Online retailers dealing with food products or its business will have register under the Food Safety and Standards Act 2006 with the food regulator <keyword id="154680" type="ORGANIZATION" weightage="100" keywordseo="FSSAI">FSSAI</keyword>, regulator's Chairman Ashish Bahuguna told PTI. 

	"These e-commerce players at their platforms are also selling food products or dealing in one or another form of food business. And food and food businesses come under the ambit of FSSAI so they have to just register," he said. 
 

	The regulator said that without registration it would be "illegal" for these companies to deal in food products or food business and "an appropriate action as per the Food Safety and Standards law could also be explored" for violation. 
 

	He also informed that the Food Safety and Standards Authority of India (FSSAI) had invited these companies and held a meeting in this regard. 
 In coming days, food specific startups Foodpanda India, Zomato, Swiggy and Peppertap and e-commerce giants like <keyword id="6354742" type="COMPANY" weightage="100" keywordseo="Flipkart">Flipkart</keyword>, <keyword id="541988" type="COMPANY" weightage="100" keywordseo="SnapDeal">Snapdeal</keyword> and Amazon may have to register with the regulator. 

	FSSAI CEO Pawan Agarwal said registering with the FSSAI will also be in the interest of ecommerce players. 
 

	"By following the regulations of the food safety act, the e-commerce players can ensure the quality of food products or even services to their consumers. And which will help these companies also," Agarwal told PTI. 
 

	Agarwal added that there transactions are electronic but if they are selling food products or dealing in food business, then that comes under the FSSAI ambit. 
 

	FSSAI has been established under the Food Safety and Standards Act, 2006 that have hitherto handled food related issues.

Online food retailers will have to register with FSSAI now

New Delhi, Jan 9 () Food safety regulator FSSAI on Thursday appealed food business operators (FBOs) to be aware of fake websites being operated for providing registration and licensing services.
 The Food Safety and Standards Authority of India (FSSAI) also said it will not be responsible for loss or damage suffered by the FBO on account of deficiency of services by such websites.
 FBOs can apply for licence or registration only through the FSSAI portal.
 "FSSAI appeals to public to exercise care and caution while applying for FSSAI licence and registration as food business operator. Only FSSAI's licensing portal should be used for registration/ license application," FSSAI Chief Executive Officer Pawan Agarwal said in a statement.
 In case of need for any help, applicants may approach the regional offices of FSSAI or jurisdictional designated officer or food safety officer for guidance, details of which are available at www.fssai.gov.in, he added.
 FSSAI said it has come to its notice that a number of websites are operating with the domain name comprising the word 'FSSAI' along with suffix or affix 'registration', 'license', etc. Some of such websites also use the logo of FSSAI.
 The regulator has not authorised any entity to register its website with the domain name comprising the word 'FSSAI' or to use its name and logo, or represent FSSAI as such, it said.
 In the event that any one intends to avail the services of any such online websites for registration or licence as food business operator, it is advisable that background check of such third party should be carried out with regard to authenticity or reliability of its services, it added.
 FSSAI has also launched a Food Safety Mitra Scheme wherein Digital Mitras are being trained to assist FBOs for online filings related to licensing and registration, at nominal charges. LUX HRS

FSSAI asks food operators to be aware of fake websites

India’s food regulator, the <a href="http://www.businessinsider.in/searchresult.cms?query=Food+Safety+and+Standards+Authority+of+India">Food Safety and Standards Authority of India</a> (FSSAI) has rejected product approval applications of Tata Starbucks, Kellogg and McCain due to lack of sufficient supporting documents. 
 
"FSSAI has rejected product approval applications of <a href="http://www.businessinsider.in/searchresult.cms?query=Tata+Starbucks">Tata Starbucks</a>, <a href="http://www.businessinsider.in/searchresult.cms?query=Kellogg">Kellogg</a> and <a href="http://www.businessinsider.in/searchresult.cms?query=McCain">McCain</a> due to lack of sufficient supporting documents for safety/risk assessment," Minister of state for Health Shripad Naik said. 
 
