"Until now, many Indians who were American citizens would seldom reveal their Indian income and investments in the US and vice versa. However, now when that information is shared by India in the US, it could attract a lot of penalty and even some other punitive action, this has led to many NRIs (non-resident Indians) moving back to India," Lloyd Pinto, director, Grant Thornton India, told ET.<br />

Experts say that people having green card will either have to declare assets, restructure holdings or come back to Indian citizenship.<br />

As many as 22 Indian states and 80 districts are under lockdown and that has brought an already weak economy to its knees. There has been a growing clamour for respite both financial as well as regulatory (like taxation and other compliances).These are some of the big announcements made by Sitharaman on March 24: <br /><br /><ol><li>Tax returns for financial year 2018-19 can be filed by June 30.</li><li>No extension of penalty on delayed deposit of TDS (tax deducted at source). However, the penalty has been halved to 9% from 18% currently.</li><li>The deadline for linking Aadhaar with PAN (Permanent Account Number) has been extended to 30 June 2020.</li><li>All investments for rollover benefit of capital gains under Income Tax act, Wealth Tax act, Prohibition of Benami Property Transfer Act, Black Money Act, Securities Transaction Tax law, equalisation levy law, '<em>vivaad se vishwaas</em>' law — the amnesty scheme for tax disputes where the time limit was expiring on March 20 — now increased to 30 June.</li><li>The last date of filing returns for the months of March, April, and May 2020, including composition scheme, extended to June 30.</li><li>For companies with turnover less than Rs 5 crore, no late fees, penalties, and interest on deferred payment. </li><li>For companies with turnover over Rs 5 crore, there will be no late fees, penalties but there will be an interest of 9%, down from 18% currently.</li><li>Customs clearance will operate 24x7. It will be doing its duty as an essential service.</li><li>MCA-21 Registry: Moratorium issued from April 1 to September 30. No additional fees for late filing. The mandatory requirements for holding meetings of Board of Directors relaxed by 60 days. </li><li>Applicability of auditors' report order was supposed to be in force from financial year ending March 2020, that has now been delayed by a year.</li><li>For the year financial year 2020, independent directors will not be held for violation if they haven't held even one meeting.</li><li>For newly incorporated companies, there is a requirement to file declarations for commencement of business within 6 months. Now, we’re giving them an additional time of 6 more months.</li><li>There is a need to create a reserve for 20% of all the deposits maturing next financial year by April, that has been deferred to June.</li><li>Similarly, there was a need to invest 15% of the amount from maturing debentures during the next financial year (April to March 2021) by April. That has been deferred to June.</li><li>Threshold for default under the Insolvency and Bankruptcy Code has been raised by 100 times to ₹1 crore.  This is effective immediately to stop the triggering of insolvency proceedings against micro, small, and medium enterprises. If the situation doesn't improve by April 30, the government may consider suspending Section 7, 9, and 10 of the bankruptcy law for a period of six months. </li><li>All sanitary import permits (shrimp, broodstock, and any aquaculture) set to expire by April 1 and April 15 2020, are being extended by three months. Even if your import is coming a month later, that will not be seen as a delay.</li><li>Re-booking for quarantine cubicles, for those cancelled consignments in aquatic quarantine facilities, will not entail additional booking charge.</li><li>The grant of no objection certificate and verification of documents for quarantine will be relaxed from 7 days to 3 days. </li><li>Debit card holders can withdraw cash from any bank ATMs for the next three months.</li><li>No fee will be charged for not having minimum balance in the savings account.</li><li>Bank charges will be reduced for digital transactions for trade and finance consumers.</li><li>The principle to be followed by Commerce Department: For procedural and eligibility point of view, extension of timeline will be given but there won't be an extension of scheme guidelines for modification. </li><li>We, both government and the regulator SEBI, are monitoring the stock market thrice a day. Various sub-groups of the task force on economy, as well outsiders, have made suggestions and we will soon come with an announcement.