In order to completely eliminate the need of sending the paper acknowledgement, called ITR-V through post to the <keyword id="2947836" type="UNKNOWN" weightage="100" keywordseo="I-T-Central-Processing-Centre">I-T Central Processing Centre</keyword> in Bengaluru, the <keyword id="65338" type="ORGANIZATION" weightage="100" keywordseo="Income-Tax-Department">Income Tax Department</keyword> today launched its ambitious One Time Password (<keyword id="510437" type="COMPANY" weightage="100" keywordseo="OTP">OTP</keyword>) based e-filing verification system. 

	The facility can be accessed using internet banking, Aadhaar number, ATM and email.
 According to the rules notified in this regard by the Central Board of <keyword id="57161" type="CITY" weightage="100" keywordseo="Direct-Taxes">Direct Taxes</keyword> (CBDT) today, any taxpayer, whose income is Rs 5 lakh or below per annum and has no refund claims, he or she can straightaway generate the 'Electronic Verification Code' (EVC) for e-filing and validating their <keyword id="6354751" type="COMPANY" weightage="100" keywordseo="Income-Tax">Income Tax</keyword> Return (ITR) through their registered mobile number and e-mail id with the department. 

	However, this most simplified option, will be subject to certain "restrictions" which will be prepared by the taxman based on the concerned taxpayer's "risk criteria and profile" in a case-to-case basis. 
 

	"This simply means that if the department has some adverse observation against the said PAN number with income less than Rs 5 lakh, he or she will not be allowed to do the verification directly through their email and mobile number alone and such cases will have to go through the other established procedures in this regard like linkup through Aadhaar database, internet baking or via the ATM," a senior official explained. 
 

	Once logged in on the banking portal, the taxpayer will be sent the EVC to his mobile number provided in the official e-filing web portal of the department which they will put in their ITR for final submission.

OTP based e-filing verification system launched for taxpayers

In a major setback for <keyword id="6354616" type="UNKNOWN" weightage="20" keywordseo="Twitter">Twitter</keyword> in India, the <keyword id="6355014" type="UNKNOWN" weightage="20" keywordseo="delhi-high-court">Delhi High Court</keyword> on Tuesday pulled up the micro-blogging site for failing to appoint resident grievance officer (RGO), saying, "How long will your process take place? This cannot be allowed", even as the court free pass to the <keyword id="6357307" type="UNKNOWN" weightage="20" keywordseo="Central-Government">central government</keyword> to act against the social media firm. A bench of <keyword id="11297383" type="COMPANY" weightage="20" keywordseo="justice-rekha-palli">Justice Rekha Palli</keyword> told Twitter's counsel, "Come up with a clear response, otherwise you will be in trouble", and sought information on Twitter's compliance with other provisions of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules, 2021) by the next date of hearing. The high court told central government counsel: "We are not stopping you from taking action, court has not granted any protection to Twitter. If they are in <keyword id="42987" type="PERSON" weightage="20" keywordseo="Violation">violation</keyword>, you know what to do." The Centre submitted that <keyword id="749437" type="COMPANY" weightage="20" keywordseo="Twitter-India">Twitter India</keyword> is in clear violation of IT Rules,2021. The Centre had informed the Delhi High Court that Twitter has failed to comply with the IT Rules, 2021 as on July 1, on four counts: Chief compliance officer not being appointed; The position of the resident grievance officer being vacant; The position of the nodal contact person (even on an interim basis) being vacant; and The physical contact address, which was shown to be there on May 29, was not available on Twitter's website. The central government counsel submitted before the court that Twitter was given three-month window to comply with IT Rules, but they did not. The counsel added that they are most welcome to do business in India, but they have to comply. The bench said, "I am not giving them any protection. I have already made it clear that they have to comply." Senior Advocate <keyword id="371031" type="PERSON" weightage="20" keywordseo="Sajan-Poovayya">Sajan Poovayya</keyword>, representing Twitter India, submitted that an interim grievance officer was appointed, but he had withdrawn his candidature on June 21. The bench responded that after June 21, and till July 6, the least it could have done was appoint another person. "How long does your process take? If Twitter thinks it can take as long it wants in our country, I will not allow that," said the bench. Poovayya sought time to seek instructions on the new appointment, which was allowed by the court, and it passed over the matter. Later, Poovayya submitted that he needs more time to obtain detailed instructions from San Francisco-based Twitter. The bench observed that these rules are binding but Twitter has not appointed anyone till now. The court posted the matter for further hearing on Thursday, and asked Twitter to inform by when it will appoint an RGO and other officials. On May 31, the Delhi High Court had issued a notice to the microblogging platform on a plea by advocate Amit Acharya. The plea had urged the high court to issue directions to the Centre to pass necessary instructions to Twitter India and <keyword id="308642" type="COMPANY" weightage="20" keywordseo="Twitter-Inc">Twitter Inc</keyword> to appoint a resident grievance officer under Rule 4 of the Information Technology (Intermediary Guidelines and Digital Ethics Code) Rules, 2021 without any delay. The plea had contended that in a nutshell, every significant social media intermediary has the responsibility of appointing not only a resident grievance officer who will act as a single-point authority for receiving and disposing of complaints within a fixed time, but someone should also receive and acknowledge any order, notice and direction issued by the competent authorities. Delhi High Court raps Twitter, 'Come up with a clear response, otherwise you will be in trouble.'