While 34 products of Tata Starbucks have been rejected which included honey vanilla flavoured syrup, sea salt and red bean sauce, two products of Kelloggs including Kellogg's special K Red Berries and special K Oats and Honey have also been rejected. 
 
The only product of McCain Foods India which was rejected was McCain Battered Pepper and Cheese Bites. 
 
The Minister said that the primary responsibility of FSSAI is to lay down science based food standards, make regulations, regulate imports and undertake coordination with states and UTs on food safety. 
 
"In cases where samples are found to be non-compliant, action is taken as per provisions of the FSS Act 2006 by the state authorities or the FSSAI," Naik added.

Tata Starbucks, Kellogg, McCain fail FSSAI test

The Food Safety &amp; Standards Authority of India (<keyword id="154680" type="ORGANIZATION" weightage="80" keywordseo="FSSAI">FSSAI</keyword>) along with several states banned <keyword id="75190" type="CITY" weightage="80" keywordseo="Nestle">Nestle</keyword>'s <keyword id="6369404" type="PERSON" weightage="80" keywordseo="Maggi">Maggi</keyword> instant noodles in June, but the company did not get some of the test reports based on which authorities banned the popular noodles in the country, a company executive told the Economic Times. 

	Moreover some of the reports were not shared with Nestle before the announcement of the ban and they have now started trickling in, he added. 
 

	A company spokesperson revealed that no test reports were sent to it before June 5, 2015 when the ban was announced, except one from a Kolkata laboratory for a single sample of Maggi noodles sent by the Uttar Pradesh FDA in April. 
 

	"...and for that report, we had made our representation on the improper testing procedure," the spokesperson said in an email, responding to questions from ET. 
 

	The ban proved to be detrimental for the company. Maggi raked in over Rs 2,000 crore in annual revenue for the company. While that has stopped now, it spent Rs 320 crore to recall the product. 
 

	Global valuation consultancy Brand Finance estimates another Rs 1,270 crore in brand loss. Nestle claims it did not get a chance to explain its stand before FSSAI and state authorities that banned the product alleging excessive levels of lead in it and mislabeling on the pack. 
 

	According to industry experts, it was unfair not to share the test reports with the company before taking such an action. 
 

	Moreover, the delay in sharing results raised questions on the test procedures, since the UK, Singapore and Canada have found Maggi imported from India safe to eat. 
 "The way the matter played out was unfair to Nestle. The company wasn't given a chance to prove themselves," said <keyword id="2867937" type="UNKNOWN" weightage="80" keywordseo="Ashwin-Bhadri">Ashwin Bhadri</keyword>, chief executive at <keyword id="1459500" type="COMPANY" weightage="60" keywordseo="Equinox-Labs">Equinox Labs</keyword>, which specialises in food testing and works closely with FSSAI on food safety compliance. 

	"Unfortunately, the issue isn't just about Maggi anymore. The controversy has had a global impact and the world is looking at India brands through the scanner,” he added. 
 

	Nestle executives raised the issue at a meeting they had with FSSAI officials on Wednesday. 
 

	An FSSAI representative present at the meeting said ideally the company should have received a letter informing it about the product not clearing the tests done and the reports of the tests should also have been shared with it. 
 

	Nestle announced that it was withdrawing Maggi noodles on June 5. But, on the same day FSSAI ordered the company to recall and stop manufacturing the product. 
 The company later approached the <keyword id="48485" type="ORGANIZATION" weightage="80" keywordseo="Bombay-high-court">Bombay High Court</keyword> to seek clarity on the interpretation of the Food Safety and Standards Act.

