Now, Trump administration wants to hike H1-B visa fees to train Americans in technology

The Trump's administration proposed over 80% hike in the Citizenship application fee, saying that the "current fees do not recover the full costs of providing adjudication and naturalization services," according to IANS. After H1-B visa fee hike, American citizenship costs might be doubled soon

As part of its revised selection process, the US has hiked by USD 10 the application fee of the H-1B work visa, the most sought-after among Indian IT professionals. The H-1B programme allows companies in the United States to temporarily employ foreign workers in occupations that require the application of a body of highly specialised knowledge and a bachelor's degree or higher in the specific specialty, or its equivalent. "This effort will help implement a more efficient and effective H-1B cap selection process," said USCIS Acting Director Ken Cuccinelli." The electronic registration system is part of an agency-wide initiative to modernise our immigration system while deterring fraud, improving vetting procedures and strengthening program integrity," he said. Upon implementation of the electronic registration system, petitioners seeking to file H-1B cap-subject petitions, including those eligible for the advanced degree exemption, will first have to electronically register with the USCIS during a designated registration period, unless the requirement is suspended, the USCIS said. The federal agency is slated to implement the registration process for the fiscal year 2021 H-1B cap selection process, pending completed testing of the system. It will announce the implementation time frame and initial registration period in the federal register once a formal decision has been made, and the USCIS will offer ample notice to the public in advance of implementing the registration requirement. The USCIS published a notice of proposed rulemaking highlighting a registration fee on September 4, 2019, which included a 30-day public comment period.The USCIS received only 22 comments during that time, and has considered all submissions and offered public responses ahead of announcing the final rule, which is effective on December 9.

Immigration lawyers are encouraging their corporate clients to submit comments about how this would hurt their ability to hire people on these skilled-work visas. "Businesses are getting back to normal right now right after COVID, and really, I think this could impact the amount of workforce and potentially foreign employees that they want to hire," Cristina Perez, an immigration lawyer at the law firm Leech Tishman, said. "I think that's not a good thing. There's study after study that shows H-1B beneficiaries really are a benefit to this country."<h2>Why the USCIS wants to raise fees — and why experts are skeptical </h2>Experts aren't surprised that the USCIS wants to raise fees, especially since it's been so long since the last increase.Under President Donald Trump's administration, the USCIS attempted to dramatically raise fees for naturalization and looked to collect $50 from asylum seekers. "Fix the problem first, then raise the fees."Some in the industry hope it starts a discussion about what it takes to retain global talent. Sunny Shuoyang Zhang, a founding partner at Born Global Ventures, said she hoped this could be used to educate employers about what it takes to keep global talent in the US, when they have the option to go places with friendlier immigration policies, like Canada. H-1B visa holders can only return to the US if they already have a job there To travel back to the US on an H-1B visa, one has to be resuming ongoing employment, be a technical specialist, a COVID-19 researcher, or a public healthcare worker in order to qualify for travel. How will the US State Department determine that you’re ‘unique’? Even if an H-1B applicant wants to return to their existing job, they have to prove themselves to be unique. The US State Department has listed five criteria, and at least two must be met for applicants to be considered. Terms and conditions for H1-B visa holders to return to the US: <ul><li>They cannot do their job remotely. </li><li>Income meaningfully exceeds the prevailing wage rate by at least 15% indicating that they can’t be replaced by an American worker. </li><li>Proposed job duties or position within the company indicates significant and unique contributions to an employer meeting a critical infrastructure need. </li><li>Education, training, and experience demonstrate unusual expertise </li><li>Denial of the visa will cause financial hardship to the U.S. employer. US eases H-1B visa norms a day after tech giants back immigration lawsuit — NASSCOM ‘cautiously optimistic’

The United States has formally notified the increase in H1B and L1 visa fee. Now, applicants will have to shell out additional $4,000 for certain categories of H1B visas post December 18, 2015. 
 
