under the constitution," the plea said. The petition stated that there is absolutely no ground or material to call for an urgent floor test on June 30, 2022, when this court is already seized of parallel proceedings and wherein constitutional issues are to be decided. "The Governor with little or scant respect to the sanctity and dignity of this court has proceeded to go ahead and order a floor test in a clear attempt to shield the MLAs from the punishment entailed on account of the constitutional sin of defection. "The floor test, no doubt, is a constitutional mandate to ascertain who has the majority as our democracy is founded on the rule of the majority. An equally concomitant consideration and constitutional imperative in the Tenth Schedule of the Constitution which prescribes and outlines who can be entitled to vote or be a part of the Assembly," the plea said. Prabhu contended that the respondents in the disqualification petitions have already lost their membership on the day they voluntarily gave up their membership from Shiv Sena. "The disqualification proceedings under the Tenth Schedule are only a formal adjudication of this fact or otherwise of disqualification. The order of the Speaker/Deputy Speaker is an ex post facto recognition of the event of disqualification which had occurred at an anterior point of time," it said. Koshyari has asked the Maharashtra Legislature Secretary to hold a floor test of the <keyword id="8400868" type="General" weightage="20" keywordseo="MVA-government" source="Orion">MVA government</keyword> at 11 am on Thursday. The Governor's letter comes amid the rebellion in the ruling Shiv Sena by senior minister <keyword id="193503" type="General" weightage="20" keywordseo="eknath-shinde" source="Orion">Eknath Shinde</keyword>, who has been camping in Guwahati since last week with the majority of party legislators and several independent MLAs, which has pushed the government led by Thackeray, who is also the Sena president, into a crisis. In a unanimous verdict on a batch of pleas related to the political crisis that led to the fall of the Maha Vikas Aghadi (MVA) government led by Thackeray following a revolt by the <keyword id="193503" type="General" weightage="20" keywordseo="eknath-shinde" source="Orion">Eknath Shinde</keyword> faction, a five-judge Constitution bench headed by Chief Justice of India D Y Chandrachud held that House speaker's decision to appoint Bharat Gogawale of the Shinde faction as the whip of Shiv Sena was "illegal". "The governor was not justified in calling upon Thackeray to prove his majority on the floor of the House because he did not have reasons based on objective material before him to reach the conclusion that Thackeray had lost the confidence of the House," said the bench which also comprised Justices M R Shah, Krishna Murari, Hima Kohli and P S Narasimha. "However, the status quo ante can't be restored because Thackeray did not face the floor test and tendered his resignation. The governor was, therefore, justified in inviting Shinde to form the government at the behest of the BJP which was the largest political party in the house," it said. The top court also referred the 2016 Nabam Rebia verdict by a five-judge constitution bench, which relates to the power of speaker on disqualification of MLAs, to a larger bench of seven judges.

Eknath Shinde's newly formed government to seek vote of confidence today

The Governor has convened a Special Session of the Maharashtra Assembly Thursday with a single point agenda of a trust vote against Chief Minister <keyword id="53973" type="General" weightage="100" keywordseo="uddhav-thackeray" source="Orion">Uddhav Thackeray</keyword>. Maha crisis: Uddhav Thackeray government to face floor test tomorrow