Foul play with Maggi? Nestle says FSSAI didn’t share test results with it

The agreement was signed in the presence of <keyword id="11579676" type="UNKNOWN" weightage="20" keywordseo="shri-arun-singhal">Shri Arun Singhal</keyword>, CEO, FSSAI, and Professor Bejon Misra, Adviser, Public Affairs, ASCI, on July 1st. As per the agreement, ASCI will identify advertisements which prima facie violate provisions of Food Safety And Standards (Advertising And Claims) Regulations, 2018, and FSSAI would further investigate these. Under the agreement, ASCI will set up a three-member expert panel to evaluate F&amp;B advertising identified by the ASCI monitoring team. There has been a marked increase in the number of complaints against F&amp;B ads during the COVID-19 pandemic. In the last financial year (FY) ASCI has processed a total number of 285 complaints compared to 175 in FY 2019-20. So, claims by F&amp;B brands, particularly those related to health and nutrition, are under greater scrutiny. Food and health continue to be important focus areas for ASCI. With this association, ASCI further strengthens its 360-degree approach of protecting consumers as well as guiding brands, agencies, and influencers towards greater responsibility. Manisha Kapoor, Secretary-General, ASCI, said: “With this agreement, ASCI will intensify its scrutiny of the F&amp;B sector. We will tap our National Advertising Monitoring Service, which monitors over 900 TV channels and publications, and over 3,000 websites. Besides national brands, we will examine regional and local ones. Our experts, with decades of experience in the F&amp;B sector, will shortlist those advertisements that require further scrutiny by FSSAI.” Subhash Kamath, Chairman, ASCI, added: “This is a significant collaboration. The common goal of consumer protection drives us all to share skills, expertise and resources in the most effective way to curb the menace of misleading advertising.”

ASCI and FSSAI join hands to curb misleading claims in food and beverage advertisements

New Delhi, Dec 31 () Food safety regulator FSSAI on Tuesday said it will spend Rs 20 crore to procure rapid food testing kits or devices for state-level field officers across the country.
 So far, the regulator has approved 30 rapid food testing kits/devices, which ensure faster, better, and cheaper real-time testing of food based on the FSSAI regulations finalised this year, it said.
 "There is a market potential of Rs 1,000 crore for such kits/devices in India alone. Wider use of rapid food testing kits and devices for food testing would be a game changer for India in 2020 and build greater public confidence in food available in the marketplace," Food Safety and Standard Authority of India (FSSAI) CEO Pawan Agarwal said.
 As of now, over Rs 5 crore has been spent on 30 devices which can provide quicker and validated results for tests conducted on different food products such as milk and edible oils, amongst others, he said in a statement.
 "The FSSAI would spend over Rs 20 crore and procure rapid food testing kits and devices. These would be provided to field officers through the state governments," he added.
 According to the FSSAI, only two out of 30 rapid kits are indigenously manufactured, rest are all imported despite the fact that many research and scientific institutions are engaged in development of such kits and devices.
 Steps have been initiated to make these devices available on government eProcurement marketplace (GeM) portal so that further purchase can be made by state governments and local bodies on their own.
 The FSSAI has initiated steps so that indigenously developed kits/devices are validated and approved under the FSSAI regulations on a fast track basis, it added.
 Aggarwal hoped that various States would also buy such kits/devices from the GeM portal to make them widely available with the enforcement officials.
 Once, such kits and devices are widely used for regulatory purposes, food industry would also begin to use them for internal quality assurance and quality control purposes, he said. LUX LUX MR

