<ul><li>The Indian Parliament on Wednesday passed a Bill that removed <keyword id="54776" type="ORGANIZATION" weightage="20" keywordseo="Leprosy">leprosy</keyword> as a ground for divorce in five personal laws. </li><li>Hindus in <keyword id="3658" type="LOCATION" weightage="20" keywordseo="India">India</keyword> can no longer seek divorce if partner has leprosy. </li><li>Leprosy patients were not considered a part of the society as the disease was not curable. </li></ul>The Indian Parliament just removed an archaic law that allowed Hindus in the country to divorce their partners if they had leprosy. On Wednesday, the upper house <a href="https://prsindia.org/billtrack/personal-laws-amendment-bill-2018">passed a bill</a> that will remove the disease -- now declared curable -- as a legitimate ground for divorce, according to the five personal laws under the Hindu Marriage Act. The bill was passed on the last day of the Budget session without instigating any debate following general agreement on the issue. The Personal Laws (Amendment) Bill seeking removal of leprosy as a ground for divorce was introduced in 2018 in the lower house of Parliament. But the first push to remove this outdated provision was mooted over a decade ago. Earlier, Leprosy patients were not considered a part of the society as the disease was not curable. Leprosy patients were isolated and segregated from society as the leprosy was not curable and the society was hostile to them The suggestion of excluding leprosy as a ground for divorces in India was first put forward by The National Human Rights Commission in 2008. The Commission said that it is a curable disease now and it is not viable to have the diseases as a basis for divorce. Following this, India signed a United Nation General Assembly’s Resolution in 2010 to eliminate any discrimination against people affected by leprosy. In 2014, the Supreme Court also instructed the centre and state governments to rehabilitate those <a href="https://economictimes.indiatimes.com/news/politics-and-nation/parliament-passes-law-removing-leprosy-as-ground-for-divorce/articleshow/67974143.cms">affected </a>by leprosy. While the World Health Organisation declared successful eradication of leprosy worldwide, India is still witnessing high incidences of the diseases. As of 2017, <a href="https://timesofindia.indiatimes.com/city/gurgaon/eliminated-in-2005-india-still-has-more-than-half-of-worlds-leprosy-patients/articleshow/56940677.cms">India had </a>nearly 57% of the world’s leprosy patient. Hindus in India could seek divorce if partner had leprosy— not anymore

<ul><li>As per the <keyword id="6354977" type="ORGANIZATION" weightage="20" keywordseo="Supreme-Court">Supreme Court</keyword>'s ruling, no third party will be allowed to interfere in marriages. </li><li>Khap panchayats are unelected (usually all-male) community councils in villages, primarily in the Jat-heavy states of Rajasthan, Uttar Pradesh and Haryana. </li><li>The ruling was based on a petition filed in 2010 by Shakti Vahini, an NGO, to put an end to honour killings.</li></ul>In a welcome move, a Supreme court bench led by Dipak Misra, the Chief Justice of India, declared on March 27th that a <keyword id="122529" type="ORGANIZATION" weightage="20" keywordseo="Khap-panchayat">Khap panchayat</keyword> did not have any power to block a <keyword id="6355896" type="UNKNOWN" weightage="20" keywordseo="Marriage">marriage</keyword> between two consenting adults and that any attempts to do so were “absolutely illegal”. The ruling will be backed by punitive measures and legislation. Khap panchayats are unelected (usually all-male) community councils in villages, primarily in the Jat-heavy states of Rajasthan, Uttar Pradesh and Haryana. While Gram (village) panchayats are allowed to act as “self-governing bodies” under Article 40 of India’s Constitution and resolve disputes, panchayats based on “khap” or clan don’t have a constitutional basis. However, these quasi-judicial councils have been acting like the moral arbiters in villages long before the Constitution was drafted. Not only do they interfere in marriages between people from different castes and religions, but they have also been responsible for ordering honour killings. A prime example is the double murder in 2007 of the newly-wedded Manoj and Babli Banwala in Haryana’s Kaithal district. Manoj and Babli were said to belong to the same gotra, or <keyword id="6374122" type="UNKNOWN" weightage="20" keywordseo="Hindu-clan">Hindu clan</keyword>. This went against the khap panchayat’s governing concept of “bhaichara”, wherein people of the same clan are considered siblings. In 2010, Shakti Vahini, a human rights NGO, filed a petition with the Supreme Court seeking to prevent such extra-judicial killings and curb the authority of the councils that ordered them. The Supreme Court’s ruling today was based on this petition. Under the law, no third party will be allowed to interfere in marriages. The Supreme Court’s order preventing the khap panchayats’ interference in marriages is a step in the right direction. But it needs to be backed by further checks on the power of these councils. While their role as arbitrators of disputes such as those involving property or loans can’t be undermined, their dated traditions and patriarchal beliefs render them impediments to India’s social progress rather than its enablers. For example, in response to the court’s tough stance on the marriage issue in February, a number of khap leaders proposed an outright ban on the <a href="https://timesofindia.indiatimes.com/city/meerut/dont-meddle-in-our-age-old-traditions-or-we-will-stop-giving-birth-to-girl-child-khap-leaders-on-sc-order/articleshow/62810872.cms">births of female children. </a>In 2015, a khap panchayat in Haryana’s Yamunagar district punished an alleged rapist with <a href="https://www.indiatoday.in/mail-today/story/rapist-haryana-panchayat-5-shoe-slaps-246781-2015-02-14">only five slaps with a shoe. </a>In 2012, a khap panchayat leader in Haryana’s Jind district attributed the rising number of rape incidents to the <a href="https://timesofindia.indiatimes.com/india/Haryana-khap-blames-consumption-of-chowmein-for-rapes/articleshow/16829882.cms">consumption of chowmein.</a> The statement came a week after another khap leader suggested lowering the legal marriage age for women from 18 to 16 so as to prevent rapes. As this is India, curbing the powers of a regressive vote-bank is an ill-advised political move, especially when the parties in question are enforcers of Hindu traditions. Local politicians and policemen are complicit in supporting the decision-making powers of these bodies. However, in order to rule, a council needs people to rule over. As more Indians migrate to cities and become less conscious of caste, one hopes that the authority of these councils will eventually wane.

