Mumbai, The Committee of Creditors (<keyword id="230701" type="General" weightage="80" keywordseo="coc" source="Orion">COC</keyword>) of <keyword id="6360090" type="General" weightage="80" keywordseo="reliance-capital" source="Orion">Reliance Capital</keyword> has approved the extension of 90 days (from January 31 to April 30) to complete the <keyword id="6359987" type="General" weightage="100" keywordseo="resolution" source="Orion">Resolution</keyword> process. Due to Torrent's legal challenge, the Administrator will file an application for deadline extension in the NCLT Mumbai on Monday, January 16. NCLT Mumbai will resume hearing in the Reliance Capital resolution matter on Monday. In the hearing on Thursday, January 12, senior counsel <keyword id="30182" type="General" weightage="50" keywordseo="kapil-sibal" source="Orion">Kapil Sibal</keyword> appearing for RCAP's COC informed the court that the bid submitted by Torrent is non-compliant. Sibal said that COC found a discrepancy in the Resolution Plan of Torrent. The financial proposal submitted by the company in the draft resolution proposal does not match the highest bid amount submitted by them in the challenge mechanism. Sibal said that after the Administrator wrote to Torrent on January 4, and after that Torrent changed its entire bid on January 6. Sibal said that Torrent does not even meet the threshold of the third round of the Challenge Mechanism. Therefore, it is non-compliant in the third round itself, and could not have participated in the fourth round. Torrent's bid in the second round was only Rs 7,500 crore, which should be the final bid by the company, while IIHL's (Hinduja) all-cash bid of Rs 8,110 crore in the third round is higher than Torrent's offer of Rs 7,500 crore. In addition, Hinduja's IIHL is offering additional upfront cash of Rs 900 crore, over and above its bid of Rs 8,110 crore, to the lenders, and this higher realisation can not be denied to the lenders, including <keyword id="6367143" type="General" weightage="50" keywordseo="lic" source="Orion">LIC</keyword> and EPFO. Torrent stalls Rcap resolution, COC approves 90-days extension to complete resolution

Even as India tries to adjust its head around the new, appearing-to-be-more-aware <keyword id="5268" type="PERSON" weightage="80" keywordseo="Rahul-Gandhi">Rahul Gandhi</keyword>, he has gone ahead and fired a fresh salvo at the ruling BJP government. After having championed the cause of farmer’s and having made his anger against the current land bill evident, he is now out to ‘save the internet’ and champion the cause of <keyword id="6391709" type="UNKNOWN" weightage="80" keywordseo="Net-neutrality">net neutrality</keyword>. 
 Speaking in the Parliament, during 'Question Hour', Rahul attacked the <keyword id="6354477" type="PERSON" weightage="80" keywordseo="Narendra-Modi">Narendra Modi</keyword> led BJP Government saying, "This government wants to sell-out the internet to the rich industrialists of this country. I am asking the government not to carve out the internet and hand it over to the industrialists.' He further said, "I want the government to immediately stop the <keyword id="6356988" type="PERSON" weightage="80" keywordseo="TRAI">TRAI</keyword> consultation and write a clear law on net neutrality.' 
 Earlier in the day, he had moved an a notice of adjournment in the Parliament seeking discussion on the issue of net neutrality. The Speaker, Sumitra Mahajan allowed Gandhi to raise his concern, which was followed by a quick, but sharp rebuttal by Telecom and Information Broadcast Minister, <keyword id="6354886" type="PERSON" weightage="80" keywordseo="Ravi-Shankar-Prasad">Ravi Shankar Prasad</keyword>. 
 Prasad said, "When <keyword id="71" type="POSITION" weightage="80" keywordseo="Prime-Minister">Prime Minister</keyword> Narendra Modi speaks about Digital India, he wants that every citizen of this country gets access to the internet. The government not only wants e-governance, but wants to give access to mobile governance to all its citizens." He further added, " TRAI is holding a consultation within its jurisdiction, but the final say in the matter lies with the <keyword id="6493697" type="ORGANIZATION" weightage="80" keywordseo="Telecom-Ministry">telecom ministry</keyword> and eventually the cabinet." 
 The telecom minister also made a scathing remark at the previous UPA2 regime, referring to August 2012, when the then telecom ministry under <keyword id="30182" type="PERSON" weightage="80" keywordseo="Kapil-Sibal">Kapil Sibal</keyword> had ordered internet service providers to block 16 Twitter accounts, including those of right-wing entities and leaders such as Sangh Parivar, Panchjanya magazine, and Pravin Togadia's blogposts, as wlee as hundreds of web-pages featuring user-generated content on websites such as <keyword id="6354576" type="CITY" weightage="80" keywordseo="Facebook">Facebook</keyword> and Youtube. Prasad said, "when we are discussing this matter, why don't we ask Rahul Gandhi, the able politician that he is, about the Twitter handles that were blocked in August 2012." 
 
