The NCLAT has upheld the fair trade regulator CCI's order, holding <keyword id="5214668" type="COMPANY" weightage="20" keywordseo="Adani-Gas-Limited">Adani Gas Limited</keyword> (AGL) "guilty of of abuse of dominant position" while supplying piped natural gas to industrial customers in Faridabad.However, a two-member NCLAT bench headed by Chairperson Justice S J Mukhopadhaya reduced the quantum of penalty from four per cent of the average annual turnover of the relevant three years to one per cent, observing that it would be "commensurate with and proportionate to the level of proved abusive conduct of AGL". <keyword id="139820" type="COMPANY" weightage="20" keywordseo="Competition-Commission">Competition Commission</keyword> of India (CCI) had on July 3, 2014 imposed a penalty of Rs 25.67 crore on AGL after finding its Gas Supply Agreement (GSA) imposing unfair conditions upon the complaints of <keyword id="487072" type="COMPANY" weightage="20" keywordseo="Faridabad-Industries-Association">Faridabad Industries Association</keyword>. CCI had also directed AGL to cease and desist from indulging in conduct found to be in contravention of the provisions of the Competition Act. This was challenged by AGL before the NCLAT, which is an appellate authority over the CCI. Faridabad Industries Association, an informant before CCI, also appealed before the tribunal. The <keyword id="6396354" type="ORGANIZATION" weightage="20" keywordseo="national-company-law-appellate-tribunal">National Company Law Appellate Tribunal</keyword> (NCLAT) also found AGL's GSA imposed unfair conditions on the industrial customers of Faridabad. "Having found that AGL, being the only supplier of natural gas and there being no gaseous substitute for the same, we find that AGL abused its dominant position qua the Industrial Customers by imposing unfair conditions upon the buyers under GSA as it existed in original form," the bench said. The tribunal observed that under clause 13 (Billing and Payment) of GSA, the terms and conditions provides that an excess payment by the buyer to the seller due to erroneous billing/ invoicing on the part of seller would give rise to no liability whatsoever on the part of the seller, including interest whereas a delayed payment by the buyer renders him liable to pay interest and there being no corresponding obligation on the part of AGL to pay interest in terms of Clause 13.7. Besides, the NCLAT also found some other clauses of GSA imposing unfair conditions. "Both the appeals are accordingly disposed of upholding the impugned order passed by the Commission holding AGL guilty of abuse of dominant position with the orders and directions passed by the Commission with modification in imposition of penalty on AGL as indicated hereinabove. "Balance amount of the penalty as reduced be deposited by AGL within thirty days of pronouncement of this judgment. All other orders/directions given by the Commission shall remain intact. The revised GSA as approved by us shall be made operational with immediate effect," the NCLAT said. The appellate tribunal noted that GSA was revised by AGL during the course of investigation, to make it more consumer friendly and to protect the interests of Industrial Consumers. "Keeping that in view we are of the considered opinion that reducing the penalty imposed on AGL from 4 per cent of the average annual turnover of the relevant three years to 1 per cent would be commensurate with and proportionate to the level of proved abusive conduct of AGL. "We are of the firm opinion that this reduction would meet the ends of justice and achieve the desired object of the statue in the peculiar facts and circumstances of the case," it said. Rai recently said the government has identified eight more pollution hotspots in addition to the existing 13 in the national capital and special teams will be deployed there to check pollution sources. He said the government has also decided to use suppressant powder to prevent dust pollution in the city. Dust suppressants could include chemical agents like calcium chloride, magnesium chloride, lignosulfonates and various polymers. These chemicals work by attracting and binding fine dust particles together, making them too heavy to become airborne. The Commission for Air Quality Management, a statutory body responsible for proactively implementing the pollution control plan known as the Graded Response Action Plan (GRAP), had last week directed authorities in the NCR to increase parking fees to discourage private transport and enhance the services of CNG or electric buses and metro trains amid a likely increase in pollution levels. This action is part of Stage II of GRAP which is implemented when Delhi's AQI is predicted to turn 'very poor'. GRAP categorises actions into four stages: Stage I 'poor' (AQI 201-300); Stage II 'very poor' (AQI 301-400); Stage III 'severe' (AQI 401-450); and Stage IV 'severe plus' (AQI &gt;450). A bench of justices <keyword id="4368791" type="General" weightage="20" keywordseo="L-Nageswara-Rao" source="Orion">L Nageswara Rao</keyword> and <keyword id="13194079" type="General" weightage="20" keywordseo="Pamidighantam-Sri-Narasimha" source="Orion">Pamidighantam Sri Narasimha</keyword> also directed the Haryana government not to take coercive action against employers. "We do not intend to deal with merits of matter as we propose to request the high court to decide expeditiously and not later than four weeks. Parties are directed not to seek adjournment and be present before court for fixing the schedule for hearing. "In the meanwhile, Haryana is directed not to take coercive action against employers. The impugned order passed by the high court is set aside as the