The resolution was moved to initiate discussions between the central government and elected representatives in Jammu and <keyword id="19896255" type="General" weightage="20" keywordseo="kashmir" source="keywords">Kashmir</keyword>, a proposal that drew a furious response from <keyword id="20450486" type="General" weightage="20" keywordseo="BJP-members" source="keywords">BJP members</keyword> who accused the Speaker of bias and lambasted the ruling National Conference (NC) government. Another BJP MLA, Sham Lal Sharma, went further, claiming the resolution had been prepared "in collusion with the Speaker in a guest house." "The mandate (of the Assembly polls) was in favor of abrogation of Article 370 because we (BJP) got 26 percent votes against NC's 23 percent," Sham Lal Sharma argued, framing the election results as support for the Centre’s 2019 decision to revoke Article 370. Meanwhile, Deputy Chief Minister Surinder Choudhary defended the resolution, emphasizing the need to restore special status. In presenting the resolution, Choudhary declared, "This Assembly reaffirms the importance of the special status and constitutional guarantees, which safeguarded the identity, culture, and rights of the people of Jammu and Kashmir, and expresses concern over their unilateral removal." The resolution also called for the Government of India to initiate a dialogue with the elected representatives of Jammu and Kashmir for the restoration of special status and constitutional guarantees and to devise constitutional mechanisms to achieve these ends. "This Assembly emphasises that any process for restoration must safeguard both national unity and the legitimate aspirations of the people of Jammu and Kashmir," the document added. As the fallout continues, the resolution has stirred deep-seated <keyword id="21391765" type="General" weightage="20" keywordseo="political-tensions" source="keywords">political tensions</keyword>, exposing rifts within the Assembly and drawing the spotlight back on the long-running debate over Article 370. BJP members chant “Jai Shri Ram”, tear documents in Jammu and Kashmir Assembly over special status resolution

Islamabad: Foreign Minister Ishaq Dar has said that <keyword id="19991528" type="General" weightage="100" keywordseo="trade-ties" source="keywords">trade ties</keyword> between Islamabad and New Delhi have remained suspended since 2019 due to the imposition of "heavy duties" by <keyword id="19895063" type="General" weightage="20" keywordseo="India" source="keywords">India</keyword> on imports from Pakistan after the <keyword id="20579845" type="General" weightage="20" keywordseo="Pulwama-attack" source="keywords">Pulwama attack</keyword>. In a written reply submitted to the <keyword id="19935944" type="General" weightage="20" keywordseo="national-assembly" source="keywords">National Assembly</keyword> on Saturday, Dar, who also holds the deputy prime minister's slot, said: "India decided to impose 200 per cent duty on imports from Pakistan, suspended the Kashmir bus service and trade across the Line of Control after the Pulwama attack." According to the Dawn newspaper, Dar was responding to a question by Pakistan Peoples Party lawmaker Sharmila Faruqui seeking details about trade challenges faced by Pakistan in its relations with neighbouring countries, especially India. In March, during a press conference in London, Dar highlighted the eagerness of Pakistan's business community to resume trade activities with India. However, his office later clarified that Pakistan has no plan to resume trade relations with India which has been "non-existent" since 2019. Pakistan downgraded its ties with India after the <keyword id="20467268" type="General" weightage="20" keywordseo="indian-parliament" source="keywords">Indian Parliament</keyword> suspended Article 370 on August 5, 2019, a decision that Islamabad believed undermined the environment for holding talks between the neighbours. "We have consistently advocated constructive engagement and result-oriented dialogue to resolve all outstanding issues, including the core issue of Jammu and Kashmir with India...," Dar said on Saturday. The foreign minister said that the "onus is now on Delhi to take steps for the creation of an environment that is conducive to peace and dialogue". India has been maintaining that it desires normal neighbourly relations with Pakistan while insisting that the onus is on Islamabad to create an environment that is free of terror and hostility for such an engagement. Islamabad and New Delhi have a long history of strained relations, primarily due to the Kashmir issue as well as the cross-border terrorism emanating from Pakistan.

