<ul><li><keyword id="830092" type="General" weightage="20" keywordseo="zomato" source="Orion">Zomato</keyword> has accused that it is taking necessary steps to ensure the safety of their partners and not put them under pressure.</li><li>IFAT is an association of 35,000 service professionals working with Zomato, Swiggy, Uber, Ola and others.</li><li>The company will start its 10-minute delivery operation in Gurugram from next month.</li></ul>Even as Zomato is celebrating its entry into the 10-minute food delivery space, the delivery partners — who are going to be executing it on the ground — do not seem too excited about it. The Indian Federation of App-based Transport Workers (IFAT) and Telangana Gig and Platform Workers Union (TGPWU) have called out the company for not fixing current issues in their system. The association has urged the company to treat their delivery partners as human beings. Shaik Salauddin, the national general secretary of IFAT and the founder state head of TGPWU, noted, “Zomato in most of the cases has not been able to resolve issues like leaked meals, which arises from faulty packaging and executing fast delivery. As a result delivery partners/workers have been penalised quite a few times. While planning to provide 10-min [sic] deliveries to its customers Zomato needs to resolve these issues and concerns of the workers.” “Further we urge Zomato to look [at] their delivery workers as human beings [as they] are more than data points for the algorithm to manage,” he added. Notably, IFAT is an association of 35,000 service professionals working with Zomato, Swiggy, Uber, Ola and others. He further noted that the company should take care of the issues and the concerns raised by the delivery partners before it assures the customers of “lightning fast” delivery. The company also needs to provide resting areas, access to bathrooms, charging stations and wifi access to its delivery partners before starting “finishing stations” for quick delivery in Gurugram, the association added. This is not the first time that someone has raised issues with the 10-minute delivery model. The petition noted that the 10-minute delivery services adds extra pressure on delivery partners, who have to resort to overspeeding and traffic rule violations to fulfill these orders on time as well as avoid being penalised by the platforms. IFAT had also agreed to the content of the petition. Zomato has mentioned that it will not be showing the delivery time to delivery partners or penalising them for late delivery. The company has taken this step to ensure the safety of their partners and not put them under pressure. The company will roll its 10-minute delivery service in Gurugram next month and later look to expand to other cities. Partners’ association tells Zomato to see delivery executives as human beings

The <keyword id="6354977" type="General" weightage="20" keywordseo="supreme-court" source="Orion">Supreme Court</keyword> on Monday sought reply from the Centre on a plea seeking social security benefits for <keyword id="7771650" type="General" weightage="20" keywordseo="gig-workers" source="Orion">gig workers</keyword> employed by online food delivery, taxi aggregators, courier applications such as <keyword id="6354720" type="General" weightage="20" keywordseo="ola" source="Orion">Ola</keyword>, <keyword id="1042120" type="General" weightage="20" keywordseo="uber" source="Orion">Uber</keyword>, <keyword id="830092" type="General" weightage="20" keywordseo="zomato" source="Orion">Zomato</keyword>, <keyword id="6358977" type="General" weightage="20" keywordseo="swiggy" source="Orion">Swiggy</keyword>, etc. Senior advocates Indira Jaising and Gayatri Singh argued for the petitioner, The Indian Federation of app-based Transport Workers (IFAT). It was argued that at present these workers are not being provided the benefit of social security under any of the labour legislations-organised or unorganised. The counsel for petitioners argued that they are seeking a declaration that gig workers were entitled to protection as unorganised workers. After hearing arguments in the matter, a bench headed by Justice L. Nageswara Rao issued notice on the petition. Jaising submitted the petitioner seeks a declaration that the drivers or delivery workers are actually workmen in the classical sense of the word, and emphasised that worldwide for Uber they have been considered as workers. During the hearing, the top court cited the new legislation Social Security Code 2020 passed by Parliament last year has a chapter on the welfare of gig workers. The counsel submitted that the gig workers under existing law, would fall under the unorganised worker. The plea, filed through advocate Nupur Kumar, said "The Respondents' companies herein have been claiming that there exists no contract of employment between them and the petitioners and that their relationship with the petitioners are in the nature of partnership. If such a claim were to be accepted, this would be inconsistent with the purpose of social-welfare legislations..." The plea contended that the respondent companies, which own the apps, exercise complete supervision and control over the manner and method of the work with those who are allowed to register on the said apps. "Denial of the social security to the "gig workers" and the "platform workers" is an affront to the workers' right to life and right against forced labour that are secured by Articles 14, 21 and 23 of the Constitution of India", added the plea. Indian Supreme Court seeks Centre's reply on plea seeking benefits for gig workers of Zomato, Swiggy, Ola, Uber