high court has not given sufficient reasons for staying the legislation," the bench said. At the outset, Solicitor General Tushar Mehta, appearing for the Haryana government, informed the bench that similar laws have been passed in four states Andhra Pradesh, Jharkhand, Maharashtra and Haryana. The bench then asked Mehta what his instructions were as it had earlier sought to know whether parties concerned are agreeable that cases pertaining to quota in the private sector on the basis of domicile be considered together. "Do you want us to transfer all the pending cases back here? Should we decide or decide on the stay and send the matter back to the high court," the bench asked. The solicitor general suggested that the top court should examine the issue and meanwhile the Punjab and Haryana High Court order should be stayed. He said the law only applies to those who get a salary less than Rs 30,000 and it is not for high-paid jobs. He further submitted that the Haryana State Employment of Local Candidates Act, 2020 was a means to regulate migrants from settling in other states. Mehta referred to several judgements in which it has been held that there is presumption of legality of statute and it not stayed unless prima facie illegal. "We are only concerned with employment as we have migrant labour of over four crore in this country. We are first concerned with livelihood," the bench said. Senior advocate Dushyant Dave, appearing for the Faridabad Industries Association, submitted this has far-reaching consequences in the economic sector and the core issue is whether the government can impose reservation in the private sector on the basis of domicile. Dave said there has been application of mind in staying of the legislation and the high court was prima facie satisfied that the legislation is unconstitutional for which it was stayed. He said over 48,000 companies registered in Haryana would be put to suffering as they cannot employ anybody from outside the state from the date of commencement of the Act. "This is private sector reservation which has no basis in the Constitution... Is this the way the legislature can act? If this law is applicable for even a day, then there will be daily prosecutions. The law provides serious penalties. There are nine lakh companies," Dave said, adding that even associations can raise the issue of the public. The bench intervened, and said, "We are not on merits. What we are on is how the high court immediately delivered an interim order." Representing the Manesar Employees Association, senior advocate Shyam Divan said it will have a destructive effect on ongoing businesses. "It will have a profound impact on business...The division bench (of the high court) considered it correctly. Let this be treated as an interim order. Do not vacate this order...Assuming there is no stay to be granted, they ought not to take any coercive steps," Divan said. The order came on an appeal filed by the Haryana government challenging the Punjab and Haryana High Court order granting an interim stay on its law providing 75 per cent quota in private sector jobs for residents of the state. The high court on February 3 had granted an interim stay on the Haryana government law on pleas filed by various industry associations from Faridabad and other bodies in the state including in Gurugram. The high court admitted multiple petitions against the implementation of the Haryana State Employment of Local Candidates Act, 2020, the counsel of one of the petitioners had said. The Act provides 75 per cent reservation in the private sector to job seekers from the state and came into force from January 15 after being notified in November last year. It applies to jobs offering a maximum gross monthly salary or wages of Rs 30,000. The Act is applicable to employers of private sector companies, societies, trusts, limited liability partnership firms, partnership firms, and any person who employs 10 or more persons on salary, wages, or other remuneration for manufacturing, carrying on business, or rendering any service in Haryana. In March 2021, Haryana Governor Bandaru Dattatreya had given his assent to the Haryana State Employment of Local Candidates Bill, 2020. Haryana can enforce quota for locals in private jobs while Supreme Court hears the appeals against it

Mumbai, Apr 23 () The Indian automobile industry, already dented by a protracted slowdown before the COVID-19 pandemic struck, is now staring at a severe and prolonged disruption due to domestic and global lockdowns and supply chain interruptions, a report said on Thursday. Currently, India sources 80-85 per cent of components for all vehicle segments domestically, mainly from clusters such as the National Capital Region (NCR, including Gurgaon, Manesar, Faridabad and Greater Noida), Pune (including Chakan, Talegaon and Ranjangaon) in Maharashtra, Mysuru in Karnataka, and Sriperumbudur and Hosur in Tamil Nadu. The rest is sourced through imports. "If rising COVID-19 infections lead to the lockdown being extended again in NCR and Pune clusters, there would be a material disruption in component supplies to vehicle makers - both sourced locally and imported," Ajay Srinivasan, director at rating agency Crisil Research, said. "Any extension of lockdown would dramatically increase the sourcing risk for products such as cast engine parts and transmission drives because major capacities are located in the Pune and Delhi-NCR belts. Passenger vehicles and two-wheelers will be particularly impacted since these two clusters are their major source of components," he added. According to Crisil, while tractors, which have medium-to-high dependence on NCR and Tamil Nadu, also face supply risk, the