Days after the <a href="http://www.businessinsider.in/Uber-Ola-this-ones-for-you-with-love-the-Indian-Government/articleshow/49240938.cms">Indian government released new guidelines for all the cab aggregators </a>plying anywhere in the country, <keyword id="1042120" type="PERSON" weightage="20" keywordseo="Uber">Uber</keyword> has come up with an acceptance to it. 
 Under the guidelines issued by the <keyword id="168381" type="ORGANIZATION" weightage="20" keywordseo="ministry-of-road-transport">Ministry of Road Transport</keyword>, ride-hailing companies must obtain licenses to operate, but are freed from being regulated as taxi companies for which it is mandatory to maintain a minimum fleet size and parking space, among other requirements, as per a WSJ report. 
 The <keyword id="44734" type="ORGANIZATION" weightage="20" keywordseo="Indian-Government">Indian government</keyword>, for the first time ever, has rolled out such guidelines to bring all the online taxi apps under one regulation. The move came after the <a href="http://www.businessinsider.in/searchresult.cms?query=Central+Motor+Vehicles+Act">Central Motor Vehicles Act</a> and state transport authorities fall short of rules that could govern these businesses. 
 
As per the recently issued guidelines, the sates would be directed on how they can draft regulations for city taxi schemes and aggregators. It also mandates the establishment of 24x7 call centre for grievance redressal. Uber, however, says that it has an instant response system in which the user gets a response within five minutes on an email complaint, reported The Economic Times. 
 
The newly issued guidelines also asks the applicant to be a registered entity under the laws of India and that it cannot own or lease any vehicle, employ any driver or represent itself as a taxi service unless it gets registered as a taxi operator under the applicable law. 
 <keyword id="6354720" type="PERSON" weightage="20" keywordseo="Ola">Ola</keyword>, last month, said that it had set-up a separate, fully-owned subsidiary that will buy cars and lease them to drivers. The new business, however, is separate from Ola’s current aggregator model. 
 
Uber, on the other hand, too is working on another model of leasing the vehicles, informed a source. However, no announcement has been made by the company so far. 
 
"This is a big leap towards recognising sector-specific regulations for technology-based, ride-hailing services in India and we look forward to working with the various state governments to get licensed under this framework," said an Uber India spokesperson. 
 
Uber, in a statement released yesterday said, "We welcome the advisory from the Ministry of Road Transport and we believe this is a major step towards positively impacting the ecosystem and its stakeholders, that technology platforms like ours have created. We will continue to work with the government, under the aegis of this progressive directive, offering our complete support and commitment towards building mobility for a billion people." 
 
SoftBank-funded Ola has also welcomed the guidelines, saying that it is a progressive directive. Both Ola and Uber face bans in the national capital as their applications for licenses to operate have been rejected.

The regulator, under its Chief Commissioner Nidhi Khare, was set to ask cab-hailing platforms to showcase their algorithms related to ride cancellations and surge pricing, along with questioning them over other issues. The CCPA has received numerous complaints of unfair trading practices, such as cab drivers forcing riders to cancel trips that result in the customers paying the cancellation charge. The authority is of the view that old customers are being charged exorbitant rates while new riders are being wooed by low fares for the same distance. Despite the Motor Vehicle Aggregator Guidelines 2020, 71 per cent customers say that ride cancellation issues by drivers continue, according to a survey by community-based social media platform LocalCircles last month. Over 45 per cent of app-based taxi consumers stated they were charged more than 1.5 times in surge pricing despite the threshold being set by the Motor Vehicle Aggregator Guidelines 2020. The extortionist practices of some drivers to undertake private trips were reported by consumers as a major concern, the report said. As thousands of Indian riders continue to suffer from paying cancellation fees sans their faults, the ride-hailing major in Australia admitted that it made false or misleading statements in cancellation warning messages and taxi fare estimates, according to the Australian Competition and Consumer Commission (ACCC). Uber now faces $26 million (Australian dollars) in penalties for adopting those illegal practices. More than two million Australian consumers were shown the misleading cancellation warning. Envisioned to lessen the travel woes, cab-hailing platforms like Uber and Ola have come a long distance in India, but riders are increasingly facing more issues. Most of the time, Uber and Ola drivers ask the riders to reveal what fare the Uber app is showing, and then decide if they want to take the ride or not depending on the amount and if it is in cash, forcing the riders to cancel the ride. Indian regulator to grill Ola and Uber over rising customer complaints

