<keyword id="860096" type="PERSON" weightage="20" keywordseo="Section-497">Section 497</keyword> of the <keyword id="75223" type="ORGANIZATION" weightage="20" keywordseo="Indian-Penal-Code">Indian Penal Code</keyword> has become a hot topic following an important ruling by the Supreme Court which scrapped this law altogether. Here we discuss in length about this law and what it implied so far. Section 497 of the India Penal Code deals with adultery. The recent judgment by the Supreme Court overturned there earlier rulings that upheld that the said law was constitutional. As per the Supreme Court’s recent decision, Section 497 of IPC goes against the constitution of India and hence need to be scrapped altogether. The bench that pronounced the recent judgment consisted of five judges including the Chief Justice <keyword id="6355251" type="PERSON" weightage="20" keywordseo="dipak-misra">Dipak Misra</keyword>, and Justices R F Nariman, A M Khanwilkar, DY Chandrachud and Indu Malhotra. Overview of Section 497 of IPC Section 497 of IPC says it is a punishable offense for a man to have sexual intercourse with a married woman without the consent of her husband. The man committing such an offense can be imprisoned for five years or more and can also be asked to pay a fine. Understanding ‘adultery’ in the legal context The dictionary meaning of the term adultery reads thus, "adultery is a voluntary sexual intercourse between a married person and a person who is not their spouse". The petitioners wish to address a few problems connected to Section 497 of IPC as explained hereunder. One big concern regarding this law is that it does not appear to be gender-neutral. In case of any act of adultery committed, the law calls for punishing the man but not the woman involved. Section 497 does not enable a woman to file a complaint against her husband when he has had sexual intercourse with another woman. A number of people call this an anti-woman law since the law seems to reduce a woman as a mere object. As per what the said law implies, a man does not need the consent of the woman to have sexual intercourse with her. The law only says, the said act will not be a crime if the woman’s husband agrees for the act. How the Supreme Court interpreted Section 497 of IPC The judges have stated recently that the Section 497 seems outdated. In fact, it appears to violate the Articles 14 and 21 of the IPC. While commenting on the said law, the justices remarked, "Adultery can be ground for civil issues including dissolution of marriage but it cannot be a criminal offence." The bench also added further that Section 497 looked 'unconstitutional' as it violates the right to equality. There are no reasons whatsoever to continue this law that does not serve the intended purpose. Nevertheless, the Supreme Court upheld that adultery can be a valid ground for applying for divorce. Talking at length about the law and the reasons for scrapping the law, Justice DY Chandrachud commented that Section 497 deprives women of their dignity. CJI Misra said, "Women must be treated with equality with men. Any discrimination shall invite wrath of Constitution. A woman can't be asked to think the way society desires."

What is Section 497 IPC

Chief Justice of India (<keyword id="19946587" type="General" weightage="20" keywordseo="cji" source="keywords">CJI</keyword>) DY Chandrachud on Saturday observed that it is "grave danger" to describe the <keyword id="19900770" type="General" weightage="20" keywordseo="court" source="keywords">court</keyword> as a "<keyword id="22227364" type="General" weightage="100" keywordseo="temple-of-justice" source="keywords">temple of justice</keyword> and equate <keyword id="20008218" type="General" weightage="20" keywordseo="judges" source="keywords">judges</keyword> with Gods" as the task of judges is to serve the public interest. Addressing a conference on Contemporary Judicial Developments in <keyword id="22227366" type="General" weightage="20" keywordseo="kolkata-cji-chandrachud" source="keywords">Kolkata CJI Chandrachud</keyword> said that "<keyword id="22226984" type="General" weightage="20" keywordseo="constitutional-morality" source="keywords">constitutional morality</keyword>" reflects an institution's commitment of the Court system. "Too very often, when we are addressed as Honour or as Lordship or as Ladyship. There is a very grave danger when people say that the court is a temple of justice. There is a grave danger that we perceive ourselves as the deities in those temples," Chandrachud said. The CJI said that "he feels reticent when he is told that the court is the temple of justice because the temple postulates that the judges are in the position of a deity." "I would rather recast the role of the judge as a server of the people. And when you regard yourselves as people who are there to serve others, then you bring in the notion of compassion, of empathy, of judging but not being judgmental about others," the CJI said. He further emphasized on the word 'contemporary' and said that the word itself speaks about in the context of contemporary <keyword id="22227365" type="General" weightage="20" keywordseo="societal-challenges" source="keywords">societal challenges</keyword> which the judges face in the work they do. "This conference speaks on Contemporary Judicial Developments and strengthening justice through law and technology. The word 'contemporary' is very important because it does not speak about the work which we do in the abstract, but in the context of contemporary societal challenges which we as judges face in the work we do. We, therefore, look at