</li><li>Under Section 149(3) of the new Companies Act, every company is required to have at least one director who has stayed in India for a total period of not less than 182 days in the previous calendar year. <br />PAN - expanded as <keyword id="134255" type="COMPANY" weightage="20" keywordseo="permanent-account-number">Permanent Account Number</keyword> is a code consisting of alphabets and numerals. In total there are 10 characters in a <keyword id="437599" type="PERSON" weightage="20" keywordseo="PAN-number">PAN number</keyword>. PAN is the identification that the <keyword id="65338" type="ORGANIZATION" weightage="20" keywordseo="Income-Tax-Department">Income Tax Department</keyword> provides the taxpayers. The objective of the PAN number is to systematize and monitor the monetary transactions in a way curbing the tax evasion. <br /><br /><strong><keyword id="7998729" type="UNKNOWN" weightage="20" keywordseo="PAN-jurisdiction">PAN Jurisdiction</keyword></strong><br /><br />Every PAN number in linked to an AO code with 10 digits found in the PAN database. This can be understood as a unique code that contains information including the jurisdiction of the PAN holder, the commissioner’s charge, the region of the chief commissioner, the range of the joint commissioner, the designation and region of the Assessing Officer (AO). Every PAN holder will belong to a particular range based on their geographical location and income source. In every region, there will be multiple units and these units will be called as wards or circles.<br /><br />The ward of a PAN holder depends on the income declared by the candidate. Different income limits go under different sub-jurisdictions. The income up to a particular limit is automatically included in a particular circle. When you change the area of your residence, the AO code can also change. When you want to modify your AO code, you will have to apply for a new AO.<br /><br /><strong>Steps to know your PAN jurisdiction</strong><br /><br /><ul><li>Knowing your PAN jurisdiction is a very simple and easy process. You can do this without even logging on to the Income tax website. Follow these steps to know your jurisdiction.</li><li>Visit the official Income Tax Department website. Click on the link ‘Know Your Jurisdiction’.</li><li>Input your PAN and mobile number and click on ‘submit’. </li><li>You will receive a ‘One Time Password’ on your registered mobile number. Input this OTP on the webpage. How do you know your PAN jurisdiction?

The income tax department has launched an online facility to correct errors in names and other details in permanent account number (PAN) and <keyword id="144117" type="ORGANIZATION" weightage="20" keywordseo="AADHAAR">Aadhaar</keyword> document, according to news agency <keyword id="6367495" type="COMPANY" weightage="20" keywordseo="PTI">PTI</keyword>.<br /> <br /> Alongside the facility to link biometric identifier Aadhaar with PAN, the department has also put two separate hyperlinks on its e-filing website -- one to update changes in existing PAN data or for application of new PAN by an Indian or a foreign citizen.<br /> <br /> The second hyperlink is for individuals who want to update Aadhaar details by logging into 'Aadhaar Self Service Update Portal' using the unique identity number. The individual can then upload scanned documents as proof for data update request.<br /> <br /> Over 1.22 crore assessees already have Aadhaar-linked PAN but the number is abysmally low as there are over 25 crore PAN card holders in the country, while Aadhaar has been issued to 111 crore people.<br /> <br /> As per statistics with the tax department, only 6 crore people file income tax returns at present.<br /> <br /> <keyword id="6355261" type="POSITION" weightage="20" keywordseo="Finance-minister">Finance Minister</keyword> <keyword id="42575" type="PERSON" weightage="20" keywordseo="Arun-Jaitley">Arun Jaitley</keyword>, through an amendment to the <keyword id="123776" type="ORGANIZATION" weightage="20" keywordseo="Finance-Bill">Finance Bill</keyword> for 2017-18, had made Aadhaar mandatory for filing income tax returns and provided for linking of PAN with Aadhaar to curb tax evasion through use of multiple PAN cards.<br /> <br /> Last week, the income tax department launched a facility to enable a taxpayer to link his Aadhaar and PAN.<br /> <br /> It required a person to put in PAN and Aadhaar number along with his name as per the <keyword id="86474" type="ORGANIZATION" weightage="20" keywordseo="Unique-Identification-Authority-of-India">Unique Identification Authority of India</keyword> (UIDAI) data.<br /> <br /> After verification from the UIDAI, the linking will be confirmed. In case of any minor mismatch in Aadhaar name provided, Aadhaar OTP will be sent to the mobile number registered with the UIDAI.<br /> <br /> Additionally, the income tax department has now launched a facility to correct anomalies in PAN or Aadhaar document.<br /><br />

To ensure less tax evasion, the government has asked banks to obtain permanent account number (PAN) or Form-60 if PAN is not available, from all bank account holders by February 28, 2017.<br />