New Delhi, Jan 15 () The government on Wednesday said it is initiating the process of coal auctions and the first round of sale of blocks under commercial mining is proposed to be launched in the ongoing fiscal.
The announcement comes days after the government approved an ordinance to ease mining laws that will allow global players to enter the coal sector.
 A company or a joint venture company incorporated in India is eligible to participate in commercial coal auctions, the coal ministry said in a statement.
"Moving ahead after the recent amendments in MMDR Act 1957 and the CMSP Act 2015, the Ministry of Coal is initiating the process for auction of coal mines for sale of coal. Expected to be held in multiple tranches, the first tranche is proposed to be launched in the current financial year," it said.
 The bidders would be required to bid for a percentage share of revenue payable to the government. The floor price shall be four per cent of the revenue share, the statement added.
 The government has released a list of 74 mines which it plans to auction under commercial mining.
 The ministry said it has urged interested stakeholders to view the discussion paper and the mine specific details and submit their views/suggestions, indicate their preferences for the mines to be considered for auction under the first tranche.
 The ordinance approved by the Cabinet last week also enables auction of unexplored and partially explored coal blocks for mining through prospecting license-cum-mining lease.
 These steps are expected to result in opening up of the coal sector completely for commercial mining to local as well as global firms. This would further boost economic growth and employment generation. SID ANU

Centre begins commercial coal auction process

New Delhi, Nov 19 () Chhattisgarh Chief Minister Bhupesh Baghel has written to Prime Minister Narendra Modi to hike minimum support price of paddy to Rs 2,500 per quintal, and procure 32 lakh metric tonnes of rice from the state for central pool.
"If under any circumstances, government of India does not increase the support price, then conditions of procurement MoU (Memorandum of Understanding) should be slackened, as it was done in year 2017 and 2018, so that state government may provide proper value of farmers' yield at its own expense," the chief minister said in the letter.
Baghel said he has requested the prime minister to give appointment to meet him to address this extremely important financial issue of national interest.
"Every year, a large quantity of paddy is procured under Decentralized Procurement Scheme in Chhattisgarh for state's requirement and central pool. I have written letters to you dated July 05, 2019, October 25, 2019 and October 30, 2019, requesting hike in minimum support price of paddy to Rs 2,500 quintal and procurement of 32 lakh metric tons of rice from Chhattisgarh for central pool," as per the letter.
The Centre, in July this year, hiked the minimum support price (MSP) for paddy by Rs 65/quintal to Rs 1,815 for the 2019-20 crop year.
The chief minister said the process of paddy procurement is about to begin to financially empower the farmers of Chhattisgarh.
Union food ministry on October 24, 2019, said the Centre would not procure rice/paddy for central pool from the states that provide bonus on minimum support price fixed by the central government.
"I would like to draw your attention towards the fact that payment of proper value of their yield has resulted in prosperity and accelerated development in rural areas. Chhattisgarh remained untouched by the recession across the state in the fields of construction, automobiles etc. This also indicates that hike in minimum support price has positive effects on financial condition of farmers and also boosts overall economy," Baghel said.
The chief minister said he made several attempts to meet the prime minister "but I couldn't get an appointment till date".
"Following the suggestions received from your office, I met Union Agriculture Minister on November 14, 2019. Besides, I met Union Food Minister again on the same day and made aforementioned request. But till date, government of India has not reconsidered its decision regarding procurement," Baghel said in the letter.
He also said "Chhattisgarh is known as 'rice bowl' and the government of India's decision may have adverse effects on procurement along with other long-term negative impacts".
The chief minister said he had a detailed discussion with the MPs, the political parties and various farmers organisations on November 5, 2019 and during the interaction, individuals, political parties and farmers organizations had unanimously supported procurement of paddy at Rs 2,500 per quintal.
He requested the prime minister to issue necessary directive/instructions for procurement of paddy at Rs 2,500 per quintal in Chhattisgarh and to accept 32 lakh metric tonnes of paddy from Chhattisgarh for central pool. AKV BAL

