In a move deemed as a very significant one in the face of Indian democratic governance, the Rajya Sabha approved the Jammu and Kashmir <keyword id="7821367" type="UNKNOWN" weightage="20" keywordseo="reservation-bill-2019">Reservation Bill 2019</keyword> after the amendments were approved by the Lok Sabha two days earlier. Here are the highlights of what we must know about the Jammu Kashmir Reservation Bill 2019. What has changed now The present bill replaces the Jammu and Kashmir Amendment Ordinance 2019 which was issued earlier on March 1, 2019. This bill gives room for some amendments in the Jammu and Kashmir Reservation Act passed in 2004 that aims to get the people residing in the areas near the international border within the purview of reservation on par with the people residing in the areas adjacent to the Actual Line of Control (ALoC). Who the bill will benefit As per the earlier bill, 3% reservation was allowed for the youth residing within 6 kms of the line of control in Jammu and Kashmir. As per the new amendments, this provision will be extended to the people living near the international border too. This measure will come to benefit the people living in Jammu, Samba and Kathua regions. Notably, the people inhabiting these regions have been pressing the government for so long to give this concession as they are confronting the impacts of cross-border firing in the Jammu and Kashmir region. At the same time, the compulsory 7 year service provision will also be applicable for the people living near the international border. How is the change effected By virtue of the Presidential order, the cabinet implemented the 77th constitutional amendment of 1995 to Jammu and Kashmir in order to give the benefits of reservation in promotion in the government services to the scheduled castes and scheduled tribes. In addition, the cabinet applied the 103 constitutional amendment of 2019 to Jammu and Kashmir that sanctioned 10% reservation to the economically backward segments of people in the general category. The setting in J&amp;K When the BJP withdrew its support to the PDP in November 2018, the Governor <keyword id="2773123" type="PERSON" weightage="20" keywordseo="Satya-Pal-Malik">Satya Pal Malik</keyword> dissolved the Jammu and Kashmir Assembly. With this move, the state came under the president’s rule. Due to security reasons, elections were not conducted so far here. Amidst this background, the parliament passed this bill and the parliament’s upper house gave its consent to extend the president’s rule in Jammu and Kashmir for the next six months. What is the controversy now While passing the Jammu and Kashmir Reservation Bill 2019, the central government claims that the given constitutional amendment was recommended by the State Administrative Council (SAC) under the leadership of Satya Pal Malik, the present governor for Jammu and Kashmir. None has questioned the decision of the government with regard to the latest amendment to favor the SCs, STs and EWS. However, there is an opposition to the way it has been accomplished. In a momentous and bold move, the government of India scrapped the <keyword id="405091" type="PERSON" weightage="20" keywordseo="Article-370">Article 370</keyword> that had granted special status to <keyword id="17605" type="PERSON" weightage="20" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword>. Henceforth, Jammu and Kashmir will become a Union Territory with a legislative assembly. On Monday, August 5, 2019, the central government of India revoked article 370 that had given an exclusively special status to Jammu and Kashmir. The scrapping of the said article puts Jammu and Kashmir on par with the other states and union territories of the country. Scrapping of the article 370 also wipes out the provisions in the article 35(A) which had prevented the non-residents of Jammu and Kashmir from getting state jobs or own a property in the valley. Earlier, Article 35(A) had also given the J&amp;K state government the power to decide if an individual was a permanent resident of the state. Those individuals defined as non-residents by the legislature were prohibited from acquiring a property in the state of Jammu and Kashmir. The said article had also barred the rights over property to the females in the state who get married to non-residents. As a result of the abolition of article 370, the residents of any other state can also buy a property in J&amp;K. Females will get back their right to property even while marrying an individual from outside the state. The present situation is expected to change the face of J&amp;K significantly inviting the setting up of manufacturing firms, businesses, and hotels in large numbers besides seeing the Indian citizens from other states buying properties in the valley.

