To protect online consumers, the government has made it mandatory for e-commerce companies from January 2018 to print not only the <keyword id="6357388" type="ORGANIZATION" weightage="100" keywordseo="MRP">MRP</keyword> on goods but also information like expiry date and <keyword id="416598" type="UNKNOWN" weightage="100" keywordseo="customer-care">customer care</keyword> details, according to PTI news report. An amendment in this regard has been made to the <keyword id="846883" type="UNKNOWN" weightage="20" keywordseo="Legal-Metrology">Legal Metrology</keyword> (Packaged commodities) Rules, 2011 by the consumer affairs ministry last month. A six-month deadline has been given to the companies to comply with the new rule. "Consumers deserve the same protection online as offline. At present, only MRP (maximum retail price) is printed on the goods sold online. We have asked the companies to declare additional details on the label," a senior official in the consumer affairs ministry said. Along with MRP, the companies have to declare manufacturing date, expiry date, nquantity, country of origin and consumer care details on the label, he said. Enough time has been given to the companies for complying with the new norms. From January 2018, it is must that goods sold via e-commerce platform should have all these declarations else the companies will face stringent action, the official said. The companies have to make these declarations in bigger font size so that consumers can easily read the same. The changes come in the backdrop of e-marketplaces posing new and complex consumer protection issues with the ministry receiving several complaints as regard to information deficit on online products/goods. Flipkart, Amazon India, <keyword id="541988" type="COMPANY" weightage="20" keywordseo="SnapDeal">Snapdeal</keyword>, Grofers and Bigbasket are some of the leading e-marketplaces entities operating in the country.

"The matter is being given utmost priority by both the ministries," said the official. "We will start this process at one place and then it will gradually spread out across the country in phases."

The Indian Government has asked companies not to sell mineral water bottles at higher MRPs at airports, malls and cinemas. Under the <keyword id="846883" type="UNKNOWN" weightage="20" keywordseo="Legal-Metrology">Legal Metrology</keyword> (Packaged Commodities) Rules, 2011, companies won’t be able to charge a higher MRP from Jan 01, 2018 onward. "Based on the experience of implementation of the rules and after a detailed stakeholder consultation, the department has amended the rules, aimed at enhanced consumer protection, but at the same time balancing with the requirement of ease of doing business," a statement from consumer affairs department read. There won’t be any dual MRPs on an identical pre-packaged commodity, which is going to benefit consumers at large. However, the rule won’t be applicable for restaurants. "This won't be applicable to restaurants as under GST they come under the category of supplier services. And the latest notification is applicable for retail services where customer buy off the counter," said Rahul Singh, secretary, <keyword id="146581" type="ORGANIZATION" weightage="20" keywordseo="National-Restaurant-Association-of-India">National Restaurant Association of India</keyword> (NRAI). Also, medical devices such as stents, valves, orthopaedic implants, syringes and tools for operations will have to display MRP. "This is to raise awareness, because the customer has a right to know what the prices (of these medical devices are)," Jai Priye Prakash, secretary, department of pharmaceuticals (DoP), told ET. So far, it was not mandatory for all medical devices declared as drugs to make mandatory declarations under the legal metrology rules. Some medical device manufacturers have welcomed the move. "Consumers were facing difficulty as devices were sold according to the paying capacity of the consumer. Even after capping of MRPs, many companies were not displaying (the MRP)," the department of consumer affairs said.

Government is considering changing the <keyword id="3588792" type="UNKNOWN" weightage="100" keywordseo="2011-commodities-packaging-rules">2011 commodities packaging rules</keyword> so that the details on the packaged food items are printed in a more visible and readable manner. The change would also mean incorporating a barcode-kind of system so that consumers can be safeguarded from spurious products. 
 The Legal Metrology (Packaged Commodities) Rules 2011 states the font size that need to be printed on the packets of consumable items, but most companies do not follow strictly, leading to font size being unreadable. This is why the US standard on font size is under consideration, said a senior official from the <keyword id="128131" type="ORGANIZATION" weightage="100" keywordseo="Consumer-Affairs-Ministry">Consumer Affairs Ministry</keyword>. 
 