Chh'garh CM urges PM Modi to hike MSP for paddy

New Delhi, Dec 16 () In sync with its commitment for 'ease of doing business', the Centre on Monday said it has decided to simplify the process of clearance for coal mining projects.
 The move, the government said, will not only expedite operationalisation of already allotted coal blocks, but also encourage prospective investors/bidders in future auctions.
 "The Ministry of Coal has re-engineered the mining plan preparation and approval process. This is likely to slash the approval period substantially from existing 90 days to about 30 days," the ministry said in a statement 
 "The re-engineering process includes simplification of guidelines and format for preparation of mining plan, amendments in relevant provisions of Mineral Concession Rules, 1960 and approval process," it said.
 The proposed simplified guidelines and format not only reduce the mining plan formulation time but also make the document lighter and easier to comprehend. This will further facilitate hosting the soft copy in an accessible data base, it added.
 The proposed system of mining plan preparation and approval allows the leasee to get mining plan prepared by Mining Plan Preparing Agency (MPPA) and get it certified by Mining Plan Certifying Agency (MPCA) and submit the mining plan to the coal ministry for approval. This will improve the quality and reduce time for detailed scrutiny, it said.
 "To ensure the quality of preparation of Mining Plan, government approved accrediting body will accredit agency(s) consisting a team of multi-disciplinary background, which will be recognised for preparation of mining plan and for certification (i.e. scrutiny from geo-mining &amp; techno-administrative angles), government will accredit agency(s) consisting of multi-disciplinary domain experts, who will certify that the mining plan prepared by MPPA is in line with the prevailing guidelines and is complete in all respects," it said.
 On certification by the MPCA, a committee in government will consider the mining plan for approval and the Centre will dispose application of within the stipulated period.
 To further ease the system, the entire mining plan approval process is proposed to be made online for application, processing and approval in the next phase.
 "This system will ultimately interact with PARIVESH portal of MoEF&amp;CC (Ministry of Environment, Forest and Climate Change) and similar portals of other related ministries and organisations of the Central and state governments," it said. SID RVK

Centre simplifies clearance process for coal mining projects

To ensure biometric data doesn’t leak either via private contractors running enrollment centres or at the central data servers that store details, the <a href="http://www.businessinsider.in/searchresult.cms?query=Aadhaar+">Aadhaar</a> system's data collection and storage is strongly protected by <a href="http://www.businessinsider.in/searchresult.cms?query=sophisticated+encryption+processes">sophisticated encryption processes</a>. 
 
Suppose the data is stolen or lost, the encryption would prevent access to the biometrics as it would need the most powerful computers literally eons to crack the code. Similarly at the central data centre, the encryption processes are repeated while storing the details, making attempts to access and use the data very difficult. 
 The unique identity authority of India's processes are intended to allay fears that biometric data collected by private contractors might be vulnerable to falling in unauthorized hands as the detail is encrypted using the highest available public key <keyword id="322130" type="TECHNOLOGY" weightage="100" keywordseo="cryptography">cryptography</keyword> encryption. 
 
