<ul class="summary-list"><li>Fourteen Tennessee lawmakers are calling for an audit of the state's children's prisons.</li><li>A ProPublica investigation found that children were held in solitary confinement for minor infractions.</li></ul>Lawmakers in Tennessee are calling for an audit of <a target="_blank" href="https://www.insider.com/former-child-detainees-tennessee-detention-center-rutherford-county-judge-2021-11">the state's children's prison system</a> after an investigation showed that children are being isolated for minor infractions.The Richard L. Bean Juvenile Service Center has been run by its namesake since 1972, and much of his methods remain "old school" today, according to <a target="_blank" href="https://www.propublica.org/article/knoxville-detention-center-illegally-locks-kids-alone-in-cells">ProPublica</a>."What we do is treat everybody like they're in here for murder," he told the outlet. "You don't have a problem if you do that."Tennessee Department of Corrections policies instituted in 2017 say that incarcerated children can be secluded into a room that is 50 square feet, but seclusion should be used as a last resort, the report says."Staff shall never use seclusion for discipline, punishment, administrative convenience, retaliation, staffing shortages, or reasons other than a temporary response to behavior that threatens immediate harm to a youth or others," the policy says.In a 2018 Tennessee Department of Children's services report from the Bean Center, one child said he was secluded after he forgot to bring his books to class, according to the outlet."Staff will put you in seclusion if they don't like you," the boy said.Several reports from the TDCS, which oversees the Bean Center, reviewed by ProPublica showed that children inside the facility and others in the state had been locked in solitary confinement for sometimes minor infractions, such as laughing during a meal.TDCS placed a corrective action plan on the Bean Center in 2018 after inspectors found that the facility was using seclusion as punishment, but in 2019 the corrective plan was removed and the facility had its license renewed, even though reports showed the use of seclusion had increased, ProPublica reported.On November 16, 14 Tennessee Democratic legislators penned a letter calling for the TDCS to run an audit of the children's prison system following the findings, according to the <a target="_blank" href="https://www.propublica.org/article/lawmakers-call-for-juvenile-detention-audit-after-alarming-findings-knoxville">outlet</a>."The Department has a constitutional duty to the legislature to enforce state laws and a moral obligation to children to ensure that youth in state-licensed facilities are being treated humanely and in accordance with Department guidelines," state Sen. Heidi Campbell wrote in the letter.Campbell later said in a post on X, formerly known as Twitter, that she is also writing legislation to outlaw corporal punishment for children in Tennessee.In the letter, the lawmakers called Bean's comments "disturbing," citing his remark that the Bean Center treats every child like they're there "for murder."The Tennessee Department of Children's Services did not immediately return Insider's request for comment.The agency told ProPublica it is immediately "taking steps" to address the concerns highlighted inside the Bean Center.""The matter is being treated with urgency and is a priority to the Department," TDCS said in a statement.

That's because they hold the record for the highest number of unprovoked shark attacks on humans.However, <a href="https://doi.org/10.1371/journal.pone.0286575" target="_blank" rel="noopener">a new study</a> published in the journal PLOS ONE earlier this month from researchers at California State University Long Beach Shark Lab reveals a different side of juvenile great whites.Using drones, the researchers surveyed the activity of sharks for a span of just over two years in the waters of 26 beaches in <a href="https://www.businessinsider.com/southern-california-coast-hotspot-great-white-sharks-beaches-shore-2023-2">southern California</a>.<div type="image" title="A researcher holds up a white drone to use to survey juvenile white sharks in their natural habitat." height="1250" width="1920" msid="100968000" hostid="261"></div>They conducted a total of 1,644 aerial drone surveys and found that juvenile great white sharks came close to human swimmers, paddle boarders, and surfers 97% of the time during their study, but the sharks never attacked once."Frankly, we were shocked. But it's probably not because they're fond of us.The shallow water near the beaches "is actually the natural habitat the juvenile white sharks use. Big sharks mostly <a href="https://ocean.si.edu/ocean-life/sharks-rays/sharks#:~:text=They%20are%20found%20in%20just,and%20under%20the%20Arctic%20ice." target="_blank" rel="noopener">dwell in the open ocean</a> or deep sea regions.Also, juvenile great whites prefer warmer waters, which again may overlap with regions beachgoers flock to."They're using the same habitats as human recreational water users," said <a href="https://www.drcatherinemacdonald.com/" target="_blank" rel="noopener">Catherine Macdonald</a>, a marine conservation biologist and director of the University of Miami Shark Research and Conservation Program.