After guidelines issued by the <keyword id="168381" type="ORGANIZATION" weightage="20" keywordseo="ministry-of-road-transport">Ministry of Road Transport</keyword> appeared to impact the business of the US-based taxi-hailing firm <keyword id="1042120" type="PERSON" weightage="20" keywordseo="Uber">Uber</keyword> in India, the company has now decided to take help of social media and online petitions. 
 Known as the <keyword id="3114129" type="UNKNOWN" weightage="20" keywordseo="City-Taxi-Scheme-2015">City Taxi Scheme 2015</keyword>, Uber has launched this campaign against Maharashtra’s draft rules for cab services. The campaign also looks forward to officially communicate its views to the government on the proposed rules. 
 
Shailesh Sawlani, Uber's general manager for Mumbai, says, "We feel it is critical for the people of Maharashtra, who have for years suffered in silence with poor quality transportation, to stand up against these regressive regulations and make their voices heard." 
 
Ola, on the other hand, prefers to directly get in touch with the government officials to resolve stalemates, according to some reports. Earlier, Ola had stated that "We work with authorities at all levels, be it central and state to resolve issues.” 
 
Uber, in the past as well, has taken help of online platform to fix issues with the government. In a similar move, Uber launched a campaign in January this year after the Delhi government banned its services following an alleged rape of a passenger by one of its driver partners. 
 
The company ran a campaign on social networking platform twitter with hash-tag #BringBackUber. Moreover, it also launched online petitions that received nearly 8,000 applications. The case, however, is now in court. 
 
Up until now, the petition in Mumbai has received around 24,000 online signatures. 
 
According to the draft rule issued by the Department of Home under Maharashtra government, a cab service licensee should have a fleet of 1,000 taxis to 4,000 taxis. Additionally, fare charged by the cabbies would be prescribed by the state transport authority. 
 
The conditions are not acceptable to Uber along with a proposal that asks its taxi drivers to maintain a feedback register and receipt printers. 
 
Sawlani also added that “The proposed scheme is a clampdown on consumer choice and freedom. It is equally important for commuters to let the government know that this scheme does not have smart solutions nor their interests at heart.” 
 
Turning down such online campaigns, a Delhi-based lobbyist for transport firms says, "The online petition in Delhi was not very effective mainly because of the timing, as it was done after the rape case. And second, there was a petition to change an existing law, unlike in Mumbai where comments are invited. Cab companies should work with authorities. It is not possible to settle all issues through the judiciary."

 Every state government has been dealing with the continuous strikes by the kali- peeli taxi unions and auto rickshaw <keyword id="44435" type="ORGANIZATION" weightage="20" keywordseo="drivers">drivers</keyword>. <keyword id="13126" type="COMPANY" weightage="100" keywordseo="Maharashtra">Maharashtra</keyword> government had released the draft for Maharashtra City Taxi Rules, 2016, to regulate app-based operators but these rules are detrimental to the ecosystem itself.

According to the guidelines, an application for grant or renewal of a license for a taxi will cost INR 1,00,000 and on top of that the license itself will cost INR 25,000 for cars up to engine capacity of 1,400 CC and for higher capacity engines typically sedans, the license will cost INR 2,61,000! Between Ola and Uber there are about 20,000-40,000 cars plying in the state, and about half of them are sedans according to Ola. 
 
Now, as taxi-aggregators are just a platform, these costs, if implemented will be transferred to drivers and then, ultimately consumers. <keyword id="824043" type="COMPANY" weightage="20" keywordseo="Business-Insider">Business Insider</keyword> caught up with two Ola drivers to find out how this will affect their already dwindling livelihoods. 
 <keyword id="3836339" type="UNKNOWN" weightage="20" keywordseo="jia-ul-haq">Jia-Ul-Haq</keyword>, a car operator said- ‘While Ola has given us a lot of employment, our salaries have been decreasing, year-on-year. The new guidelines will leave us with nothing and close to the brink of poverty. We are already paying for auto loans, car insurance and this will make sure that we don’t even get the INR 20,000, which we earn right now.’ 
 <keyword id="1194067" type="PERSON" weightage="20" keywordseo="Mohammed-Nazim">Mohammed Nazim</keyword> who works with four Ola drivers said,’ Where is the development in this? It is all about the inconvenience. The cost will be ultimately transferred to the customers otherwise these charges will put us further into debt.’ 
 