the law and its intersection of technology from the perspective of the societal conditions in which those whom we serve exist in our societies because the true merit of our work lies in addressing challenges faced by those at whose feet we are intended to serve the common citizens of India," he said. He further said that the people exist in a federal structure that is marked by a great deal of <keyword id="20051946" type="General" weightage="20" keywordseo="diversity" source="keywords">diversity</keyword>. "I was born in Mumbai, belong to a small village located 60-70 kilometers away from Pune. The work as judges we do in Delhi is to realize the importance of preserving the diversity of India. So how do we then dwell on the constitutional of morality? At one level constitutional morality is founded in the permeable values. The values which the Constitution, Preamble sets out," he added. The CJI said that C onstitutional morality addresses itself in every component of society. "The Consitution is not merely a dialogue between the states and its citizens, or Union or the states, or States and States. It is a dialogue within and between the societies. The Consitution Morality itself addresses to every component of society," he said. He said that even while sentencing anyone in a criminal case, the judges do that with a sense of compassion, since at the end, a human being is being sentenced. "So these concepts of constitutional morality, which I think, are the key, not just for the judges of the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="261" meta.entityid="Supreme Court">Supreme Court</keyword> or the High Court but also for the district judiciary itself, because the engagement of the common citizens begins first and foremost with the district judiciary," <keyword id="20026571" type="General" weightage="20" keywordseo="CJI-Chandrachud" source="keywords">CJI Chandrachud</keyword> said. He further stressed on the relevance of technology in the functioning of the judiciary and said that the language is the central barrier to accessing and understanding verdicts by common people. "Technology can provide us with some answers. Most judgments are written in English. Technology has enabled us to translate them. We are translating 51,000 judgments in other languages," CJI said.

"Grave danger": CJI Chandrachud on equating court with temple, judge with God

New Delhi [India], November 24 (ANI): Hearing the Adani-Hindenburg matter, the <keyword id="6354977" type="General" weightage="50" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday remarked that it is easy to make allegations against anyone and opined the petitioners to show some responsibility while levelling charges against any party. A bench of Chief Justice of India DY Chandrachud, also comprising justices JB Pardiwala and Manoj Misra passed the remarks when one of the petitioners raised questions over members of the expert committee. Advocate Prashant Bhushan, appearing for one of the petitioners, told the court about one of the members of the expert committee Somashekhar Sundaresan, noting that he has been a lawyer representing Adin various forums including in the SEBI Board. CJI DY Chandrachud raised an objection to the petitioner's submission and remarked that if one goes with the theory that a lawyer who appeared 17 years ago can now not be appointed to the committee and like this, no lawyer who has appeared for an accused should become a High Court judge. CJI DY Chandrachud remarked that he is not an in-house counsel he was a lawyer and he appeared in 2006 and this conflict arose 17 years later. There has to be some responsibility for the allegations being levelled, SC remarked. During the hearing, the court also remarked that it is easy to make allegations and one must be also very careful. "We are not giving a character certificate to anyone," SC noted. When the hearing commenced today, Solicitor General Tushar Mehta told the top court that SEBI is not seeking an extension of further investigation matters relating to the Hindenburg report. Out of 24 cases in the Adani-Hindenburg matter, investigations in 22 cases are over For the remaining two cases, they need information from foreign regulators and others and they have been in consultation with them, SG Mehta informed the court. The court then said that it had intervened in the matter due to the extreme volatility of the stock market and sought to know what is SEBI planning to do for such kind of volatility and planning to protect investors in cases like short selling. SG Tushar Mehta took the court through the recommendations of the Expert Committee which SEBI has agreed with in principle. Advocate Prashant Bhushan, appearing for the petitioner, told the SC that there were many factual revelations in the Hindenburg report. He raised doubts about SEBI's role in the matter and says a lot of information was available to it in 2014. Bhushan informed the SC about a letter written in 2014 by the Directorate of Revenue Intelligence regarding substantial money siphoned to Mauritius. SG Mehta questioned Bhushan over this and said that DRI concluded the proceedings in 2017. The court remarked that to advocate Bhushan, appearing for the petitioner, it is easy to make allegations and one must be also very careful. SG Tushar Mehta urged the top court to stop these kinds of allegations. The court remarked that SEBI, a statutory body looks into stock market frauds. SG Tushar Mehta said that there is a growing tendency to plant stories outside India to influence decisions within India. After hearing the matter in length, the court reserved the order