FSSAI to spend Rs 20cr for procuring food testing kits

To prevent food wastage, Food regulator <keyword id="154680" type="ORGANIZATION" weightage="20" keywordseo="FSSAI">FSSAI</keyword> and <keyword id="6372077" type="ORGANIZATION" weightage="20" keywordseo="nasscom">Nasscom</keyword> Foundation have joined hands to a develop an app and set up a 24x7 helpline number to connect donors with surplus edibles to food distribution organisations. "India will soon have access to a common help-line and a mobile application 'Food Donation in India' to donate food to the needy. FSSAI and NASSCOM Foundation have signed an MoU today to jointly build a technology platform for Food Donation in India," FSSAI said in a statement. The platform will also facilitate registration of surplus food distribution organisations, and initially, the network of 81 such organizations across PAN India, known as the Indian Food Sharing Alliance (IFSA) will be a part of this platform, it said.
 The solution, FSSAI said, will provide an easy accessible platform that will cater to different stakeholders like food businesses, hoteliers, caterers, individuals etc and facilitate food donations in any part of the country.
 FSSAI CEO Pawan Agarwal said that this would definitely provide a recognition to the organisations involved in surplus food distribution and would help in reducing the wastage of food in the country through food donation.
 Ashok Pamidi, CEO, Nasscom Foundation said the collaboration is a significant step in the direction of leveraging tech for solutions and the foundation hopes more such engagements in future.

 On June 4, a team led by <keyword id="75190" type="CITY" weightage="20" keywordseo="Nestle">Nestle</keyword> CEO <keyword id="225478" type="PERSON" weightage="20" keywordseo="Paul-Bulcke">Paul Bulcke</keyword> met government officials including Malik and health secretary BP Sharma. Nestle tried hard to convince FSSAI official that Maggi was safe to consume, but FSSAI, which played a major role in this controversy, lashed out the Swiss multinational food and beverage company and imposed a ban on the product. This information was revealed in an Economic Times report. 
 The decision, however, has been challenged by the <keyword id="34523" type="CITY" weightage="20" keywordseo="fmcg">FMCG</keyword> giant Nestle in <keyword id="48485" type="ORGANIZATION" weightage="20" keywordseo="Bombay-high-court">Bombay High Court</keyword>. 
 
Yudhvir Singh Malik, considered as a tough taskmaster by his FSSAI colleagues, is the man who assumed charge in October 2014 and just after that FSSAI’s various meetings with overseas delegations have acquired the status of formal engagements. And inter-ministerial meetings have been taking place more frequently, owing to which the office of the regulator has acquired a new energy. 
 
According to Malik’s colleague, "The order issued against Nestle -which reasons out the problems, explains Nestle's grounds of defence and logically details why it is not acceptable -has his (Malik’s) stamp all over. I am sure that he has personally drafted it word by word." 
 
As mentioned in the financial daily, it was after Malik took over the list of hundreds of products rejected since 2012 was drawn up; it was posted on the FSSAI website in April. A clearer regulatory pathway for product approval is being drawn up. A recall mechanism for defective food, drafted in large parts in 2011, has been sent to the World Trade Organisation for its comments and inputs from member countries. 
 
Malik has inherited several labeling wrangles from his predecessors, mostly starting in 2013. These include disputes with imported chocolate brands such as Godiva, Guylian, Lindt and Mars besides liquor makers such as Diageo and Pernod Ricard. 
 
Last month, Malik told stakeholders that it would be unfair to draw a parallel between India's food regulatory t system and those of the US and the European Union (EU) because consumer awareness is higher in those markets. 
 
Besides this, more responsive legal systems overseas compel industry to self-regulate. He also said that Indian consumers tend to be less skeptical than those in more mature markets.