Pranay Jivrajka, COO, Ola talked to us to talk about an alternative scheme which is very inclusive in nature and enables and gives an opportunity for aggregators to bring all forms of mobility on the platform. This also allows the traditional cabs to join. 

	 
	He said ‘If a driver has to buy a vehicle, he saves up INR 40-70,000 right now to get the car on road, but permit costs are projected to get as high as INR 3.5 lakh. <a href="http://www.businessinsider.in/A-survey-reveals-60-of-employed-Indians-aspire-to-be-entrepreneurs/articleshow/55152360.cms">It will be quite difficult for a driver to turn into an entrepreneur.</a> No one gives loans on permits fees. (Eds: Adds details) New Delhi, May 1 () The government on Friday announced that a "limited" lockdown, including suspension of inter-state travel, air and train services, will continue to remain in force for another two weeks throughout the country from May 4 but some activities would be allowed after classifying areas into Red, Orange and Green zones.The government order, which announced extension of the lockdown invoking the Disaster Management Act, said a limited number of activities will remain prohibited throughout the country, irrespective of the zone. These prohibited activities include travel by air, rail, metro and inter-state movement by road, running of schools, colleges, and other educational and training hospitality services, cinema halls, malls, gymnasiums, sports complexes. All social, political, cultural and other kinds of gatherings and religious places or places of worship for public will also remain shut, the order said but added that movement of persons by air, rail and road is allowed for select purposes, and for purposes as permitted by MHA. The home ministry also issued new guidelines to regulate different activities in this period, based on the risk profiling of the districts of the country into new zones with 'Red' signifying a hotspot.The statement said that the Union Health Ministry would be sharing classification of districts into zones to the states and union territories on weekly basis. The statement said that outside the containment zone falling within Red zones, certain activities are prohibited in addition to those prohibited throughout the country which includes plying of cycle rickshaws and auto-rickshaws, running of taxis and cab aggregators; intra-district and inter-district plying of buses; and, barber shops, spas and saloons. However, some activities have been allowed in the Red Zones with restrictions that includes movement of individuals and vehicles is allowed only for permitted activities, with a maximum of two persons (besides the driver) in four-wheeler vehicles, and with no pillion rider in the case of two-wheelers. Industrial establishments in urban areas including Special Economic Zones (SEZs), Export Oriented Units (EOUs), industrial estates and industrial townships with access control have been permitted. Construction activities in urban areas have been limited to in-situ construction (where workers are available on site and no workers are required to be brought in from outside) and construction of renewable energy projects. Shops in urban areas, for non-essential goods, are not allowed in malls, markets and market complexes. However, all standalone (single) shops, neighbourhood (colony) shops and shops in residential complexes are permitted to remain open in urban areas, without any distinction of essential and non-essential. E-Commerce activities in the Red Zones are permitted only in respect of essential goods. and private offices can operate with up to 33 per cent strength as per requirement, with the remaining persons working from home. All government offices shall function with senior officers of the level of Deputy Secretary and above at full strength, and the remaining staff attending up to 33 per cent as per requirement. Most of the commercial and private establishments have been allowed in the Red Zones which includes print and electronic media, IT and IT enabled services, data and call centres, cold storage and warehousing services, private security and facility management services, and services provided by self-employed persons except for barbers. The statement said that the Orange Zones, in addition to activities permitted in Red Zone, taxis and cab aggregators will be permitted with one driver and one passenger only. Inter-district movement of individuals and vehicles will be allowed for permitted activities only. Four-wheeler vehicles will have maximum two passengers besides the driver and pillion riding will be allowed on two-wheelers.In the Green Zones, all activities are permitted except the limited number of activities which are prohibited throughout the country, irrespective of the Zone. (Eds: Updating with details) New Delhi, May 1 () A "limited" lockdown which includes suspension of air, train and inter-state road travel will continue to remain in force for two more weeks from May 4 across the country, but some activities would be allowed after classifications of districts into 'Red', 'Orange' and 'Green' zones based on COVID-19 risk profiling, the government announced on Friday. Educational institutions; all social, political, cultural