HEDGEYE: One Of The Most Polarizing Companies In Finance Is Suing A Stay-At-Home Dad For Defamation

<p>Two of <keyword id="6354616" type="CITY" weightage="60" keywordseo="Twitter">Twitter</keyword>'s most notorious characters, <keyword id="1739206" type="UNKNOWN" weightage="60" keywordseo="Keith-McCullough">Keith McCullough</keyword>, the CEO of <keyword id="1862411" type="UNKNOWN" weightage="60" keywordseo="Hedgeye">Hedgeye</keyword>, and anonymous financial blogger ZeroHedge <a href="https://twitter.com/zerohedge/status/377188719230337025">got in an epic spat on Twitter</a> last night and it's still continuing this morning. </p>
<p>ZeroHedge is famous for his relentless gloom and mockery of the financial and political system.</p>
<p>McCullough is known for trumpeting his endless #timestamps, and for attacking the traditional Wall street system.</p>
<p>ZeroHedge started the fight when he called out McCullough on his 26-year-old energy analyst Kevin Kaiser's bearish call last week on Kinder Morgan.  A lot of people on Wall Street <a href="http://www.businessinsider.com/kevin-kaiser-causes-kinder-morgan-sell-off-2013-9">have been criticizing that call</a> that knocked $4 billion off the company's market cap. </p>
<p>McCullough defended his analyst by pointing out that they were right on Linn Energy ($LINE).  ZeroHedge snapped back by hinting that they got the idea from The Value Investors Club, a website<span> where people post different investment picks.</span></p>
<p><span></span><span>Then McCullough whipped out his classic "timestamp" phrase on ZeroHedge telling him to timestamp his trade ideas.  ZeroHedge used that opportunity to make a swipe at Hedgeye's business model saying that they are "based on daytrading hedge fund hotel ideas without capital at risk." (Burn!)</span></p>

Two Of The Most Notorious Folks On Financial Twitter Got Into A Huge Fight Last Night

<ul class="summary-list"><li>Stubborn inflation, sluggish growth, and further rate hikes may tank stocks, one strategist says.</li><li>Hedgeye's Keith McCullough says strong momentum and positive sentiment may pave the way for a crash.</li></ul><p>A triple-whammy of resurgent inflation, depressed growth, and further hikes to interest rates could tank the US stock market, one strategist says.</p><p>Inflation has plunged from over 9% last summer to about 3% in recent months, but it still remains above the Federal Reserve's 2% target. Some experts have <a href="https://markets.businessinsider.com/news/stocks/us-inflation-outlook-forecasts-recession-hanke-krugman-erian-fed-rates-2023-7">declared the threat is over</a>, but Hedgeye Risk Management CEO Keith McCullough expects price growth to accelerate to 3.5% and remain elevated for a while, he <a href="https://www.marketwatch.com/story/own-what-the-mother-of-all-bubbles-crowd-doesnt-this-market-strategist-expects-stagflation-and-is-investing-for-it-now-64193143?mod=home-page" target="_blank" rel="noopener">told MarketWatch</a> in a recent interview.</p><p>The Fed has hiked interest rates from almost zero to over 5% since last spring in a bid to curb the pace of price increases. Higher rates encourage saving over spending and increase borrowing costs, meaning they can sap demand, pull down asset prices, and even drag an economy into recession.</p><p>While some investors <a href="https://www.businessinsider.com/investing-strategy-bond-market-fed-cuts-rates-treasurys-10yr-yields-2023-8">expect the central bank to reverse its hikes soon</a>, McCullough predicts a rate increase in September, and potentially another in November as inflation proves stubborn.</p><p>"This is a major catalyst for the next leg down in the equity market," he said. "When the Fed tightens into a slowdown, things blow up."      </p><p>"I don't think the Fed cuts interest rates until the stock market crashes," he added, noting that a combination of strong momentum and positive sentiment toward stocks has laid the groundwork for a severe sell-off.</p><p>The market strategist suggested a few ways for investors to avoid the "heart-attack risk" of holding US stocks.</p><p>"Own what the 'Mother of All Bubbles' crowd doesn't," he told MarketWatch, highlighting gold and Japanese stocks as two alternatives.</p><p>Moreover, McCullough cautioned against staking money on an economic rebound when conditions are still fraught.</p><p>"Now everyone thinks everything is AI and rainbows and puppy dogs," he said, pointing out there was a banking crisis only a few months ago.                   </p>