Long stints in electoral politics and past experience in handling key government departments are the hallmarks of Congress-NCP-Shiv Sena legislators who took oath as ministers along with Maharashtra Chief Minister Uddhav Thackeray at the Shivaji Park here on Thursday evening. Thackeray is heading a coalition government, the Maha Vikas Aghadi (MVA), whose main constituents are the Sena, the Congress and the NCP. <keyword id="6360285" type="PERSON" weightage="20" keywordseo="chhagan-bhujbal">Chhagan Bhujbal</keyword>, Jayant Patil (both from the NCP), Balasaheb Thorat and Nitin Raut (both from the Congress), Eknath Shinde and Subhash Desai (both from the Sena) took oath as ministers along with Thackeray. Chhagan Bhujbal: Bhujbal (72) is a veteran figure in Maharashtra politics, who has the rare distinction of being associated with all the three major non-BJP parties in the state. A senior Nationalist Congress Party (NCP) leader, Bhujbal had been a member of both the Shiv Sena and the Congress at different times. Taking over as a minister is a sort of revival of his political fortunes after spending two years in jail since March 2016 in a money laundering case when the BJP-led government was in power. Bhujbal, who represents the OBC community, cut his political teeth in the Shiv Sena. He served as the Mayor of Mumbai, a Sena bastion, two times - 1985-86 and 1990-91. He quit the Sena in 1991, causing quite a stir in state politics, and joined the Congress. Bhujbal resigned from the Congress in 1999 and sided with Sharad Pawar who formed the NCP the same year. He became deputy chief minister in December 2008 and held key portfolios such as home affairs and public works in the Congress-NCP government. Jayant Patil: Jayant Patil (57) is perceived as a leader with a clean image. He took charge of the NCP's Maharashtra unit replacing Sunil Tatkare in April 2018, ahead of the crucial Lok Sabha and state Assembly polls. The NCP retained its tally in the 2019 April Lok Sabha election and fared better in the October Assembly polls, but the credit largely went to his boss, Pawar. Being part of a motley alliance of once-rival and ideologically divergent parties, Patil, known for composed demeanour, will be one of the key leaders who will be seen doing the trapeze act to ensure the three-party government sustains. Patil, son of well-known Maharashtra leader the late Rajaram Patil, held key portfolios like finance, home and rural development from 1999 to 2014 when the Congress-NCP combine ruled the state. Eknath Shinde: Shinde (55) is the most prominent face of the Sena in the adjoining Thane city from where has been elected consecutively four terms to the assembly. Considered a troubleshooter in the Sena, Shinde was the PWD minister in the previous BJP-led government (2014-19. Subhash Desai: One of the confidants of Uddhav Thackeray, Desai (77) is currently an MLC. The senior-most member of the cabinet had been a member of the assembly three times. Now serving his third term in the upper house of the legislature, Desai was the industries minister in the 2014-19 BJP-Sena government. Balasaheb Thorat: Congress leader Balasaheb Thorat (66) took charge of the party's state unit at a difficult time. When Thorat became the Maharashtra Congress chief in July this year, the party was already staring down the barrel after its Lok Sabha poll debacle in the state, once its citadel. It could win only one seat in the general election and was relegated to inferior position than its ally, the NCP. The Congress (44) though fared better in the Assembly elections, winning two more seats than its 2014 tally. The result may not be satisfactory for the party, which led the state several times in the past, a trusted lieutenant of the party's central leadership, Thorat ensured proper co-ordination in the state unit hit by factionalism. Thorat, known for maintaining a low profile, was first elected as an MLA from Sangamner in 1985 as an independent. In 1990, he contested Assembly poll on a Congress ticket and this is his eighth term as a legislator. He became a minister of state in 1999 and was promoted as a cabinet minister in 2004. The Congress legislature party leader has held revenue, agriculture, water conservation and protocol portfolios in the past. Nitin Raut: A key leader of the Congress from its erstwhile bastion of Vidarbha in eastern Maharashtra, Raut (62) is a four-term MLA. He is national chairman of the Congress's Scheduled Caste department and one of the working presidents of the party in Maharashtra. Hailing from Nagpur, Raut, too, comes with past experience in government. He has held animal husbandry, employment guarantee and water conservation departments so far.

Coal production has gone up, supply has improved, and attempts are being made to improve transmission lines. That’s laudable”, Kumar told reporters. 
 
Domestic <a href="http://www.businessinsider.in/searchresult.cms?query=coal+supply&amp;sortorder=effectivedate">coal supply</a> has improved and international coal prices have fallen over the last two years. Thermal power, which accounts for approx 70% of the country’s power generation, rose around 5% to 943 billion units in 2015-16. The country’s thermal power capacity has shot up more than 11% to 2,10,675 MW by March 2016. 
 
