<ul><li>Two days after Jammu and Kashmir and Ladakh were brought directly under the central government's control, Prime Minister Narendra Modi chose to make a special address to the nation.</li><li>Modi also said that the Union Territory status of Jammu and Kashmir is a temporary measure and the state will get its own assembly as soon as possible.</li><li>While the contentious decision has been contested by his rivals, both houses of the Indian Parliament have approved the Presidential order that redefined Jammu and Kashmir's political status.</li><li>Article 370 and Article 35A had given nothing but terrorism, separatism, dynasty politics, and corruption," he said.</li></ul>Two days the state of Jammu and Kashmir, including the Ladakh region, were split into two Union Territories, Prime Minister Narendra Modi revealed that this is a temporary measure only. While Ladakh will remain under the direct control of the central government, Jammu and Kashmir will get to hold its elections once again and elect a local leader. To those who oppose the move to abrogate Article 370 and Article 35A in Jammu and Kashmir -- provisions that allowed the state to make its own laws -- Modi said that he respects their right to disagree but urged them to keep aside the differences in 'national interest'. This speech has come two days after the central government wrested direct control over the volatile Jammu and Kashmir state by disbanding the province into two Union Territories namely Jammu and Kashmir and Ladakh, first through a Presidential order and later got it ratified by the Parliament.  He assured the people of Jammu and Kashmir that the situation in the region will come back to normal as soon as possible and promised that there will be no obstacle in the upcoming Eid celebrations next week. In his address, PM Modi said that "Article 370 and Article 35A had given nothing but terrorism, separatism, dynasty politics, and corruption." He also added that Pakistan had been using this as a weapon to push its agenda in Kashmir and that over 42,000 people lost their lives in the process. Modi also said that the women of Kashmir were denied equal rights, poor workers did not not get the benefit of India's minimum wage laws, and socially marginalised Scheduled Castes and Scheduled Tribes were deprived of the benefits of the central government's affirmative action. He also promised state benefits, for government employees including the Police in Jammu and Kashmir as well as in Ladakh, like leave travel allowance, house rent allowance, and allowance for children's education among others. "We have removed the obstacles to the development of Jammu and Kashmir," said Prime Minister Narendra Modi in his special address to the nation, which will also be aired on the state-owned All India Radio. Cheaper metro fares The 25 km long metro will connect Indira Nagar to HMT Junction and Hamzuri Bagh to Osmanabad through Srinagar. The fares of this metro will also be cheaper at 1.5 times that of a bus — unlike other metros across the country. The metro project is expected to cost ₹5,108 crore — and nearly 21% of it will be funded by the centre. The Jammu and Kashmir government will also infuse equal amount into the project. Once operational, the government is expecting a return of investment of ₹146 crore from the project, in the first five years. “Revenue for the <keyword id="7960419" type="COMPANY" weightage="20" keywordseo="Srinagar-Metro">Srinagar Metro</keyword> will mainly consist of farebox collection and non-fare box sources such as parking, taxes, advertisements, and property development,” TOI reported citing the Detailed Project Report (DPR) of Srinagar. The said articles had earlier granted special status of the state of Jammu and Kashmir. Hence the laws governing the other states were not applicable to Jammu and Kashmir. The state had its own unique laws. The revoking of articles 370 and 35A has now given way to realizing the cherished dream of patriots “One Nation, One Constitution and One Flag”. The twin decision by the <keyword id="6354477" type="PERSON" weightage="20" keywordseo="Narendra-Modi">Narendra Modi</keyword> government scrapped the articles 370 and 35A on Monday, August 5, 2019 cancelling the special status and all its associated special powers enjoyed by J&amp;K. Henceforth, Jammu and Kashmir will be a separate union territory with a legislature while Ladakh will be another independent union territory without a legislature. Abolishing the special status of J&amp;K and bifurcation of the state had been the demands of majority Indians for so long. Also, the BJP had earlier promised these measures in its election manifesto. Jammu and Kashmir has now become an integral part of India. The state will no more have its own separate laws. The legislation of Jammu and Kashmir will have to follow the constitution of India. The scrapping of <keyword id="2945985" type="PERSON" weightage="20" keywordseo="Article-35A">article 35A</keyword> has now made all Indians eligible to buy a property in Jammu and Kashmir. The elected governments at the state will henceforth function as the governments of other union territories in India. </td></tr></tbody></table> Data from Election Commission Jammu and Kashmir has been sliced down the middle with the Bharatiya Janata Party (BJP) claiming seats in Jammu and Ladakh, while the valley has chosen Farooq Abdullah's Jammu and Kashmir National Conference (JKNC) to represent them. In fact, this is Abdullah's fourth win in Srinagar in his 42-year political career. The state has a reputation for low voter participation. Since 1998, Jammu and Kashmir has registered to lowest voter turnout of all the Indian states in every election. This year, the voter turnout dipped even further. In Anantnag, one of Jammu and Kashmir’s constituencies, the voter turnout was a mere 8.76% — the worst the constituency has seen in two decades. The share of people that did vote chose JKNC's Hasnian Masoodi. In fact, a lot of constituencies that are considered to be PDP’s strongholds recorded low polling numbers as separatists and militant groups reportedly called for a boycott of the Lok Sabha Election. Jammu and Kashmir has 6 Lok Sabha constituencies in total. Baramulla and Jammu went for polling during the first phase of 2019 Lok Sabha elections on April 11. Srinagar and Udhampur voted during the second phase of elections on April 18. The polling in Ladakh was conducted on May 6. Since it has been declared as a highly sensitive constituency, the single seat of Anantnag went for polling in three phases on April 23, 29 and May 6, which was a record setting news in the history of Indian elections. For three years, the constituency of Anantnag remained vacant. Now the key contesting candidates working out their luck from Anantnag seat are Sofi Youssaf of BJP, Ghulam Ahmed Mir of Congress, Hasnain Masoodi of National Conference and Mehbooba Mufti of PDP. In 2014 general elections, Mehbooba Mufti secured a thumping victory over Mirza Mehboob Beg of the National Conference. Mehbooba Mufti is contesting from Anantnag seat for the third time now. During 2014 Lok Sabha elections, the results favored two parties equally by giving three seats each from the state to BJP and PDP (People’s Democratic Party). From Ladakh seat, BJP’s Thupstan Chhewang won in 2014 elections with a thin margin of just 36 votes.