Recently, the Wall Street Journal's <a href="https://twitter.com/carney"><span class="s2">John Carney</span></a> issued a Twitter challenge for an updated version of this list. </span></p><p class="p2"> <span style="line-height: 1.5em;">In an industry where people often take themselves too seriously, or even define their own existence by their job title, it's easy to dismiss this challenge with a flippant, "Just avoid everyone on Wall Street."  Fair enough, and that's why I'd rather get a Sriracha enema from Guy Fieri than be seen at the </span><a href="http://nypost.com/2015/01/28/inside-hunt-fish-where-beauties-trawl-for-sugar-daddies/"><span class="s2">Hunt &amp; Fish Club</span></a><span style="line-height: 1.5em;">.  But nonetheless, I've managed to restrict my list to just the Top 25 in this year's version of people to avoid on Wall Street: </span></p><ol class="ol1"><li class="li1"><span class="s1">Avoid the guy who bitches about affirmative action.  Odds are he's benefited from nepotism more times than he cares to admit.</span></li><li class="li1"><span class="s1">Avoid the guy who acts like his parents' place in Nantucket is really his beach house.</span></li><li class="li1"><span class="s1">Avoid the guy who name-drops college.  A good education is a prerequisite for a job on Wall Street, and <a href="http://www.businessinsider.com/the-gselevator-guide-to-being-a-man-2013-9"><span class="s2">as Carney says</span></a>, "A guy who drops the H Bomb clearly thinks his biggest accomplishments are behind him."</span></li><li class="li1"><span class="s1">In New York, avoid the guy with the pocket square and greasy hair.</span></li><li class="li1"><span class="s1">In London, avoid the guy with the pinky ring and floppy hair.</span></li><li class="li1"><span class="s1">Avoid the serial connector on LinkedIn, a.k.a. eHarmony for the underemployed.</span></li><li class="li1"><span class="s1">Avoid the guy who has MBA and CFA printed on his business cards.  </span></li><li class="li1"><span class="s1">Avoid the girl that tries too hard to fit in - swearing unnaturally, and even dropping the c-bomb.</span></li><li class="li1"><span class="s1">Avoid the back office guys who refer to themselves as investment bankers, or the repo guys who call themselves traders.</span></li><li class="li1"><span class="s1">Avoid fat people. He should be on a beach in Barbados by now. </span></li><li class="li1"><span class="s1">Avoid the guy who roots for Duke and didn't go there. (Notre Dame if you're a broker or in wealth management.)</span></li><li class="li1"><span class="s1">Avoid the convenient feminists - the girls who use cleavage and short skirts to get ahead, and then when things don't go their way, start bitching to HR about sexism. </span></li><li class="li1"><span class="s1">Avoid the "When I was at Goldman Sachs…" guy.  He's not there anymore.</span></li><li class="li1"><span class="s1">Avoid the bucket shop bankers turned CNBC pundits.  They'll drink on your dime and parrot your ideas. </span></li><li class="li1"><span class="s1">Avoid the guy who jumped around to a different bank every two years.  His Patek Philippe (paid for by a bull market BNP Paribas guarantee) doesn't make him a hitter. </span></li><li class="li1"><span class="s1">Avoid the guys who mime golf swings in the office.  They never break 100 on the course, and always say things like, "Big dog's gotta eat" after every half-decent drive. </span></li><li class="li1"><span class="s1">Avoid the guy who uses his business card to impress women in bars. The 25 people you should avoid on Wall Street

<p><span style="font-size: 15px; line-height: 1.5em;">Prominent short-seller </span>David Einhorn<span style="font-size: 15px; line-height: 1.5em;"> raised eyebrows last month when he popped up on </span><keyword id="6354616" type="CITY" weightage="60" keywordseo="Twitter">Twitter</keyword><span style="font-size: 15px; line-height: 1.5em;"> to disavow that he had tweeted about <keyword id="380994" type="ORGANIZATION" weightage="60" keywordseo="Herbalife">Herbalife</keyword> Ltd.</span></p>
<p>"Apparently I have a twitter impersonator," said the hedge fund manager, adding that he had no plans "to tweet about <keyword id="6354298" type="ORGANIZATION" weightage="60" keywordseo="stocks">stocks</keyword>."</p>
<p>What set off Einhorn, founder of Greenlight Capital, was a post by a since-suspended Twitter account called @Greenlightcap that read: "The $HLF tug of war will in the end come down to who has more money to play with. I wouldn't want to be in Bill's shoes right now #TeamIcahn."</p>
<p>That may have misled people into thinking that Einhorn - whose infrequent tweets under @davidein tend to be about poker - was picking sides in the battle between two other big-name investors, Carl Icahn and Bill Ackman, who have opposing positions in Herbalife.</p>
<p>Einhorn isn't the only shortseller who has been impersonated on Twitter, which has become an important source of information for many investors. In late January, shares of Audience Inc and Sarepta Therapeutics Inc plunged following tweets that were purported to be from short-selling researchers.</p>
<p>"Twitter pump and dump schemes are obviously something for the market to be concerned about, even if they are just a new way for people to do schemes that have been done forever," said Keith McCullough, chief executive officer at Hedgeye Risk Management in New Haven, Connecticut. He uses Twitter and has more than 22,000 followers.</p>