Khap panchayats can’t stall marriage between consenting adults: Supreme Court

Age is also an influencer here. Younger respondents were seen to be more liberal than the older ones. Also, women were found to be less homophobic than men.

	In one of her fund-raiser campaigns for equality, Ms Iyer says, “Sexuality is not a choice. Homophobia is.” 
 

	The social media has not been sitting idle on the sidewalk either. Facebook, with its pro-gay photo filter which colours your profile picture in rainbow with a click, is evident to understand the importance of acceptance to an acceptance. Rather an acknowledgement to a legislation. 
 

	Gay couples who are susceptible to social and moral wounds inflicted by their communities and countries need more than just a legal nod. They need a genuine hug from the heart of the people they are surrounded by. 
 

	It has so happened that supporting a cause has come to be seen as a sign of progress. Be it legalisation of marijuana or same-sex marriage. When there is a sizeable community or a pod of population that wants the rights for something, the ones supporting it are seen as advanced and in time or ahead of their time. And the ones hostile are seen as backward and regressive. 
 

	Russia and the Arab world have maintained less enthusiasm toward the legalisation of same-sex marriage or for that matter even the pro-gay photo filter from Facebook.

I'm straight and Russian but I'm not a homophobe!” 

	Muna Iraqi, Egyptian TV presenter gave his opinion, “I support people's right to love freely, without any persecution.”
 

	Gays are not from out of space. They are from here. Just as you and me are. That's why, what we think about them matters in how they are able to think about themselves. If not individually, then collectively. 
 Speaking on last week's landmark Supreme Court judgement, Modern Family's <keyword id="868675" type="UNKNOWN" weightage="100" keywordseo="Jesse-Tyler-Ferguson">Jesse Tyler Ferguson</keyword>, who plays Mitchell Pritchett - a gay lawyer, father, and son in the hit television series says that the show has played a great deal in changing the perceptions of gay couples in general. Jesse is gay in real life as well. 

	Pope Francis, in July 2013, when asked about same-sex relationships, said, “if a homosexual person is of good will and is in search of God, I am no one to judge. It is not right to interfere spiritually in the life of a person.” 
 

	He further adds, “Tell me, when God looks at a gay person, does he endorse the existence of this person with love, or reject and condemn this person? We must always consider the person. Here we enter into the mystery of the human being. In life, God accompanies persons, and we must accompany them, starting from their situation. It is necessary to accompany them with mercy.” 
 

	I believe that this world is one big modern family. A family accepts its people for who they really are. The ability to maintain discernment toward one's discretion and prerogative. Who are we to judge a verdict already pre-allotted by nature? We are famous because of our human nature. It takes one preposition to make us inhuman. Make us infamous. The 'in'. It is that time now to put the 'in' in the inn of the bygones and position our prepositions toward the positioning of a free disposition. 
 

	After all, our world is supposed to be full of sunshine and rainbows. Isn't it?

Rekha Sharma also addressed the "lewd" comment incident that occurred earlier regarding a picture of the widow of Kirti Chakra recipient Captain Anshuman Singh. NCW chief Rekha Sharma said, "It was a very derogatory comment that we saw on social media, and we immediately took suo motu cognizance of it. The police have filed an FIR against this person. However, the individual is most likely from Pakistan." "Many such comments are being made, and we are taking those comments very seriously and urging the police to file FIRs in those cases as well," she added. Delhi Police acknowledged the National Commission for Women's (NCW) letter to the Delhi Commissioner of Police, demanding the arrest of the man and submission of a detailed report to the panel within three days. The police said a complaint was received from the National Commission for Women, alleging that a social media user had made an extremely lewd and derogatory comment on a picture of the widow of a late soldier. Taking cognizance of the complaint and after a preliminary examination of its contents, a case FIR under Sections 79, BNS-2023, and Section 67 of the IT Act 2000 has been registered at the Police Station Special Cell, and an investigation is underway. Captain Anshuman Singh, a doctor, was posted with the 26 Punjab as a medical officer in the Siachen Glacier area. On the night of July 19, 2023, there was a fire incident at an Indian Army ammunition dump at the camp where he was posted. Captain Singh saw a fibreglass hut engulfed in fire and immediately acted to rescue four to five individuals trapped inside. He went inside the medical investigation room, which was also on fire, to retrieve the critical medical aid box but could not make it out due to heavy fire amid strong winds. He was awarded the Kirti Chakra posthumously. Captain Singh's wife, Smriti, and his mother received the award from President Droupadi Murmu.
