<ul><li>A former court staff has accused <keyword id="45053" type="POSITION" weightage="20" keywordseo="Chief-Justice-of-India">Chief Justice of India</keyword> <keyword id="245445" type="PERSON" weightage="40" keywordseo="Ranjan-Gogoi">Ranjan Gogoi</keyword> of making sexual advances at her in his home office, according to a report. </li><li>The appellant has also alleged that she was dismissed when she resisted and that her family members were targeted thereafter. </li><li>Supreme Court of India assembled a special bench, including CJI Gogoi, to hear the case on Saturday.</li></ul>The Chief Justice of India (CJI), Ranjan Gogoi, has been accused of sexual harassment by a former staff, <a href="https://scroll.in/article/920678/chief-justice-of-india-sexually-harassed-me-says-former-sc-staffer-in-affidavit-to-22-judges">according to a report by Scroll</a>. In the wake of this shocking allegation, the Supreme Court of India assembled a special judges’ bench on Saturday (April 20), which CJI Gogoi was also a part of. A former court officer who worked from Gogoi’s home office between August and December 2018 has accused the CJI of making sexual advances adding that when she resisted, she was unceremoniously terminated. In an affidavit, the 35-year old woman has also alleged that even her family members were targeted and harassed after her dismissal. The registrar’s note said that the special hearing was scheduled on a “matter of great public importance touching up on the independence of the judiciary.” Solicitor General Tushar Mehta prodded the Bench to register a complaint in his name but the court refrained for the time being and asked to media to show restraint, responsibility and wisdom so that the independence of the judiciary is not affected by baseless allegations.

Ranjan Gogoi was one of the four judges who came out in an unprecedented press conference in January 2017 protesting against the then CJI <keyword id="6355251" type="PERSON" weightage="20" keywordseo="dipak-misra">Dipak Misra</keyword>. In a letter, four senior judges had said that “there have been instances where cases having far reaching consequences for the nation and the institution have been assigned by the chief justices of this court selectively to the benches ‘of their preference’ without any rationale basis for such assignment.” Gogoi signed off on the letter saying,“it’s a discharge of debt to the nation which we have done.”

<ul><li>India’s Supreme Court has issued a blanket ban on stubble burning in Punjab, Haryana and UP to keep Delhi’s air quality from getting worse. </li><li>“Farmers cannot kill others for their own livelihood,” said Justice Arun Mishra. </li><li>The administration at large will be held responsible for any stubble fires going forward. </li><li>The Supreme Court will hold another hearing on Wednesday where chief secretaries from the respective states have been asked to explain why there is on fine against stubble burning. </li></ul>India’s Supreme Court called for a hearing to address the national capital’s deteriorating air quality and the bench is coming down hard on stubble burning. Justice Arun Mishra, one of the judges presiding over the hearing, asserted that farmers in Haryana and Punjab can’t “kill others for their own livelihood”. He also pointed out that stubble burning isn’t harming the people of Delhi but also the residents in their states. The court has directed all crop burning to stop immediately. If caught, the entire administration will be held responsible. Another hearing will be held on Wednesday on the matter. Chief secretaries of Punjab, Haryana and UP have been asked to attend the hearing. They will be asked to explain why stubble burning shouldn’t be fined and is still prevalent in their states. Accusing the center and state governments of passing the buck, Mishra blamed them for “making a mockery of the system”, to the point that people are being advised not to venture into the city. “This cannot happen in a civilised country. Right to life is most important,” he said. Putting out the fires The Joint Secretary from the Ministry of Environment, Forest and Climate Change (MoEF) told the bench that satellite feed of the active fires have been shared with the relevant authorities. Following which the Additional Solicitor General (ASG) of India , Atmaram Nadkarni, informed the court that the fires have been extinguished. He said the next step is to make sure that no new fires come up. The MoEF wanted to use a reward system to entice people into reporting fires but the court felt that questioned whether leaving it up to informers would be enough. Instead, it has put police and local administration in charge of making sure that stubble burning does not take place. Supreme Court bring down the hammer In addition to restricting all stubble burning, the Supreme Court has also put a blanket ban on all demolition and construction activity in the National Capital Region (NCR). Should construction continue despite the ban, the local administration will be held liable. A fine of ₹1 lakh will be levied on those found engaging in such activities. Those found burning garbage will also have to face a fine of ₹5,000. The Delhi government has been asked to explain how it justifies restricting the movement of private vehicles through the odd-even scheme, but allows 2-wheelers, 3-wheelers and taxis to continue their operations uninterrupted. “Delhi is choking every year and we are not able to do anything. Every time this is happening for ten to fifteen days,” said Justice Arun Mishra.