According to the government’s targets, the country’s transmission lines network will be expanded to a further 3,64,900 cKm by March 2017. The addition of 2,49,400 MVA transformation capacity during 2012-16, has been the highest ever in the country’s history. 
 
When asked about the country’s power challenges, Kumar said, “Wind power is under-utilized, renewable power should be more widely adopted and we’ll have to bring focus back to hydro-electric power. Coal and gas-based power plants must also be revived.” 
 
The current government has been conducting auctions to revive stranded gas-based plants.

Shinde, who presided over a meeting of Shiv Sena MLAs, MLCs and MPs on Wednesday, was kept in the loop about the fast-paced developments in the NCP which culminated in Ajit Pawar taking oath as deputy CM along with eight other ministers on July 2 in a stunning turn of events, they said. A section of Shiv Sena lawmakers had raised certain concerns after the NCP faction led by Ajit Pawar joined the one-year-old Shinde-BJP government. The induction of the rebel NCP group in the cabinet has dented the prospects of ministerial aspirants from the BJP and the Shiv Sena, leaving some of them upset and Shinde is aware of their sentiments Sena MP Gajanan Kirtikar said earlier in the day. Amid the changed politician equation, Shiv Sena MLAs and MPs on Wednesday night attended a meeting at Shinde's official residence 'Varsha' in south Mumbai. "A lot of issues were discussed in the meeting like the ones pertaining to the monsoon session of Parliament as well as in the state legislature, strengthening the party's organisation," said a party MP. Another party MP said Shinde was asked whether he know about the sudden developments in the NCP to which he responded in the affirmative. The MP said the political developments took place at a rapid pace due to which Sena lawmakers could not be informed about them in advance. The chief minister stressed the Ajit Pawar-led NCP group joining the ruling alliance will only help the party lawmakers, the MP added. "He said there was nothing to worry as the BJP and the Shiv Sena have been in the government for a year now and the NCP (faction led by Ajit Pawar) joining the government will not affect its functioning in anyway," a Shiv Sena MLC said. Last year, more than three dozen Shiv Sena MLAs, led by Shinde, had revolted against party president Uddhav Thackeray over his decision to join hands with the the NCP and the Congress which crystallised in formation of the <keyword id="8357634" type="General" weightage="20" keywordseo="maha-vikas-aghadi" source="Orion">Maha Vikas Aghadi</keyword> (MVA) government in 2019. They had also alleged Ajit Pawar, who was the finance minister in the erstwhile MVA government, did not allocate enough funds for development of their constituencies. Earlier in the day, Sena MP Kirtikar told PTI, "The scope of ministerial aspirants from the BJP and the Shiv Sena minimised after the NCP (rebel faction) joined the government. This has upset some MLAs. The chief minister was aware of this." With the induction of nine ministers from the <keyword id="17888465" type="General" weightage="20" keywordseo="ajit-pawar-camp" source="Orion">Ajit Pawar camp</keyword>, the strength of the Shinde-Fadnavis cabinet has gone up to 29, leaving 14 posts still vacant. On Tuesday, Shiv Sena spokesperson and MLA Sanjay Shirsat indicated there was some uneasiness in a section of the party after the latest political development. "Party (Shiv Sena) workers and supporters have started asking us how and why did Ajit Pawar and his group join the government? They said will it shrink their political space in the state. But I can assure you that Ajit Pawar joining the government was inevitable," Shirsat said.

