The <keyword id="6371973" type="General" weightage="20" keywordseo="Karnataka-high-court" source="Orion">Karnataka High Court</keyword> on Monday struck down provisions of the <keyword id="6354780" type="General" weightage="100" keywordseo="karnataka" source="Orion">Karnataka</keyword> Police (Amendment) Act, 2021 that banned online games. The division bench headed by the Chief Justice Ritu Raj Awasthi and Justice Krishna S. Dixit gave the order. The bench said in its order that in the 'Karnataka Act number 28/2021 to the extent the provisions, (not the entire Act) declared to be ultra vires to the Constitution of India and struck down. The consequences of striking down the provisions shall follow.' "However, nothing in this judgment shall be construed to prevent an appropriate legislation be brought about concerning the subject i.e; betting and gambling in accordance with the provisions of the constitution. A writ of mandamus is issued restraining the respondents from interfering with online gaming business and allied activities of the petitioners," the order said. The Karnataka Police (Amendment) Bill, 2021 was mooted by ruling BJP to amend the Karnataka Police Act 1963, in the Monsoon session. The BJP leaders claimed that they were introducing the Bill to ban online gaming in the interest of people. The law included all forms of wagering or betting in connection with any game of chance barring horse racing. However, the new law was opposed by online gaming companies and it was said that the policy would affect the prospectus of the city which is emerging as a hub of online gaming companies. The new Act banned all formats of online games involving wagering, betting and gambling of all nature and forms in the state. Under the new legislation, online gaming was considered a non-bailable offence with a fine of Rs 1 lakh and imprisonment up to three years. Along with banning games of skills, the government had also categorised online games using electronic means and virtual currency, electronic transfer of funds in connection with any game as gambling. The new legislation was passed in the Monsoon session by both the Houses of the legislature in Karnataka. Mobile Premier League (MPL) was one of the first companies to stall its operations in Karnataka. Paytm First Games was also locked. The online gaming companies moved to the court questioning the new legislation. Similar law was also challenged in Tamil Nadu and online gaming operators got relief against the government order from the High Court. The Internet and Mobile Association of India (IAMAI) had stated that the new legislation by the government will dent the image of Karnataka as a startup hub and the state exchequer will see a huge revenue deficit. It also maintained that with the new legislation offshore gamblers will flourish. Sources say that the state has more than 100 gaming companies with a workforce of 4,000. Karnataka High Court quashes law banning online gaming, calls it unconstitutional

Ramasubramanian that the issue was whether it was game of skill or chance or gambling. The Karnataka government contended that cybercrime has become a major issue and cited filing of 28,000 cases in the last three years, while emphasising the need for a law against online gaming to maintain public order. It further argued that people have died by suicide and the online gaming has ruined many families, therefore it was necessary to deal with its ill effects. The state government's plea said: "The Karnataka Police (Amendment) Act, 2021 made criminalised wagering, betting or risking money on the unknown result of an event." On February 14 this year, the high court struck down the government's ban and the legal provision which criminalised playing games of skill, including online games, and betting. The top court issued notice to online gaming industry body All India Gaming Federation and skill-based gaming firms. It directed to tag this matter with a similar matter, where the Tamil Nadu government has challenged the judgment by the Madras High Court. The Karnataka High Court had said that the Act was unconstitutional and there cannot be any ban on online games of skill. The state government contended before the apex court that the high court had grossly erred in not taking into account the material produced by it in connection with cases registered by the police authorities. SC admits Karnataka govt plea on online gaming

Bengaluru, May 7 () The 'CheckmateCovid' online chess tournament raised an amount of Rs 15 lakh, which was donated to the Karnataka Chief Minister's COVID-19 Relief Fund.A total of 19,245 players registered for the tournament, which had a total prize pool of Rs 10 lakh, a media release issued here said on Thursday.The tournamemt was conducted by Karnataka government along with the United Karnataka Chess Association and Mobile Premier League (MPL).GM Ankit Rajpara won the tournament, which was held on May 2 and 3.GM Bhakti Kulkarni won the award for the top-ranked female player and Shakuntala Devi won the award for top-ranked player above 60 years of age.The tournament saw a total of 2.37 lakh chess games."I thank all the players who participated and contributed to the CheckmateCovid Chess Tournament. We are glad to have collected a large amount for the CM's Covid Relief Fund. We must continue to come together and fight this crisis," said Karnataka Sports Minister CT Ravi.The matches were played in the Speed Chess format, with each player getting three minutes in the game. Surge pricing is back! This time it’s has new aliases. Days after global taxi aggregator <keyword id="1042120" type="PERSON" weightage="100" keywordseo="Uber">Uber</keyword> rolled out its ‘upfront fares’ tariff, <keyword id="6354720" type="PERSON" weightage="100" keywordseo="Ola">Ola</keyword> has not been left wanting either. The Bengaluru-based online transport app has introduced ‘low peak pricing’. 
 
Have things changed? Well, yes and no. The earlier version of the app would display the surge pricing tariff as ‘1.5x’ or ‘1.8x’, now a customer gets to see the actual rate per kilometer applicable at the time of booking. Ola claims this lets one know beforehand how much his/her ride will cost. 
 
That’s all fine. However, this is not the death of surge pricing as the tariff is still based on the demand, traffic and other factors. As for Uber, its ‘upfront fares’ is a clear indication that surge pricing is here to stay. 
 