Delimitation stands for the defining of the boundaries of assembly or parliamentary constituencies in a country or province governed by a legislative set up. The process of delimitation actually redraws the size and scope of the constituencies and also decides the number of seats that have to be reserved for the Scheduled castes. Delimitation process is repeated in regular intervals to ensure that the different constituencies have a similar number of votes. The process of delimitation is entrusted to a commission specially set up for this purpose. The orders of the delimitation commission cannot be questioned by the state legislative assembly, parliament or any court of law. Delimitation in the past Usually delimitation commissions are set up after every census following the enactment of delimitation Act by the parliament under the Article 82 of the constitution. So far, 4 delimitation acts were passed in 1952, 1962, 1972, and 2002. The existing delimitation of constituencies are the result of the delimitation act, 2002 accomplished in the same year based on the data obtained from the 2001 census. Delimitation Act 2002 In the delimitation Act 2002, a special amendment was made to freeze the delimitation of states in the country till the census after 2026. This will mean that the status of the present constituencies will have to be maintained till the first census after 2026. This amendment was made on the following grounds. When delimitation was done according to the population, the states which achieved in population control found their number of seats reduce while the states reporting higher populations were benefited by more constituencies. Therefore only after 2026, changing the number of seats in the parliament can be considered. Delimitation in <keyword id="17605" type="LOCATION" weightage="20" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword> Following the accession of Kashmir into India, Sheikh Abdulla’s government allotted 30 seats for the Jammu region, 43 seats for the Kashmir region and two seats for the Ladakh region. After this move, the regional disparity continued to exist with Jammu having 37 seats, Kashmir having 46 seats and Ladakh having 4 seats. Between 2005 and 2008, the Gulam Nabi Azad’s government recommended a 25% increase in the number of seats in all the three geographies. Though this process would have increased an additional of 22 constituencies in the assembly, the PDP – Congress alliance could not achieve this since it lacked majority in the assembly. Demands for Delimitation in J&amp;K In 2002, the Farooq Abdullah government amended the constitution of Jammu and Kashmir leading to the freezing of delimitation till 2026. This will mean that the status quo of the constituencies in Jammu and Kashmir will remain the same till 2026 on par with the other states of India. While the need for delimitation is felt increasingly in the region now more than ever in the past, the present moves by the BJP government seeks to fulfill the long-standing demands of the people of Jammu and Kashmir so that they will get an equal representation in the parliament. Legal experts say that the Delimitation Act of 2002 can be struck down by the Governor and the decision will have to get the concurrence of the parliament within a period of six months after passing the ordinance.

Understanding Delimitation in the context of Jammu and Kashmir

Pakistan continues to violate LoC ceasefire with India for the 5th consecutive day

In a momentous and bold move, the government of India scrapped the <keyword id="405091" type="PERSON" weightage="20" keywordseo="Article-370">Article 370</keyword> that had granted special status to <keyword id="17605" type="PERSON" weightage="20" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword>. Henceforth, Jammu and Kashmir will become a Union Territory with a legislative assembly. On Monday, August 5, 2019, the central government of India revoked article 370 that had given an exclusively special status to Jammu and Kashmir. The scrapping of the said article puts Jammu and Kashmir on par with the other states and union territories of the country. Scrapping of the article 370 also wipes out the provisions in the article 35(A) which had prevented the non-residents of Jammu and Kashmir from getting state jobs or own a property in the valley. Earlier, Article 35(A) had also given the J&amp;K state government the power to decide if an individual was a permanent resident of the state. Those individuals defined as non-residents by the legislature were prohibited from acquiring a property in the state of Jammu and Kashmir. The said article had also barred the rights over property to the females in the state who get married to non-residents. As a result of the abolition of article 370, the residents of any other state can also buy a property in J&amp;K. Females will get back their right to property even while marrying an individual from outside the state. The present situation is expected to change the face of J&amp;K significantly inviting the setting up of manufacturing firms, businesses, and hotels in large numbers besides seeing the Indian citizens from other states buying properties in the valley.

