New Delhi, Jan 22 () The finance ministry on Wednesday staggered last dates of filling GSTR-3B, a monthly return form, and has provided three dates for different categories of taxpayers, a moved aimed at de-stressing the system.
Currently, the last date for filing GSTR-3B is 20th of every month. From now onwards, there will three dates -- 20th, 22nd and 24th -- of every month for different categories of tax payers.
In past, glitches in the return filing system of GST Network were reported on the last day of filing of returns and trade and industry had to face problems.
It may be noted here that about one-fifth of the total GSTR-3B returns were filing on the last day (January 20).
"From now on, the last date for filing of GSTR-3B for the taxpayers having annual turnover of Rs 5 crore and above in the previous financial year would be 20th of the month. Thus, around 8 lakh regular taxpayers would have the last date of GSTR-3B filing as 20th of every month without late fees," the ministry said in a statement.
The taxpayers having annual turnover below Rs 5 crore in previous financial year will be divided further in two categories. 
The tax filers from 15 states/UTs -- Chhattisgarh, Madhya Pradesh, Gujarat, Daman and Diu, Dadra and Nagar Haveli, Maharashtra, Karnataka, Goa, Lakshadweep, Kerala, Tamil Nadu, Puducherry, Andaman and Nicobar Islands, Telangana and Andhra Pradesh -- will now be having the last date of filing GSTR-3B returns as 22nd of the month without late fees. 
This category would have around 49 lakh GSTR-3B filers who would now have 22nd of every month as their last date for filing GSTR-3B returns. 
For the remaining 46 lakh taxpayers from the 22 States/UTs of Jammu and Kashmir, Laddakh, Himachal Pradesh, Punjab, Chandigarh, Uttarakhand, Haryana, Delhi, Rajasthan, Uttar Pradesh, Bihar, Sikkim, Arunachal Pradesh, Nagaland, Manipur, Mizoram, Tripura, Meghalaya, Assam, West Bengal, Jharkhand and Odisha having annual turnover below Rs 5 crore in previous financial year the last date will be 24th.
The ministry further said it has also taken a note of difficulties and concerns expressed by the taxpayers regarding filing of GSTR-3B and other returns. 
"The matter has been discussed by the GSTN with Infosys, the Managed Service Provider, which has come out with above solution to de-stress the process as a temporary but immediate measure," it added. 
For further improving the performance of GSTN filing portal on permanent basis, several technological measures are being worked out with Infosys and will be in place by April 2020.

FinMin allows 3 last dates for filing GSTR-3B for different categories of taxpayers

New Delhi, Jan 21 () GST Network (GSTN) on Tuesday said 13.30 lakh GSTR-3B returns, about one-fifth of total such returns, were filed on the last day on January 20 despite some technical glitches.
 This month's return filing data till date show that the GSTN return filing system was working within its expected limits which is evident by the fact that till January 14, a total of 24.66 lakh GSTR-3B were filed, GST Network said in a statement.
 "A total of 65.65 lakh GSTR-3B for the tax month of December were filed, out of which 13.30 lakh GSTR-3B returns were filed on last day itself, i.e., on January 20, 2020," it said.
 Several taxpayers complained of technical glitches on filing returns on social media.
 There have been few issues about one-time passwords (OTPs) being received with some time lag on account of delay by the e-mail service provider or local internet issues, it said.
 "Thus, in order to ensure that no inconvenience is faced by the taxpayer on this account, the OTPs are sent simultaneously on e-mail as well as on registered mobile number so that in case there is a delay in receiving OTP on e-mail, OTP received on mobile phone or vice versa can be used. The taxpayer can use OTP received on any channel for filing their returns," it said.
 In the last three days 8.32 lakh, 6.09 lakh and 13.30 lakh GSTR-3B returns were filed on January 18, 19 and January 20, respectively.
 On January 21 also, till 12 pm, more than 2 lakh GSTR-3B were filed for the tax month of December, totalling the GSTR-3B returns filed to 67.70 lakh in this month, it added. DP CS HRS

