<p><table class="image-container float_right" width="200"><tr><td><div class="image"></div><p class="source">Asa Mathat | All Things Digital</p><p class="caption">Oracle CEO Larry Ellison</p></td></tr></table>When HP and <keyword id="43340" type="CITY" weightage="60" keywordseo="Oracle">Oracle</keyword> were fighting in court last summer over HP's <keyword id="598942" type="UNKNOWN" weightage="60" keywordseo="Itanium">Itanium</keyword> servers, <a href="http://www.businessinsider.com/oracle-lawsuit-hp-sales-impact-2012-6">HP hinted it would come after Oracle for $4 billion</a>.</p>
<p>HP won the suit and is back in court, to hear what damages, if any, it is entitled to get. Sure enough, HP is aiming for $4 billion.</p>
<p>It put an expert witness on the stand who said Oracle cost HP $4 billion to $4.2 billion in business.</p>
<p>The suit concerned Oracle's plans to stop making its flagship database software for HP's high-end, expensive Itanium servers. A California judge ruled in HP's favor and said that Oracle had to continue to make its database products for Itanium.</p>
<p>In a hearing in a Santa Clara, Calif. court today, HP's had an economist testify. He said that the uncertainty caused by Oracle's decision drove customers away, reports <a href="http://www.computerworld.com/s/article/9237689/HP_eyes_4B_damages_claim_in_Itanium_case_against_Oracle?taxonomyId=144&amp;pageNumber=1">IDG News Services' Stephen Lawson</a>.</p>
<p>In the second quarter of HP's 2011 fiscal year, when the fight began, Itanium revenue fell 11 percent from the year prior, <span style="color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 15px; font-style: normal; font-variant: normal; font-weight: normal; letter-spacing: normal; line-height: 20px; orphans: auto; text-align: left; text-indent: 0px; text-transform: none; white-space: normal; widows: auto; word-spacing: 0px; -webkit-text-size-adjust: auto; -webkit-text-stroke-width: 0px; background-color: #ffffff; display: inline !important; float: none;">HP's expert witness said</span>. The following quarters it fell 18.1 percent, 32 percent and 38 percent from the year-ago quarters.</p>
<p>Oracle's lawyers had a pretty good counter-argument for the falling revenue. They pointed out that during that time HP was undergoing a lot of turmoil, including firing its CEO Leo Apotheker.</p>
<p>Both HP and Oracle declined comment.</p>

HP To Oracle: You Hurt Our Server Business And Owe Us $4 Billion

HP sued Oracle for breach of contract a fews years ago and won.</p><p>The two were back in court to determine damages, with testimony from such folks as Mark Hurd and Larry Ellison.</p><p>The jury just announced the win for HPE.</p><p>Oracle's lawyer, Dorian Daley, says Oracle still thinks it's in the right and will appeal:</p><p style="padding-left: 30px;">"Five years ago, Oracle made a software development announcement which accurately reflected the future of the Itanium microprocessor. Two trials have now demonstrated clearly that the Itanium chip was nearing end of life, HP knew it, and was actively hiding that fact from its customers. Oracle never believed it had a contract to continue to port our software to Itanium indefinitely and we do not believe so today; nevertheless, Oracle has been providing all its latest software for the Itanium systems since the original ruling while HP and Intel stopped developing systems years ago.</p><p style="padding-left: 30px;">Further, it is very clear that any contractual obligations were reciprocal and HP breached its own obligations. Now that both trials have concluded, we intend to appeal both today's ruling and the prior ruling from Judge Kleinberg."</p><p>Meanwhile HPE lawyer John Schultz is, naturally, happy with the outcome: </p><p style="padding-left: 30px;">"HP is gratified by the jury's verdict, which affirms what HP has always known and the evidence overwhelmingly demonstrated - Oracle's decision to stop future software development on the Itanium server platform in March of 2011 was a clear breach of contract that caused serious damage to HP and our customers. Hewlett Packard Enterprise just won $3 billion in a lawsuit against Oracle