Now anyone can purchase land in Jammu Kashmir after scraps article 370 and 35A

With both articles abolished, the ‘state’ of Jammu and Kashmir no longer exists. It is bifurcated into two parts — the union territory (UT) of Ladakh without an assembly, and the UT of Jammu and Kashmir with an assembly.

Jammu and Kashmir, and Ladakh will now be two separate Union Territories

In a move deemed as a very significant one in the face of Indian democratic governance, the Rajya Sabha approved the Jammu and Kashmir <keyword id="7821367" type="UNKNOWN" weightage="20" keywordseo="reservation-bill-2019">Reservation Bill 2019</keyword> after the amendments were approved by the Lok Sabha two days earlier. Here are the highlights of what we must know about the Jammu Kashmir Reservation Bill 2019. What has changed now The present bill replaces the Jammu and Kashmir Amendment Ordinance 2019 which was issued earlier on March 1, 2019. This bill gives room for some amendments in the Jammu and Kashmir Reservation Act passed in 2004 that aims to get the people residing in the areas near the international border within the purview of reservation on par with the people residing in the areas adjacent to the Actual Line of Control (ALoC). Who the bill will benefit As per the earlier bill, 3% reservation was allowed for the youth residing within 6 kms of the line of control in Jammu and Kashmir. As per the new amendments, this provision will be extended to the people living near the international border too. This measure will come to benefit the people living in Jammu, Samba and Kathua regions. Notably, the people inhabiting these regions have been pressing the government for so long to give this concession as they are confronting the impacts of cross-border firing in the Jammu and Kashmir region. At the same time, the compulsory 7 year service provision will also be applicable for the people living near the international border. How is the change effected By virtue of the Presidential order, the cabinet implemented the 77th constitutional amendment of 1995 to Jammu and Kashmir in order to give the benefits of reservation in promotion in the government services to the scheduled castes and scheduled tribes. In addition, the cabinet applied the 103 constitutional amendment of 2019 to Jammu and Kashmir that sanctioned 10% reservation to the economically backward segments of people in the general category. The setting in J&amp;K When the BJP withdrew its support to the PDP in November 2018, the Governor <keyword id="2773123" type="PERSON" weightage="20" keywordseo="Satya-Pal-Malik">Satya Pal Malik</keyword> dissolved the Jammu and Kashmir Assembly. With this move, the state came under the president’s rule. Due to security reasons, elections were not conducted so far here. Amidst this background, the parliament passed this bill and the parliament’s upper house gave its consent to extend the president’s rule in Jammu and Kashmir for the next six months. What is the controversy now While passing the Jammu and Kashmir Reservation Bill 2019, the central government claims that the given constitutional amendment was recommended by the State Administrative Council (SAC) under the leadership of Satya Pal Malik, the present governor for Jammu and Kashmir. None has questioned the decision of the government with regard to the latest amendment to favor the SCs, STs and EWS. However, there is an opposition to the way it has been accomplished. Formerly a princely state, the state has a total number of 78,50,852 voters listed on its electoral rolls. This figure comprises of 41,09,804 male voters, 37,40,709 female voters and 339 third gender electors. In 2014 Lok Sabha elections, JKPDP and BJP shared three seats each among them. In 2009 Lok Sabha elections, the result showed 3 seats for JKN, 2 constituencies for INR and 1 constituency for IND. During 2004 Lok Sabha elections, JKN got 2 places, INC got 2 constituencies and JKPDP won from 1 seat. The one another seat was won by an independent candidate. Jammu and Kashmir has 6 Lok Sabha seats in total namely Baramulla, Jammu, Srinagar, Udhampur, Ladakh an Anantnag. There are no reserved seats in the state. The state can also send 4 members to represent it in the Rajya Sabha. <ul><li>Two days after Jammu and Kashmir and Ladakh were brought directly under the central government's control, Prime Minister Narendra Modi chose to make a special address to the nation.</li><li>Modi also said that the Union Territory status of Jammu and Kashmir is a temporary measure and the state will get its own assembly as soon as possible.