One-fifth taxpayers file return on last day: GST Network

New Delhi, Feb 1 () Goods and services tax (GST) collection has crossed the Rs 1 lakh crore-mark for the third month in a row in January on the back of anti-evasion steps taken by tax officers.
 This is second time since introduction of GST in July 2017 that the monthly revenues have crossed Rs 1.1 lakh crore.
 The GST collection is in line with the target set by Revenue Secretary Ajay Bhushan Pandey after a high-level meeting with senior tax officials earlier this month.
 During the month, GST revenue from domestic transactions has shown a growth of 12 per cent over the revenue during January 2019, according to an official statement.
 Taking into account the integrated goods and services tax (IGST) collected from imports of goods, the total revenue during January 2020 has increased by 8 per cent in comparison to the revenue during January 2019, it said. 
 However, the IGST on import of goods has shown a negative growth of (-)3% as compared to January, 2019.
 "The gross GST revenue collected January 2020 is Rs 1,10,828 crore, of which CGST is Rs 20,944 crore, SGST is Rs 28,224 crore, IGST is Rs 53,013 crore (including Rs 23,481 crore collected on imports) and Cess is Rs 8,637 crore (including Rs 824 crore collected on imports)," it said.
 The GST collection stood at Rs 1.02 lakh crore in January 2019, as per the official statement.
 The total number of GSTR 3B returns filed for the month of December up to January 31, 2020 was 83 lakh.
 The government has settled Rs 24,730 crore to Central Goods and Services Tax (CGST) and Rs 18,199 crore to State Goods and Services Tax (SGST) from IGST as regular settlement.
 The total revenue earned by the centre and state governments after regular settlement in January 2020 is Rs 45,674 crore for CGST and Rs 46,433 crore for SGST.
 This month, the government set an ambitious target of Rs 1.1 lakh crore monthly GST revenue for the remaining part of the current fiscal and asked taxmen to step up efforts to achieve the goal.
 To augment revenue collection, the Revenue Secretary revised GST collection target to Rs 1.25 lakh crore for the last month of this financial year with specific focus on fraudulent input tax credit (ITC) claims as found in data analytics review.
 It was emphasised that GST authorities would look into the mismatch of supply and purchase invoices, data analytics of mismatch in GSTR-1, GSTR-2A and GSTR-3B, failure of filing returns, over invoicing, recuperation of fake or excess refunds availed beyond the permissible limits.
 Around 40,000 companies have been red-flagged for excess or fraudulent ITC availment and other tax related wrongful issues through data analytics, out of 1.2 crore GST registrants and focus would be on these identified taxpayers, sources said. DP ANS

Govt nets Rs 1.1 lakh cr from GST in Jan

New Delhi, Jan 17 () The tax department on Friday raised GST collection target to Rs 1.15 lakh crore over the next two months and Rs 1.25 lakh crore for March month by checking fraudulent input tax credit claims.
 The decision in this regard was taken in a high-level meeting chaired by Revenue Secretary Ajay Bhushan Pandey held on Friday, sources said.
 Last month, the department had raised its GST tax collection target to Rs 1.1 lakh crore per month with Rs 1.25 lakh crore for a single month for the remaining period of this financial year while the direct tax target was to remain at Rs 13.35 lakh crore sans the corporate tax relief of Rs 1.45 lakh crore.
 The meeting was attended by all the very senior officials of CBIC and CBDT to devise an action plan and make the field functions more efficient to achieve the collection aims without any overreach, sources said.
 According to sources, it is learnt that GST authorities would look into the mismatch of supply and purchase invoices, data analytics of mismatch in GSTR-1, GSTR-2A and GSTR-3B, failure of filing returns, over invoicing, recuperation of fake or excess refunds availed beyond the permissible limits, patching the tax leakages, action on checking fake or huge ITC claims, data analytic review of all the refund under inverted duty structure, etc.
 Sources further said that SMSs and emails will be sent to all such fraudulent or excess ITC claimants, targeted defaulters, non-filers and those who provide mismatched information in their returns or over invoice or who have been identified through data analytics for tax evasion by duping the system through rogue modus operandi.
 Taxpayers who have taken ITC wrongfully can voluntarily repay amount equal to inadmissible credit before verification and punitive action is taken against them, they said.
 The electronic communications to such identified targeted taxpayers and fraudulent refund seekers and over-invoice users would be followed by visits from the GST field formations to make them abide by the law and pay due taxes in time, sources said, adding, the field formations would be required to report on daily basis.
 Weekly high level review of revenue augmentation measures and efforts made or actions taken against these targeted gamers, fraudulent ITC seekers and identified default taxpayers would be done by the Revenue Secretary.
 Around 40,000 companies have been red-flagged for excess or fraudulent ITC availment and other tax related wrongful issues through data analytics, out of 1.2 crore GST registrants and focus would be on these identified taxpayers, sources said.
 Field formations have been directed to conclude ITC recuperation without any overreach but in a stipulated timeframe, sources added.
 Sources emphasised that the permissible ITC limits have been further reduced to 110 per cent of the declaration made by the suppliers from January 1, 2020 and the taxpayers filing their return for the month of December 2019 should take this into consideration while filing their FORM GSTR-3B, to avoid any punitive action by the authorities. Tax Dept raises GST revenue target to Rs 1.15 lakh cr for Jan-Feb