Post his 56-day vacation, this is the second time that Rahul Gandhi has attacked the Modi Government, providing a sense to the country that he might just have returned with an improved sense of issues to target, even touching all the correct ‘raw nerves’ of the Narendra Modi-led BJP government.

He further said that even this matter floated by TRAI will be first discussed by the department of telecom followed by the <keyword id="158388" type="ORGANIZATION" weightage="80" keywordseo="Telecom-Commission">Telecom Commission</keyword> and then a consolidated view will be taken.

This is Rahul 'crusader' Gandhi's bid to 'save the internet'

Former <keyword id="71" type="POSITION" weightage="80" keywordseo="Prime-Minister">Prime Minister</keyword> <keyword id="6359397" type="PERSON" weightage="80" keywordseo="Manmohan-Singh">Manmohan Singh</keyword> does not have to appear in a <keyword id="6364736" type="ORGANIZATION" weightage="80" keywordseo="Delhi-court">Delhi court</keyword> on April 8, the <keyword id="6354977" type="ORGANIZATION" weightage="80" keywordseo="Supreme-Court">Supreme Court</keyword> said today. The top court has suspended the summons sent to the <keyword id="6378412" type="POSITION" weightage="80" keywordseo="politician">politician</keyword> by a <keyword id="6362306" type="ORGANIZATION" weightage="80" keywordseo="CBI-court">CBI court</keyword> last month. The investigating agency has three weeks to respond to Dr Singh's petition against his summons. 
 Dr Singh, 82, had been told to make a personal appearance with industrialist Kumar <keyword id="286113" type="PERSON" weightage="80" keywordseo="Mangalam-Birla">Mangalam Birla</keyword> for a case that says a coal field was illegally awarded in 2005 to Hindalco, a company owned by Mr Birla. At the time, Dr Singh held direct charge of the <keyword id="111919" type="ORGANIZATION" weightage="80" keywordseo="coal-ministry">Coal Ministry</keyword>. 
The former PM has not been charged with any crime but is being investigated for criminal breach of trust, criminal conspiracy, and corruption. He has denied any wrong doing. The CBI has twice said it would like to close the case against him, but has been over-ruled by the judge handling the matter. 
 "There was no criminal intent, it (the allotment) was an administrative decision and not an illegality," said the politician's lawyer, <keyword id="30182" type="PERSON" weightage="80" keywordseo="Kapil-Sibal">Kapil Sibal</keyword>, who was also <keyword id="2789849" type="UNKNOWN" weightage="80" keywordseo="Telecom-Minister-in-Dr-Singh">Telecom Minister in Dr Singh</keyword>'s government. Two of Dr Singh's three daughters were present in court today. 
 The case known as "Coalgate" came to light in 2012 after <keyword id="222693" type="COMPANY" weightage="80" keywordseo="The-National">the national</keyword> auditor said 1.86 lakh crores had been lost because coal blocks were distributed without a transparent bidding process. Last year, the Supreme Court declared as illegal nearly 300 coal licenses issued by consecutive governments since 1993. Over the last few weeks, 32 of the coal blocks were auctioned by the <keyword id="6360789" type="ORGANIZATION" weightage="80" keywordseo="Modi-Government">Modi government</keyword>. 
 Judge <keyword id="2055026" type="UNKNOWN" weightage="80" keywordseo="Bharat-Parashar">Bharat Parashar</keyword> of the CBI court said in the summons to Dr Singh that "a well-planned conspiracy was hatched" to award a coal field in Odisha to <keyword id="105310" type="CITY" weightage="80" keywordseo="Hindalco-Industries">Hindalco Industries</keyword>, part of the $40 billion <keyword id="44373" type="CITY" weightage="80" keywordseo="Aditya-Birla-Group">Aditya Birla Group</keyword>, which is chaired by Kumar Mangalam Birla. 
 
Hindalco has said that it made its case for the mining license "in a transparent and lawful manner".

Supreme Court sides with Ex PM Manmohan Singh, says appearance in court on April 8 not required

The <keyword id="6354977" type="ORGANIZATION" weightage="80" keywordseo="Supreme-Court">Supreme Court</keyword> may have struck down the draconian, super abused Section 66A of the <keyword id="6379296" type="UNKNOWN" weightage="80" keywordseo="IT-Act">IT Act</keyword>, but if some people within the current Government have their way, it could soon make a comeback, in a different <keyword id="44111" type="CITY" weightage="80" keywordseo="Avatar">avatar</keyword> hitherto. <keyword id="51958" type="ENTERTAINMENT" weightage="80" keywordseo="YES">Yes</keyword>, you heard that right. 
 