The font size for a food packet ranging from 200 grams/ml up to 500 grams/ml would be doubled, from 2 mm to 4 mm, while packets above that would have a font size of 8 mm. 
 
Coming to the barcode, this would help the government in distinguishing products made in India from those made in other countries, so that sale of fake food items can be stopped.

The <keyword id="25455" type="General" weightage="80" keywordseo="finance" source="Orion">Finance</keyword> Minister released a list of items that will not attract any GST, when sold loose, and not pre-packed or pre-labeled. In a series of tweets, she said: "Recently, the GST Council in its 47th meeting recommended to reconsider the approach for imposition of GST on specified food items like pulses, cereals, flour, etc. There have been a lot of misconceptions about this that have been spread. Here is a thread to lay the facts." "Is this the first time such food articles are being taxed? No. States were collecting significant revenue from foodgrain in the pre-GST regime. Punjab alone collected more Rs 2,000 cr on food grain by way of purchase tax. UP collected Rs 700 cr," she said. "Taking this into account, when GST was rolled out, a GST rate of 5% was made applicable on BRANDED cereals, pulses, flour. Later this was amended to tax only such items which were sold under REGISTERED brand or brand on which enforceable right was not foregone by supplier," the FM said. "However, soon rampant misuse of this provision was observed by reputed manufacturers &amp; brand owners and gradually GST revenue from these items fell significantly. This was RESENTED by suppliers and industry associations who were paying taxes on branded goods. They wrote to the Govt to impose GST uniformly on all packaged commodities to stop such misuse. This rampant evasion in tax was also observed by States." "The Fitment Committee - consisting of officers from Rajasthan, West Bengal, <keyword id="20154" type="General" weightage="80" keywordseo="tamil-nadu" source="Orion">Tamil Nadu</keyword>, Bihar, Uttar Pradesh, Karnataka, Maharashtra, Haryana, and Gujarat - had also examined this issue over SEVERAL meetings and made its recommendations for changing the modalities to curb misuse. "It is in this context that the GST Council in its 47th meeting took the decision. With effect from July 18, 2022, only the modalities of imposition of GST on these goods was changed with no change in coverage of GST except 2-3 items," said the minister. "It has been prescribed that GST on these goods shall apply when supplied in 'pre-packaged and labelled' commodities attracting the provisions of Legal Metrology Act." "For example, items like pulses, cereals like rice, wheat, and flour, etc, earlier attracted GST @ 5% when branded and packed in unit container. New Delhi, The <keyword id="76562" type="COMPANY" weightage="20" keywordseo="Confederation-of-All-India-Traders">Confederation of All India Traders</keyword> (CAIT) in a communication sent to Union Commerce Minister <keyword id="6355222" type="PERSON" weightage="20" keywordseo="piyush-goyal">Piyush Goyal</keyword> demanded <keyword id="2465241" type="PERSON" weightage="20" keywordseo="immediate-action">immediate action</keyword> against e-commerce entities including <keyword id="18635" type="CITY" weightage="20" keywordseo="Amazon">Amazon</keyword>, <keyword id="6354742" type="COMPANY" weightage="20" keywordseo="Flipkart">Flipkart</keyword>, <keyword id="830092" type="COMPANY" weightage="20" keywordseo="Zomato">Zomato</keyword>, <keyword id="6358977" type="UNKNOWN" weightage="20" keywordseo="swiggy">Swiggy</keyword> and others. "It is a case of daylight robbery of e-commerce entities in India and therefore demand immediate action against the erring e-commerce portals and online mechanism providers," CAIT said. CAIT has accused Amazon, Flipkart, Zomato, Swiggy and various other e-commerce entities for violation of mandatory display of Country of Origin and Manufacturer, seller Details on products sold through their respective E-Commerce Portals as required under the Consumers Protection (E Commerce) Rules,2020, Legal Metrology (Packaged Commodities) Act, 2011 and guidelines of Food Safety &amp; Standards Authority of India. "It is a case of daylight robbery of e-commerce entities in India and, therefore demands immediate action against the erring e-commerce portals and online mechanism providers," CAIT said. CAIT National President B.C. Bhartia and Secretary General Praveen Khandelwal in a communication to Goyal said that e-commerce entities conducting business in India including Amazon, Flipkart and others are highly violating the mandatory conditions spelled out in above Acts. "It is a pity that particularly in e-commerce every guidelines, Rules &amp; Regulations, Laws and policies are being flouted openly and no department has so far taken any cognizance of compliance issues resulting in a highly vitiated and mess like e-commerce trade of India," CAIT said. Bhartia and Khandelwal said that Rule 10 of Legal Metrology (Packaged Commodities) Rules, 2011 provide that e-commerce entities should have to display name and address of the manufacturer, name of the country of origin, common/generic name of the product, net quantity, best before/use by date (if applicable), maximum retail price, dimensions of the commodity, etc. This rule was introduced in June 2017 and provided a transition period of six months thereby its implementation from January 1,2018 but even after a lapse of three years, the above rules are not being complied by e-commerce companies prominently by Amazon, Flipkart, etc. Failure to make declarations as above will amount to selling non-standard packages and will invite penalty under the above said Act, including fine or imprisonment or both, CAIT said. Both trade leaders further said that similar obligations were imposed on e-commerce food business operators vide guidelines issued by the Food Safety &amp; Standards Authority (FSSAI) on February 2,2017. "But such FBOs like Zomato, Swiggy, etc. are not complying with the above rules," CAIT said. Bhartia and Khandelwal said that under Rule 4(2) of the Consumer Protection (E Commerce) Rules, 2020, it is provided that every e-commerce entity shall provide the following information in a clear and accessible manner on its platform, displayed prominently to its users, namely, legal name of the e-commerce entity, principal geographic address of its headquarters and all branches, name and details of its website, and contact details like email address, fax, landline and mobile numbers of customer care as well as of grievance office. Similar provisions are also spelled out in Press Note 2 of the FDI Policy, 2016. CAIT said no e-commerce entity has appointed a Nodal Officer as also complying with above provisions. Important rights of the consumers are being violated as they are not aware of the seller or description of the product at the time of purchase of products from e-commerce portals. CAIT seeks action against Amazon, Zomato, Flipkart and Swiggy for 'daylight robbery'