Amidst tumultuous uproar as well as strong criticisms, the BJP government headed by the Prime Minister Narendra Modi took some bold steps with regard to the status of governance in the valley of Jammu and Kashmir. The government has now decided to roll back the Article 370 and Article 35(A). Repealing these two articles will scrap the special status and exclusive powers enjoyed by the State of Kashmir. This will mean that Kashmir will come in par with all the other states and will be governed by the same laws that govern the rest of India. The implications of removing 35(A) could mean some significant changes effected to the face of Jammu and Kashmir. Overview of Article 35(A) As per the provisions contained in Article 35(A), the state government heading Jammu and Kashmir can define who the permanent residents of the state are. This article came into force earlier following the Constitution (Application to J&amp;K) order, 1954, which was passed by Rajendra Prasad, the then president on the advice of the then Prime Minister Jawaharlal Nehru. Definition of permanent resident of Kashmir At the time of adopting the article 35(A) in 1956, the state’s constitution defined the term ‘permanent resident’ as someone who was the subject of the state as on May 14, 1954, or the one who had been the resident of the state for more than 10 years and has acquired an immovable property through legal means. What the article 35(A) implied The clauses contained in the Article 35(A) would bar anyone from outside Jammu and Kashmir (who is not a permanent resident) from getting a state job or owning a property in the state. This article is also known as permanent residents’ law. Yet another important provision of article 35(A) deprives the state’s female residents’ right to property if they get married to an outsider. This provision will eventually extend to the children born to such a female. What has changed now in Kashmir? After the repealing of Article 35(A), Kashmir will no longer enjoy any special status or powers. In response to the proposal by Amit Shah, President Ram Nath Kovind issued the Constitution (Application to Jammu and Kashmir) Order, 2019, stating that the provisions of the Indian Constitution will henceforth be applicable to J&amp;K. The Constitution (Application to Jammu and Kashmir) Order, 2019 takes effect "at once", and shall "supersede the Constitution (Application to Jammu and Kashmir) Order, 1954". The promulgation issued by the President observes, "All the provisions of the Constitution shall apply in relation to the state of Jammu and Kashmir." The order also added that in the proviso to clause (3) of Article 370, the term "Constituent Assembly of the State referred to in clause (2)" will henceforth read as "Legislative Assembly of the State". Kashmir comes on par with any other state in India. The present legislative moves by the central government has scrapped the special status and powers to the state of Kashmir. Henceforth, all the laws that govern the other states of India will come to govern the state of Kashmir also.

Article 35A - What will change in Jammu Kashmir after the end of Article 35 A

Residents of Delhi, Himachal Pradesh, Jammu &amp; Kashmir, Rajasthan, Uttar Pradesh and Jharkhand have to be prepared for <a href="http://www.businessinsider.in/searchresult.cms?query=power+cuts">power outages</a> as state-run generators have asked <a href="http://www.businessinsider.in/searchresult.cms?query=discoms">discoms</a> to clear the dues at the earliest. 
 The state run power generators are threatening to cut off supplies unless <keyword id="53091" type="UNKNOWN" weightage="20" keywordseo="discoms">discoms</keyword> pay up Rs 20,000-crore outstanding bills. Around 80% of the dues are owed by these northern and eastern states and likely to face maximum number of <keyword id="6361137" type="UNKNOWN" weightage="20" keywordseo="power-cuts">power cuts</keyword>. 
 
The <a href="http://www.businessinsider.in/Companies-Can-Supply-Power-24X7-Without-Increasing-Tariff-Piyush-Goyal/articleshow/37242272.cms">electricity demand</a> has increased due to deficient and sweltering heat in most parts of the country so much so that farmers’ <keyword id="6368114" type="UNKNOWN" weightage="20" keywordseo="power-demand">power demand</keyword> touched 1.5 lakh mega watt last week. 
 
Although farmers get power either free or heavily subsidised rates, but payments to the power generators becomes uncertain because the utilities apparently do not have the money to pay this bill. 
 
In Delhi, reportedly, <a href="http://www.businessinsider.in/searchresult.cms?query=BSES+Rajdhani+Power+">BSES Rajdhani Power</a> and BSES Yamuna Power have outstanding dues of about Rs 1,600 crore. 
 
They owe money to central power generators such as National Hydro Power Corporation, Satluj Jal Vidyut Nigam, Tehri Hydro Development Corporation, Nuclear Power Corporation of India and Power Grid Corporation of India. 
 
Dues of power distributors in Jammu &amp;Kashmir are over Rs 2,700 crore while Rajasthan-based utilities owe about Rs 1,000 crore to generators. 
 
Among the power generators, Damodar Valley Corporation has the biggest outstanding dues of Rs 8,769 crore and Jharkhand is the biggest defaulter.

According to the terror outfit’s broadcast channel, Amaq News, their territory in India is called ‘Wilayah of Hind’ (India Province). But, top officials in the Indian state of Jammu &amp; <keyword id="6354495" type="LOCATION" weightage="20" keywordseo="kashmir">Kashmir</keyword> as well as the country’s intelligence agencies are categorically denying these claims -- in spite of a clash between the region’s militants and the Indian Military, on Friday. Conflicting claims According to a statement by ISIS via the messaging app, Telegram, the clash between the groups occurred in the Amshipora village of Kashmir. Media reports, on the same day, reported that a militant was killed — Ishfaq Sofi a.k.a Abdullah Bhai of Islamic State <keyword id="17605" type="PERSON" weightage="20" keywordseo="Jammu-and-kashmir">Jammu and Kashmir</keyword> (ISJK). It was then that ISIS began to claim responsibility for attacks against the Indian Military in Kashmir since 2017. Intelligence agencies and the Director General of Jammu Kashmir Police, Dilbagh Singh, said that the terrorist who died wasn’t from ISIS from an ‘IS-inspired’ group. While he could be potentially influenced by the ideology of IS, he ‘definitely’ did not belong to the group nor has the outfit any footprint in Kashmir. To be fair, ISIS also hasn’t lent any details about the geographic boundaries of their newly founded ‘province’. Not the first time Laying claim to a territory an ISIS ‘province’ is not new for the terror organisation. They’ve reportedly declared a Turkey Province and Central Africa province as well.
