The <keyword id="65281" type="COMPANY" weightage="20" keywordseo="Election-Commission-of-India">Election Commission of India</keyword> or ECI is a constitutional body entrusted with the responsibility of administering the elections in India. Appointment and Tenure The President appoints the Chief Election Commissioner and Election Commissioners. The tenure of these officers is six years or up to 65 years of age, whichever is earlier. The status and pay of these officers is similar to what is enjoyed by the Judges of the Supreme Court. The election Commissioners or the regional commissioners can be removed from office only if recommended by the CEC. The CEC can be removed only by the President of India supported by a resolution passed in both the houses of the parliament with special majority on the grounds of incapacity or misbehavior. Role of Election Commission In organizing the elections of the largest democracy of the world, the Election Commission of India plays a crucial and decisive role. The Election Commission in India has the prime responsibility to ensure the conduct of free and fair elections in the country. Towards this end, the Commission has to implement the norms and Model Code of Conduct. Since the role of the Election Commission will need a high degree of independence and autonomy, the Constitution has empowered this body with the power to supervise the political bodies and candidates. It can take the action it deems appropriate in case of any violations. Responding to the BJP’s complaint, the EC replied, “There does not seem to be any violation of the model code of conduct by the government of Haryana in the matter after the coming into force of the model code of conduct from September 12.” 
 
The EC said it had examined the allegations of violation of the model code of conduct and asked for reports from the concerned state departments. “However, in case you have any further or additional information in this regard, you may furnish the same to the commission,” it said. 
 
The report submitted by the financial commissioner, Town and Country Planning Department, said, “The decision on the request for renewal and transfer of licence in favour of DLF Ltd is pending in the department since October 2012 for want of clarification regarding the issue of ownership. The department has sought this clarification from the Director General, Consolidation of Land Holdings and Land Records, which is yet to be received and hence the request for transfer and renewal of licence is pending in the department on which no action has been taken since then.” 
 
“It is clarified that neither any allegation about any action taken by the Town and Country Planning Department has been made in the news reports, nor any action on the subject... has been taken in the Town &amp; Country Planning Department, either during the period of model code of conduct or before imposition of such code,” the report added.

Election Commission of India launches ‘Voter Turnout’ mobile app

After a detailed meeting on the rescheduling of the poll date, the Commission changed the poll schedule as announced by it on January 8. According to the new schedule for Punjab assembly polls, now the date of notification will be January 25 (Tuesday), 2022, last date of nomination will be January 22, 2022 (Tuesday), date of scrutiny - February 2, 2022 (Wednesday), date of withdrawal would be February 4 (Friday) and date of polling will be February 20, 2022 (Sunday). Counting of Votes will be taken up on March 10, 2022 (Thursday). The Election Commission received several representations from State Government, Political Parties and other organizations drawing attention regarding movement of a large number of devotees from Punjab to Varanasi for participation in Sri Guru Ravidas Ji Jayanti celebrations, which is observed on February 16, 2022, the EC said in a statement. It was brought to the notice of the Commission that a large number of devotees start moving for Varanasi around a week before the day of celebration and keeping the poll day on February 14, 2022 will deprive a large number of electors from voting. In view of this, they had requested to shift the poll date a few days after February 16, 2022, the EC officials said. "Commission has also taken inputs from State Government and Chief Electoral Officer of Punjab in this regard and after considering these new facts emerging out of these representations, inputs from the State Government and Chief Electoral Officer, past precedence and all facts and circumstances in the matter, now Commission has d<keyword id="65910" type="General" weightage="20" keywordseo="ECI" source="Orion">eci</keyword>ded to reschedule the General Elections to Legislative Assembly of Punjab," the ECI said in a statement. Earlier, the ruling Congress party, the BJP and the Aam Aadmi Party had requested the Commission to defer the polling on February 14 as it is close to the Sri Guru Ravidas Jayanti on February 16. Submitting a written request by the Congress Party on January 13, it said that over 20 lakh of Schedule Caste voters go to the religious visit to the places related to Sant Ravidas ji. The Party further said that a sizable number of SC voters visit Varanasi from February 10 to 16 every year, therefore, the scheduled date for the poll in Punjab should be postponed till Ravidas Jayanti. Later the BJP and Aam Aadmi party also made a similar request to the EC, reiterating the same reason stating that many of the voters will either miss their religious trip or skip voting on February 14. Election Commission postpones polling day in Punjab to February 20

New Delhi, The <keyword id="40807" type="General" weightage="20" keywordseo="election-commission" source="Orion">Election Commission</keyword> (EC) issued a show-cause notice to Congress leader Rahul Gandhi on Thursday for his "panauti", "pickpocket" and "loan waiver for the super rich" jibes at Prime Minister Narendra Modi, and asked him to respond by Saturday. The ruling Bharatiya Janata Party (BJP) had approached the poll panel against the <keyword id="6316776" type="General" weightage="20" keywordseo="former-congress-president" source="Orion">former Congress president</keyword>, saying it was "unbecoming" of a "very senior leader" to use such language. The EC reminded Gandhi that the Model Code of Conduct prohibits leaders from making unverified allegations against political rivals. The Congress leader used those words targeting the prime minister at recent rallies in poll-bound Rajasthan. In its representation to the EC, the BJP had asserted that the allegation of grant of waivers to industrialists of Rs 14,00,000 crore over the last nine years was "not borne out on facts". The EC notice said the expression "panauti" ex-facie falls in the equity of the prohibition of section 123 of the Representation of the People Act, dealing with corrupt practices. Clause 2, sub section (ii) of section 123 states that any person who induces or attempts to induce a candidate or an elector to believe that he, or any person in whom he is interested, will become or will be rendered an object of divine displeasure or spiritual censure, shall be deemed to interfere with the free exercise of the electoral right of such a candidate or elector, the notice reminded Gandhi. The Congress leader had used the "panauti" barb against Modi in a poll speech in Rajasthan as the prime minister had attended the World Cup cricket final that India lost to Australia after 10 consecutive wins in the tournament. A Hindi slang, "panauti" loosely refers to someone who brings bad luck. The former Congress president took the "pickpocket" dig at Modi during a poll speech on Wednesday, alleging that the prime minister diverts people's attention while industrialist Gautam Adani picks their pockets. This is how pickpockets operate, he had alleged. The notice also recalled a general advisory issued by the EC, in which the poll panel had expressed concerns at the "plummeting level of political discourse" during electioneering. The commission also told Gandhi about a Supreme Court observation that if freedom of speech and expression is protected by Article 19(1)(a) of the Constitution, the right to reputation is also considered to be an inextricable part of the right to life protected by Article 21 and "balancing these two rights is a constitutional necessity". "Accordingly, you are requested to provide your explanation on the allegation made and to show causes as to why action as deemed fit for alleged violation of Model Code of Conduct and relevant penal provisions is not initiated by the commission. Wisconsin elections commission: Recount expected to uphold Trump's win