New Delhi, Come January 1, and <keyword id="6354679" type="COMPANY" weightage="20" keywordseo="gst">GST</keyword> taxpayers would be able to pay their <keyword id="535383" type="PERSON" weightage="20" keywordseo="tax-dues">tax dues</keyword> on a self-assessment basis without having to go through the cumbersome process of filing tax returns on a monthly basis. <keyword id="9257566" type="COMPANY" weightage="20" keywordseo="the-central-board-of-indirect-taxes">The Central Board of Indirect Taxes</keyword> and Customs (CBIC) will introduce the <keyword id="10425522" type="UNKNOWN" weightage="20" keywordseo="new-quarterly-return">new Quarterly Return</keyword> and Monthly Payment Scheme (QRMP) for GST taxpayers from next year that will allow taxpayers to file only 4 GSTR-3B returns in a year instead of 12 returns at present. As per the scheme, while returns through form GSTR-3B will be filed only quarterly and not monthly as at present, taxpayers would be lower to pay taxes dues on a monthly basis based on a self-assessment method. The self assessment would allow taxpayers to pay their monthly dues based on 100% of net cash liability paid in the previous month or 35% of cash liability paid on the previous quarter or actual self-assessment of tax dues after deducting the input tax credit (ITC). Under the new scheme, GSTR-3B will be filed only at the end of three-month period. Under QRMP scheme, the taxpayer would have the preference to pay their due monthly taxes as per his own choice either by cash ledger or through pre-filled challan which would be 35% of the previous quarter's cash paid or may pay as per actual. Thereby, a small taxpayer would require professional help, as and when required, particularly in the last month of the quarter and can be free from tax-related stress by simply making payment through a system-generated, pre-filled challan. The scheme would impact almost 94 lakh taxpayers, about 92% of the total tax base of the GST, who have an annual aggregate turnover (AATO) up to ₹5 crore, said the Sources in the Department of Revenue (DoR). Sources in the know of the matter said that the QRMP scheme has optional feature of Invoice Filing Facility (IFF) to mitigate business related hardships for the small and medium taxpayers. Under the facility of IFF, the small taxpayers who opt to be quarterly return filers under QRMP scheme would be able to upload and file such invoices even in the first and second month of the quarter for which there is a demand from the recipients. Further, this would engage buyers who earlier used to avoid purchase from the small taxpayers in the want of uploading of invoices in the system on monthly basis. According to Sources, that the taxpayer would need not upload and file all the invoices for the month and could upload and file only those invoices which are required to be filed in IFF as per demand of the recipients. The remaining invoices of the first and second months can be uploaded in the quarterly GSTR-1 return. The IFF would be available up to a cut-off date and credit would flow to the recipient after the cut-off date on filing of the IFF. GST taxpayers to get flexibility to decide on monthly tax payment