A chartered flight carrying <keyword id="6358821" type="General" weightage="80" keywordseo="shiv-sena" source="Orion">Shiv Sena</keyword> MLAs, who have rebelled against the party bringing a crisis to the MVA government in <keyword id="13126" type="General" weightage="100" keywordseo="maharashtra" source="Orion">Maharashtra</keyword>, arrived here early Wednesday. Sources said that the flight from Surat in Gujarat landed at Guwahati's Lokapriya Gopinath Bordoloi international airport at around 6.30 am. The exact number of rebel Shiv Sena MLAs travelling in the flight is not known immediately but the flight had 89 passengers, including onboard crew, sources said. The Maharashtra MLAs are being taken in special buses to a city hotel with police protection. Assam is currently ruled by a BJP-led government. The move came after <keyword id="8524279" type="General" weightage="50" keywordseo="shiv-sena-minister" source="Orion">Shiv Sena minister</keyword> <keyword id="193503" type="General" weightage="50" keywordseo="eknath-shinde" source="Orion">Eknath Shinde</keyword> rebelled against the party and herded some MLAs to BJP-ruled Gujarat. This is perhaps for the first time that MLAs from a Western Indian state is being taken to a Northeastern state after their rebellion against the party leadership. The Shiv Sena, which heads the MVA, has 55 MLAs, followed by allies NCP (53) and the Congress (44) in the 288-assembly where the current simple majority mark is 144. Rebel Sena MLAs arrive in Assam as Maharashtra political crisis continues

Ahead of his possible resignation, Chief Minister <keyword id="53973" type="General" weightage="20" keywordseo="uddhav-thackeray" source="Orion">Uddhav Thackeray</keyword> started making 'final calls' after his emotional challenge to the rebels previous evening that he was ready to quit the post (CM) as well as <keyword id="110829" type="General" weightage="20" keywordseo="shiv-sena-chief" source="Orion">Shiv Sena chief</keyword>, here on Thursday. Simultaneously, alliance partner Nationalist Congress Party (<keyword id="42402" type="General" weightage="20" keywordseo="ncp" source="Orion">NCP</keyword>) state President and Minister Jayant Patil ruled out the possibility of the CM's demitting office and expressed optimism that the political crisis would be defused. On Wednesday evening, Thackeray addressed the state via social media and expressed his readiness to step down from both crucial posts provided the rebels led by Minister Eknath Shinde come to meet him and say they don't want him to continue. However, Shinde promptly spurned the CM's offer, reiterating his pre-condition that the Shiv Sena must first walk out of its Maha Vikas Aghadi (MVA) alliance government with the NCP and Congress. Hours after that, late on Wednesday, Thackeray and family packed up their bags and left the CM's official residence 'Varsha' at Malabar Hill and returned to the family home, 'Matoshri' in Bandra. Prior to that, he also held meetings with NCP President Sharad Pawar and NCP state chief Patil, Congress leaders including state President Nana Patole and central leader Kamal Nath, besides other senior Sena leadership. Thackeray is scheduled to address an online meeting of all top Mantralaya bureaucrats this day ostensibly to express his gratitude for their cooperation and contributions during the 30-month tenure of the MVA regime. The political suspense continued with Sena MP Sanjay Raut claiming in Mumbai that "around 20 MLAs" from the rebel group were in contact with the party leaders, besides the 15-odd currently in Mumbai. "About 20 MLAs are in touch with us... When they come to Mumbai, you will get to know. We will reveal soon under what circumstances and pressures these (rebel) MLAs left us," declared Raut. Mumbai, June 22 (IANS) Maharashtra Chief Minister <keyword id="53973" type="General" weightage="20" keywordseo="Uddhav-Thackeray" source="Orion">Uddhav Thackeray</keyword> late on Wednesday vacated his official residence 'Varsha' at Malabar Hill to return to his private home 'Matoshri' in Bandra along with his family. The move came hours after his emotional appeal to the rebel group of Shiv Sena MLAs, led by Minister Eknath Shinde, that he (Thackeray) was ready to quit both as as CM and as party President, provided the rebels met him and made the demand. Thackeray - who tested Covid-19 positive this morning - also said that he had kept his resignation letter ready and any of the rebels could go and hand it over to the Governor. On his part, Shinde responded by saying that steps would have to be taken for Hindutva and reiterated his demand to break off with the Nationalist Congress Party and Congress to form the government with the Bharatiya Janata Party. The crisis shows no sign of defusing despite effects by the MVA allies, the offer to quit by the CM, and even his decision to vacate his official residence.