Meet Yudhvir Singh Malik, the man who led the nationwide Maggi Ban

New Delhi, Nov 25 () Food regulator FSSAI on Monday said that over 1.06 lakh food samples were analysed last fiscal, of which 3.7 per cent were found to be unsafe and 15.8 per cent sub-standard.
 The Food Safety and Standards Authority of India (FSSAI) reported 36 per cent rise in civil cases to 2,813 and 86 per cent increase in criminal cases to 18,550, it said in a statement.
 There has been a 67 per cent increase in the number of cases where penalties were imposed to 12,727. A total amount of Rs 32.58 crore has been realised during 2018-19, up 23 per cent from previous year. There have been 701 convictions in criminal cases.
 FSSAI released the data on enforcement efforts by states/UTs in the country. The released data includes samples analysed, non-conforming samples, cases launched, convictions and penalties by states/UTs during the year 2018-19
 "During the year 2018-19, a total of 1,06,459 samples were analysed. While 3.7 pc of these samples were found to be unsafe, 15.8 pc were found to be sub-standard and 9 pc samples had labelling defects," FSSAI said in a statement.
 There has been a 7 per cent increase in the number of samples analysed during 2018-19 as compared to 2017-18 and "25 per cent more samples were found non-conforming compared to the previous year", the regulator said, adding that this indicates there has been better targeting of enforcement efforts by states/UTs.
 "More rigorous enforcement by states is essential to build public trust in food," FSSAI CEO Pawan Agarwal said. 
 He admitted that public trust has been eroded in recent times due to fake news, creating widespread perception of large-scale adulteration in the country.
 FSSAI is working with states and UTs, particularly with weaker ones in this regard, he added.
 "For this, FSSAI is increasing the capacity of state food laboratories and enabling use of private food labs for testing food samples. Enforcement efforts have to be better targeted and preceded by surveillance efforts to identify hotspots and problem areas," Agarwal said.
 Uttar Pradesh, Gujarat, Kerala, Madhya Pradesh, Punjab, Tamil Nadu, Bihar, Jammu &amp; Kashmir, Delhi and Chandigarh performed well, while states that have performed poorly include Chhattisgarh, Himachal Pradesh, Karnataka, Assam, Jharkhand, Odisha, Rajasthan, West Bengal, Telengana, and Uttarakhand.

In recent news published in The Economic Times, Tata Starbucks Pvt Ltd, a joint venture of <keyword id="320278" type="COMPANY" weightage="20" keywordseo="Tata-Global-Beverages-Ltd">Tata Global Beverages Ltd</keyword> and <keyword id="1115459" type="COMPANY" weightage="20" keywordseo="Starbucks-Coffee-Co">Starbucks Coffee Co</keyword>, said it is "diligently working with the <keyword id="109212" type="ORGANIZATION" weightage="20" keywordseo="Food-Safety">Food Safety</keyword> and <keyword id="179673" type="ORGANIZATION" weightage="20" keywordseo="Standards-Authority-of-India">Standards Authority of India</keyword> (FSSAI) to provide the technical information relating to our pending ingredient applications that they have requested". 
 
"In line with the FSSAI guidelines, while we finalise the documentation necessary to complete these applications, Tata Starbucks has initiated the suspension of applicable ingredients from certain products served in our India stores," the company said in a regulatory filing. 
 
It however did not give details of the ingredients it is removing pending FSSAI approval. 
 
The company said it will use other FSSAI-approved ingredients that meet Starbucks global standards so as to enable it to continue offering its range of beverages, informs the financial daily. 
 
"These actions ensure that we are able to continue delivering the unique Starbucks Experience to our customers without disruption," it said. 
 
The company maintained that all its imported ingredients, including the ones it is suspending, were "safe and meet the safety standards in over 65 countries where Starbucks operates." 
 
"All of these imported ingredients received the then applicable product testing and safety authorisations when they were imported into India," the statement said. 
 
Starbucks, it said, has "the highest standards for the safety and quality of the beverages and food" offered to customers. "We are committed to complying with the regulations in every market we operate in."

Starbucks can only use ingredients approved by FSSAI in India

New Delhi, Mar 31 () Food regulator FSSAI on Tuesday declared import clearance of food items and testing at notified labs as essential services during the lockdown period. "The Food Safety &amp; Standards Authority (FSSAI) has classified the import clearance of food items and functioning of notified food testing laboratories (including National Food Labs) under Essential Services during the COVID-19," it said in a statement. All personnel who are assigned the charge of these essential services are required to be available in office on all working days from Monday to Friday between 9:30 AM to 6:00 PM in order to facilitate the trade as well as ensure smoother operation of related services across the country.The FSSAI has its Offices at six locations namely Chennai, Kolkata, Mumbai, Delhi, Cochin and Tuticorinand. These offices are fully operational for scrutiny of applications, visual inspection and sampling for import clearance to ensure expeditious processing of applications and timely issuance of NOC. "FSSAI is keeping a close watch on the situation. It will continue to assist food importers as well as ensure regular supervision and testing of food items and will take appropriate steps to ensure the safety of food products," the statement said. FSSAI declares import clearance of food items, testing at notified labs as essential services