The government hopes that the lack of human interface in storing the data and procedures such as data collectors being required to authenticate every entry though their own biometric verification will help convince the <a href="http://www.businessinsider.in/searchresult.cms?query=Supreme+Court+">Supreme Court</a> that privacy concerns have been addressed by the <keyword id="6355252" type="CITY" weightage="80" keywordseo="UIDAI">UIDAI</keyword>. 
 
How would you know that the <a href="http://www.businessinsider.in/searchresult.cms?query=UIDAI+">UIDAI</a> programme's was successful? Because it has not received any credible complaints or proof of misuse of data since it started the ambitious scheme almost five year ago. This is partly due to the processes that make even loss of a recording machine or copying on a flash drive a futile exercise. 
 
The data are being collected on software - Enrollment Client (EC) Software - written, maintained and provided by the UIDAI. It is encrypted to prevent leaks at the enrollment centres managed by private vendors and in transit. The private agencies on ground use the EC Software which ensures that only authentic and approved person can sign-in for the purpose of enrolling people. 
 
The enrollment client software used by private vendors strongly encrypts individual electronic files containing <a href="http://www.businessinsider.in/searchresult.cms?query=demographic+and+biometric+details+">demographic and biometric details</a> of residents at the time of enrollment and even before the data is saved in any hard disk. 
 
The encryption uses highest available public key cryptography encryption with each data record having a built-in mechanism to detect any tampering. 
 
The e-data packages are always stored on disk in PKI encrypted form and is never decrypted or modified during transit making it completely inaccessible to any system or person. 
 Among other <keyword id="6355300" type="CITY" weightage="60" keywordseo="security">security</keyword> measures, UIDAI has ensured that the <keyword id="144117" type="ORGANIZATION" weightage="100" keywordseo="AADHAAR">Aadhaar</keyword> database is not linked to any other databases.

 Dual GST 
India is a federal republic Country. In the constitution of India there is distinct division of powers between the Center and the States. Both have been assigned the powers to raise resources through appropriate legislation. Therefore a dual GST is Constitutional requirement of fiscal federalism wherein Centre and States will be simultaneously levying it on a common tax base. 
 
Registration 
Those who are already registered under Central Excise Law, Service Tax Law, Central Sell Tax or State VAT do not need file a fresh application. They will get automatically get a PAN based registration number. Those who are not already registered under aforementioned laws, can get registered within 30 days from the date they becomes liable. Others liable to register under GST Act, can apply either through GSTN portal or facilitation center. The applicant must have PAN to apply for registration under GST.

How this budget will be a gamechanger for SMEs and MSMEs

The newly minted 170 <a href="http://www.businessinsider.in/searchresult.cms?query=Indian+Administrative+Service+%28IAS%29+" target="_BLANK￿￿￿￿">Indian Administrative Service (IAS)</a> officers of 2013 batch are literally being kept on their toes as they have been asked to come up with new and innovative ideas to simplify government processes before they meet <a href="http://www.businessinsider.in/searchresult.cms?query=PM+Narendra+Modi" target="_BLANK￿￿￿￿">PM Narendra Modi</a>. 
 These officers, who are on deputation to the Centre before they head for their first state postings as part of an idea mooted by the <keyword id="71" type="POSITION" weightage="80" keywordseo="Prime-Minister">prime minister</keyword>, have time till November 30 to come up with ideas on simplifying at least two processes of the government. 
 
They are scheduled to face Modi at a feedback session at the end of a rigorous three-month stint at the Centre. 
 
Before their session with Modi, each of the officers have to prepare a 'Paper on Innovation' or 'Process re-engineering to improve functioning of the government', along with identifying at least two processes for simplification and compiling the guidelines or norms pertaining to their desk. 
 
A typical day, which begins with yoga for two hours from 6:30 am, is chock-a-block with meetings with senior officers and involves grappling with files related to the Centre's flagship programmes. 
The <a href="http://www.businessinsider.in/searchresult.cms?query=Department+of+Personnel+and+Training+%28DoPT%29+" target="_BLANK￿￿￿￿">Department of Personnel and Training (DoPT)</a> has issued at least 99 orders over the past one month on how they should go about their work, including a detailed 13-week work calendar to follow. But they can fall back on three senior secretaries who have been appointed as chief mentors. 
 