</li><li>While the contentious decision has been contested by his rivals, both houses of the Indian Parliament have approved the Presidential order that redefined Jammu and Kashmir's political status.</li><li>Article 370 and Article 35A had given nothing but terrorism, separatism, dynasty politics, and corruption," he said.</li></ul>Two days the state of Jammu and Kashmir, including the Ladakh region, were split into two Union Territories, Prime Minister Narendra Modi revealed that this is a temporary measure only. While Ladakh will remain under the direct control of the central government, Jammu and Kashmir will get to hold its elections once again and elect a local leader. To those who oppose the move to abrogate Article 370 and Article 35A in Jammu and Kashmir -- provisions that allowed the state to make its own laws -- Modi said that he respects their right to disagree but urged them to keep aside the differences in 'national interest'. This speech has come two days after the central government wrested direct control over the volatile Jammu and Kashmir state by disbanding the province into two Union Territories namely Jammu and Kashmir and Ladakh, first through a Presidential order and later got it ratified by the Parliament.  He assured the people of Jammu and Kashmir that the situation in the region will come back to normal as soon as possible and promised that there will be no obstacle in the upcoming Eid celebrations next week. In his address, PM Modi said that "Article 370 and Article 35A had given nothing but terrorism, separatism, dynasty politics, and corruption." He also added that Pakistan had been using this as a weapon to push its agenda in Kashmir and that over 42,000 people lost their lives in the process. Modi also said that the women of Kashmir were denied equal rights, poor workers did not not get the benefit of India's minimum wage laws, and socially marginalised Scheduled Castes and Scheduled Tribes were deprived of the benefits of the central government's affirmative action. He also promised state benefits, for government employees including the Police in Jammu and Kashmir as well as in Ladakh, like leave travel allowance, house rent allowance, and allowance for children's education among others. "We have removed the obstacles to the development of Jammu and Kashmir," said Prime Minister Narendra Modi in his special address to the nation, which will also be aired on the state-owned All India Radio. <ul><li>On August 2, thousands of <keyword id="44352" type="PERSON" weightage="20" keywordseo="Amarnath-Yatra">Amarnath Yatra</keyword> pilgrims were asked to leave <keyword id="6354495" type="LOCATION" weightage="20" keywordseo="kashmir">Kashmir</keyword> immediately. </li><li>Since then, section 144 has been imposed, internet services have been suspended, political leaders like <keyword id="19464" type="PERSON" weightage="20" keywordseo="Omar-Abdullah">Omar Abdullah</keyword> and <keyword id="6375812" type="PERSON" weightage="20" keywordseo="mehbooba-mufti">Mehbooba Mufti</keyword> have been placed under house arrest. </li><li>Union Home Minister Amit Shah reportedly held a meeting to discuss the recent developments in Kashmir.</li></ul>On Friday (August 2) evening, the Indian government asked <a href="https://www.businessinsider.in/the-india-pakistan-border-in-kashmir-is-simmering-again-thousands-of-amarnath-pilgrims-have-been-sent-back/articleshow/70500904.cms">thousands of Amarnath Yatra pilgrims</a> to leave Kashmir immediately citing a terror threat. Since then, the state has been in confusion and chaos. Making matters worse is a series of speculation by both <a href="https://twitter.com/SankarshanT/status/1157987037938511872">news outfits as well as on social media </a>that has led to people fearing the worst and hoarding food and necessities. The radio silence from New Delhi, while building up troops in the valley, in the face of rampant speculation has added to the unease, particularly in the Kashmir valley. The speculations range from the abrogation of <a href="https://www.businessinsider.in/what-is-article-35a-of-the-indian-constitution-all-you-need-to-know/articleshow/69684605.cms">Article 35A</a> and <a href="https://www.businessinsider.in/what-is-article-370-of-the-indian-constitution-all-you-need-to-know/articleshow/69684790.cms">Section 370</a> of the Indian Constitution to the splitting up of the state into 3 parts – Jammu, Kashmir, and Ladakh. However, there