<br /> "Income-tax Rules have been amended to provide that bank shall obtain and link PAN or Form No. 60 (where PAN is not available) in all existing bank accounts (other than BSBDA) by February 28, 2017, if not already done," a notification by the <keyword id="121964" type="ORGANIZATION" weightage="20" keywordseo="Central-Board-of-Direct-Taxes">Central Board of Direct Taxes</keyword> (<keyword id="128665" type="ORGANIZATION" weightage="20" keywordseo="CBDT">CBDT</keyword>) stated today.<br />
<br />
The persons who are having bank accounts but have not submitted PAN or Form No 60 are advised to submit the PAN or Form No 60 to the bank by February 28, 2017, the notification stated.<br />
<br /> However, this rule will not apply to <keyword id="3961607" type="UNKNOWN" weightage="20" keywordseo="basic-savings-bank-deposit-accounts">Basic Savings Bank Deposit Accounts</keyword> (BSBDA), which are zero balance <keyword id="25450" type="UNKNOWN" weightage="20" keywordseo="savings">savings</keyword> accounts, including Jandhan accounts.<br />
<br />
The BSBDA were introduced to take care of simple banking needs of people, which come with free ATM card, monthly statement and cheque book.<br />
<br />
Last month, RBI had mandated that no withdrawal shall be allowed from the accounts having substantial credit balance/deposits if PAN or Form No.60 is not provided in respect of such accounts.<br />
<br />
It further said that the banks and post offices had also been mandated to submit information in respect of cash deposits from April 1, 2016 to November 8, 2016 in accounts where the cash deposits during the period November 9, 2016 to December 30, 2016 exceeds the specified limits.<br />
<br />
It has also been provided under the new rules that person who is required to obtain PAN or Form No.60 shall record the PAN/Form.No.60 in all the documents and quote the same in all the reports submitted to the Income-tax Department.

After that, she can finally apply for UK citizenship and potentially become a dual citizen of the US and the UK.</p><p>All the while, the "Suits" actress will be paying taxes to the IRS on any income she makes - regardless of where she earns it.</p><p>"US citizens, green card holders, and permanent residents are required to file tax returns with the IRS every year no matter where they reside," Avani Ramnani, director of financial planning and wealth management at <a href="http://francisfinancial.com/">Francis Financial</a>, told Business Insider.</p><p>"This is a special tax return called the <a href="https://www.irs.gov/individuals/international-taxpayers/us-citizens-and-resident-aliens-abroad">expatriate tax return</a>," she said. "US citizens, including Meghan Markle, get taxed on international income earned outside the US." </p><p>But Markle may qualify for the <a href="https://www.irs.gov/individuals/international-taxpayers/foreign-earned-income-exclusion">foreign earned income exclusion</a>, Ramnani said, which in 2018 waives taxes on the first $104,100 of income earned in the residing country. But, Ramnani said, "this credit may not be dollar-for-dollar as there are a lot of factors that come into play."</p><p>There's another US tax provision called the <a href="https://www.irs.gov/individuals/international-taxpayers/foreign-housing-exclusion-or-deduction">foreign housing exclusion</a>, which gives the taxpayer an additional deduction or credit for living expenses abroad. It does not include "expenses that are lavish or extravagant under the circumstances."</p><p><a href="http://fortune.com/2017/11/27/prince-harry-meghan-markle-nottingham-cottage/">Nottingham Cottage</a>, the future homestead of Markle and Prince Harry, is located on the sprawling grounds of Kensington Palace, and would probably be considered lavish.</p><p>As <a href="https://www.washingtonpost.com/news/worldviews/wp/2017/11/28/meghan-markles-u-s-citizenship-could-cause-tax-headaches-for-british-royal-family/?utm_term=.6f1a8622afde">the Washington Post first reported</a> back in November, Markle could "cause tax headaches" and create some "mundane hurdles" for the royal family.</p><p>If she becomes a dual US/UK citizen, Markle will have to continue filing her taxes each year with the IRS. This week she was told that March 20 is her last working day.<br /><br />The situation is getting worse for those on H-1B visas as they have to find a new job within 60 days or else, they would be left with no other option but to head back to India.<br /><br />Under current circumstances, when all IT companies are on a firing spree, getting a job within that short period, they feel is next to impossible.<br /><br />Sita (name changed), another IT professional on an H-1B visa, got laid off from Microsoft on January 18.