DoT withdraws order that asked for no coercive action against defaulting telcos

The Supreme Court on Wednesday recalled its March 27 order, where it had allowed the sale of BS-IV compliant vehicles for 10 days, barring in Delhi-NCR, after the lifting of the <keyword id="8902499" type="UNKNOWN" weightage="20" keywordseo="nationwide-lockdown">nationwide lockdown</keyword> imposed to fight the <keyword id="1754604" type="PERSON" weightage="20" keywordseo="coronavirus">coronavirus</keyword> pandemic. In its March order, the top court had allowed some relief to the <keyword id="128764" type="PERSON" weightage="20" keywordseo="auto-dealers">auto dealers</keyword>, permitting the sale of 10 per cent unsold BS-IV inventory. The apex court on Wednesday said that it will not allow registration of BS-IV vehicles sold after March 31. A bench headed by Justice Arun Mishra and comprising Justices S. Abdul Nazeer and Indira Banerjee pulled up the Federation of Automobile Dealers Association of India (FADA), saying it would be a violation of the court order if it allowed sale of vehicles after opening of the lockdown. "No BS-IV vehicle will be registered if sold after March 31, 2020," noted the top court. The bench observed that registration takes time after the sale of the vehicle, and told the FADA that BS-IV vehicles are sold and it wants registration for these vehicles despite orders passed earlier. Senior advocate <keyword id="9538472" type="PERSON" weightage="20" keywordseo="k-v-viswanathan">K.V. Viswanathan</keyword>, representing FADA, argued that the court allowed registration in March, and the order from the top court says no registration after March 31, and if one buys a vehicle before that, registration has to be done. The bench replied that it is asking about transactions after the order was passed. "We will protect only if VAHAN registration is correct. We will ask the government to check VAHAN data. How were vehicles sold online at 3 per cent to 40 per cent off? That too after March 31, what is this fraud," asked the SC bench. Justice Mishra told FADA not to take advantage by playing fraud. The bench asked the Centre to file data on vehicles uploaded on VAHAN portal post March 31, and also 15 days prior to this date. The top court also asked the FADA to give details of the vehicles sold to the government. The bench has posted the matter for further hearing on July 23. On June 15, the apex court had slammed the FADA for not following its order permitting the sale of limited BS-IV vehicles after March 31, after which BS-VI emission norms came into force. The bench observed that the court allowed the sale and registration of 1.05 lakh BS-IV vehicles, but it seems 2.55 lakh vehicles were sold. The top court has sought details of sale and registration from the FADA. The apex court had fixed the deadline of March 31, 2020, for the sale of <keyword id="6370870" type="COMPANY" weightage="20" keywordseo="bs-iv">BS IV</keyword> compliant vehicles across the country. It had it clear that no BS-IV vehicles will be allowed to be sold in Delhi-NCR from April 1, 2020. Supreme Court withdraws order of registering BS-IV vehicles post lockdown

The Supreme Court Monday pulled up the governments of Punjab and Haryana for increase in <keyword id="1023531" type="UNKNOWN" weightage="20" keywordseo="stubble-burning">stubble burning</keyword> despite its order prohibiting it and said people in Delhi can't be left to die due to air pollution. A bench of justices Arun Mishra and Deepak Gupta took serious note of stubble burning in the two states and said that the life span of millions of citizens has shortened and people are "suffocating" due to pollution in Delhi-NCR. "Can you treat people like this and permit them to die due to pollution," asked the bench.

The Supreme Court on Monday, during the hearing on the adjusted gross revenue (AGR) matter of telecom companies, questioned the Centre as to how is it possible to sell the spectrum and whether it is transferable. A bench, headed by Justice Arun Mishra, told Solicitor General Tushar Mehta, representing the Department of Telecommunications (DoT), to come prepared on the next hearing, and explain how can spectrum be sold or whether is transferable. The bench also asked Mehta to get the NCLT orders connected with the query, as it scheduled the next hearing on the matter on August 14. Mehta contended before the bench that the government has filed an appeal saying spectrum is a national property and it should not be part of bankruptcy assets. At this, the bench questioned: "Why there was a delay in filing the appeal? What if the spectrum is sold in the meanwhile?" Mehta contended before the bench that the Centre has told the National Company Law Tribunal that spectrum is a national property, cannot be an asset of the company, and it cannot be sold. The bench also questioned how Aircel's spectrum and license were sold and who gave the permission for it. Aircel's monitoring committee's lawyer contended before the bench that no dues to government are be paid under the bankruptcy resolution plan, and insisted that he will place the details in court. The lawyer contended that the company paid the money to buy spectrum, and it is a transferable asset. The Centre, however, said Aircel's dues were Rs 12,000 crore. As the bench questioned the DoT as to how it proposes to recover the <keyword id="8275485" type="UNKNOWN" weightage="20" keywordseo="agr-dues">AGR dues</keyword> from a company which has gone into insolvency, Mehta replied that DoT's stand is that spectrum cannot be part of bankruptcy assets.

Supreme Court adjourns AGR case hearing to August 14

New Delhi, Jan 21 () The Supreme Court on Tuesday agreed to list next week the fresh pleas of telecom firms, including Bharti Airtel, Vodafone Idea and Tata Teleservices, seeking a fresh schedule of payment of statutory dues to the tune of Rs 1.47 lakh crore to the Department of Telecommunications.
 A bench headed by Chief Justice S A Bobde took note of submissions by a battery of senior lawyers including A M Singhvi and C A Sundaram and said it will list the fresh pleas "sometime in next week" before the same bench which had heard the earlier petition in the high-stake matter.
 "We are not disputing the payment to be made by us rather we want working out of fresh schedule of payment," Sundaram told the bench which also comprised justices S A Nazeer and Sanjiv Khanna.
 The telcos said they wanted an open court hearing on their fresh pleas with regard to working out fresh schedule of payment of their dues .
 "That (open court or in-chamber hearing) will be decided by the bench concerned," the CJI said.
 Earlier on January 16, a bench headed by Justice Arun Mishra had dismissed review petitions of telecom firms seeking review of its earlier order asking them to pay Rs 1.47 lakh crore in statutory dues by January 23, saying it did not find any "justifiable reason" to entertain them. SJK LLP LLP DV