New Delhi, In a bid to ensure the availability of <keyword id="9418" type="PERSON" weightage="20" keywordseo="masks">masks</keyword> and hand <keyword id="1015112" type="PERSON" weightage="20" keywordseo="sanitisers">sanitisers</keyword> in the market and their sale at MRP in the wake of the coronavirus outbreak in the country, the Central government has decided to bring both the commodities under the Essential Commodities Act, 1955. The Union Ministry of Consumer Affairs said in a statement on Friday that in view of the coronavirus (Covid-19) outbreak and concerns over the logistics for Covid-19 management, particularly during the last couple of weeks, masks (2 ply and 3 ply surgical masks, N95 masks) and hand sanitisers have been noted to be either not available with most of the vendors in the market or are available at exorbitant prices, the government has notified an order under the Essential Commodities Act to declare these two items as essential commodities up to June 30, 2020 by amending the schedule of the Essential Commodities Act, 1955. The ministry has also issued an advisory under the Legal Metrology Act. Under the Essential Commodities Act, after discussions with the manufacturers, the states can ask them to enhance their production capacity to make the supply chain smooth, while under the Legal Metrology Act, the states can ensure the sale of both the items at MRP. The states may now notify the Central order in their official gazette and also issue their own orders under the Essential Commodities Act to that effect and take necessary actions as per the situation prevailing in the respective states, the ministry said. --IANS pj/arm