Just a few hours after the apex court’s landmark judgment, some members of the current government are toying with the idea of coming out with a similar provision, that will effectively curb any ‘menace’ on the internet. 
 Infact, while welcoming the Supreme Court’s decision to scrap section 66A of the IT Act, Rajya Sabha MP <keyword id="4032986" type="PERSON" weightage="80" keywordseo="Rajeev-Chandrashekhar">Rajeev Chandrashekhar</keyword> said the government now needs to replaces the entire intermediary rules under the law and come up with a multi stakeholder discussion to come up with new rules. 
 
"I think the next step for this government should be to come up with a new 66A after some consultation," Chandrashekhar told the Economic Times. "And since, it will be done through consultations, it will give everybody the comfort that it is addressing misuse of internet, but at the same time preserving and respecting the right to express freely for lots of innocent users on the internet." 
 
In his PIL in 2012, Chandrashekhar had argued that section 66A is unconstitutional because in the name of securing the Internet and in the name of preventing the abuse of internet, government and government bureaucrats were overreaching and trespassing into the constitutional right of free speech. 
 "The problem with Section 66A is that it criminalizes without a proper definition of the crime. In <keyword id="823722" type="UNKNOWN" weightage="80" keywordseo="the-section">the section</keyword> it will say offensive, without a threshold of evidence before criminalization. Section 66A is the only section that criminalizes a wide range of activities independent of the mental state of the person sending electronic communication," he told ET. 
 He said the previous government did not take any action to replace section 66A despite assurances. "When I started arguing over this issue in 2012 with the government, when <keyword id="30182" type="PERSON" weightage="80" keywordseo="Kapil-Sibal">Kapil Sibal</keyword> was the IT minister, I suggested to him to cancel 66A and come up with a new 66A. It was then brought to the parliament and debated and Sibal gave an assurance in parliament that we will do a public consultation and multi stakeholder discussion on creating a new 66A. He did not," Chandrashekhar said. 
 
He suggested given the government's focus on digital India, they are well within their rights to say that they'll come up with new set of intermediary rules to replace the ones from 2011, the ET report said. 
 "You need to keep the law order people on one side of the table, you need to keep NGOs and people from <keyword id="59810" type="ORGANIZATION" weightage="80" keywordseo="Civil-society">civil society</keyword> on one side of the table and people from information technology on another side of the table and then through that process come up with openly intermediary guidelines that meet the public policy guidelines of security, abuse of the internet and internet proliferation and innovation," Chandrashekhar said.

However, appearing for the petitioners’ side, Harish Salve said under the new policy, users were unwittingly made to give consent to both WhatsApp and Facebook and the latter could snoop on messages privately circulated between users of WhatsApp. "They claim that this is being done to improve services to be given in future to users. Whether the snooping is done electronically or manually, the right to privacy of users gets breached. The government is duty bound to protect the fundamental right of every citizen. If it is failing, then the SC can surely issue appropriate directions," Salve said. The bench fixed May 15 for preliminary hearing.

The <keyword id="62528" type="ORGANIZATION" weightage="100" keywordseo="Department-of-Telecom">Department of Telecom</keyword> (DoT) has taken up the issue of morality on social media as part of its proposed action plan for Prime Minister-elect Narendra Modi. 
 
“Focus on national security, public safety, morality, privacy and disaster management are in the framework,” according to a DoT presentation, which was shown to the Cabinet secretary. 
 A senior DoT official said it was on the lines of what <keyword id="30182" type="PERSON" weightage="80" keywordseo="Kapil-Sibal">Kapil Sibal</keyword> had suggested earlier – the screening of social media. Sibal was heavily criticised for his suggestion. 
 
“There is so much objectionable content on social media websites, which does not go down well with the common people. Morality largely has to do with that,” the official said. 
 
He, however, said this was not the final PPT that will be sent to the new government. 
 
DoT has also suggested abolishing archaic laws such as the Telegraph Act 1885 and replacing it with a consolidated Communications Act. It also suggested minimising regulatory burden to facilitate rapid growth. 
 
As per reports, the country is already working on a policy on telecom security, which will maintain a balance between a common man’s right to privacy and the requirements of security agencies.

 A month ago, Airtel’s Zero Plan and the TRAI’s consultation paper on over the top website usage created a huge furor amongst the youth in the country. The debate on net neutrality in India has reached such proportions that even Facebook Founder and CEO <keyword id="475824" type="PERSON" weightage="80" keywordseo="Mark-Zuckerburg">Mark Zuckerburg</keyword> had to face the IRE OF India’s youth, resulting in many top internet companies leaving the internet.org platform. 
 Since then, TRAI has set up a consultation committee to discuss and debate the matter and arrive at a policy recommendation to the Telecom Ministry. Prasad, had earlier in the day said that the government has always been pro net neutrality and that a committee had already been set-up in January 2015 seeking opinion on the matter, the report on which will be submitted to DoT by the second week of May 2015. He further said that even this matter floated by TRAI will be first discussed by the department of telecom followed by the <keyword id="158388" type="ORGANIZATION" weightage="80" keywordseo="Telecom-Commission">Telecom Commission</keyword> and then a consolidated view will be taken. 
 