on various aspects related to the issue. Earlier, the <keyword id="6355630" type="General" weightage="50" keywordseo="securities-and-exchange-board-of-india" source="Orion">Securities and Exchange Board of India</keyword> (SEBI) filed a status report before the Supreme Court apprising it that out of 24 investigations arising out of the Hindenburg report, 22 are final in nature and 2 are interim in nature. The investigation was carried out in compliance with the directions of the top court's order dated March 2, 2023, SEBI has investigated 24 matters. In the mid of May, the top court gave three months more time to the Securities and Exchange Board of India (SEBI) to conduct a probe into the Hindenburg report SEBI was granted time till 14th August 2023 to conduct the probe. On March 2, the <keyword id="6356229" type="General" weightage="80" keywordseo="apex-court" source="Orion">apex court</keyword> directed the capital market regulator SEBI to investigate any violations of securities law by the <keyword id="6367820" type="General" weightage="80" keywordseo="adani-group" source="Orion">Adani Group</keyword> in the wake of the Hindenburg report, which led to a massive wipeout of more than USD140 billion of the Adani Group's market value. Supreme Court, on March 2, set up an expert committee on the issue arising from the <keyword id="9916845" type="General" weightage="50" keywordseo="hindenburg-research" source="Orion">Hindenburg Research</keyword> report on Adani Group companies. The committee will consist of six members, headed by former apex court judge Justice AM Sapre. The top court had then asked SEBI to file a status report within two months. The apex court was then hearing petitions pertaining to the Hindenburg report, including the constitution of a committee relating to regulatory mechanisms to protect investors' interests. The January 24 Hindenburg report alleged stock manipulation and fraud by the conglomerate. The Adani Group has attacked Hindenburg as "an unethical short seller", stating that the report by the New York-based entity was "nothing but a lie". Adani-Hindenburg case: Easy to make allegations, can't take unsubstantiated ones, remarks SC

The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Thursday declined to postpone the GATE-2022 exam saying that postponement will create "chaos and uncertainty" in the lives of students who have registered for it. A bench headed by <keyword id="3360108" type="General" weightage="20" keywordseo="Justice-D-Y-Chandrachud" source="Orion">Justice D.Y. Chandrachud</keyword> and comprising <keyword id="12007072" type="General" weightage="20" keywordseo="justices-surya-kant" source="Orion">Justices Surya Kant</keyword> and <keyword id="177282" type="General" weightage="20" keywordseo="vikram-nath" source="Orion">Vikram Nath</keyword> said the court is not willing to entertain a petition 48 hours before the exam, as it will create chaos and uncertainty in the lives of the students who have already registered for the GATE-2022 exam. The bench was informed that over 9 lakh students are taking the GATE-2022 exam. The bench added that there is no overarching reason for it to exercise its jurisdiction under Article 32 of the Constitution, to supplant the duties and functions of the regulatory authorities who have taken a decision in connection with the schedule of the exam. The bench pointed out that now everything is opening up and it is not correct for courts to step into academic matters. The bench said: "We are not inclined to entertain a petition under Article 32...These petitions are accordingly dismissed." Advocate Satpal Singh, representing a petitioner, contended that many state governments have imposed a lockdown on weekends, and in this backdrop holding the exam is unfair and urged the court to defer the exam for a month. The bench told the petitioners counsel that some petitioners have moved before it and many others have already prepared for the exam. It pointed out that the exams were notified in August last year and 9 lakh are appearing for it, and 20,000 have signed an online petition. "Only authorities can look into this", said the bench. Justice Chandrachud queried the petitioners' counsel, "Look at the legitimacy of courts entering into these thickets. Just because some states have issues, how do we play with the careers of all students..." After a detailed hearing in the matter, the top court dismissed the pleas seeking postponement of the exam in the backdrop of third Covid wave. Supreme Court junks plea to postpone GATE-2022 exam

The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Friday cleared the decks for postgraduate medical counselling and admissions, including the Other Backward Classes (<keyword id="45661" type="General" weightage="80" keywordseo="obc" source="Orion">OBC</keyword>) and economically weaker sections (<keyword id="11939755" type="General" weightage="100" keywordseo="ews" source="Orion">EWS</keyword>) reservations for the current academic year, 2021-22. A bench headed by <keyword id="3360108" type="General" weightage="20" keywordseo="Justice-D-Y-Chandrachud" source="Orion">Justice D.Y. Chandrachud</keyword> and A.S. Bopanna upheld the constitutional validity of 27 per cent reservation for OBC and 10 per cent EWS for the NEET-UG and NEET-PG. However, the top court added that it would decide on the rationale of criteria of Rs 8 lakh income for EWS category in March this year. On Thursday, after conducting a day-long hearing on petitions challenging the validity of EWS quota in postgraduate medical admissions and the Centre's argument favouring the quota, the