(Eds: Adds details ) New Delhi, Mar 13 () The government on Friday declared face masks and hand sanitizers as essential commodities for the next 100 days as it stepped up efforts to boost supply and prevent hoarding of these items in its fight to check spread of coronavirus disease. The Centre has also invoked Disaster Management Act to ensure price regulation and availability of surgical and protective masks, hand sanitizer and gloves. Both masks (2ply &amp; 3 ply surgical masks, N95 masks) and hand sanitisers have been brought under Essential Commodities Act, 1955, empowering States to regulate production, distribution and prices of these items and also crackdown on hoarding and blackmarketing. "Government has notified an order under the Essential Commodities Act to declare these items as essential commodities up to June 30, 2020, by amending the schedule of the Essential Commodities Act 1955," the Consumer Affairs Ministry said in a statement.The decision would empower the government and States/UTs to regulate production, quality and distribution of masks and hand sanitizers for smooth sale and availability of these items. It also empowers to carry out operations against speculators and those involved in over pricing and black marketing."It will enhance the availability of both the items to the general people at reasonable prices or under MRP (maximum retail price)," the ministry said. The government pointed out that masks and hand sanitizers are either not available in the market or are available with great difficulty at exorbitant prices, in view of the ongoing outbreak of COVID-19.The government has also issued an advisory under the Legal Metrology Act.Under the EC Act, state governments can ask manufacturers to enhance their production capacity of these items for augmenting supply, while States can ensure sale of both the items at MRP under the Legal Metrology Act.States can now notify the central order in their official gazette and also issue their own orders under the EC Act depending on the situation, the ministry said.They may take action against offenders under the EC Act and PBMMSEC Act (Prevention of Blackmarketing and Maintenance of Supplies of Essential Commodities Act) 1980. An offender under the EC Act can be punished with an imprisonment of up to seven years or fine or both. Under the PBMMSEC Act, one can be detained for maximum six months.Meanwhile, the Centre has also invoked Disaster Management Act to ensure price regulation and availability of surgical and protective mask, hand sanitizer and gloves.Amid reports of non-availability and black marketing of surgical and protective masks, sanitizers and gloves and as a measure of preparedness to address the challenge of outbreak of COVID-19, the health ministry has mandated the National Pharmaceutical Pricing Authority (NPPA) to notify these items as drugs. "In pursuance of directions conveyed by Ministry of Health and Family Welfare vide order dated 13.03.2020 under clause (I) of sub-section (2) of section 10 of the Disaster Management Act, 2005, National Pharmaceutical Pricing Authority has been mandated to regulate the availability and prices of the Surgical and protective masks, Hand sanitizers and Gloves," the pharmaceuticals department under the Chemicals and Fertilisers Ministry said. The NPPA has directed all State /UT governments to take necessary steps to ensure sufficient availability of surgical and protective masks, hand sanitizers and gloves at prices not exceeding the MRP printed on the pack size. State/UT Governments have also been directed to monitor the production and distribution of above mentioned items by the Manufacturers/ Importers, Stockists and Retailers and ensure that hoarding, black marketing and profiteering may not happen.The EC Act was established to ensure the delivery of certain commodities or products, the supply of which, if obstructed owing to hoarding or black-marketing, would affect the normal life of people. This includes foodstuffs, drugs, fuels (petroleum products).The Act itself does not lay out rules and regulations but allows the states to issue control orders related to dealer licensing, regulate stock limits, restrict movement of goods and requirements of compulsory purchases under a levy system. Govt notifies hand sanitizers, surgical masks, gloves as essential commodities