Going by the current momentum of things, this session of the Parliament is clearly all about showcasing the fact that Rahul Gandhi is ‘back for good’ and the new rejuvenated Gandhi scion will be making it rather tough for the BJP. The <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords">Supreme Court</keyword> on Friday agreed to list for an early hearing the appeal of US-based creditor Glas Trust Company LLC against a judgment of the <keyword id="19916400" type="General" weightage="20" keywordseo="NCLAT" source="keywords">NCLAT</keyword>, which had stayed <keyword id="19965539" type="General" weightage="20" keywordseo="insolvency-proceedings" source="keywords">insolvency proceedings</keyword> against ed-tech firm <keyword id="19958178" type="General" weightage="20" keywordseo="Byjus" source="keywords">BYJU's</keyword> and approving its Rs 158.9 crore dues settlement with the <keyword id="19901245" type="General" weightage="20" keywordseo="BCCI" source="keywords" meta.keywordsubtype="org" meta.entityname="BCCI" meta.hostid="153" meta.entityid="BCCI">BCCI</keyword>. A bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra was urged by senior advocate NK Kaul, appearing for the ed-tech major, that the case needed to be heard at the earliest. Kaul said, "The only funding was done by the promoters and today no one has brought any external borrowing. We have to show today how malafide the petition (of US firm) is." "I will get it listed as early as possible," the CJI, who was indisposed and in quarantine for the last few days, said. Senior advocate Kapil Sibal, appearing for the US-based creditor, said it also wanted an early hearing. Earlier on August 22, the bench had refused to pass an interim order to ensure that the committee of creditors (CoC) does not hold any meeting in pursuance of the insolvency proceedings against the embattled ed-tech firm. It had listed the plea for a final hearing on August 27. The bench had said the developments, which may take place in the meantime, can be negated if it finds there was no merit in the appeal of the US-based creditor against the judgment of appellate insolvency tribunal NCLAT. The plea was mentioned earlier also on August 20 by Byju's and the BCCI and the top court had then also refused to pass an interim order to restrain the Insolvency Resolution Professional (IRP) from constituting a committee of creditors (CoC) in the insolvency proceedings against the ed-tech firm. In a major setback to Byju's, the top court had on August 14 stayed the verdict of NCLAT, setting aside the insolvency proceedings against the ed-tech major and approving its Rs 158.9 crore dues settlement with the Indian cricket board. The August 2 verdict of the NCLAT had come as a huge relief for Byju's as it had effectively put its founder Byju Raveendran back in control. The top court, however, had prima facie termed the NCLAT verdict as "unconscionable" and stayed its operation while issuing notices to Byju's and others on the appeal of the ed-tech firm's US-based creditor against the judgment of the insolvency appellate tribunal. The case stemmed from Byju's default on a Rs 158.9 crore payment related to a sponsorship deal with the BCCI. The top court had directed the BCCI to keep a sum of Rs 158 crore it had received from Byju's after a settlement in a separate escrow account till further orders. "Issue notice. Pending further orders there shall be a stay of the impugned order of August 2 of NCLAT. In the meantime, BCCI shall maintain the amount of Rs 158 crore, which shall be realised in pursuance of a settlement, in a separate escrow account until further orders," the bench had said. The NCLAT had approved the Rs 158.9 crore dues settlement with the BCCI and set aside the insolvency proceedings against Byju's. Byju's had entered into a "Team Sponsor Agreement" with the BCCI in 2019. Under the agreement, the ed-tech firm got exclusive rights to display its brand on the Indian cricket team's kit and some other benefits. Byju's had to pay a sponsorship fee. The company met its obligations till the middle of 2022 but defaulted on subsequent payments of Rs 158.9 crore. After insolvency proceedings were initiated, Byju's entered into a settlement with the BCCI. On July 16, the Bengaluru bench of the National Company Law Tribunal (NCLT) had admitted 'Think and Learn', Byju's parent company, to the insolvency resolution process on a plea filed by the BCCI over default in payment of outstanding dues of almost Rs 158.9 crore. While suspending the board of the ed-tech firm, the NCLT had appointed an interim resolution professional to run the operations of the company, suspended the company's board of directors, and brought it under moratorium by freezing its assets. The US-based lenders suspected that the settlement amount was being diverted from the credit they had extended to Byju's.