commercial vehicles are unlikely to be affected much because they source across clusters. As for imports, India is dependent on China for critical components such as electronic control chips, engine control units and sensors. If logistics between the two countries remains disrupted for longer, it may translate into higher procurement costs due to airlifting, the rating agency said in its report. Also, imports of engine components and drive transmission from the US and Germany are likely to be adversely impacted if manufacturing in these regions takes time to bounce back. For other components, there is a moderate dependence on imports. These include alloy wheels, which are mostly imported from countries in south-east Asia and China, it said, adding the two-wheeler players dependent on such imports could be affected. Going beyond these counts, logistics is also expected to cause some anxiety for vehicle makers, which mostly use the JNPT, Chennai and Mundra ports, and have about 95 per cent of goods transported from ports to manufacturing plants through roadways, according to the report. "Congestion following slower clearance of goods at ports stemming from labour shortage and lack of significant uptake in export volumes are expected to push up shipping freight rates, and also extend the turnaround times via road. (Eds: updates with latest COVID tally)New Delhi, Apr 15 () Agriculture, construction, Information Technology and industrial units in the SEZs and rural areas are among some sectors where the coronavirus-induced lockdown restrictions will be lifted with safeguards from April 20 in a bid to kickstart the country's battered economy and reduce the distress caused to millions of people. As the second phase of the national lockdown came into force on Wednesday, the Ministry of Home Affairs(MHA) unveiled the 'consolidated revised guidelines' relaxing the curbs with conditions. The relaxations lay strict emphasis on social distancing with a warning by Union Home Secretary Ajay Bhalla that it will be withdrawn if there is any violation of the lockdown norms, as coronavirus cases crossed 1,000 for the second consecutive day on Wednesday. The 40-day lockdown period ends on May 3. The total number of COVID-19 infections crossed 12,000 while the death toll surpassed 400, according to official data. As part of series of restrictions, spitting in public places has been prohibited and it will be a punishable offence with a fine under the Disaster Management Act. Any violation may result in imprisonment of up to one year or a fine, or both. Wearing of masks in public places has also been made compulsory and sale of liquor, gutka and tobacco totally banned. The guidelines come a day after Prime Minister Narendra Modi announced the extension of the three-week nationwide lockdown for another 19 days till May 3 to battle the coronavirus pandemic. He had also indicated conditional easing of some curbs after April 20 in areas which are not hotspots to allow some "select necessary activities". The Union Health Ministry has identified 170 districts as COVID-19 hotspots and 207 districts as potential hotspots, officials said, reiterating yet again there has been no community transmission of the disease in the country so far. The permitted activities from April 20 are aimed at ensuring agricultural and related activities remain fully functional, rural economy functions with maximum efficiency, employment opportunities are created for daily wage earners and other members of labour force, select industrial activities are allowed to resume their operations, with safeguards and mandatory standard operating protocols and digital economy, the MHA said. Addressing the daily briefing, Lav Agarwal, Joint Secretary in the Ministry of Health, said states have been asked to classify districts which have reported a higher number of cases as hotspots, the districts where cases have been reported as non-hotspots, and green zones where no cases have been reported. "Hotspots are those districts which are reporting more number of cases or where the rate of growth of COVID-19 cases is high," Agarwal said, adding a detailed direction has been issued to states stating consolidated efforts are required to utilise this period of lockdown to curb the spread of the virus. Cabinet Secretary Rajiv Gauba held a video conference with all chief secretaries, DGPs, health secretaries, collectors, SPs, municipal commissioners and CMOs where hotspots were discussed and orientation on field level implementation of containment strategy was given. "They were told about large outbreak containment strategies, cluster containment strategies. Delineation of buffer and containment zone, parameter mapping, defining of entry and exit point were also discussed in detail," Agarwal said. The death toll due to coronavirus rose to 392 with 39 fatalities reported since Tuesday evening, while the number of cases saw a jump of 1,118 to go up to 11,933 on Wednesday, according to the Union Health Ministry. As many as 1,343 people were cured and discharged, and one has migrated, it said. A single day highest increase of 1,463 cases was recorded on Tuesday. A tally based on updated reports from the states showed the number of cases was 12,220 with 1,373 patients recovering. The death toll touched 417. Data obtained from the Indian Council of Medical Research (ICMR) said that till April 14 the number of samples tested stood at 2,44,893, an increase of 27,339 from the corresponding figure till the previous day (2,17,554). Experts feel the figures are modest for a country of the size of 1.3 billion and "much more number of tests" are needed to combat the COVID-19 outbreak in the country. "Given the massive size