The time spent with the central government will help the officers "acquire a national perspective and a deeper appreciation of harmonization of diversities in national policies", according to a concept paper on the exercise being undertaken for the first time. 
 The chief mentors include home secretary <keyword id="1928895" type="PERSON" weightage="40" keywordseo="Rajiv-Mehrishi">Rajiv Mehrishi</keyword>, <keyword id="193102" type="POSITION" weightage="40" keywordseo="defence-secretary">defence secretary</keyword> Mohan Kumar and <keyword id="2665691" type="UNKNOWN" weightage="40" keywordseo="Niti-Aayog">NITI Aayog</keyword> chief executive Sindhushree Khullar. 
 
The 52 ministries and departments where the young IAS officers have been posted as assistant secretaries have been divided into four clusters — social, economic, infrastructure and regulatory. 
 
Further, these clusters have been assigned to Jugal Mohapatra (secretary, rural development), AC Duggal (secretary, finance services), Amitabh Kant (secretary, DoPT) and Sanjay Kothari (secretary, DoPT) respectively, who have been tasked with meeting every 15 days to take stock of the performance of the assistant secretaries. 
 
On August 26, <a href="http://www.businessinsider.in/searchresult.cms?query=cabinet+secretary+" target="_BLANK￿￿￿￿">cabinet secretary</a> PK Sinha held a special meeting and assigned the job to these senior secretaries. Sinha also directed the ministries to allot desks pertaining to the <keyword id="6360789" type="ORGANIZATION" weightage="100" keywordseo="Modi-Government">Modi government</keyword>'s flagship programmes to the new officers or programmes which have a bearing on states in terms of implementation. This will give the officers an opportunity to look at the projects from the point of view of both Centre and the ground level, Sinha said at the meeting. 
 The DoPT is keeping a close watch on the number of files initiated and disposed of at the desk of each <keyword id="222361" type="POSITION" weightage="40" keywordseo="assistant-secretary">assistant secretary</keyword>, who has to attend meetings within and outside the ministry with other officers as well. The trainees have been asked to meet every officer in their ministry. 
 
As per the 13-week work calendar, the assistant secretaries have to meet officers and secretaries across the board in the first two weeks, identify a specific project in the third week on which they will do extensive and intensive work, and work on action on frontlines for Swachh Bharat Abhiyan on October 2. 
 
Between the fourth and the eight weeks, they will have to come to grips with the intricacies of implementation of schemes and projects, and "wear the thinking caps — question and challenge existing processes and policies" in the ninth and tenth weeks. 
 The 11th and 12th weeks will be time to "bring it all together" with a presentation to the secretary on two processes that can be simplified or modified and bring files handed by the officer to the logical end. The assistant secretaries have already had meetings with principal secretary to the PM, Cabinet secretary, foreign secretary, home secretary, <keyword id="51689" type="ORGANIZATION" weightage="40" keywordseo="Railway-Board">Railway Board</keyword> chairman, <a href="http://www.businessinsider.in/searchresult.cms?query=Comptroller+and+Auditor+General" target="_BLANK￿￿￿￿">Comptroller and Auditor General</a>, central information commissioner, central vigilance commissioner, chief election commissioner and NITI Aayog V-C. 
 
They have attended two recent conferences held by the PM this month and submitted weekly notes on their activities since their stint began on September 1. Besides, the Institute of Secretariat Training and Management has sent 23 case studies on noting and drafting which have been distributed among the assistant secretaries.

Once the trial is successfully completed and the deficiencies are met, the proper booking system would be up and running for actual use. 
 
"We have started the trial run of online booking system for community centres and open space/parks. With the launch of this project, Delhiites can book PWD's parks and community centres for marriage functions and other events online and even make payment through Internet. This project may be launched on 1 December," said a senior official from PWD. 
 