<div type="image" title="Graphic showing that juvenile white sharks swam closest to paddle boarders." height="433" width="777" msid="100968006" hostid="261"></div>"This is completely normal shark behavior and there is nothing that suggests to me that sharks are choosing locations based on human presence," Macdonald added.<h2>Why juvenile white sharks don't typically attack humans</h2>Although great white sharks are infamous for attacking humans, the actual number of attacks is low. You're more likely to get struck and die by lightning.In fact, most of these cases in California are of mistaken identity, according to the researchers. Alabama, the SCOTUS ruling that guarantees a defendant "reasonable time" to obtain counsel.</li></ul>When former President Donald Trump's attorneys sought to push the ex-president's federal election interference trial to April 2026, they cited the landmark Supreme Court case regarding the infamous convictions of the "Scottsboro Boys" — nine young Black men falsly accused of raping two white women. In the 1932 decision, Powell v. Alabama, the court's ruling guaranteed the right of a defendant to "reasonable time and opportunity to secure counsel."The Scottsboro case attracted widespread attention. The men were swiftly arrested, tried, and sentenced within weeks, with hardly had any opportunity to speak with their attorneys before their convictions.As a result of Powell, the men had their convictions reversed — but the effects of the accusations didn't go away. Collectively, the men had spent decades in prison. By 1950, some battled declining health and violence. One of the men died by suicide. Trump's legal team, in seeking to fight charges that Trump sought to subvert the 2020 presidential election results, argued that that the former president needed additional time to prepare a defense, pointing to Powell.US District Judge Tanya Chutkan wasn't persuaded by the citation and <a href="https://www.businessinsider.com/trump-election-interference-trial-super-tuesday-federal-court-start-date-2023-8">set the trial</a> to begin in March 2024."I have seen many cases unduly delayed because a defendant lacks adequate representation or cannot properly review discovery because they are detained," the judge said. "That is not the case here."Chutkan said that Trump — who has not been jailed for any extensive period of time — had a "profoundly different" situation that what was outlined in Powell.Dehlia Umunna, a professor at Harvard Law School, recently <a href="https://www.washingtonpost.com/history/2023/09/02/scottsboro-boys-trump-election-case/">told The Washington Post</a> that it was "unbelievably juvenile" for the Trump team to cite the Scottsboro case."The Supreme Court held that there was an explicit denial of due process because the Scottsboro defendants were not afforded reasonable time and opportunity to procure counsel," she told the newspaper. Durham was detained on armed robbery charges, and Parish was detained on attempted second-degree murder charges, the sheriff's office said. "These kids are in danger. The risk comes from a whole number of sources that we outline in the lawsuit, but the biggest one is just endemic violence in these facilities," said Previn Warren, from the law firm of Jenner &amp; Block. "There are not enough staff and the staff that are there are not adequately trained to contain the amount of violence that is going on … kids are just getting hurt." The lawsuit, which was filed Tuesday, alleges that the South Carolina Department of Juvenile Justice is violating the civil rights of children detained at the Broad River Road Complex and four other state detention facilities. It also states that staff at the facilities use solitary confinement — in cells with no natural light — as a way to "protect" them from violence, which is rampant in the facilities. Some children spend months in isolation, and there is no meaningful educational or mental health services for the detained youth, according to the lawsuit, which was filed on behalf of the South Carolina State Conference of the NAACP, Disability Rights South Carolina, and Justice 360.More than 250 children are in custody, and they are disproportionately Black and from families that live below the federal poverty line, according to the suit.