has been no clear evidence to suggest any of the above. Let us look at all that has happened over the last three days that have intensified tensions in Kashmir leading to warnings from Pakistan too. Security beefed up The state of <keyword id="23412" type="CITY" weightage="20" keywordseo="Jammu-Kashmir">Jammu &amp; Kashmir</keyword> has been under President’s rule since December 2018 and now, section 144, which prohibits an assembly of more than 4 people in an area, has been imposed. "As per the order, there shall be no movement of public and all educational institutions shall also remain closed. There will be a complete bar on holding any kind of public meetings or rallies during the period of operation of this order. Identity cards of essential services officials will be treated as movement passes wherever required. However, there is no curfew in place as reported in a section of media," an official statement said as reported by IANS. The government had already deployed an additional paramilitary personnel of 10,000 in the state. According to <a href="https://timesofindia.indiatimes.com/india/security-deployment-at-vital-installations-in-kashmir-increased-political-parties-hold-meeting-top-developments/articleshow/70524096.cms">reports</a>, riot control vehicles too have been deployed in the state. <keyword id="7948376" type="UNKNOWN" weightage="20" keywordseo="leaders-under-house-arrest">Leaders under house arrest</keyword> The state’s top political leaders were placed under house arrest late Sunday night. Former Chief Minister Omar Abdullah took to Twitter to write about the imminent house arrest. “I believe I’m being placed under house arrest from midnight tonight &amp; the process has already started for other mainstream leaders. No way of knowing if this is true but if it is then I’ll see all of you on the other side of whatever is in store. Allah save us,” he wrote on Twitter. His rival, and a former Chief Minister, Mehbooba Mufti wrote, “How ironic that elected representatives like us who fought for peace are under house arrest. The world watches as people &amp; their voices are being muzzled in J&amp;K. The same Kashmir that chose a secular democratic India is facing oppression of unimaginable magnitude. Wake up India.” Life comes to a standstill Internet services have been suspended since Sunday night in the state. Meanwhile, education institutions in the state too have been asked to remain shut from today until further orders. Kashmir university exams which were supposed to take place from August 5 to 10 have been postponed, according to IANS. BSNL will be giving satellite phones to media persons at the steep price of ₹1 lakh a piece to file stories from the Valley, said an IANS report. However, according to ANI, schools and colleges will reopen today in Ladakh as restrictions under Section 144 CrPC have not been imposed in the region. Security meeting in Pakistan In Pakistan, Prime Minister Imran Khan called for a <a href="https://www.dawn.com/news/1498058/nsc-meeting-pakistan-to-respond-to-any-misadventure-aggression-by-indian-forces">meeting</a> of the National Security Committee to discuss the developments along the border and reportedly, react to any steps taken by the Indian military. While Pakistan alleged that the Indian army used cluster bombs along the Line Of Control, the Indian army has said it was to foil an attempt by Pakistan’s Border Action Team (BAT) to cross over to the Indian side of the border. "Pakistan army regularly attempts to push terrorists through infiltration and opens up with multitude of weapons to assist them. India, during numerous Directorate of Military Operations-level talks, has maintained the right to respond. Such responses are only against military targets and infiltrating terrorists who are aided by Pakistan Army. Allegations of firing of cluster bombs by India is yet another Pakistan's lie and deception," <a href="https://www.indiatoday.in/india/story/indian-army-pakistan-cluster-bombs-ammunition-loc-kashmir-1576890-2019-08-03">the Indian army said in a statement.</a> Cabinet meeting in India Meanwhile, in Delhi, Union Minister Amit Shah is said to have held a security meeting including National Security Adviser Ajit Doval to discuss the situation in Kashmir. Other senior officials at the meeting included, Home Secretary Rajiv Gauba, Intelligence Bureau chief Arvind Kumar, Research and Analysis Wing (RAW) chief Samant Kumar Goel. According to an IANS report, Shah is reportedly planning to visit the state.