court said there is a situation, where in national interest, the counselling has to begin, which was also a key demand of protesting resident doctors. A bench comprising Justices D.Y. Chandrachud and A.S. Bopanna said: "We are in a situation, where in the national interest the counselling has to begin." Solicitor General Tushar Mehta, representing the Centre, argued that all candidates eligible for the EWS quota, as per existing criteria, have got their certificates for registration and added that seats in all the government colleges have been increased to accommodate the EWS quota. "So, this will not harm the chances of general category students...", he added. Mehta also clarified that super-speciality courses have no reservation and none of the judgments remotely suggests that there cannot be reservation in PG courses. On the aspect of the EWS quota, he said there was a study, application of mind, and wide consultation when the government decided to fix the Rs 8 lakh income limit. The Centre has accepted the report of a three-member panel constituted to revisit the EWS criteria. The panel, in its report, said: "Firstly, the EWS's criteria relates to the financial year prior to the year of application whereas the income criterion for the creamy layer in OBC category is applicable to gross annual income for three consecutive years." The panel added: "Secondly, in case of deciding the OBC creamy layer, income from salaries, agriculture, and traditional artisanal professions are excluded from the consideration whereas the Rs 8 lakh criteria for EWS includes that from all sources, including farming. So, despite being the same cut-off number, their composition is different and hence, the two cannot be equated." After hearing the parties in the matter, the top court reserved its judgment on the petitions challenging the 27 per cent reservation for Other Backward Classes (OBC) and 10 per cent reservation for EWS in all-India quota seats for postgraduate medical courses. As many as 15 per cent seats in MBBS and 50 per cent seats in MS and MD courses are filled through all-India Quota from the candidates selected through the NEET. NEET-PG admissions: Supreme Court allows counselling with 27% OBC and 10% EWS quota

Union Minister <keyword id="20150028" type="General" weightage="20" keywordseo="Chirag-Paswan" source="keywords">Chirag Paswan</keyword> expressed his disagreement with the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords" meta.keywordsubtype="org" meta.entityname="Supreme Court" meta.hostid="261" meta.entityid="Supreme Court">Supreme Court</keyword>'s observation on <keyword id="22418374" type="General" weightage="20" keywordseo="creamy-layer" source="keywords">creamy layer</keyword> among Scheduled Castes and Scheduled Tribes, and said that the <keyword id="22663720" type="General" weightage="20" keywordseo="Lok-Jandhakti-Party" source="keywords" meta.keywordsubtype="org" meta.entityname="Lok Jandhakti Party" meta.hostid="261" meta.entityid="Lok Jandhakti Party">Lok Jandhakti Party</keyword> (Ram Vilas) will be filing a review peition against the ruling. Emphasising that <keyword id="20053971" type="General" weightage="20" keywordseo="Dalit" source="keywords">Dalit</keyword> people in various spheres of life still face <keyword id="21301343" type="General" weightage="20" keywordseo="untouchability" source="keywords">untouchability</keyword>, Paswan said that the basis of giving <keyword id="19914887" type="General" weightage="20" keywordseo="reservation" source="keywords">reservation</keyword> to Scheduled Caste is 'untouchability,' so there is no point of creamy layer in it. "We disagree with the observation of the Supreme Court and we have registered this disagreement prominently. We are clear about this that the base of the Scheduled Caste is untouchability. It does not have an educational or economic basis. In such a situation, there can be no provision of creamy layer in it, reservation within the reservation is not correct, because even today the example of a Dalit youth is given who is prevented from riding a mare," Chirag Paswan told reporters on Sunday. "There are many such big names, who are on high posts, but even after they go to the temple, the temple is washed with Ganga water, so even today discrimination takes place based on untouchability... We, LJP (Ram Vilas) are also going to file a <keyword id="20143564" type="General" weightage="20" keywordseo="review-petition" source="keywords">review petition</keyword> in the Supreme Court regarding this matter," he added. The Supreme Court, in a landmark ruling on Thursday, ruled that states have the power to sub-classify SCs and STs and said that the authority concerned, while deciding if the class is adequately represented, must calculate adequacy based on effective and not quantitative representation. The top court ruled by a majority judgement of 6:1, that sub-classification within the SCs and STs reservation is permissible. As many as six separate opinions were delivered in the case. The judgement was delivered by the seven-judge bench led by Chief Justice of India DY Chandrachud, which overruled earlier judgement in the EV Chinnaiah matter, which had held that sub-classification was not permissible because SC/STs form homogenous classes. Besides CJI Chandrachud, other judges on the bench were Justices BR Gavai, Vikram Nath, Bela M Trivedi, Pankaj Mithal, Manoj Misra, and Satish Chandra Sharma. Justice Bela M. Trivedi, in a dissenting opinion, said that she disagreed with the majority judgement that sub-classification within the Scheduled Caste and Scheduled Tribes is permissible.