of our population, the number of tests needs to be ramped up and should be conducted more rigorously. We need to do effective contact tracing and test them so that those people in turn do not infect others," Dr Ravi Shekhar Jha, Senior Consultant and Head of the Department of Pulmonology at Fortis Escorts, Faridabad, told . The MHA guidelines broadly lists activities allowed from April 20 and restrictions till May 3. The exemptions given will not be applicable in COVID-19 hotspots/ containment zones and the State/UT governments shall not dilute guidelines in any manner but may impose stricter measures as per local requirements, according to the MHA. All work places which have been allowed to function shall have adequate arrangements for temperature screening and providing sanitizers at convenient places. India Inc backed the government's move to allow industrial units located in rural areas to function, and said it will ensure preventive measures for COVID-19 while restarting the economic activities. "The guidelines will boost the country's economic growth in a slow but steady manner," said Jaxay Shah, National Chairman of CREDAI, an apex body of private real estate developers associations. Services provided by self-employed electrician, Information Technology(IT) system repairs, plumbers, motor mechanics, carpenters will be allowed giving relief to people looking for such facilities. Laying out the dos and don'ts, the guidelines stated that all work places should make adequate arrangements for temperature screening and must provide sanitisers at convenient places. Educational institutions, coaching centres, domestic, international air travel, train services will remain suspended, the ministry said. Public places such as cinema halls, malls, shopping complexes, gymnasiums, sports complexes, swimming pools and bars will be shut too till May 3. All social, political, sports, religious functions, religious places, places of worship will also be closed till then, according to the guidelines. However, highway 'dhaba' (eateries), truck repairing shops, call centres for government activities will remain open from April 20. Both government and private industries and industrial establishments "operating in rural areas, i.e. outside the limits of municipal corporations and municipalities" will be allowed to operate, according to the guidelines. Manufacturing, industrial units with access control in Special Economic Zones(SEZs), export oriented units, industrial estates, industrial townships will also be allowed. Activities permitted five days from now include those related to agricultural and the horticultural sectors, farmers and farm workers in the field as well as procurement of agri products. Shops selling agriculture machinery and those dealing with spare parts, supply chains and repairs as well as 'custom hiring centres' related to farm machinery will also be open from that day. Units manufacturing drugs, pharmaceuticals, medical devices, medical infrastructure, including manufacture of ambulances, will also open. Noting that digital economy is critical to services sector, the ministry said e-commerce operations, operations of IT and IT enabled services(ITeS), data and call centres for Government activities, and online teaching and distance learning are all permitted. The IT and ITeS sector will be allowed to operate with up to 50 per cent strength. The home ministry said permitted industries must make arrangements for stay of workers within their premises or adjacent buildings by observing social distancing norms. The transportation of workers to workplace would also have to be arranged by the employers in dedicated transport by ensuring social distancing. The guidelines also stated that grocery stores, fruits, vegetables shops/ carts, milk booths, poultry, meat and fish shop will remain open during the lockdown period. However, highway 'dhaba' (eateries), truck repairing shops, call centres for government activities will remain open from April 20. Both government and private industries and industrial establishments "operating in rural areas, i.e. outside the limits of municipal corporations and municipalities" will be allowed to operate, according to the guidelines. Manufacturing, industrial units with access control in Special Economic Zones(SEZs), export oriented units, industrial estates, industrial townships will also be allowed.Activities permitted five days from now include those related to agricultural and the horticultural sectors, farmers and farm workers in the field as well as procurement of agri products.Shops selling agriculture machinery and those dealing with spare parts, supply chains and repairs as well as 'custom hiring centres' related to farm machinery will also be open from that day.Units manufacturing drugs, pharmaceuticals, medical devices, medical infrastructure, including manufacture of ambulances, will also open. Noting that digital economy is critical to services sector, the ministry said e-commerce operations, operations of IT and IT enabled services(ITeS), data and call centres for Government activities, and online teaching and distance learning are all permitted. The IT and ITeS sector will be allowed to operate with up to 50 per cent strength. The home ministry said permitted industries must make arrangements for stay of workers within their premises or adjacent buildings by observing social distancing norms. The transportation of workers to workplace would also have to be arranged by the employers in dedicated transport by ensuring social distancing. The guidelines stated that grocery stores, fruits, vegetables shops/ carts, milk booths, poultry, meat and fish shop will remain open during the lockdown.