The government has extended the deadline for filing <keyword id="6354679" type="General" weightage="100" keywordseo="gst" source="Orion">GST</keyword> returns for the month of September by a day to October 21, the CBIC said on Friday. On Thursday, taxpayers faced a slow functioning of the GST portal, which was the last date for filing monthly GST returns for some taxpayers. Following that, the <keyword id="12579914" type="General" weightage="50" keywordseo="central-board-of-indirect-taxes-and" source="Orion">Central Board of Indirect Taxes and</keyword> <keyword id="6360806" type="General" weightage="50" keywordseo="customs" source="Orion">Customs</keyword> (CBIC) said that an extension of the due date was being considered. Govt extends deadline for filing September GST return till Oct 21

Footwear major <keyword id="19980586" type="General" weightage="80" keywordseo="bata-india" source="keywords">Bata India</keyword> has received a notice from the <keyword id="19980587" type="General" weightage="50" keywordseo="state-tax-officer" source="keywords">State Tax Officer</keyword>, Anna Salai Assessment Circle, Chennai, amounting to Rs 60.56 crore, the company said in a filing to the bourses on Thursday. The notice dated December 27, 2023, pertains to several issues raised in a final audit report on December 25, for the 2018-19 financial year, according to the filing. The issues raised include differences in turnover on outward supplies in the monthly GST returns, differences in tax on outward supplies in the GSTR-9 &amp; GSTR-9C returns, excess <keyword id="19980589" type="General" weightage="50" keywordseo="input-tax-credit" source="keywords">Input Tax Credit</keyword> (<keyword id="19896958" type="General" weightage="80" keywordseo="itc" source="keywords">ITC</keyword>) availed, and <keyword id="19980588" type="General" weightage="50" keywordseo="itc-reversal" source="keywords">ITC Reversal</keyword> on credit note. Bata India gets ₹60 crore sales tax notice

New Delhi, Nov 20 () GST Network on Monday said the return filing system is working fine.
 The statement comes a day after certain complaints made on the social media regarding the GSTN system not functioning.
 GSTN said that the GST return filing system is working within expected limits. "Had it not been so, how more than 11.52 lakh GSTR3B (October) returns could have been filed yesterday with about 1.82 lakh returns filed in a peak hour," it said.
 Also, on November 18, more than 8.14 lakh returns were filed, while on Wednesday, over 9.23 lakh GSTR 3B returns were filed by 4.00 pm and filing is going on smooth with 6.30 lakh returns filed between 12 to 4 pm, it said.
 GSTN said any online system has to have a load threshold and for GST return filing system, it is at 1.5 lakh returns filing at a particular moment. If this threshold is reached, the site shows a message asking the taxpayer to wait for his turn in a few minutes, it said.
 Referring to complaints, GSTN said it could have been possible that some filers may have momentarily experienced being logged out at the load threshold of 1.5 lakh returns load at a particular point of time or some difficulty due to any local issue at the taxpayer filers' end.
 GSTN said the taxpayers are requested that they should not wait till the last three days to file their returns as normally there may be huge rush of return filing on these days. HRS