Presently, these venues can be booked only by visiting the Delhi Secretariat office, and thus consumes a lot of time and efforts of citizens. The motive of launching the online booking system is to save time of the technologically sound citizens. Also, in the wake of a recent corruption scam whereby three tent operators were blacklisted by PWD on account of fraudulent bookings, this project will also help in bringing full-transparency in the venue booking process. 
 
Central and State government employees would have to book the venue 90 days before the function while those who are not employed with Central or State governments would have to book the venue 30 days prior to the function date. 
 
At present, PWD has over 12 community centres and open areas/parks located in Gulabi Bagh, Karkadooma, Kalyanvas and Timarpur.

The local services on the network of Central Railway (CR) and Western Railway (WR) -- the city's lifeline -- is specifically for the employees of the Maharashtra government who are engaged in essential services. This follows repeated appeals by Maharashtra Chief Minister Uddhav Thackeray to the Centre for resumption of services as part of the unlocking process post COVID-19 lockdown. Accordingly, the familiar sight and sounds of the suburban trains greeted Mumbaikars since early morning as the CR and WR together started 450 services, according to officials. The WR will run 60 pairs of its 12 car suburban services -- total 120 -- in both directions between <keyword id="74906" type="LOCATION" weightage="20" keywordseo="Churchgate">Churchgate</keyword> and <keyword id="1077401" type="LOCATION" weightage="20" keywordseo="Dahanu-Road">Dahanu Road</keyword>, according to WR spokesperson <keyword id="3465642" type="PERSON" weightage="20" keywordseo="Ravindra-Bhakar">Ravindra Bhakar</keyword>. The CR will run 100 services on either side on its Main line -- between Chhatrapati Shivaji Maharaj Terminus to Thane, Kalyan, Karjat and Kasara and 70 services on either side of Harbour line -- Chhatrapati Shivaji Maharaj Terminus and Panvel, said CR spokesperson Shivaji Sutar. "These trains will run between 05.30 hrs to 23.30 hrs", said a CR-WR joint statement early Monday. "It is requested not to rush to the stations and follow medical and social protocols as mandated for CoVID-19," the CR-WR joint statement said.

The central government may also share the CET merit list with states for state government jobs on a cost-sharing basis. The NRA will be a society registered under the Societies Registration Act, 1860 and government will be doling out ₹1,517.57 crore to set it up. However, it estimates that it will be able to save around ₹600 crore per annum under the new system — breaking even in around three years. How will CET work? The CET serves as an entrance exam. It’s a first level test to shortlist candidates for a particular post. The scores of the test will remain valid for three years and can be used to apply for jobs across the government spectrum. Each person will have two additional chances to improve their scores, and only the best of all scores will be taken into final consideration. "There are 1.25 lakh vacancies every year in Group B and C for Railways, banks and SSC for which 2.5 crore to 3 crore people apply," said Chandramouli. What will CET achieve? According to the Indian government, the CET is aimed at solving problems for the candidates. From the varying schedules of different exams to their different application processes, the CET will simplify the entire ecosystem. By bringing all the exams under one umbrella, It will also address the infrastructure shortage that creates scope for malpractice, said Chandramouli. One exam will also mean just a one-time payment of exams fees instead of shelling out separate payments. Chandramouli pointed out that the CET will also enable job opportunities to reach rural areas for those candidates for whom travelling to testing centres, located mostly in urban centres, may not be possible or affordable. To remain accessible, the CET will also be available in multiple languages. For institutions, CET will standardise the process that could solve for the delay that occurs from time to time in the finalisation of results. The government asserts that the central test will shorten the overall cycle time of recruitment from the current 12 to 18 months. Cabinet approves creation of ‘National Recruitment Agency’ — Government and PSU bank job seekers will now have to clear a single central test