<keyword id="14264235" type="General" weightage="20" keywordseo="rebel-shiv-sena" source="Orion">Rebel Shiv Sena</keyword> MLA Sanjay Shirsat has written a letter to Maharashtra Chief Minister <keyword id="53973" type="General" weightage="20" keywordseo="uddhav-thackeray" source="Orion">Uddhav Thackeray</keyword>, claiming that state minister <keyword id="193503" type="General" weightage="20" keywordseo="eknath-shinde" source="Orion">Eknath Shinde</keyword> took the step of going against the party leadership as Sena MLAs, who faced "humilitation" for the last two-and-a-half years, persuaded him to do so. While the <keyword id="6358821" type="General" weightage="20" keywordseo="shiv-sena" source="Orion">Shiv Sena</keyword> legislators had no access to the chief minister, the Congress and NCP, which are the "real opponents" of the Sena, were getting all the attention, he claimed in the letter, dated June 22. The Sena shares power with the NCP and Congress in Maharashtra. Shirsat, the MLA from Aurangabad (West) Assembly constituency, in the letter claimed that despite the Shiv Sena being in power and having its own chief minister, the coterie around Thackeray never allowed them access to 'Varsha', the CM's official residence. There was no question of going to 'Mantralaya', the state secretariat, because the chief minister never came there, he said. The letter was posted by Shinde on his Twitter handle, claiming these were the sentiments of the Sena MLAs. Shinde is currently camping with some rebel MLAs in Assam's Guwahati city, plunging the Sena-led Maharashtra government into a crisis. In the letter, Shirsat said Eknath Shinde opened doors for the party MLAs to listen to their grievances, issues about development work in their constituencies and related fund, and problems with allies Congress and NCP. "Only Shinde heard us out and took steps to resolve all the problems. The party MLAs persuaded Shinde to take this step (of revolt) for the rights of all the legislators," Shirsat said in the letter. While the Shiv Sena legislators had no access to the chief minister, the Congress and NCP, which are the "real opponents" of the Shiv Sena, were getting all the attention, he claimed. "The Shiv Sena votes did not split in the Rajya Sabha polls, then why so much distrust in us for the Legislative Council polls?" he asked. The Shiv Sena-led tripartite Maha Vikas Aghadi (MVA) in Maharashtra was trumped by the BJP in the Rajya Sabha polls to six seats from the state on June 10, when the Sena's second candidate, Sanjay Pawar, lost to BJP's Dhananjay Mahadik. In the MLC polls to 10 seats held on June 20, the MVA again suffered a setback when it lost one out of the six seats it contested. The opposition BJP in the state won all the five seats which it had contested. Referring to the show of strength by Shiv Sainiks at 'Varsha' on Wednesday, Shirsat in the letter said, ''The doors of Varsha opened for the common people in the real sense yesterday. These doors were closed for us despite being the Shiv Sena MLAs." "The cotorie around you never allowed us access to you. Whenever we got a call from 'Varsha' that you would like to meet us, we were made to wait for several hours by your cotorie. They never took our calls...why should we be humiliated like this despite being elected by three to four lakh people?" the legislator sought to know. Shirsat also said the party MLAs were not allowed to accompany Maharashtra cabinet minister Aaditya Thackeray (the CM's son) to Ayodhya (in Uttar Pradesh during his visit on June 15). ''Aren't Hindutva, Ram Mandir, Ayodhya Shiv Sena's core issues? Then why we were stopped from accompanying Aaditya Thackeray to Ayodhya?" he asked. The legislator further said he had checked in his luggage at the airport when he was told that the CM has said no MLA will accompany Aaditya Thackeray (on his Ayodhya visit). "The Shiv Sainiks at the grassroot would question us as to how our real opponents Congress and NCP get access to you and to the development funds despite the chief minister being ours," Shirsat said. "We would have a tough time answering our voters and workers why the Shiv Sena legislators were sidelined despite being in power. In all our tough times, Shinde stood by us, which is the reason we are with him today,'' he added.
