Defending its 2019 law criminalising <keyword id="20415107" type="General" weightage="100" keywordseo="triple-talaq" source="keywords">triple talaq</keyword>, the Centre has told the <keyword id="19895345" type="General" weightage="20" keywordseo="Supreme-Court" source="keywords">Supreme Court</keyword> that the practice is "fatal" for the social institution of <keyword id="19896575" type="General" weightage="20" keywordseo="marriage" source="keywords">marriage</keyword>. In an affidavit filed in response to petitions challenging the law, the Union of India said despite the top court setting aside the practice in 2017, it has "not worked as a sufficient deterrent in bringing down the number of divorces by this practice" among the members of the community. "It is submitted that Parliament in its wisdom has enacted the impugned Act to protect the rights of married <keyword id="19943278" type="General" weightage="20" keywordseo="Muslim-women" source="keywords">Muslim women</keyword> who are being divorced by triple talaq. "The impugned Act helps in ensuring the larger constitutional goals of <keyword id="20809677" type="General" weightage="20" keywordseo="gender-justice" source="keywords">gender justice</keyword> and <keyword id="20250318" type="General" weightage="20" keywordseo="gender-equality" source="keywords">gender equality</keyword> of married Muslim women and helps subserve their fundamental rights of non-discrimination and empowerment," the affidavit said. On 22 August 2017, the <keyword id="19936355" type="General" weightage="20" keywordseo="apex-court" source="keywords">apex court</keyword> had declared instant triple talaq (talaq-e-biddah) unconstitutional. On August 23, 2019, the top court agreed to examine the validity of the Muslim Women (Protection of Rights on Marriage) Act, 2019. Violation of the law entails imprisonment of up to three years. New Delhi, May 2 () The Jamiat Ulama-i-Hind has moved the Supreme Court seeking to intervene in a plea filed by a Mumbai resident opposing burial of people dying of COVID-19 in a graveyard near his residence. Mumbai-resident Pradeep Ghandy has approached the apex court after his plea, made on the ground that burial of COVID-19 patients in the graveyard in Bandra West would spread infection in adjoining areas, was rejected by the Bombay High Court on April 27.Ghandy's plea challenging the high court order will come up for hearing on May 4 before a bench of Justices R F Nariman and Indira Banerjee. The Muslim body, while seeking intervention in the appeal filed by Ghandy, said that apprehension of burial of bodies of those infected with COVID-19 will risk the spread of such infection in the vicinity is unfounded and that at the outset there is no risk of spreading of the COVID-19 virus during such burial."It is submitted that the burial of dead bodies is essential to the religion of Islam as well as in other religions such as Christianity. Such a right forms part of the right to practice one's religion under Article 25 of the Constitution of India," the plea said. The Muslim body said that it is a common myth that persons who have died of a communicable disease should be cremated, but this is not true and cremation is a matter of cultural choice and available resources. "It has further been clarified that till date there is no evidence of persons having become infected from exposure to the bodies of persons who died from COVID-19," the plea said.The petition of Jamiat said that the entire grievance of the petitioner is based on the apprehension that burial of those persons who were infected with COVID-19 would risk the spread of such infection in the neighbouring areas, which includes the residence of the petitioner herein. "It is submitted that such a fear is completely unfounded and unsupported by advisories issued by the Government of India as well as by the World Health Organization," it said.The plea said that it is evident from the guidelines issued by the Ministry of Health and Family Welfare as well as by the WHO, burial does not pose any additional risk of COVID-19 and all the precautions that have been prescribed are to prevent the contact of any bodily fluid of the dead person with those who are handling the body. "It is further relevant to note that even USA, United Kingdom, Italy, Canada and the Middle Eastern nations are burying those persons who have died due to COVID 19 and no such increased risk of spread of COVID-19 virus has been highlighted by these nations due to the act of burying the dead bodies," the plea said.The Muslim body said that the Union Ministry of Health and Family Welfare had on March 15 issued detailed guidelines regarding dead body management in the times of COVID-19 which categorically provide that the main driver of transmission of the said virus is through droplets and that there is unlikely to be an increased risk of COVID infection from a dead body to health workers or family members who follow standard precautions while handling body.It said that even the World Health Organization (WHO) has issued an interim guidance dated March 24, dealing with the issue of burial of bodies of those patients who died due to COVID-19. "It has been clarified in the said interim guidance that except in cases