The Comptroller and Auditor General (<keyword id="19900713" type="General" weightage="20" keywordseo="CAG" source="keywords">CAG</keyword>) has asked the <keyword id="19900485" type="General" weightage="20" keywordseo="Finance-Ministry" source="keywords" meta.keywordsubtype="org" meta.entityname="Finance Ministry" meta.hostid="153" meta.entityid="Finance Ministry">Finance Ministry</keyword> to identify <keyword id="22837132" type="General" weightage="20" keywordseo="high-risk-taxpayers" source="keywords">high risk taxpayers</keyword> in the <keyword id="20981418" type="General" weightage="100" keywordseo="GST-composition-scheme" source="keywords">GST composition scheme</keyword> on a periodical basis and verify from other sources, including third parties, their declared <keyword id="22837745" type="General" weightage="20" keywordseo="value-of-sales" source="keywords">value of sales</keyword> to check <keyword id="20121097" type="General" weightage="20" keywordseo="tax-evasion" source="keywords">tax evasion</keyword>. Based on an analysis of 8.66 lakh composition taxpayers under the central jurisdiction between 2019-20 to 2021-22 fiscals, the Comptroller and Auditor General (CAG) found that a significant number of <keyword id="19951327" type="General" weightage="20" keywordseo="gst" source="keywords">GST</keyword> taxpayers have a high risk of crossing the <keyword id="22837744" type="General" weightage="20" keywordseo="turnover-threshold" source="keywords">turnover threshold</keyword> for composition levy scheme (CLS). These high risk taxpayers were identified by audit from the data contained in GST returns viz. GSTR-4A, GSTR-7 along with third party data sources such as IT returns, 'Vahan' database etc. The GST composition scheme is available to taxpayers whose aggregate turnover, in the preceding financial year, has not exceeded Rs 1.5 crore. For taxpayers in special category states, this limit is Rs 75 lakh. The CAG said two major risk areas in respect of CLS taxpayers are under-declaration of the 'value of outward supply' by the taxpayers to continue in the scheme; and non-fulfillment of eligibility conditions for availing CLS. The audit also observed that there were certain CLS taxpayers who were continuing in the Scheme despite not fulfilling the eligibility criteria prescribed in the Act and the Rules, and a substantial number of CLS taxpayers were not discharging their obligatory responsibilities of filing returns and payment of tax under reverse charge. "The Ministry should identify high risk taxpayers in the CLS on a periodical basis using a risk-based approach and verify their declared value of outward supply from other sources including third parties to minimize the possibility of misuse by ineligible persons," the CAG said in a report tabled in Parliament recently. The official auditor also suggested that the Finance Ministry may develop a system of identifying ineligible taxpayers and take action to exclude them from the CLS in order to prevent misuse of the intended benefits of the scheme.

Finance Ministry should identify high risk taxpayers in GST composition scheme: CAG

New Delhi, Feb 15 () Interest payable on delayed payment of GST will henceforth be calculated on net tax liability and the law is being amended to give effect to it, the Central Board of Indirect Taxes and Customs (CBIC) said on Saturday. Amid worry in the industry regarding CBIC's recent directive to field formations to begin recovery of about Rs 46,000 crore of unpaid interest on delayed GST payment, the CBIC, in a series of tweets, clarified that the central and several state governments have prospectively amended the GST Acts to collect interest on net tax liability. The CBIC said GST laws, as of now, permit interest calculation on delayed GST payment on the basis of gross tax liability. This position has been upheld in the Telangana High Court's decision dated April 18, 2019. "In spite of this position of law and Telangana High Court's order, the central government and several state governments, on the recommendations of the GST Council, amended their respective CGST/SGST Acts to charge interest on delayed GST payment on the basis of net tax liability," the CBIC said. "Such amendment will be made prospectively. The states of Telangana and West Bengal are in the process of amending their state GST Acts. After the process of amendment is complete, the changed provisions can be put in operation for the entire country," it added. Businesses, other than those under the composition scheme, registered under goods and services tax (GST) have to file returns (GSTR-1) showing tax liability by 11th of following month and pay taxes by filing GSTR-3B by 20th. There have been cases where GST assessees have paid taxes after due date but did not pay the interest due on account of delayed payment. There were doubts on whether the interest was to be paid on gross tax liability or net tax liability. Of the total <a href="https://www.livemint.com/Politics/6VE7QlPV6PlQyZAoOH8PnO/GST-collections-cross-Rs1-trillion-in-April-the-first-time.html" data-type="tilCustomLink">revenue</a> of ₹1.03 trillion collected in April, ₹186.52 billion was GST collected by the centre, ₹257.04 billion was state collected GST and ₹505.48 billion was integrated GST according to the statement by the finance ministry. In addition to that, the cess was ₹85.54 billion including ₹7.02 billion from imports.  GST revenue buoyancy is expected to improve during the upcoming months after the electronic tracking of goods movement shows results after its implementation on 1 April 2018. This is expected to be a barrier for tax evaders that keep transactions completely off their books or under-report their profit turnovers. With the introduction of schemes such as invoice matching with new improved tax return forms, revenue charge mechanism (a mechanism in which large registered dealers have to pay tax for purchases from small unregistered vendors) and the requirement for some taxpayers to withhold tax while making payments, it is expected to improve the tax anti-evasion architecture.  Compliance to these schemes remains a challenge till date with only around two-thirds of the taxpayers filling in tax returns on time. They have to use a <keyword id="4673477" type="ORGANIZATION" weightage="20" keywordseo="GSTR">GSTR</keyword> 3B form, introduced along with the GST in July 2017, which must be filed by everyone who has registered for GST. A tax of 5.79 billion was paid by 59.3% of the registered composition dealers who filed their quarterly return in April. “This represents a tipping point in the GST collection in India and indicates that the tax collections are stabilising- it is now essential to allow the reform to stabilise and not keep making constant changes as simplification and stability are essential attributes of increased tax compliance,” <a href="https://www.livemint.com/Politics/6VE7QlPV6PlQyZAoOH8PnO/GST-collections-cross-Rs1-trillion-in-April-the-first-time.html" data-type="tilCustomLink">said</a> M.S. India crosses the trillion mark in tax collection in April, the first time since GST was implemented