<ul><li>The Indian Federation of App-based Transport workers (IFAT) have filed a petition in the Supreme Court seeking social security benefits.</li><li>They demanded that gig workers should be considered as “unorganised workers”, which will make their employers liable to pay them certain benefits.</li><li>The lack of employment contracts between gig workers and new age platforms does not mean there is no employer-employee relationship, the petition read.</li></ul>Some of India’s gig workers — associated with new age firms like Uber, Ola, Zomato and Swiggy — are seeking government intervention to help them overcome the impact of the pandemic and make their employers pay for it. The Indian Federation of App-based Transport workers (IFAT) filed a public interest litigation (PIL) in the Supreme Court two days ago, seeking their inclusion as “unorganised workers” or “wage workers” within the Unorganised Workers Social Welfare Security Act, 2008. The association, in collaboration with concerned individuals and organisations, noted that the denial of social security to gig workers and “platform workers’ has resulted in their exploitation through forced labour. The transport gig workers, in the petition accessed by Business Insider, noted that the failure to register them as unorganised workers or provide them with social security is violating their right to life and personal liberty as well as right to equality. They also added that app-based companies — Zomato, Swiggy, Uber, Ola and others — currently claim that they are in partnership with gig workers, therefore there is no contract of employment between the two parties. Hence, they want their hands off any responsibility or accountability over the lives and livelihood of the contractual workers associated with them. “The mere fact that their employers call themselves “aggregators” and enter into the so-called “partnership agreements” does not take away the fact that there exists a jural relationship of employer and employee; master and servant and worker within the meaning of all applicable laws,” the petition read. IFAT added that the contracts were made in a way to disguise the nature of the relations between the gig workers and these apps. They also cited a recent Supreme Court ruling in the United Kingdom, which <a href="https://www.businessinsider.com/uber-reclassify-uk-drivers-minimum-wage-benefits-supreme-court-defeat-2021-3">stated</a> that Uber Drivers are in fact workers in the company and are entitled to certain benefits. The workers’ association added that the transport gig workers in India are struggling with decreasing income, increasing fuel prices, immense pressure from loan recovery agents as well as state officials, who too are trying to make a living in this pandemic. Now, a netizen has gone a step ahead to launch an online petition to force these companies to roll back their ambitious 10 minute delivery project, saying that it was “never the need of the consumer”. “Everyone was doing just fine by getting their groceries delivered in bulk in a day or two, or buying them from their neighbourhood Kirana store,” the petitioner said, highlighting that this just fuels impulse buying and does very little to “safeguard the delivery partner”. “I opened my door and saw the delivery boy drenched, his raincoat muddy. He handed me my order, and started limping towards the stairs. I asked him what was wrong, so he told me he had been in a minor accident. The reason? He was speeding to deliver my order in under 10 minutes,” the person wrote <a href="https://www.change.org/p/swiggycares-dunzoit-zeptocares-blinkitcares-give-up-your-promise-of-10-20-minute-deliveries">in the petition</a>. Business Insider was able to verify the petitioner. Shaik Salauddin, the national general secretary of Indian Federation of App-based Transport Workers (IFAT), in a conversation with Business Insider too confirmed that these types of incidents are pretty common in the 10 minute delivery scenario. He emphasised that the delivery partners are under immense pressure to make deliveries under 10 minutes or else they will be penalised. To avoid bad reviews or penalties, the delivery partners are forced to resort to breaking traffic rules and over-speeding that does make them more prone to accidents, Salauddin added. The larger problem here is that there is no clarity on what the company’s plan of action would be in case a partner is injured while making deliveries. “Jaan ka khatra hai. Essential kya zaroorat hai pehle meri baat company se yeh hai. Agar aap delivery 10 minute mein nahi kar rahe toh kisiki jaan jane walli hai vahan pe? Aisa toh koi product grocery toh nahi hai na ki agar nahi hai toh jaan chale jati. [This endangers lives. I would first like to ask them what essential products are they delivering? It’s not like someone would lose their life if they don’t get that product or grocery within 10 minutes],” he added.