<p><div class="KonaFilter image-container display-table float_right"><div><div class="image on-image"><p class="source"><span>Kimberly White/Stringer/Getty Images</span></p><p class="caption">Oracle executive chairman and CTO Larry Ellison.</p></div><p></p></div></div>Hewlett Packard <keyword id="6356323" type="UNKNOWN" weightage="60" keywordseo="Enterprise">Enterprise</keyword> (HPE) and Oracle are heading <a href="http://www.wsj.com/articles/trial-set-to-open-in-legal-battle-between-h-p-and-oracle-1464639770">back to court to determine</a> how much money, if any, Oracle owes HPE over a case it won in 2011.</p><p>HPE is going to ask for $3 billion in the breach-of-contract suit.</p><p>Since that last trial, Hewlett-Packard has split into two companies, HPE, which makes servers and software for enterprises, and HP Inc., which makes PCs and printers.</p><p>HPE is the company pursuing this lawsuit, which came about after Oracle hired Mark Hurd. Hurd was the former CEO of HP. He left HP amid questions involving his expense reports and allegations that he was trying to get one of HP's contract workers to date him.</p><p>Oracle had just bought Sun. Larry Ellison was friends and tennis buddies with Hurd and hired Hurd to help him turn Oracle into a hardware company. This meant Oracle was now a competitor to its former partner, HP.</p><p>Oracle said it would no longer create versions of Oracle's database for HP's most expensive, most profitable servers, built with a special Intel chip, Itanium. Many of HP's customers had bought that server specifically to run Oracle's database, which needs a powerful server to perform well. That's one of the reasons why Oracle bought hardware company, Sun, to begin with.</p><p>(Another reason it bought Sun was to get its hands on Java, Sun's popular web programming language. And that led to Oracle suing Google for billions of dollars, although <a href="http://www.businessinsider.com/google-won-its-lawsuit-against-oracle-2016-5">a jury just sided with Google saying it doesn't owe Oracle any money</a>.)</p><p>In the meantime, when Oracle wanted to end support for Itanium, HP sued for breach of contract and won.</p><p>Both companies are back in court this week to determine what kind of damages, if any, HPE is owed. </p><p>HPE will argue that the confusion over support for its servers cost it $1.7 billion in sales and another $1.3 billion in lost future sales. Hewlett Packard Enterprise is suing Oracle for $3 billion

<br /> The morning hour scramble for booking Tatkal tickets will now considerably ease as <keyword id="65866" type="COMPANY" weightage="20" keywordseo="IRCTC">IRCTC</keyword> has upgraded its website by introducing two high-capacity servers that have doubled peak-time efficiency.<br />
 <br /> The Indian Railway Catering and Tourism Corporation’s (IRCTC) portal installed two Linux-enabled servers recently. This will be raising the booking capacity to over 14,000 tickets per minute from the existing 7,200, much to the relief of passengers jostling for tatkal reservation, which faces heavy <keyword id="37572" type="ENTERTAINMENT" weightage="20" keywordseo="rush">rush</keyword> in its first 15 minutes since 10 am when the service opens every day.<br />
 <br /> The capacity augmentation has been done as an “immediate step” to cater to the summer-time demand for tatkal tickets and a forenoon flurry in their online reservation, revealed IRCTC <keyword id="147380" type="POSITION" weightage="20" keywordseo="chairman-and-managing-director">Chairman and Managing Director</keyword> Dr A K Manocha.<br />
 <br />
“The positive results are already showing,” he pointed out. “The measure is vital, considering that 54% train tickets in the country are booked through IRCTC website.” The average daily sale of train tickets through the portal, which is the world’s second busiest with 3 crore registered users, is around 5.5 to 6 lakh. It has registered a record 14,800 tickets per minute.<br />
 <br />
IRCTC, which is a 16-year-old ‘mini Ratna’ PSU of Indian Railways, had introduced e-ticketing in 2002 through its digital platform. The website was first upgraded in end-April last year, facilitating 1,50,000 concurrent connections (users at a time) and the ability to entertain 1,000 enquiries per second.<br />
 <br />
“Even that was later found insufficient, given the summer-time rush for tatkal tickets—especially in premium trains plying between the most sought-after destinations,”  said the CMD of the 1999-founded IRCTC, which is also into railway food catering and tourism promotion.<br />
 <br />
“The two HP Itanium servers have now helped raise the capacity of concurrent connections to 3,00,000, while the facility for enquiries has trebled to 3,000 per minute. Logging in on the IRCTC’s website has become smoother and more efficient. ”<br />
 <br />
With the addition of two new servers, IRCTC has now 17 servers while the existing 1.4 GB bandwidth has increased by 25 %.<br />
 <br />
The tatkal reservations on all Indian trains total roughly to 4,00,000 tickets (around 2.5 lakh PNRs). Of these, 50,000 tickets are slotted ‘critical’, given their high demand owing to various reasons during a given season.<br />
 <br />
On April 1 this year, when advance reservation period was made 120 days, IRCTC improved its national record by enabling booking of 13,45,000 tickets.<br />

Getting Tatkal tickets on IRCTC would no longer be a tough fight this summer. Here’s why