of haemorrhagic fevers (such as Ebola, Marburg) and cholera, dead bodies are generally not infectious. Only the lungs of patients with pandemic influenza, if handled improperly during an autopsy, can be infectious. Otherwise, cadavers do not transmit disease," the plea said.On April 27, the High Court had refused to grant relief on a plea challenging Brihanmumbai Municipal Corporation's (BMC) permission to use cemetery in Bandra to bury bodies of COVID-19 victims.The petition, filed by Gandhy and others, living near the Konkani Muslim Kabrastan in suburban Bandra, claimed that locals were afraid of community spread of the virus, if the burial is not done properly. New Delhi, Apr 7 () Some Muslim clerics and scholars have appealed to the members of the community to avoid visiting graveyards on Shab-e Bara'at on Wednesday to pray for their ancestors, but pay their respect to them while staying at home in view of the coronavirus pandemic.On Shab-e Bara'at, Muslims visit the graveyards of their departed relatives to pray for them. It falls on Wednesday, April 8, this year.The appeal has been issued on behalf some well-known Muslim clerics and scholars of the country, including Maulana Tauqeer Raza Khan, President, Muslim Ittehad Parishad; Maulana Syed Mahmood Madni, General Secretary, Jamiat Ulama-e Hind; Dr Zafarul-Islam Khan Azhari, Chairman, Delhi Minorities Commission; and Maulana Mufti Muhammad Mukarram, Shahi Imam, Fatehpuri Masjid. New Delhi, May 11 () A Muslim body has moved the Supreme Court seeking enforcement of fundamental rights of jail inmates saying it would be a "travesty of justice" and a "blot" on the criminal justice system if any innocent undertrial prisoner dies due to spread of COVID-19 in jails. The Jamiat Ulama-I-Hind has sought impleadment in the suo motu (on its own) matter taken by the apex court relating to de-congestion of jails to prevent over-crowding in view of Coronavirus outbreak. It has referred to media reports which said that several prisoners in Mumbai's Arthur Road jail have tested positive for COVID-19. The plea alleged that in Maharashtra, 11,000 prisoners have been identified by the high powered committee but only 2,520 have been released while in Madhya Pradesh, 6,033 prisoners have been released against the 12,000 identified by the panel. "It is therefore necessary to avoid any delay in releasing of the prisoners as a delayed response may not have the desired effect," it said. "While even convicted prisoners have the right to life and personal liberty to be protected by the state in the event of a pandemic, it would be a travesty of justice and a blot on our entire criminal justice system if an wrongly implicated, innocent undertrial prisoner dies due to the spread of COVID-19 in prison," the plea said. "The present application for impleadment is to seek enforcement of, inter alia, the fundamental right to life and personal liberties of prisoners under Article 21 of the Constitution who are currently languishing in over-crowded prisons across the country, where social distancing is impossible and are therefore, facing an acute risk of contracting the Coronavirus," the plea said. The plea, filed through advocate Ejaz Maqbool, said the apex court had in its March 23 order directed the states and union territories (UTs) to constitute high powered committees which could decide which prisoners may be released on interim bail or parole during the pandemic. It said though the high-powered committee of most states and UTs have already specified the criteria for release of prisoners, the jail inmates are not being released immediately. It said that several countries have released prisoners amid the COVID-19 pandemic and the apex court should direct the Centre and the states to expedite the process of release. The apex court, in its April 13 order passed in the matter, had made it clear that it has not directed all the states and UTs to "compulsorily" release prisoners from jails and its earlier directives were meant to prevent over-crowding of prisons in view of coronavirus outbreak. The top court had said that its orders have to be followed in letter and spirit and it would be also applicable to correctional homes, detention centres and protection homes. The apex court on April 7 had directed all states and UTs to ensure through Director Generals of Police (DGPs) that prisoners released from jails get safe transit, so that they can reach their homes amid the lockdown due to coronavirus. It had on March 23 directed all states and UTs to constitute high-level committees to consider releasing on parole or interim bail prisoners and undertrials for offences entailing up to seven-year jail term to decongest prisons in the wake of coronavirus. The apex court on March 16 had taken suo motu cognisance of overcrowding of prisons across the country and said it was difficult for jail inmates to maintain social distancing to prevent the spread of coronavirus. By Asim Kamal New Delhi, May 17 () It was billed to be a Ramzan like no other and it really is, but many devout Muslims apprehensive about not going to the mosque or iftaar gatherings are appreciative instead that the lockdown has helped them stay true to the spirit of the holy month. Three weeks into fasting, many