The US Citizenship and Immigration Service (USCIS) said applicants of certain L-1A and L-1B will have to submit an additional amount of $4,500. 
 As per the Consolidated Appropriations Act, 2016, signed into law by <keyword id="67474" type="UNKNOWN" weightage="20" keywordseo="US-President-Barack-Obama">US President Barack Obama</keyword> on December 18, 2015, additional fees has to be paid by petitioners who employ 50 or more employees in the US, with more than 50 per cent of those employees in H1B or L (including L-1A and L-1B) non-immigrant status. 
 
This will remain effective through September 30, 2025, USCIS said. 
 
In a statement, USCIS warned that it will begin rejecting H1B and L1 visa petitions received on or after February 11, 2016 that do not carry the information required under the new law. 
 
USCIS has also revised the necessary forms in this regard. 
 
During the 30-day period immediately following this web alert, USCIS may issue a Request for Evidence (RFE) to determine whether the additional fee applies to the petition.

H1-B denial rates for initial petitions have increased four times between 2015 to 2018, from 6% to 24%. The denial rates have spiked further to 32% in the first quarter of 2019 . US Immigration is denying more H1-B visas than ever before — without notice or authority

<ul><li>Among Indian IT companies in the US nearly 80,000 employees are there on visas with the majority using the coveted H-1B. </li><li>TCS has the largest number of employees in the US within Indian IT services companies but only 40% are on the H-1B visa. </li><li>Tech Mahindra and Cognizant half a great dependency with nearly of their US staff on H-1B. </li></ul>In a bid to protect American jobs, US President Donald Trump signed an executive order on June 22 introducing restrictions on new visa applications — including the IT sector’s coveted H-1B visa. There are currently 79,649 Indians working with Indian IT companies — including Tata Consultancy Services (TCS), Cognizant, Infosys, Tech Mahindra, <keyword id="30331" type="CITY" weightage="20" keywordseo="HCL-Technologies">HCL Technologies</keyword> and Wipro — on visas in the US. While the new visa restrictions don’t impact people who are existing visa holders, Japanese brokerage firm Nomura points out that it could lead to a further increase in the rejection rates of renewals. Nearly 80,000 Indians with H-1B visas work for TCS, Infosys and other Indian IT companies — here's a company-wise breakup

<ul><li>US President <keyword id="6354484" type="PERSON" weightage="20" keywordseo="Donald-Trump">Donald Trump</keyword> is expected to announce suspension of H1B, L1 and other temporary work visas.</li><li>The suspension is expected to be announced hours ahead of Trump's rally in Tulsa, Oklahoma.</li><li>The suspension will not affect those already in the US, the report states.</li></ul>US President Donald Trump said that he will be announcing new visa restrictions in coming days. We're going to be announcing something tomorrow or the next day on visas," Xinhua news agency quoted Trump as saying in a Fox News interview on Sunday. He however declined to give any details but acknowledged that there will be some exclusions. "You need them for big businesses where they have certain people that have been coming in for a long time, but very little exclusion and they're pretty tight," he said. "And we may even go very tight for a period of time." Fox News Chief White House correspondent John Roberts tweeted that the restrictions will be imposed on H-1B, H-2B, L-1 and J-1 visas. H-1B visas are designed for certain skilled workers such as those employed in science, engineering, and information technology fields, while H-2B visas are given to seasonal workers such as hotel and construction staff. L-1 visas are meant for executives who work for large corporations and J-1 visas are issued to research scholars, professors and other cultural and work-exchange programs. Trump will reportedly sign an executive order to suspend the visas through the end of the year, as the administration is addressing a major economic fallout, including high unemployment among Americans, amid the coronavirus pandemic. That would be Trump's latest step to restrict immigration. In April, he temporarily halted the issuance of US green cards to some foreigners. Trump, who has maintained a hardline stance on immigration and used that to appeal to his voters, has been accused of using the pandemic to promote his political agenda.