<br /><br />She is a single mother. It would be beneficial for tech companies to show special consideration for H-1B workers and extend their termination date by a few months, as the job market and recruitment process can be challenging,” he said.<br /><br />Global Indian Technology Professionals Association (GITPRO) and Foundation for India and Indian Diaspora Studies (FIIDS) on Sunday launched a community-wide effort to try and help these IT professionals by connecting job seekers to job referrers and informers. FIIDS will work on efforts to influence policymakers and decision-makers of US Citizenship and <keyword id="50403" type="General" weightage="20" keywordseo="immigration" source="Orion">Immigration</keyword> Services (USCIS).<br /><br />“With massive layoffs in the tech industry, January 2023 has been brutal for tech professionals. Many talented folks lost their jobs. As the tech industry is dominated by Indian immigrants, they are the highest to get impacted," Khande Rao Kand said.<br /><br />The laid-off H-1B holders need to find an H-1B sponsoring job in 60 days or leave within 10 days after becoming out of status.<br /><br />"This has a huge disruption on the family lives and children's education etc on this tax-paying and contributing legal immigrant,” Khande Rao Kand from FIIDS said. Bhutoria said it would be beneficial for the immigration process to be redesigned to better support H-1B workers and retain highly skilled talent in the US.<br /><br />In deep distress, the fired Indian IT workers have formed various WhatsApp groups to find ways to have a solution to the terrible situation they are in.<br /><br />In one of the WhatsApp groups, there are more than 800 jobless Indian IT workers who are circulating among themselves vacancies appearing in the country.<br /><br />In another group, they have been discussing various visa options, with some immigration attorneys who have volunteered to offer their consultancy services during this time.<br /><br />“These circumstances have such a devastating effect on us immigrants and are nerve-wracking. We are kinda lost,” said Rakesh (name changed) was laid off from Microsoft on Thursday. He is in the US on an H-1B visa.<br /><br />Adding to the miseries of Indian IT professionals is the latest decision of Google that they are pausing their Green Card processing. This is primarily because, at a time when they have fired thousands of employees, they cannot be seen arguing before the USCIS that they need a foreign IT professional as a permanent resident. We've heard that Biden was once Vice President of the United States and a US senator. Apparently, he is the presumptive Democratic nominee for president. </p><p>The Trump campaign confronts a huge problem: Americans don't have strong opinions about Joe Biden, don't seem to want to have strong opinions about him, and <a href="https://www.nytimes.com/2020/07/10/us/biden-trump-campaign.html?action=click&amp;module=Top%20Stories&amp;pgtype=HomepageHomepage">aren't paying much attention to what Republicans are saying about him</a>. The greatest taunter in American <keyword id="6358883" type="UNKNOWN" weightage="60" keywordseo="politics">politics</keyword>, Trump swept to power by naming and degrading his opponents. (<a href="https://en.wikipedia.org/wiki/List_of_nicknames_used_by_Donald_Trump">This list of Trump-coined nicknames</a> may be his greatest accomplishment.) Americans don't like Trump, but he made us dislike his rivals more, especially Low-energy Jeb Bush and Crooked Hillary Clinton. </p><p>Biden has so far eluded Trump's dagger, partly by hibernating as Trump flounders through the pandemic, and partly by being a nondescript old guy. Only 28% of Americans have a strongly unfavorable view of Biden, an amazingly tiny number in this environment. And he's way, way less unpopular than Hillary Clinton was this time four years ago. She had a minus-22 net favorability rating, <a href="https://www.nbcnews.com/politics/meet-the-press/biden-far-less-unpopular-hillary-clinton-was-four-years-ago-n1231055">while Biden is just minus-1</a>. (Trump is minus-31!) </p><p>Trump just can't figure out how to smear Biden because, as a boring white man, he just doesn't set off Trump or Trump's supporters the way Barack Obama or Hillary Clinton did. Trump has tried depicting Biden as "creepy," but that's not working, <a href="https://www.businessinsider.com/fox-news-host-trump-campaign-latest-attack-biden-sandra-smith-2020-7">even with his own people</a>. He's tried harder to make "Sleepy Joe" stick, but that also isn't grabbing voters. If anything, Sleepy Joe sounds like a relief. If only we had a president who was sleeping, and <a href="https://www.businessinsider.com/donald-trump-schedule-daily-routine-2018-1#trumps-daily-routine-didnt-work-for-me-6">who didn't wake up at 5:30 am to tweet and watch Fox</a>. </p><p>The economy is sinking. The pandemic is raging. Trash-talking represents Trump's best opportunity to win in November, which means he needs to figure out how to demonize Biden and fast. </p><p>As Republican consultant Nelson Warfield told The New York Times: "I made my first negative ad starring Hillary Clinton in 1992 and I kept doing ads criticizing her across the next 24 years. And I was by no means alone. Republicans have months to do to Biden what Republicans had over two decades to do to Hillary." — <em>DP</em></p><p><strong>But Trump and his allies have already landed on a line of attack against Biden</strong></p><p>His alleged "<a href="https://www.washingtonpost.com/politics/trump-increasingly-preoccupied-with-defending-his-physical-and-mental-health/2020/06/22/c7e0a95c-b3ed-11ea-9b0f-c797548c1154_story.html">cognitive decline</a>."