New Delhi, Jul 7 () India's drugs regulator has asked drug controllers in states and Union Territories to keep a strict vigil to prevent black marketing of the anti-viral Remdesivir injection, approved for emergency and restricted use to treat COVID-19 patients. Drugs Controller General of India (DCGI) Dr V G Somani said in a communication to Drugs Controllers in states and UTs that his office received a letter raising concerns that certain unscrupulous persons were indulging in black marketing and over-pricing of the drug. He said the complaint was received from LocalCircles, a community engagement and social media platform, through the ministry of health. The Central Drugs Standard Control Organisation (CDSCO) has approved restricted emergency use of Remdesivir injectable formulation for treatment of patients with severe COVID-19 infection subject to various conditions and restrictions, Somani said in his letter on Monday. Initially, Remdesivir formulation of the innovator was approved on June 1 for import and marketing in the country. However, the importer is yet to bring it to India after taking import license from the CDSCO. Subsequently, the CDSCO has granted permission to manufacture and market the drug to Cipla, Hetero, and Mylan laboratory for same indication, conditions and restrictions, the letter stated. "In view of the above, you are requested to instruct your enforcement officials to keep strict vigil on the matter to prevent the black marketing and sale of the drug Remdesivir injection above MRP. "Action taken in the matter may please be intimated to this office at the earliest," Somani said in his letter addressed to state and UT drug controllers. The Union Health Ministry in its Clinical Management Protocols for COVID-19' has allowed the use of Remdesivir for restricted emergency purposes in patients in the moderate stages of the COVID-19 disease under "investigational therapies". The LocalCircles in its letter said that it received many posts and comments from citizens across India on its platform about the alleged black marketing of Remdesivir. "The MRP of Remdesivir marketed by Hetero Healthcare Limited is Rs 5,400 but consumers have reported it being sold at a price of anywhere between Rs 15,000 to 60,000," the LocalCircles said. "Various medical shops have been telling buyers that the medicine is in short supply but can be made available if they are ready to pay a premium. This is putting an extreme pressure on the families of many critical patients who are trying hard to somehow secure the medicine. "It has also been reported that doctors at many private hospitals are directing families to procure and get the medicine themselves," it said. In a survey conducted by LocalCircles, which received 8,329 responses, 93 per cent consumers from 233 districts of India said the legal metrology and drug inspectors should be directed to immediately act against such black marketing of the Remdesivir, which at this point in time, could be termed as a life-saving drug, the letter mentioned. COVID-19: Central drugs regulator asks states, UTs to prevent black marketing of Remdesivir

New Delhi, Dec 10 () The government is aware of the problems faced by exporters and efforts are being taken to boost exports, including to emerging markets through preferential and free trade agreements, Union Minister Hardeep Singh Puri said on Tuesday.
Addressing an event organised by Engineering Export Promotion Council (EEPC), the minister said he had a meeting with member exporters from EEPC India in August, based on which a short and medium-term strategy for enhancing engineering shipments has been formulated.
"Efforts are also being undertaken to increase our exports to emerging markets of Africa, Latin America through PTAs/FTAs (preferential/free trade agreements)," the Minister of State for Commerce said.
In essence, we are trying to provide whatever support you, as exporters, need from the government, Puri said.
Based on feedback from EEPC India, non tariff barriers for engineering sector have been identified, including the list of countries where test reports of the Central Power Research Institute are not accepted, he noted.
"These have been shared with the concerned territorial divisions of the Department for taking them up bilaterally with the concerned country/region, for resolving the issues expeditiously," the minister said.
Outlining the measures taken by the government to enhance exports, the minister said a fully electronic refund module for quick and automated ITC (income tax credit) online refund system is now in place, and the remission of duties for taxes on export products (RoDTEP) scheme, which will replace the Merchandise Exports from India Scheme (MEIS), has already been announced.
We are framing a new scheme known as NIRVIK to provide higher insurance coverage to banks on their export credit to Export Credit Guarantee Corporation (ECGC), Puri said.
The scheme NIRVIK (Niryat Rin Vikas Yojana) will provide more comfort to banks to lend to exporters.
He also observed that action is being initiated to establish accredited labs to International Organisation of Legal Metrology either through Petroleum and Explosives Safety Organisation (PESO) or any other certifying agency for facilitating export of measuring equipments. RSN BAL