Bypolls to one Lok Sabha and 56 assembly seats on November 3 and 7: Election Commission

Polling began amid tight security arrangements for 94 assembly constituencies in 17 districts of Bihar from 7 am on Tuesday for the second phase of assembly elections. Foolproof security arrangements have been made for voting as well as to ensure that social distancing norms are in place in the times of a pandemic. Bihar Election 2020: Polling begins for 94 seats in Bihar amid tight security

As the model code of conduct is in place ahead of assembly polls next month, the Delhi Public Works Department has asked all its chief engineers to provide list of those project works which have already started on the ground and those which are yet to begin. The department has asked for the list of such works at the earliest after the Election Commission sought the same. Delhi will go to polls on February 8 to elect 70 members and the results will be declared on February 11. In a written communication to all chief engineers, the PWD said the department has sought details of such works on January 9 and the office of Delhi Chief Electoral Office on January 14. "You are again requested to send the information on priority through email "mailto:electiondelhi2020@gmail.com" \nelectiondelhi2020@gmail.com under intimation to this office," said the written communication issued on Friday. It also stated that the list of works which have already been started on the ground and list of fresh work which has not started on the ground should be sent. Earlier this month, the services department of the Delhi government had asked HoDs to ensure that neither the proposals sent by them breach the model code of conduct nor the compliance of court orders are delayed due to the fear of their breach. "All departments of the government of National Capital Territory of Delhi, while forwarding proposals to the chief secretary for consideration or approval, should clearly mention that provisions of the Model Code of Conduct are not attracted," it had said.

The issue has been on the election watchdog’s priority list since 2016 and now looks to be gaining momentum, as most parties other than <keyword id="14666" type="ORGANIZATION" weightage="20" keywordseo="BJP">BJP</keyword> have agreed to it in principle following an all-party meeting in August, and a draft reform has been sent to the law ministry. The idea behind the move is to ensure that smaller, regional parties get a fair chance when campaigning for elections and to limit the role played by wealth in determining electoral outcomes. Recent data from the Association of Democratic Reforms (ADR), a NGO, shows a significant wealth gap between the party in power, BJP, and opposition parties like the Congress- which doesn’t bode well for a fair election result next year. The EC has said that a limit to a party’s election spending hinges on the limit placed on individual candidate spends, and proposed that the party limit should be 50% or less of the combined maximum spend prescribed for all of the party’s candidates. The Law Commission has said in the past that a party spending limit will be extremely difficult to implement and monitor, so it remains to be seen whether the EC’s proposal will pass muster. The EC places a cap on how much individual candidates can spend, based on what legislature they’re campaigning for and what state they’re in, but has not yet placed a cap on the election expenditure incurred by a party. For a Lok Sabha candidate, the cap is between ₹5 and ₹7 million while the cap for state assembly candidates is between ₹2 and ₹2.8 million. Anonymous donations As part of its bid to crack down on electoral spending, the EC also wants to limit anonymous donations to 20% of a party’s total collections. This would be a significant reform as parties usually declare most of their donations as being from anonymous donors. While the EC has capped online cash donations to political parties at ₹2,000 instead of ₹20,000 and facilitated the launch of electoral bond sales, it still has more to work to do in making the political funding more transparent. A number of political parties, including the BSP, never end up declaring any donors because they say all their individual donations are less than ₹2,000. According to the ADR, 46% of all the funds political parties received in 2016-17 came from unknown sources. In response to this, the EC feels that the proportion of anonymous donations to overall donations should be capped at 20%, so the origin of at least 80% of a parties’ funding sources can be identified.

The counting of votes was underway, which began at 8 a.m. on Thursday in the crucial five state Assembly polls. The Election Commission (EC) is likely to announce polling dates for Haryana on September 19. The term of current assembly elected in 2014 will expire on 2 November 2019. In the previous elections in 2014, Manohar Lal Khattar of the BJP became Chief Minister after his party won 47 of the 90 seats in the state, getting a clear majority. Notably, Khattar was the first non-jat chief minister of the state in 18 years. The Indian National Lok Dal won 19 seats, while the incumbent Congress won only 15. The BJP hopes to retain power in the state this time too, but it is facing anti-incumbency. However, a fractured opposition that consists of the Congress and the Indian National Lok Dal (INLD) could benefit the BJP. In 2014, the polling schedule for Maharashtra and Haryana was announced on September 20. Polling in both the states took place in a single phase on October 15. Results were announced on October 19. They will also be the first after the abrogation of Article 370. These polls will serve as a litmus test for the BJP government amidst reports of acute economic slowdown.