Muslims feel the coronavirus-forced lockdown has a silver lining after all -- it has left them with plenty of time to read the Quran, attend virtual Quran classes and focus on prayers. After all, Ramzan is a time for self-discipline and introspection, they point out.Tanvir Parvez, a lawyer from Ghaziabad, was among those bracing himself for a Ramzan devoid of its usual charms of special prayers in mosques (Taraweeh), sitting with his friends and family to break the fast at iftaar time and gatherings to discuss the teachings of Prophet Mohammad.Parvez, who has never missed the Taraweeh during Ramzan, said he was gutted to learn that this year prayers would not be allowed in mosques due to the coronavirus lockdown. "I was mentally preparing for a bad Razman experience with so many restrictions in place, but it has turned out to be a very special one as staying at home with family, discussing religion and reading the Quran with English translation has given me a new perspective on life," the 63-year-old told . The special prayers, iftaar congregations and spiritual gatherings are being missed, but the benefits have also made it a special "special Razman" this year."Earlier Ramzans were just about racing against time from the courts to reach home for iftaar, but now I am involved in making iftaar with my wife and though the spread is very simple, it brings the family closer as everyone is involved," he said.People are also relishing the time they are getting to introspect and learn more about Islam with no distractions such as grand iftaar parties and shopping sprees.Hasan Askari, an agriculturist based in Ghaziabad, said the month usually raced by with a string of iftaar parties and endless shopping trips, but not this time."The lockdown is proving to be a boon with distractions like shopping and endless iftaar parties not there, allowing me to read books on Islamic teachings which my brother-in-law gets from Jeddah and watching Islamic sermons online," Askari told .Prominent Muslim body Jamiat Ulema-e-Hind's president Maulana Arshad Madani said it is heartening to see Muslims finding positivity in these difficult times and using the lockdown downtime to learn more about Islamic teachings and Quran."Another significant trend witnessed this year is that seeing the sufferings of migrant labourers and the needy, Muslims have undertaken charity at a scale not seen before," Madani told .Even though everyone's economic future is uncertain, Muslims are helping the poor with money and food in a massive way to realise the true meaning of Ramzan, he said.Another popular trend this Ramzan has been Muslims watching religious programmes and taking up Quran classes online.Professor Salim Engineer, vice president of the Jamaat-e-Islami Hind, said his organisation is webcasting many religious programmes on its YouTube channel to explain the meaning of Quranic verses and important Islamic issues."We are also webcasting programmes for non-Muslims. Recently, we shot one with religious leaders from different religions discussing the importance of fasting. In mosques, 1,000-1,500 people would listen to the discussions. This year, many thousands are watching these programmes online during Ramzan," he told .Iftaar food, normally an elaborate feast with kebabs, kormas and much more, have also become simpler. Sultana Siddiqui, a homemaker from Lucknow, would spend most of her day preparing the meals. Not this time though. "Making non-vegetarian delicacies during Ramzan takes up a lot of time. But this year with most meat shops closed and lockdown in place, the iftaar menu is very modest and allows plenty of free time to devote to Islamic learning and preaching," Siddiqui said."I have enrolled for online Quranic classes to fine tune my Arabic pronunciation and also to enhance my understanding of the Quran. It has been a life-changing experience," she said.There are also those missing the festive fervour of iftaar parties and sehri (pre-dawn meal at the start of a fasting day) at old Delhi's famous eateries."Ramzan is a time when family and friends come together -- praying, fasting and feasting. With many family members stranded in different parts, the festive feel is missing this time," said Qazi Aamir Ali, a corporate employee working in Gurgaon.Also, the going is not easy for everyone. While middle and upper class homes are finding positivity during the holy month, the poor and the needy are struggling to make ends meet."We are fasting through the day and there is hardly anything to eat around sehri. Organisations and people are reaching out, so iftaar is sorted, but we begin our fast just by drinking water," said Shaheen Bano, an out of work house maid and mother of six."We pray to Allah and fast that these difficult days will pass, I will go back to work and see smiles on my kids' faces," she said.Ramzan is the ninth month of the Islamic calendar during which Muslims worldwide refrain from eating and drinking from dawn to dusk and end their fast in the evening. The month is in its fourth week now and Eid will be celebrated on May 24 or 25, depending on the sighting of the moon.For Muslims, this Ramzan is also about hope that their prayers will be answered and a new dawn will emerge in post-pandemic times.