The recent announcement from the Government of India potentially opens up opportunities for our business growth and also create job opportunities. We intend to foray with five cult.fit fitness centres and keep on working to expand our offerings,” said Ankit Nagori, co-founder, cure.fit. Curefit was founded in 2016 by Myntra co-founder Mukesh Bansal and former Flipkart Chief Business Officer Ankit Nagori. In a momentous and bold move, the government of India scrapped the <keyword id="405091" type="PERSON" weightage="20" keywordseo="Article-370">Article 370</keyword> that had granted special status to <keyword id="17605" type="PERSON" weightage="20" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword>. Henceforth, Jammu and Kashmir will become a Union Territory with a legislative assembly. On Monday, August 5, 2019, the central government of India revoked article 370 that had given an exclusively special status to Jammu and Kashmir. The scrapping of the said article puts Jammu and Kashmir on par with the other states and union territories of the country. Scrapping of the article 370 also wipes out the provisions in the article 35(A) which had prevented the non-residents of Jammu and Kashmir from getting state jobs or own a property in the valley. Earlier, Article 35(A) had also given the J&amp;K state government the power to decide if an individual was a permanent resident of the state. Those individuals defined as non-residents by the legislature were prohibited from acquiring a property in the state of Jammu and Kashmir. The said article had also barred the rights over property to the females in the state who get married to non-residents. As a result of the abolition of article 370, the residents of any other state can also buy a property in J&amp;K. Females will get back their right to property even while marrying an individual from outside the state. The present situation is expected to change the face of J&amp;K significantly inviting the setting up of manufacturing firms, businesses, and hotels in large numbers besides seeing the Indian citizens from other states buying properties in the valley.

With both articles abolished, the ‘state’ of Jammu and Kashmir no longer exists. It is bifurcated into two parts — the union territory (UT) of Ladakh without an assembly, and the UT of Jammu and Kashmir with an assembly.

 Union territories are governed directly by the central government, hence earning them the name. States, on the other hand are administrative units, and have their own governments. Article 370 made the provision for the state to have its own constitution. Jammu and Kashmir, and Ladakh will now be two separate Union Territories

Article 370 of the Indian Constitution is a temporary provision that grants a special status of autonomy to the state of Jammu and Kashmir. Article 370 was enacted under part XXI of the constitution that pertains to "Temporary, Transitional and Special provisions". Article 370 accords special status to the state of Jammu and Kashmir. As per this article, all the different provisions of the constitution that are applicable to other states of India are not to be extended to Jammu and Kashmir. How and when Article 370 came about? The provision of Article 370 was drafted in the year 1947 by Sheikh Abdullah, who was appointed as the Prime Minister of Jammu and Kashmir together by Jawaharlal Nehru and Maharaja Hari Singh. During a discussion in the Parliament, Sheikh Abdullah argued that Article 370 must never be kept under the temporary provisions of the Constitution. He insisted that Jammu and Kashmir must be granted what he described as ‘iron clad autonomy’. However, the center did not comply with this demand. The provisions contained in Article 370 Article 370 exempts the state of Jammu and Kashmir from the Indian Constitution excepting in cases of Article 1 and Article 370 itself. The provisions of article 370 permit the state to draft its own constitution. Ultimately this means that the Parliament’s legislative powers are restricted with regard to Jammu and Kashmir. Article 370 states that the parliament will need the concurrence of the state government of Jammu and Kashmir for applying any law in the state other than those related to defense, foreign affairs, communications and finance. This will mean that the residents of the state of Jammu and Kashmir are governed by a separate set of laws in matters of property ownership, fundamental rights, citizenship and some others when compared to the Indians living in other states. As per the provisions contained in Article 370, the citizens of India from the other states of the country cannot purchase any property or land in Jammu and Kashmir. Also, this article says the central government has no powers to declare any financial emergency in the state as per Article 360. Emergencies in Jammu and Kashmir can be declared only during the times of external aggression or wars. If there are any internal disturbances within the state or there are any instances of imminent dangers, the central government cannot declare an emergency in the state unless the state government concedes to the moves of the union government. Under Article 370, the Union government cannot increase or decrease the borders of Jammu and Kashmir. Is it possible to delete Article 370? Article 370 permits deletion through a presidential order. Such an order must be however preceded by the concurrence of the constituent assembly of Jammu and Kashmir. One view says that this article cannot be deleted since such an assembly was dissolved in 1957. Another view says that it can be deleted if the state assembly concedes to deleting it.