"We are collecting samples (of Nestle's Cerelac baby cereals) from across the country. It will take 15-20 days to complete the process," Food Safety and Standards Authority (FSSAI) CEO G Kamala Vardhana Rao told PTI on the sidelines of an Assocham event on food fortification. FSSAI is a statutory body under the administration of the Ministry of Health and Family Welfare. The move comes following concerns about alleged high sugar content in Nestle's baby food products expressed by both the consumer affairs ministry and the National Commission for Protection of Child Rights (NCPCR) after taking note of a global report published by Swiss NGO Public Eye. The global report has claimed that Nestle sold baby products with higher sugar content in less developed South Asian countries including India, Africa and Latin American nations as compared to markets in Europe. However, Nestle India has maintained that it never compromises on compliance and it has reduced added sugar in baby food products in India by up to 30 per cent depending on variants over the past five years. Earlier, addressing the Assocham event, the FSSAI CEO highlighted the importance of food fortification for human health and called for fortification beyond rice to include millets and other alternative foods. FMCG firms have introduced varieties of millet-based products in the last few years and they can further expand the basket of nutritional foods in the country, he added. The CEO also unveiled an Assocham's knowledge report 'Fortifying India's Future: Significance of Food Fortification and Nutrition' on the occasion. New Delhi, Apr 15 () Food regulator FSSAI on Wednesday issued guidelines related to hygiene and safety that food business operators (FBOs) need to follow during the coronavirus disease outbreak. In its 14-page 'Food Hygiene and Safety Guidelines for food businesses during coronavirus disease (COVID-19) pandemic', the FSSAI has suggested various measures that need to be taken by the FBOs. "These specific measures, detailed in the document, include maintaining high levels of personal hygiene; excluding COVID-19 infected persons from the operations; practicing social distancing; and appropriate cleaning/sanitisation of the food operations' premises, food contact materials etc," FSSAI said in a statement. As per the guidelines, food business owners or employers should have a COVID 19 screening protocol in place to screen all personnel entering the premises. Those with temperature more than 99 degree Fahrenheit and/or flu like symptoms should not be allowed to enter establishments. Large food businesses have been asked to set up a local emergency response team to handle suspected coronavirus case. The document is primarily intended for all types of food businesses including food service, transport and retail operations. The guidance has been developed based on the best practices currently recognized and adopted internationally.Although there is currently no evidence that food is a likely source or route of transmission of COVID-19 virus, it is important to take all precautions to prevent any possibility of person to person spread of COVID-19 infection during food business operations, the statement said. The FSSAI said that FBOs are already following various hygienic and sanitary measures as per Schedule IV of Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011. "Nevertheless, COVID-19 situation demands implementation of some additional focussed measures mainly to prevent human-to-human spread of the disease in food business operations and also to reduce the likelihood of contamination of various materials in contact with food such as equipment, packaging materials etc," the statement said.In view of this, the Food Safety and Standards Authority of India (FSSAI) has developed a detailed guidance on specific measures that can be taken by various types of food businesses in addition to those specified under the FSS Act, to prevent spread of COVID-19. "Coronavirus disease (COVID-19), which is caused by a new type of coronavirus, has been declared a pandemic by the World Health Organization (WHO). The disease is transmitted from person to person primarily through close contact with one another, and respiratory droplets produced when an infected person coughs or sneezes. In the absence of a known cure for the disease, all efforts are towards prevention of the spread of this disease from person to person," FSSAI noted. MJH MR