</p><p>Now, it's no secret that the former vice president has never been the most eloquent speaker, and he is 77 years old. But Biden has also spoken of a <a href="https://www.theatlantic.com/magazine/archive/2020/01/joe-biden-stutter-profile/602401/">lifelong struggle with stuttering</a>, and his campaign released a summary of his most recent medical exam in December which described him as "healthy" and vigorous."  </p><p>The president, for his part, was roundly mocked last month for being <a href="https://www.cnn.com/2020/06/26/politics/donald-trump-second-term/index.html">unable to articulate a single ambition he wants to pursue in a second term</a> during a Fox News town hall hosted by Sean Hannity, arguably Trump's most prominent media sycophant.</p><p>Once again on Fox News last night, following a 70-second supercut of Biden verbal gaffes, <a href="https://www.youtube.com/watch?v=b7b1NMMoqR4">Hannity asked Trump</a> if he thought the Biden campaign was trying to get the candidate to back out of a debate for fear that he'd be embarrassed. </p><p>"He hasn't taken any cognitive test, because he couldn't pass one," Trump said. "I actually took one when I, very recently, when I was, you know, the radical left was saying 'is he all there, is he all there,' and I proved I was all there because I aced it. I aced the test. And he should take the same exact test." — <em>Anthony Fisher</em></p><p><strong><div type="image" title="Donald Trump Stephen Miller immigration visa executive order" height="1299" width="1732" msid="76900730" hostid="261"></div></strong></p><p><strong>Another perverse attack on legal immigrants</strong></p><p>This administration, so incompetent in controlling the pandemic, is proving diabolically capable at restricting <keyword id="50403" type="ORGANIZATION" weightage="60" keywordseo="Immigration">immigration</keyword>. The Washington Post reports that <a href="https://www.washingtonpost.com/opinions/how-the-trump-administration-is-turning-legal-immigrants-into-undocumented-ones/2020/07/09/15c1cbf6-c203-11ea-9fdd-b7ac6b051dc8_story.html">USCIS has massively scaled back printing </a>of essential papers that legal immigrants need, notably green cards. Citing budget constraints, USCIS has canceled work at one of its two contract printers and reduced production at the other, leaving legal residents in a state of undocumented limbo. </p><p>Also this week, the <a href="https://www.npr.org/2020/07/09/889301025/u-s-broadcasting-agency-will-not-extend-visas-for-its-foreign-journalists">Voice of America, under a new Trump-allied CEO</a>, decided not to renew visas for foreign nationals who work there. And the administration continues its efforts to expel international students who attend colleges that have adopted online classes to get through the pandemic. </p><p>These policies and many other Trump anti-immigrant efforts betray the administration's fundamental lack of confidence in America. The Stephen Millerized White House believes that immigrants are coming to steal from us, and take our money and ideas back to their home countries. International students are here to exploit our system and heist our intellectual property for China. Foreign reporters are here to subvert VOA. The White House sees immigrants as spies and fifth columnists fundamentally loyal to a foreign nation, rather than dreamers galvanized by the American promise. Historically, international students often stay here and become the most productive, creative workers in the economy. Foreign reporters become inspired here, and become evangelists for American values. </p><p>For all its America Firstism, the Trump White House doesn't trust America enough to believe that it can inspire this generation of students and green card holders. — <em>DP</em></p><p><strong>Biden's 'Buy American' plan is good, but it needs teeth</strong></p><p>On Thursday, presumptive Democratic presidential nominee Joe Biden made a speech outlining a plan to revive the middle class in Scranton, Pennsylvania. In it, he promised to invest in manufacturing and tech (outside Silicon Valley); reverse the Trump tax cuts; support shareholder capitalism; and get corporations to pay their fair share of taxes.