<div type="image" title="Violence DJJ" height="361" width="723" msid="91158881" hostid="261"></div><h2>Endemic violence </h2>The lawsuit details documented cases of violence against the detainees, by each other, as well as staff. Between July 2018 and May 2019, there were "134 fights and 71 assaults that resulted in 99 injuries to youth in a facility with an average daily population of just over 100," according to the lawsuit, which cited a recent Justice Department report. The civil rights groups allege that when children are assaulted, staff does little to investigate or record the incidents. In cases where they believe a child will continue to be assaulted, they use solitary confinement to keep them away from the attackers.There, they are held for 23 hours a day with no sunlight. Earlier this year, one unnamed 16-year-old detained at the BRRC was assaulted by three other kids who entered his room. He was left "bleeding profusely." "Rather than intervening in the attack, the officer on duty told Child 1 to stay away from the facility's cameras so that he could not be seen bleeding," the lawsuit said.In another case, a 15-year-old detained at the state's <keyword id="12330258" type="UNKNOWN" weightage="60" keywordseo="juvenile-detention" source="Orion">Juvenile Detention</keyword> Center was assaulted by several boys who kicked him in the head as he laid on the floor, according to the suit. There was one correctional officer nearby and he was unable to break up the fight, and had to call for backup. Eventually, he was taken to the infirmary and was only treated with Tylenol, despite severe injuries, according to the suit. Since then, the same group of assailants have been allowed to "approach, taunt, and menace him," the suit says.First quarter of 2021, there were 25 instances of inappropriate sexual contact, with a majority at BRRC. There were a total of 178 injuries to youth at that five facilities during the same time period. Staff was responsible for five assaults, according to the lawsuit. <div type="image" title="DJJ juvenile detention" height="740" width="688" msid="91158882" hostid="261"></div><h2>"Nightmarish" conditions </h2>The civil rights groups allege inhumane conditions at the facilities, where rooms are overrun with odor, trash, and bugs. When toilets back-up, for example, they have been left unfixed for weeks. On one occasion, sprinklers went off, and the children continued to be housed in standing water, as their clothes and bodies were soaked, the suit says."In certain facilities, maggots and cockroaches come up through the drains," the suit alleges.Some of these allegations have been documented in the media. During a staff walk-out last summer protesting worker conditions at BRRC, correctional employees spoke out about a broken sewage system that left waste all over the floor.Lt. Ricky Dyckes Jr., told reporters, according to the suit, that there were tissues, feces, urine on the floor. "You can smell it when you come to lock up," he is quoted saying in the lawsuit. "Those kids are inhaling it and living in those conditions. This is just unacceptable." <div type="image" title="Eden Hendrick listens as Gov. Henry McMaster nominates her to be the next director at the South Carolina Department of Juvenile Justice" height="3840" width="5760" msid="91158883" hostid="261"></div><h2>A history of issues </h2>South Carolina's juvenile detention facilities have been in and out of the spotlight since the 1960s, when Pulitzer Prize winning reporter Howard James exposed that boys were "beaten with fists, rubber hoses, ropes, broken hoe handles and broom handles, and other weapons." In the 1990s, a group of law firms and civil rights organizations representing children incarcerated in the facilities successfully sued the agency over the use of solitary confinement, and was put under a consent decree, which required monitoring from an outside agency.The state ended up paying $1.1 million to settle 9 nine claims alleging that children as young as ten years old had been sexually assaulted at DJJ facilities at the time."One thing that really shocks my conscience about this case is just how long these abuses have been going on and how many attempts there have been to fix them that have not ultimately resulted in lasting change for this very vulnerable population," Warren told Insider.For the last year, walk-outs, audits, and a DOJ report resulted in the resignation of the former executive director Freddie Pough.  In February Eden Hendrick was named as new director, after working as the acting director for the five months prior.She has publically acknowledged failures of the department. "We're not here to indict the current leader. We're here to task for the systemic changes that current leadership is acknowledged needs to happen," Warren said. "These are systemic failings that predate director Hendrick's tenure by years and decades, so this isn't about any lack of leadership on her part. It's about ensuring that the changes that she has indicated she wants to implement do get implemented and are appropriately resourced, and happen fast because these kids are in danger and they need the help right now." A message left with the Department of Juvenile Justice was not immediately returned.