<p>In such hoaxes, anonymous users set up accounts with names that sound like prominent market players, issue negative commentary, and spark massive declines. The selling that follows shows how the rapid spread of information on <keyword id="6354632" type="COMPANY" weightage="60" keywordseo="Social-media">social media</keyword> can make for volatile trading, and is a warning to investors who trade on news before fully verifying the source.</p>
<p>The FBI monitors Facebook and Twitter, and told <keyword id="76338" type="CITY" weightage="60" keywordseo="Reuters">Reuters</keyword> in November that social media will be a big part of securities fraud. The U.S. Securities and Exchange Commission's website has a warning that swindlers can use social media "to appear legitimate, to hide behind anonymity, and to reach many people at low cost." And the Financial Industry Regulatory Authority has issued social media guidelines to broker-dealers, requiring that they keep records of usage.</p>
<p>In January 2012, the SEC charged an advisor with attempting to sell fictitious securities through LinkedIn Corp, an online social network catering to professionals.</p>
<p>"As some violators have learned the hard way, using social media to defraud investors leaves an electronic trail of footprints for our investigators to follow," said John Nester, a spokesman for the SEC in Washington, D.C.</p>
<p>LOOKING FOR INFORMATION</p>
<p>Investors can minimize the risk of being conned by only trusting the Twitter accounts of established users and independently researching any tip or rumor.</p>
<p>In addition to Twitter, another popular site for traders is Stocktwits.com, where users send messages almost exclusively about stocks. These sites in some ways are more sophisticated versions of on-line chat rooms that were popular during the dot-com boom. Rumors in those rooms flowed freely, and became a breeding ground for untrustworthy information.</p>
<p>Twitter and StockTwits have stronger filters - the Einhorn impersonator's account was suspended shortly after the misleading post - but the spigot of false information cannot be shut entirely.</p>
<p>StockTwits doesn't allow discussions of penny stocks "since those are the ones that are the most vulnerable to being pushed around," said Howard Lindzon, the company's San Diego-based chief executive.</p>
<p>Twitter, which did not respond to requests for comment, verifies the accounts of public figures, focusing on "highly sought users in music, acting, fashion, government, politics, religion, journalism, media, advertising, business, and other key interest areas," according to its website.</p>
<p>Analytic firms are also emerging to help traders navigate social media.</p>
<p>The activity in audio chip maker Audience, which has a market value of $275 million, serves as a prime example of the peril of following sources that are not what they seem - and is also where social media scanners see an opportunity.</p>
<p>The initial fake tweet was posted at 8:44 a.m. New York time on Jan. 29, by someone pretending to be short-seller Carson Block of Muddy Waters. Block is best known for exposing accounting problems and taking short positions in a series of Chinese companies listed in the United States.</p>
<p>The share declines did not accelerate until after 2 p.m., when trading picked up, and more than 300,000 shares traded in a two-minute period, far exceeding the stock's daily average volume of about 186,000 shares.</p>
<p>Dataminr, a New York-based social media analytics firm that monitors Twitter for stock activity, said it sent an alert on the fake tweet at 12:28 p.m. The firm "was able to warn its clients of a market rumor far in advance of the market-movement, along with providing context on the veracity of the message," said Dataminr Chief Executive Ted Bailey.</p>
<p>While Dataminr declined to provide the actual language of the alert, it said the alert conveyed skepticism about the tweet on Audience, noting the account's past activity and its "demonstrated domain expertise across the social graph."</p>
<p>Overall, analytic firms said scanning programs were not advanced enough to be fully automated yet.</p>
<p>"We're a strong believer in the human element in this," said Emmett Kilduff, CEO of Dublin-based Eagle Intel, a social media analytics firm that has alerts evaluated by a research team composed of former portfolio managers and analysts.</p>
<p>Another analytics firm, London-based Knowsis, filters its alerts through market professionals. CEO Oli Freeling-Wilkinson said the firm looks at who is sending information, taking into account the person's location, whether they are an established market professional, and how shares react.</p>