</p><p>This is all very good, but it's going to need teeth, and the biggest tooth is antitrust enforcement.</p><p>In part, a renewed focus on antitrust will be necessary to preserve the small and medium sized enterprises (SMEs) that survived the pandemic. When it's over the SMEs that survived will likely need more help than their corporate counterparts, putting them at risk for consolidation. That means the government will have to keep a watchful eye on <keyword id="31671" type="CITY" weightage="60" keywordseo="markets">markets</keyword> to ensure that little guys aren't swallowed by the big ones.</p><p>Then there's the task of cleaning up consolidation in our current markets. Even before the pandemic (and increasingly after the financial crisis), the US was becoming a country of bigger and bigger companies using their power to destroy competition and limit consumer choice. We see that in <a href="https://www.businessinsider.com/break-up-facebook-and-other-big-american-companies-2019-5">tech</a>, <a href="https://www.ers.usda.gov/webdocs/publications/88057/eib-189.pdf">agriculture</a>, <a href="https://www.npr.org/2019/12/03/784553287/what-does-it-mean-when-2-giant-newspaper-companies-merge">media</a>, telecommunications, and healthcare.</p><p>We need to update and enforce antitrust regulations that were left to wither after their relevance was questioned starting in the 1970s. Back then, legal scholars started to argue that antitrust should be defined by how corporate consolidation impacts price and only price, not competition in general. Four decades later and we now have an economy of companies too powerful to regulate and too big to compete with. Just ask any company that's tried to go head to head with Facebook.</p><p>It's time to change the game by going back to basics. Back in 1890, Sen. John Sherman — for whom our Sherman Antitrust legislation is named — famously declared: "If we will not endure a king as a political power, we should not endure a king over the production, transportation, and sale of any of the necessaries of life." <p><div class="KonaFilter image-container display-table float_right"><div><div class="image on-image"></div><p></p></div></div>A federal judge in Hawaii will hear arguments from state lawyers <a href="http://www.politico.com/f/?id=0000015a-af57-d665-a3de-bf77c9f90000">next Wednesday</a> regarding President Donald Trump's revised executive order restricting travel from six majority-Muslim countries.</p><p>The lawyers are seeking a temporary restraining order on the ban, which was signed on Monday, weeks after the original order was challenged in courtrooms across the country and ultimately blocked from reinstatement by the 9th Circuit Court of Appeals.</p><p>The <a href="http://www.businessinsider.com/trumps-revised-travel-ban-excludes-iraq-people-with-current-visas-2017-3">revised order</a> no longer bars current visa holders and green card holders from entering the US, and removes Iraq from the list of affected countries, which now include just Iran, Syria, Somalia, Sudan, Libya, and Yemen. It also includes Syrian refugees as part of its 120-day refugee admissions suspension, whereas previously Syrian refugees were barred indefinitely.</p><p>Unlike the original order, this ban also gave advanced notice of its implementation, which will occur March 16 unless a judge grants a restraining order.</p><p>State attorneys for Hawaii argued in their <a href="http://www.politico.com/f/?id=0000015a-ac35-d689-a37a-eff5607f0001">amended complaint</a> that the order will cause "grave injury" to Muslims in Hawaii, and will affect its foreign students and workers and upset the state's tourism-based economy.</p><p>"President Trump's new Executive Order is antithetical to Hawaii's State identity and spirit," the complaint argues.</p><p>"It is damaging Hawaii's institutions, harming its economy, and eroding Hawaii's sovereign interests in maintaining the separation between church and state as well as in welcoming persons from all nations around the world into the fabric of its society."</p><p>The state's attorneys argued that the revised order violates the First Amendment and Fifth Amendment by having the effect and intent of "disfavoring Islam," inflicting harm on Hawaii's residents, discriminating against individuals based on their religion and nationality, and violating individuals of due process rights.</p><p>The complaint lists its lead plaintiff as Ismail Elshikh, the Imam of the Muslim Association of Hawaii, whose mother-in-law lives in Syria and could be prevented by the ban from obtaining a visa to visit the state.</p><p>The state's lawyers argued that Elshikh and his family will be subjected to "discrimination and second-class treatment."</p><p>The complaint also noted that the state hosts 12,000 foreign students and international faculty members, many of whom are from the seven countries identified in Trump's original order, including at least 27 graduate students currently studying at the University of Hawaii.