US President Donald Trump to suspend H1B visas, will not affect those already in the states

It seems the US government’s imposition of additional fee of up to USD 4,500 for certain categories of H-1B visa for Indians is not going well with many at the <keyword id="6357722" type="COMPANY" weightage="20" keywordseo="silicon-valley">Silicon Valley</keyword>. 
 
Veritas CEO Bill Coleman called for dramatic expansion of the H-1B visa scheme -popular among Indian tech firms. 
 The H1B visa allows US employers to recruit foreign professionals in speciality occupations within the US. However, the <keyword id="396996" type="UNKNOWN" weightage="20" keywordseo="Indian-IT-industry">Indian IT industry</keyword> was affected after the US imposed an additional fee. 
 
Amid this, Coleman said there was a huge crunch of quality IT professionals. 
 
"The entire Silicon Valley believes that the H-1B visa policy needs to be dramatically expanded. We can't hire enough good people. They are just not available here. The salaries here are going through the roof, because everybody is competing to hire from everybody else," said Coleman, who is also a former chairman of Silicon Valley Leadership Group. 
 
Soon headed to India, where Veritas has about 1,700 people working for it with Pune being a major centre, Coleman said he plans to migrate some of his facilities to India from Florida. 
 
"That is a priority," he said. 
 
"In Silicon Valley you go to Apple, Facebook or Google, open their websites, you will find thousands of open jobs. One of the biggest problem here is that everybody is trying to hire from everybody else. As they can't find enough good candidates what they are doing is pushing the salaries through the moon," he said. 
 
Coleman said the number of H-1B visas should be based on market demand and the programme's expansion is one of the top priorities for the Silicon Valley. 
 
Coleman said India, now the fastest-growing emerging economies of the world, offers a "great" and "long term" opportunities for IT firms and he aims to make the best of it. 
 
"We are targeting growth in excess of 40 per cent in our sales in India," he said. 
 
Coleman said Prime Minister Narendra Modi's government has brought "a breadth of fresh air." 
 
"It is not that difficult to do business in India...the regulations have gotten better, but they are not up to the leading free market standards yet. Things are improving under Modi and we are happy about that," he said.

They will now have 30 days to submit their comments once the rule is published in the Federal Register. </li></ul>The US Department of Homeland Security is looking to revamp the current lottery system used to allot the technology sector’s favorite visa, the H-1B. Instead of random selection and baseline eligibility, the government is pitching for a wage-based selection process that will prioritise higher salaries. The department accused employees in the US of ‘exploiting and abusing’ the current system. It claims that instead of bringing the best and the brightest into the country, the random selection process is bringing in relatively lower-paid foreign labour at the expense of the US workforce. The department also justified that the new system will be more appropriate for the current crisis, where supply of foreign talent is more than demand. “If finalized as proposed, this new selection process would incentivize employers to offer higher wages or petition for positions requiring higher skills and higher-skilled workers instead of using the program to fill relatively lower-paid vacancies,” said the <a href="https://www.dhs.gov/news/2020/10/28/dhs-trump-administration-protect-american-jobs-unfair-international-competition">notice. </a> US technology giants are fighting the change to visa rules tooth-and-nail Over 50 US technology companies — including big wigs like Microsoft, Amazon, and Facebook — have taken a stand against the ban on the entry of foreign employees into the US. The legal brief challenges US President Donald Trump on the issue. It argues that visa restrictions will hurt the interest of businesses within the US and lead employees to hire workers outside the US instead of letting them work from within the country. These companies assert that instead of helping the debilitating state of the employment, the restrictions will only serve to damage the already struggling US economy further. However, one US court has already shot down an appeal filed by 169 Indian who challenged the ban. The US District Judge argued that those Indian IT companies, on the hand, have so far claimed that Trump’s <keyword id="6358066" type="UNKNOWN" weightage="20" keywordseo="h-1b-visa">H-1B visa</keyword> ban does not have any immediate impact on their operations.