This comes after the two online taxi aggregators were directed by several state governments to end surge pricing based on a barrage of protests and complaints from customers and taxi unions. Uber had rolled back its surge model in Delhi last month, agreeing to charge a per-kilometer fare and not exceed the government-prescribed rate. The Karnataka government has even threatened to ban Uber in the state if it doesn’t say goodbye to surge pricing. 
 
On Monday, Ola filed in the Karnataka High Court saying that it has complied with all requirements to continue operating. This was to counter to a petition by rival Uber India which challenged the Karnataka On-Demand Transportation Technology Aggregator Rules, 2016. 
 
Both Ola and Uber have been fighting a bloody price war. Both firms have been offering discounts to customers to gain more market share.

Gaming companies cannot provide services to anyone with a fake ID. Gaming companies are using facial recognition technology and algorithms to ensure that the rules are followed and the children don’t use means to illegally game at other times by using their parent’s phone or using Fake IDs. China’s anti-addiction regulations for video games are making it difficult for game developers to operate — here’s why

About 76% of respondents feel that addiction to action games lead to changed behaviour and can increase depression and anxiety levels, according to the "India Digital Wellness Report" by consumer cybersecurity brand NortonLifeLock. Nearly 70% of respondents feel that children connecting with strangers while playing games online can lead to cyberbullying, harassment, and violence. The findings are based on an online survey of over 1,500 city-based Indian adults. "People could be drawn to online gaming for entertainment, but data shows that it is not all about fun and games. The virtual playing field comes with risks such as identity theft, cyber bullying, phishing, and credit card theft, to name a few," Ritesh Chopra, Director, NortonLifeLock, India, said in a statement. Two of every three respondents said they prefer playing online games to going outdoors or having social interactions. Almost 73% of the parents in the survey said that their children prefer shooting and adventure games, while 21% said that their children show a preference for casino and card games. There is a sense of growing concern among parents as 45% of respondents said they find it difficult to control their children's smartphone usage. Interestingly, 81% of the respondents who put a check mechanism on children's usage of smartphones feel they have not been effective in controlling the gaming time. The children of 42% of these respondents played games online for more than two hours every day. However, online gaming seems to have some positive impact, too, on users. About 81% of respondents feel that multiplayer online games enhance teamwork skills, while 70% of respondents feel that playing online games can make people smarter, as they improve brain coordination and reaction. The online gaming space, largely perceived to be male dominated, seems to have a lot of female takers, the results showed. About 88% of female respondents find online games to be the best pastime as compared to 86% of their male counterparts. The study also showed that when it comes to mobile gaming, children and parents tend to have a shared behaviour -- six in every 10 respondents said that they and their children spend roughly the same amount of time playing games online.

The creator of 'Fortnite' has banned more than 1,000 accounts for cheating during the first round of its $30 million tournament

The panel of state finance ministers is likely to recommend a uniform <keyword id="6354679" type="General" weightage="100" keywordseo="gst" source="Orion">GST</keyword> levy of 28 per cent on <keyword id="6422069" type="General" weightage="20" keywordseo="Online-gaming" source="Orion">online gaming</keyword> irrespective of whether it is a game of skill or game of chance, sources said. However, it is likely to suggest a revised formula for calculating the amount on which the Goods and Services Tax (GST) would be levied. Currently, online gaming attracts 18 per cent GST. The tax is levied on gross gaming revenue, which is the fees charged by online gaming portals. Sources said that the GoM report is almost final and would be submitted to the GST Council soon for consideration. The Group of Ministers (GoM), chaired by <keyword id="6355772" type="General" weightage="50" keywordseo="meghalaya" source="Orion">Meghalaya</keyword> Chief Minister Conrad Sangma, had in its earlier report submitted to the Council in June suggested a 28 per cent GST on on the full value of the consideration, including contest entry fee, paid by the player, without making a distinction such as games of skill or chance. However, the Council had asked the GoM to reconsider its report. Following that the GoM took the views of the Attorney General and also met stakeholders from the online gaming industry. Although the GoM deliberated on separate definitions for 'games of skill' and 'games of chance', it finally decided to tax both as demerit goods attracting a 28 per cent GST. The message has to be clear that online gaming is a demerit good. However, some relaxation in valuation methods could be provided, sources told PTI. The GoM report in June had suggested that the GST should be levied on the entire amount received as consideration from the participant. Charging 28 per cent GST on the entire amount, which a player deposits for a game for both categories of online game, would reduce the prize money left for distribution and drive away players from legitimate tax deducting portals. This may also encourage online gamers towards unlawful portals that do not deduct tax, sector experts had said. Online gaming witnessed a spurt during the time of Covid lockdown with the number of users in India rising substantially. As per a KPMG report, the online gaming sector would grow to Rs 29,000 crore by 2024-25 from Rs 13,600 crore in 2021. The parents of such children are helpless. In case they insist the children to stop playing it, they become aggressive and go into depression,” Arora said in his <a href="https://www.indiatvnews.com/technology/news-pubg-mobile-ban-again-in-india-582250">PIL</a>. This comes almost a year after PUBG Mobile was banned in Ahmedabad, Rajkot, Surat, Vadodara and Bhavnagar in India in March 2019. He died before he could be attended to by doctors. The World Health Organization too <a href="https://www.who.int/features/qa/gaming-disorder/en/">classified</a> ‘gaming disorder’ as a medical condition. “For gaming disorder to be diagnosed, the behaviour pattern must be of sufficient severity to result in significant impairment in personal, family, social, educational, occupational or other important areas of functioning and would normally have been evident for at least 12 months,” said WHO. But very few people are coming forward to bell the cat and that includes creator of the game.