Analysts are expecting flat revenues but we're hearing that there could be a couple of bigger items of interest:</p>
<ul>
<li>A reorganization of the U.S. sales force, which may be announced only internally, not publicly.</li>
<li>A big new agreement with former-partner-turned-bitter-rival, Hewlett Packard.</li>
</ul>
<p>Both of those tidbits come from Wall Street analyst Pat Walravens, director of technology research for JMP Securities, one of the analysts who closely follows Oracle <a href="http://www.businessinsider.com/oracles-anthony-fernicola-joins-salesforcecom-2013-8">and breaks a lot of news about the company.</a></p>
<p>Walravens tells us that the reorg could be taking place in the current quarter and that people inside Oracle expect to be called into a meeting "to announce the change later this week." There may also be news about a restructured hardware business.</p>
<p>Oracle declined comment when reached by Business Insider.</p>
<p>Most analysts are expecting less-than-stellar financial results from Oracle. The consensus is 67 cents a share on sales of $9.2 billion. That's flat revenues from the year-ago quarter, and slightly improved profits.</p>
<p>Walravens expects software sales to be flat, and hardware revenue sales to be worse than expected, diving 13%. Oracle has said hardware revenue will be down 1% - 11%. Oracle's hardware sales have declined heavily for 11 quarters in a row.</p>
<p>So a reorg of the North American sales force could be good news.</p>
<p><a href="http://www.businessinsider.com/oracle-sales-force-changes-2013-9">As we've previously reported,</a> Oracle president Mark Hurd has been systematically overhauling the sales force for more than two years, but so far, his changes haven't sparked the kind of growth analysts would like to see.</p>
<p>When he began, we started hearing stories about how some of the company's <a href="http://www.businessinsider.com/oracle-former-employees-explain-why-it-cant-sell-hardware-2012-4">more experienced salespeople were quitting</a> because the atmosphere had become too cutthroat and stressful.</p>
<p>A few weeks ago, we talked to one salesperson who quit the company less than a year after joining. This person told us that, under Hurd, the sales territory was less than 20 square miles of a metropolitan area and included so few companies that it would have been very difficult to earn the quota Oracle expected, about $2 million in annual sales.</p>
<p>"My territory was extremely small. The amount of business I could call on, I exhausted that in amount of time I was there. They wanted you to keep calling those same companies. I'm not the kind of sales rep that's going to call on the same company over and over," this person told us.</p>
<p>Walravens is hearing similar stories. As he reported in his research note, an Oracle reseller told him that in one territory alone Oracle had "16 reps just [selling] on the database. I don't know how they make a living."</p>
<p>We're told that the North American sales teams to be restructured report to <a href="http://www.oracle.com/us/corporate/press/executives/matthew-mills-bio-1686531.html">Matt Mills</a>, who took over after top North American sales guy <a href="http://www.businessinsider.com/oracles-anthony-fernicola-joins-salesforcecom-2013-8">Anthony Fernicola moved to Salesforce.com.</a> This could be Mill's first big attempt to put his own stamp on things.</p>
<p>On top of all that, Oracle may have patched up its relationship with HP.</p>
<p>Walravens expects the two companies to announce that HP has signed a $150 million contract to renew its Oracle licenses. HP has always been a big Oracle customer, and for decades was a close partner who helped sell Oracle technology. But their relationship went south after Oracle bought Sun and started competing head-to-head in the hardware market with HP.</p>
<p>Oracle also hired Hurd after HP fired him as CEO, which lead to a lawsuit that was ultimately settled. Then Oracle said it would stop making its database software for HP's flagship Itanium computer servers. That lead to another lawsuit, <a href="http://www.businessinsider.com/hp-wins-its-lawsuit-against-oracle-2012-8">which HP won</a>.</p>
<p>Given its lack of overall growth, Oracle may have decided it needs HP again. Given Oracle's lackluster hardware sales, HP may have decided that Oracle isn't much of a threat. "Sun is a lot smaller when Oracle bought it," Walravens points out.</p>
<p>If that's the case, the companies may announce a big kiss-and-make-up partnership, similar to the one Oracle signed <a href="http://www.businessinsider.com/oracle-and-salesforce-partner-on-cloud-2013-6">last summer</a> with another friend-turned-rival, <a href="http://www.businessinsider.com/oracle-and-salesforce-partner-on-cloud-2013-6">Salesforce.com.</a></p>
<p>But that's just speculation at this point. Sources close to HP tell us that they haven't heard about a new contract or partnership with Oracle.</p>
<p>HP also had no comment.</p>