Chandrachud commenced his address by lauding the conference's revolutionary focus on technology and its potential to catalyse crucial dialogues at the crossroads of technology and the judiciary. He acknowledged the profound impact of judicial dialogues in fostering cross-cultural exchange and mutual learning among diverse legal systems. Highlighting the deep-rooted ties between India and Singapore, Chandrachud commended both nations for their commitment to upholding the rule of law and promoting access to justice. "Judicial dialogues indeed play a vital role in fostering cross-cultural exchange and mutual learning among different legal systems. India and Singapore share not only deep social, cultural, and economic ties but also a commitment to upholding the rule of law and promoting access to justice. As two dynamic and rapidly evolving nations, both India and Singapore recognise the transformative potential of technology in modernising their respective judicial systems," said the CJI. He lauded Singapore's emergence as a global technology and innovation hub, citing its adoption of cutting-edge initiatives such as online dispute resolution platforms and electronic filing systems. "Singapore has positioned itself as a global hub for technology and innovation. With its strategic location, business-friendly environment, and robust legal framework, Singapore has attracted top talent and investment in the tech sector... Additionally, the Singapore International Commercial Court leverages technology to facilitate international dispute resolution, offering efficient and cost-effective solutions for resolving cross-border commercial disputes," he further said. The CJI praised India's strides in leveraging technology to modernise its judiciary, particularly through initiatives like the e-Courts project. "India boasts a vibrant tech ecosystem and a rich legal heritage. With a population of over a billion people and a rapidly growing economy, India presents enormous opportunities in adopting technology within the <keyword id="20199889" type="General" weightage="20" keywordseo="judicial-system" source="keywords">judicial system</keyword>. The e-Courts project, for instance, aims to computerise court processes, digitise case records, and establish online case management systems across all levels of the judiciary. By reducing administrative burdens and automating routine tasks, e- Courts enhance the speed and efficiency of legal proceedings, ultimately improving access to justice for all citizens," Chandrachud said. The Chief Justice then turned his attention to the transformative potential of AI in legal research, describing it as a "game-changer" that empowers legal professionals with unmatched efficiency and accuracy. He elucidated specific instances where AI, notably ChatGPT, had been utilised in court adjudication, citing examples from Colombia and India. "Additionally, the Supreme Court of India introduced live transcription services, an initiative aimed at enhancing accessibility to legal information. This initiative has been particularly impactful in addressing linguistic diversity, as live transcription services translate judicial proceedings into 18 regional languages and Hindi, ensuring that legal information is accessible to citizens across India using AI termed as the Supreme Court Vidhik Anuvaad Software. This not only saves time and resources but also improves access to justice by reducing delays and backlogs in the court system," he said, "In 2023, Justice Juan Manuel Padilla, a Colombian judge, utilised the ChatGPT to deliver a judgment in a case involving insurance claims for an autistic child," Chandrachud elaborated, underscoring the complementary role of AI in augmenting judicial reasoning rather than supplanting it. Similarly, he recounted how the Punjab and Haryana High Court in India sought insights from ChatGPT in a bail petition. However, Chandrachud cautioned against overlooking the ethical, legal, and practical considerations associated with <keyword id="20230984" type="General" weightage="20" keywordseo="AI-integration" source="keywords">AI integration</keyword> into court proceedings. "These instances show that we cannot avoid the question of using AI in court adjudication. The integration of AI in modern processes including court proceedings raises complex ethical, legal, and practical considerations that demand a thorough examination. The use of AI in court adjudication presents both opportunities and challenges that warrant nuanced deliberation," he asserted. He noted the importance of transparency, accountability, and fairness in AI utilisation, highlighting concerns about potential errors and biases inherent in AI systems.