and other kinds of gatherings; hospitality services; and religious places or places of worship for public will also remain shut across the country, a central government order said and added that movement of persons by air, rail and road would be allowed for select purposes as permitted by the Ministry of Home Affairs (MHA). Citing a letter issued by the Union Health Ministry on Thursday, the Union Home Ministry said in a statement that activities as per the classification of 'Red', 'Orange' and 'Green' zones will be permitted but a "limited" number of activities shall remain closed across the country. According to the health ministry, there are 130 'Red' zones in the country with maximum of 19 in Uttar Pradesh, followed by 14 in Maharashtra in the country. The number of 'Orange' Zone is 284 and 'Green' is 319. All the districts of the national capital have been put under 'Red' zone. A district will be considered as a 'Green' zone if there are no confirmed cases so far or there is no reported case for the past 21 days. The MHA statement said the restrictions were extended partially after a comprehensive review and in view of the lockdown measures having led to significant gains in the COVID-19 situation in the country. The total number of confirmed COVID-19 cases in India has risen to 35,365 with 1,152 deaths. Places of large gatherings such as cinema halls, malls, gyms and places of political, cultural gatherings to remain shut. Religious places and places of worship will also remain shut. Movement of individuals for all non-essential activities shall remain strictly prohibited between 7 pm and 7 am during lockdown. Local authorities shall issue orders under appropriate provisions of law, such as prohibitory orders [curfew] under Section 144 of CrPC, for this purpose, and ensure strict compliance. In all COVID-19 zones, people above 65, those with co-morbidities, pregnant women, children below age of 10 to stay at home, except for essential works. OPDs, medical clinics shall be permitted to operate in red, orange and green zones with social distancing norms during lockdown. In red zones and outside containment areas plying of cycle-rickshaws, auto-rickshaws, taxis, opening of barber shops, spas, salons prohibited. In red zones movement of individuals, vehicles allowed only for permitted activities during lockdown and a maximum of 2 persons, besides driver, in four wheelers, no pillion rider on two wheelers. The home ministry said 'Aarogya Setu' app must for people living in COVID-19 containment zones. Sale of liquor, paan, tobacco to be allowed after ensuring minimum six-feet social distancing; not over 5 persons at one time at shop.These shops should not be located in markets and malls in urban areas. However, consumption of liquor, paan, gutka, tobacco etc., is not allowed in public places during lockdown. The home ministry said the containment zones shall be demarcated within Red (Hotspots) and Orange Zones by States and UTS and District Administrations based on the guidelines of the health ministry.The boundary of the Containment Zone shall be defined by District Administrations taking into account the following factors: mapping of cases and contacts; geographical dispersion of cases and contacts; area with well demarcated perimeter; and enforceability. The boundary of the Containment Zone will be a residential colony, mohalla, municipal ward, municipal zone, Police Station area, towns etc., in case of urban areas; and, a village, cluster of villages, Gram Panchayats, group of Police Stations, blocks etc., in case of rural areas. Protocol within Containment Zones. Intensive surveillance mechanism as outlined in the Standard Operating Protocol (SOP) issued by the health ministry is to be established within the Containment Zone. The local authority shall ensure 100 per cent coverage of Aarogya Setu app among the residents of Containment Zones. Wearing of face cover is compulsory in all public and work places and adequate stock of such face covers shall be made available. No separate or fresh permissions are required from authorities for activities already permitted to operate under the guidelines on Lockdown measures up to May 3. Marriages related gatherings shall ensure social distancing, and the maximum number of guests allowed shall not be more than 50.Last rites related gatherings shall ensure social distancing, and the maximum numbers allowed shall not be more than 20. Spitting in public places shall be punishable with fine, as may be prescribed by the State and UT local authority. Those who refuse to comply with any direction with regards to the lockdown guidelines can be punished with imprisonment for a term which may extend to one year or with fine, or with both. If such obstruction or refusal to comply with directions results in loss of lives or imminent danger thereof, shall on conviction be punishable with imprisonment for a term which may extend to two years. Whoever knowingly makes a claim which he knows or has reason to believe to be false for obtaining any relief, assistance, repair, reconstruction or other benefits can be punished with imprisonment for a term which may extend to two years, and also with fine, the order said.