The draft <keyword id="2617070" type="PERSON" weightage="20" keywordseo="Personal-Data-Protection-Bill">personal data protection bill</keyword> that seeks to empower the Centre to exempt any government agency from the provisions of the proposed legislation has the industry worried, as they warn that such exemptions represent "new, significant threats" to the privacy of Indians. The proposed bill also provides for voluntary verification of social media users and transfer of non-personal data. The outcry from industry watchers, analysts and civil society comes amid the draft bill suggesting that the Centre will be empowered to exempt any government agency from the application of the Act and verify social media users.
 One of the provisions of the draft bill states that the Centre can - in the interest of sovereignty, the security of the state, and public order - "direct that all or any of the provisions of this Act shall not apply to any agency of the Government in respect of processing of such personal data..."
 The bill, which was cleared by the Cabinet last week, is likely to be introduced in the Lok Sabha in the next couple of days.
 Mozilla's Policy Advisor Udbhav Tiwari said that if Indians are to be truly protected, it is urgent that Parliament reviews and addresses "these dangerous provisions before they become law".
 "Indians have been waiting for a strong data protection law for years now, and this latest bill delivers real privacy in regards to processing by companies and is a dramatic step backwards in terms of processing and surveillance by the government. Exceptions for government use of data, the verification of social media users, and the forced transfer of non-personal data all represent new, significant threats to Indians' privacy," said Tiwari.

 While the bill seeks to protect personal and sensitive data of individuals, it proposes to allow processing of private data without explicit consent in case of security, credit scores, debt recovery, operation of search engines and whistle blowing.
 The draft bill also states that the central government can frame policy for the digital economy with respect to non-personal data. In particular, it can direct any data processor to "provide any personal data anonymised or other non-personal data to enable better targeting of delivery of services or formulation of evidence-based policies by the Central Government".
 Further, social media entities with user base above a certain threshold and whose "actions have, or are likely to have a significant impact on electoral democracy, security of the State, public order or the sovereignty and integrity of India," will be notified as 'significant data fiduciary'.
 Every social media intermediary classified as a 'significant data fiduciary' will enable the users in India to voluntarily verify their accounts. Any user undergoing such voluntarily verification will have to be provided with a mark of verification that is visible to all users of the service. Such entities will also have to get their policies and conduct (of data processing) audited by an independent data auditor.
 Jaspreet Singh, Cyber Security Leader, EY India said termed the Bill a "double-sided sword".
 Singh said that while it protects the personal data of Indians by empowering them with data principal rights, "it bestows the central government with exemptions which are against principles of processing".
 "The State can process even sensitive personal data when required, without an explicit consent from the data principals. However, the government will need to show that any processing of personal data is necessary and processing of sensitive personal data is strictly necessary for the exercise of any function of the State authorised by law for the provision of service or benefit," Singh said.
 These broadly-worded carve-outs "can be misused and hence need to be carefully examined", he cautioned.
 Arun Prabhu, Partner at Cyril Amarchand Mangaldas noted that portions of the bill have been pared down, and some changes such as the lack of a clear implementation timeline, requirement to share non personal data, obligations for social media verification "may be a potential source of concern."
 He, however, said that certain changes made to the Draft Bill are business friendly, providing for increased certainty, a regulatory sandbox for Artificial Intelligence/Machine Learning and other innovative technology, limiting localisation to non-sensitive data and a potential carve out for non-Indian data processed under contract.
 Gartner said that the primary concern will be the execution of the bill across which will include advisory from regulatory bodies such as RBI, IRDAI, SEBI.
 "There must to very clear guidelines which the enterprises can easily follow without relying completely on consulting service providers. Very clear deadlines must be mentioned and clarity on the fines in case of violation must be clearly mentioned and should be available on public website," Rajpreet Kaur, Principal Analyst of Gartner said. Approximately Rs 3,900 crore, a commitment made tothe state, has not been released by the Centre which, instead,told the state that it would be given permission to secure aloan of about Rs 1,400 crore, the chief minister said. The Centre, as per the Constitution, has to give theshare of states in the taxes collected by it and there is nokindness on the part of the former (Centre), he pointed out. Talking about other types of funds provided by theCentre, he said the Centre also releases funds to the statesas its share and such amount given by the Centre has nottouched even Rs 10,000 crore any year during the last fiveyears (in Telangana), he claimed.The Congress had earlier tried to trumpet such fundsand the present NDA government is trying to do it on a largerscale, he said.Telangana is one of the five to six states which takecare of themselves and also contribute to the nation buildingprocess, he said."Telangana is one state which is building itself andwhich is participating very actively in the nation buildingprocess by way of contributing huge taxes from the state ofTelangana.