</p><p>Foreign students paid more than $400 million into the Hawaiian economy through their tuition, fees, and living expenses, and supported 7,590 jobs and generated more than $43 million in state taxes, the complaint said.</p><p>The lawyers also argued that tourism is Hawaii's "lead economic driver," bringing in 8.7 million visitors in 2015 alone, who accounted for $15 billion in spending.</p><h2><span>'Nationality- and religion-based discrimination'</span></h2><p><div class="KonaFilter image-container display-table float_right"><div><div class="image on-image"></div><p></p></div></div>The complaint, like those against Trump's first order, uses in its arguments previous statements Trump has made, such as those calling for "a total and complete shutdown of Muslims entering the United States" and accusing the American immigration system of "importing radical Islamic terrorism to the West."</p><p>"President Trump repeatedly campaigned on the promise that he would ban Muslim immigrants and refugees from entering the United States, particularly from Syria, and maintained the same rhetoric after he was elected," the complaint said.</p><p>The lawyers also included in the complaint several comments made by Trump allies that appear to call into question the intent of Trump's order. The complaint cites comments made by former New York City Mayor Rudy Giuliani, who told Fox <keyword id="6355005" type="COMPANY" weightage="60" keywordseo="News">News</keyword> that Trump had consulted him on how to legally implement a "Muslim ban."</p><p>Also cited is Trump's senior adviser Stephen Miller, who told Fox News last month that Trump's revised order would have the same effect as the original one.</p><p>The lawsuit also sought to undercut Trump's claims that the order was urgently needed to prevent terrorist attacks. Hawaii was the first state to challenge Trump's new travel ban - here's why it says the order is still unconstitutional

<p><div class="KonaFilter image-container display-table float_right"><div><div class="image on-image"></div><p></p></div></div>Federal judges in several states began hearing arguments from lawyers on Wednesday regarding President Donald Trump's revised executive order restricting travel from six majority-Muslim countries.</p><p>Lawyers are facing off on the order in Maryland, Washington state, and Hawaii, where separate lawsuits have been filed.</p><p>The plaintiffs are seeking a temporary restraining order on the ban, which was signed last Monday, weeks after the original order was challenged in courtrooms across the country and ultimately blocked from reinstatement by the 9th Circuit Court of Appeals.</p><p>The <a href="http://www.businessinsider.com/trumps-revised-travel-ban-excludes-iraq-people-with-current-visas-2017-3">revised order</a> no longer bars current visa holders and green card holders from entering the US, and removes Iraq from the list of affected countries, which now include just Iran, Syria, Somalia, Sudan, Libya, and Yemen. It also includes Syrian refugees as part of its 120-day refugee admissions suspension, whereas previously Syrian refugees were barred indefinitely.</p><p>Unlike the original order, this ban also gave advanced notice of its implementation, which will occur Thursday at 12:01 a.m. unless one of the judges grants a restraining order.</p><p>In Maryland, refugee organizations including the International Refugee Assistance Project called on US District Judge Theodore Chuang to halt Trump's order. They argued in legal filings that evidence of security threats, which the Trump administration cited as justification for the order, were "implausibly thin," and that the revised order maintained the original ban's "discriminatory intent," according to <a href="https://www.washingtonpost.com/local/social-issues/lawyers-face-off-on-trump-travel-ban-in-md-court-wednesday-morning/2017/03/14/b2d24636-090c-11e7-93dc-00f9bdd74ed1_story.html" target="_blank">the Washington Post</a>. </p><p>"The Executive Order causes severe and irreparable injury to the individual plaintiffs, the organizational plaintiffs, and the organizational plaintiff's clients, separating family members from one another, stranding people in unsafe locations overseas, and stigmatizing and demeaning one religious group," one legal filing said.</p><p>Chuang said Wednesday he will issue a ruling, but could not guarantee it would come before Trump's ban takes effect.</p><p><span>Hawaii had been the first state to file a lawsuit last Wednesday, followed by Washington - which had been the first state to challenge Trump's original ban in January. Washington's renewed lawsuit has been joined by Oregon, Minnesota, Maryland, New York, California, and Massachusetts.