Efforts being made to boost exports: Minister

The government has asked e-commerce companies to compulsorily declare the expiry dates and maximum retail prices (MRP) of packaged consumer products that they display online, so that consumers can be protected from being sold old goods. In a notification dated June 23rd, the <keyword id="393956" type="ORGANIZATION" weightage="100" keywordseo="Ministry-of-Consumer-Affairs">Ministry of Consumer Affairs</keyword> made an amendment to the Legal Metrology (Packaged Commodities) Rules, 2011, mandating e-commerce companies and online marketplaces to display the expiry date, the MRP, and the country of origin of the products being sold on their platforms. The rules will come into effect from January 1, 2018. "An ecommerce entity shall ensure that the mandatory declarations as specified, except the month and year in which the commodity is manufactured or packed, shall be displayed on the digital and electronic network used for ecommerce transactions," states the Legal Metrology (Packaged Commodities) Amendment Rules, 2017. Indian soldier tests positive in Ladakh An Indian Army soldier has been placed in an isolation ward at a hospital in Ladakh after he was found infected with coronavirus, sources in the Army told IANS. It is the first positive case of coronavirus in the Army. The Ladakh Scouts soldier is currently admitted in the SNM hospital in Ladakh. It was found that the soldier’s father had a travel history to Iran and has also tested positive. His father is also undergoing treatment at a Ladakh hospital. UP government to provide aid to daily wagers As the UP government extended the shutdown in the state due to the COVID-19 scare on Tuesday (March 17), it announced that it would provide financial assistance to daily-wage labourers in the state who will be hit by the shutdown. UP chief minister Yogi Adityanath decided to form a high-level committee under the chairmanship of Finance Minister Suresh Khanna, comprising agriculture and labour ministers, to decide the nature of the assistance to the labourers. “There is a section of poor people who go out for work daily to eke out a living, but these restrictions could affect their livelihood. In order to ensure that the daily-wage labourers are not affected, a three-member committee has been formed under the chairmanship of the state finance minister.” The committee will submit its report to the Chief Minister in three days. Goa government-issued health advisory and seized over 1000 spurious masks The Goa government on Tuesday (March 17) issued a health advisory on the usage of anti-coronavirus masks, even as a series of raids conducted by the Goa government’s legal metrology department resulted in the seizure of more than 1000 spurious masks. The mask usage guidelines were introduced in Goa, which has been emulated from the advisory issued by the Union Ministry of Health and Family Welfare, urging people not to wear masks unnecessarily. It also recommends private sector employers to explore the possibility of getting employees to work from home. The guidelines also lay down methods for selection of the right quality masks as well as its disposal once used. Meanwhile, in a series of raids department, more than a 1,000 spurious masks, many of them touted to be of the N-95 specification, were seized. Bengal reported its first case A first confirmed novel coronavirus case was detected in West Bengal on Tuesday (March 16), as a youth who returned from the UK recently tested positive. The patient had a sore throat and a slight cold and was being given supportive treatment for the symptoms. The 18-year-old youth, who came back from the UK on March 15, was admitted to the state’s referral hospital for infectious diseases ID Hospital, Beliaghata, on Tuesday morning. His sample, sent to the National Institute of Cholera and Enteric Diseases (NICED), was found to be positive in the evening. Karnataka’s infected number at 11 after woman tests positive A 67-year-old woman tested positive for coronavirus, taking the total number of cases in Karnataka to 11, state Health Minister B. Sriramulu said on Tuesday. “The 11th victim who tested positive is a resident of Bengaluru and returned to the city from Dubai via Goa on March 9. She is a known case of chronic kidney disease,” Sriramulu said in a tweet. Though the woman was in home isolation since returning from Dubai, she was admitted to a designated hospital on Monday. “In all, 21 high-risk contacts have been identified, including five family members. They all are under strict home quarantine,” the minister said. Railways cancel 85 trains over COVID-19 crisis Following the coronavirus outbreak, the Indian Railways on Tuesday (March 17) cancelled 85 trains due to low occupancy in different zones from March 18 to April 1. A senior Railway Ministry official said the decision to cancel the trains was taken in view of the low occupancy amid the coronavirus outbreak in several states. An official said that Central Railway cancelled 23 trains, followed by South Central Railway cancelling 29 trains, Western Railways cancelling ten trains, northern Railways five, North Western Railways four, East Coast Railways five and South Eastern Railways cancelling nine trains from March 18 to April 1.