<p>No system is fail proof, and big share reactions will still likely occur from time to time, goosed initially by Twitter but later as investors react to price moves. It is this aspect that will keep people on their toes.</p>
<p>"There's an impulse, when you see a name of yours moving like this, to shoot first and ask questions later and find out why it is moving," said Sam Ginzburg, head of trading at First New York in New York.</p>

Clinton also</span> deleted about 31,000 pages of emails that she says were personal.</p><p>It is unclear whether it was fully erased before it was turned over to the FBI earlier this month. The nature of her server means there might still be ways for investigators to recover old data.</p><p><span>"A hard disk drive is very difficult to manipulate," computer scientist <span>Darren Hayes, <span>director of cybersecurity at Pace University's School of Computer Science and Information Systems, told The <a href="http://www.businessinsider.com/the-probe-of-hillary-clintons-server-could-find-more-than-just-emails-2015-8">Associated Press</a>.</span></span> </span></p><p><span>"Once you get your hands on a hard drive, there's a lot you can recover."</span></p><p><span><div class="KonaFilter image-container display-table"><div><div class="image on-image"><p class="source"><span>REUTERS</span></p><p class="caption">First Lady Hillary Clinton talks with students working on computers in the </p></div><p></p></div></div></span></p><p><span>Files that are deleted from a disk can be recovered from the hard drive, he noted, and data deleted from the drive altogether may still leave fragments that can be accessed with enough digging. </span></p><p><span><span>"They may have deleted a lot of data, but there's a lot of data that a good forensics team would be able to recover," Hayes said.</span></span></p><p class="p1"><span>Additionally, Platte River</span><span> </span><a href="http://www.breitbart.com/video/2015/08/16/abcs-karl-highly-likely-theres-a-backup-server-with-hillary-clintons-emails/">told ABC</a><span> on Sunday that it is "highly likely" a backup copy of the server was made, meaning any emails Clinton deleted before she handed the server over to investigators may still be readily accessible.</span></p><p class="p1">"The reason you back up a server is fairly straightforward, and it would be standard practice to do so," <a href="http://www.businessinsider.com/hillary-clinton-it-firm-platte-river-says-email-backups-are-likely-2015-8">McGeorge told BI</a>. <span>"There's a lot they [investigators] can learn from the server, but not having the backups would probably make that job much more difficult."</span></p><p class="p1"><span>ABC News chief White House correspondent Jonathan Karl said Platte River was "cooperating with the FBI," which is running the investigation out of its Washington, D.C., headquarters in <a href="http://www.businessinsider.com/hillary-clintons-private-email-and-fbi">what The New York Times called</a> "an unusual move."</span></p><p><span>"Nearly all [FBI] investigations are assigned to one of the bureau's 56 field offices," The Times said.</span></p><p><span>"But given this inquiry's importance, senior F.B.I. officials have opted to keep it closely held in Washington in the agency's counterintelligence section, which investigates how national security secrets are handled."</span></p><p><span><div class="KonaFilter image-container display-table"><div><div class="image on-image"><p class="source"><span>Reuters</span></p><p class="caption">Hillary Clinton</p></div><p></p></div></div></span></p><p class="p1">Clinton, for her part, insists she never broke <a href="http://www.businessinsider.com/hillary-clintons-lawyer-david-kendall-2015-8">the law</a> by knowingly mishandling national security secrets, and there is no evidence that she did.</p><p class="p1">"I was permitted to and used a personal email and, obviously in retrospect, given all the concerns that have been raised, it would have been probably smarter not to," she <a href="http://www.washingtontimes.com/news/2015/aug/17/new-hillary-clinton-email-count-305-documents-pote/">told Iowa Public Radio</a> last week. "But I never sent nor received any classified email, nothing marked 'Classified.' And I think this will all sort itself out."</p><p class="p1">Nevertheless, the investigation has cast a dark shadow on her presidential campaign. Clinton is the front-runner for the Democratic nomination for president.</p><p class="p1">Authorities sifting through the emails <a href="http://www.businessinsider.com/report-authorities-are-finding-more-classified-info-in-hillary-clintons-emails-2015-8">say they have reportedly found</a> more than <a href="http://www.businessinsider.com/report-authorities-are-finding-more-classified-info-in-hillary-clintons-emails-2015-8">60 emails</a> containing classified information, not including two emails discovered by the intelligence community's inspector general, Charles McCullough III.