</span></p><p>A legal brief filed by California argues that the state's residents - including its more than 10 million immigrants and 150,000 international students - will be harmed by the new ban, according to the <a href="http://www.latimes.com/politics/essential/la-pol-ca-essential-politics-updates-california-will-join-lawsuit-1489378505-htmlstory.html">Los Angeles Times</a>. The brief also alleged the state will suffer financial harm, as visitors from the Middle East spent $681 million in the state in 2015, generating $40.8 million in sales tax revenue.</p><p>"The Trump Administration may have changed the text of the now-discredited Muslim travel ban, but they didn't change its unconstitutional intent and effect," California's attorney general Xavier Becerra told media on Monday.</p><p>"It's still an attack on people - women and children, professors and business colleagues, seniors and civic leaders - based on their religion and national origin."</p><p> </p><p>Trump administration officials have defended both bans as necessary in preventing the entry of travelers from countries affected by terrorism, until more rigorous vetting procedures can be implemented.</p><h2>'Antithetical to Hawaii's State identity and spirit'</h2><p><div class="KonaFilter image-container display-table float_right"><div><div class="image on-image"></div><p></p></div></div>State attorneys for Hawaii argued in their <a href="http://www.politico.com/f/?id=0000015a-ac35-d689-a37a-eff5607f0001">amended complaint</a> that the order will cause "grave injury" to Muslims in Hawaii, and will affect its foreign students and workers and upset the state's tourism-based economy.</p><p>"President Trump's new Executive Order is antithetical to Hawaii's State identity and spirit," the complaint argues.</p><p>"It is damaging Hawaii's institutions, harming its economy, and eroding Hawaii's sovereign interests in maintaining the separation between church and state as well as in welcoming persons from all nations around the world into the fabric of its society."</p><p>The state's attorneys argued that the revised order violates the First Amendment and Fifth Amendment by having the effect and intent of "disfavoring Islam," inflicting harm on Hawaii's residents, discriminating against individuals based on their religion and nationality, and violating individuals of due process rights.</p><p>The complaint lists its lead plaintiff as Ismail Elshikh, the Imam of the Muslim Association of Hawaii, whose mother-in-law lives in Syria and could be prevented by the ban from obtaining a visa to visit the state.</p><p>The state's lawyers argued that Elshikh and his family will be subjected to "discrimination and second-class treatment."</p><p>The complaint also noted that the state hosts 12,000 foreign students and international faculty members, many of whom are from the seven countries identified in Trump's original order, including at least 27 graduate students currently studying at the University of Hawaii.</p><p>Foreign students paid more than $400 million into the Hawaiian economy through their tuition, fees, and living expenses, and supported 7,590 jobs and generated more than $43 million in state taxes, the complaint said.</p><p>The lawyers also argued that tourism is Hawaii's "lead economic driver," bringing in 8.7 million visitors in 2015 alone, who accounted for $15 billion in spending.</p><h2><span>'Nationality- and religion-based discrimination'</span></h2><p><div class="KonaFilter image-container display-table float_right"><div><div class="image on-image"></div><p></p></div></div>Hawaii's complaint, like those against Trump's first order, uses in its arguments previous statements Trump has made, such as those calling for "a total and complete shutdown of Muslims entering the United States" and accusing the American immigration system of "importing radical Islamic terrorism to the West."</p><p>"President Trump repeatedly campaigned on the promise that he would ban Muslim immigrants and refugees from entering the United States, particularly from Syria, and maintained the same rhetoric after he was elected," the complaint said.</p><p>The lawyers also included in the complaint several comments made by Trump allies that appear to call into question the intent of Trump's order. The complaint cites comments made by former New York City Mayor Rudy Giuliani, who <a href="http://www.businessinsider.com/giuliani-trump-asked-me-how-to-do-a-muslim-ban-legally-2017-1" target="_blank">told Fox News</a> that Trump had consulted him on how to legally implement a "Muslim ban."</p><p>Also cited is Trump's senior adviser Stephen Miller, who told Fox <keyword id="6355005" type="COMPANY" weightage="60" keywordseo="News">News</keyword> last month that Trump's revised order would have the same effect as the original one.</p><p>The lawsuit also sought to undercut Trump's claims that the order was urgently needed to prevent terrorist attacks.