New Delhi, Mar 11 () The finance ministry has flagged 17 'areas of dissatisfaction' with Infosys-designed GST Network, including transition issues for taxpayers in Jammu and Kashmir, Aadhaar verification and lack of scalability of server. The other areas which the ministry has flagged as "unresolved or late resolved" with Infosys include delay in providing software for blocking of e-way bill generation in cases of non-filers of GSTR-3B. Besides, new supply code for point of sale outside India, or deploying a feature that would allow assigning registration application to the same jurisdictional officer after past rejection (a decision on which had been taken in early 2019), were also flagged by the ministry. Infosys, which in 2015 won the contract for managing backend for GST Network (GSTN), has drawn flak from the ministry over the tech glitches, some of them have been unresolved for almost two years. The finance ministry has sought an urgent resolution plan from the Bengaluru-based software giant to address these tech glitches and the 17 areas have been highlighted by the government, sources said. An email sent to Infosys on the issue did not elicit any comment. Infosys chairman Nandan Nilekani has been summoned by the Government to make a presentation before the GST Council on March 14 following high level meetings at the finance ministry to fix the outstanding problems. The ministry has made it clear to Infosys that the onus of performance of GST portal lies with the company and that it should meet the expectations. In a strongly worded letter to Infosys on March 5, the ministry had said some of the problems highlighted as early as 2018 are still unresolved and failures month after month has lead to genuine taxpayers "getting frustrated". "Infosys is requested to go through the pending issues, day-to-day disruptions and the future road map and come up with a plan for quick resolution within 15 days. "Infosys has set high international standards and it is expected that the efficiency which your organisation is known for should be visible in GST project also," the ministry had said in the letter to Infosys. Meanwhile, in a strongly worded letter to Infosys on March 5, the ministry said some of the problems highlighted as early as 2018 are still unresolved and failures month after month lead to genuine taxpayers "getting frustrated". Highlighting the issues faced on the GSTN portal, the ministry said even though the GST system has been in operation for the last 30 months, there have been instances of taxpayer complaints on facing issues in filing returns in the last two days of filing of returns (for GSTR-1 and GSTR-3B). "It is noticed that MSP (Master Service Provider) M/s Infosys have been repeatedly asked to take timely action and to identify the root cause of issues after each event and taken corrective action. However, problem still persists," it said. The ministry said such glitches on the portal leads to an unhealthy tax compliance requirement more so when on account of such disruptions some taxpayers end up becoming liable for payment of late fee, interest. New Delhi, Apr 1 () Goods and Services Tax (GST) revenue in March stood at Rs 97,597 crore, lower than over Rs 1.05 lakh crore collected in February.Of the total Rs 97,597 crore revenue, the central GST stood at Rs 19,183 crore, state GST at Rs 25,601 crore and integrated GST at Rs 44,508 crore, which included Rs 18,056 crore collected on imports, the Finance Ministry said in a statement on Wednesday.The total number of GSTR-3B returns filed up to March 31, 2020 is 76.5 lakh.
