The <keyword id="19895345" type="General" weightage="20" keywordseo="supreme-court" source="keywords">Supreme Court</keyword> on Wednesday cancelled the bail granted to former <keyword id="127124" type="General" weightage="100" keywordseo="DHFL" source="Orion">DHFL</keyword> promoters <keyword id="20244074" type="General" weightage="20" keywordseo="kapil-wadhawan" source="keywords">Kapil Wadhawan</keyword> and his brother Dheeraj in the multi-crore rupees bank loan scam case. A bench of Justices Bela M Trivedi and S C Sharma said the high court and the trial court committed error in granting bail to them. "We have no hesitation that the charge sheet having been filed and cognisance being taken in due time, respondents could not have claimed statutory bail as a right," the bench said. Under the Code of Criminal Procedure (CrPC), an accused becomes entitled for grant of statutory bail if the probe agency fails to file the charge sheet on conclusion of the investigation in a criminal case within 60 or 90 days period. In this case, the CBI filed the charge sheet on the 88th day after registration of the FIR and the trial court granted default bail to the accused and the Delhi High Court upheld the order. The Wadhawan brothers were arrested in this case on July 19 last year. The high court, however, had clarified it did not go into the merits of the case. The charge sheet was filed on October 15, 2022 and cognisance was taken. The FIR in the case was based on a complaint made by the <keyword id="19936703" type="General" weightage="20" keywordseo="union-bank-of-india" source="keywords">Union Bank of India</keyword>.

Loan scam case: SC cancels bail granted to DHFL's Wadhawans

The Central Bureau of Investigation (<keyword id="6354572" type="General" weightage="100" keywordseo="cbi" source="Orion">CBI</keyword>) on Monday approached the Delhi High Court challenging a <keyword id="143275" type="General" weightage="80" keywordseo="trial-court" source="Orion">trial court</keyword> order granting statutory bail to Dheeraj and Kapil Wadhawan, ex-promoters of <keyword id="127124" type="General" weightage="80" keywordseo="dhfl" source="Orion">DHFL</keyword>, in what is considered India's biggest bank fraud case to the tune of Rs 34,926.77 crore. The bail was granted on the ground that an incomplete chargesheet was filed within the statutory period. The CBI sought an urgent stay on the matter on Monday before the bench headed by Delhi High Court Chief Justice <keyword id="1495287" type="General" weightage="50" keywordseo="satish-chander-sharma" source="Orion">Satish Chander Sharma</keyword> also comprising Justice Subramonium Prasad. The Special Judge of the Trial Court on Saturday, while passing the order, stated that Kapil Wadhawan and Dheeraj Wadhawan are entitled to statutory bail without discussing the merits of the case because of an incomplete chargesheet. The trial court Judge said, keeping in view the gravity and seriousness of the case perhaps accused persons might not be entitled to any bail but this court is compelled to release them under statutory law from custody by giving a mandatory concession of default bail due to incomplete chargesheet. The CBI cannot be entirely blamed for filing an incomplete chargesheet because it was not humanly possible and was also practically very difficult to complete the very big investigation task within a period of 90 days especially when the accused persons themselves took several years altogether to complete the offences, the court said. It could not have been expected from CBI to unearth each and every accused, find out every corner of the conspiracy, collect entire evidence and trace out the huge embezzled amount etc. within such a short period of 90 days when some part of the investigation has to take place out of the country also, noted the court The court is not blaming the investigating agency for any lapse, intentional delay, lethargy, negligence and for not doing its homework before filing a chargesheet if the practical difficulties of it and the fact of shortage of time are taken into consideration. Otherwise also, investigating officers are human beings and it will be highly unreasonable to expect them to work for entire 24x7 days and to run from one place to another without any break, said the trial court. The court further noted that both these accused were formally arrested on July 19 this year in the present case, though they were already in custody in some other cases pending in Lucknow and Mumbai since April, 2020. The CBI filed the chargesheet consisting of about 55,000 pages in the court on October 15 this year kept in six trunks. Cognizance on this chargesheet has been already taken. This chargesheet filed was described as incomplete by the accused persons, against the provisions of Section 173 Cr.P.C. Before the trial court, Advocate Vijay Aggarwal appearing for the Wadhawan brothers argued that an incomplete chargesheet has been filed and his clients are entitled to statutory bail as further investigation on various material aspects has not been conducted by CBI. He further argued that at present only 75 accused persons are chargesheeted and this figure may go up by more than 10 times after the complete investigation and in that eventuality for trial of this case alone, there may be a necessity of exclusive one single court to deal with this case. He also stated that out of Rs 34,926 crore which was allegedly embezzled by the accused persons, CBI is able to recover even less than 2 per cent of the said amount. Advocate Vijay Aggarwal also argued that the existence of power of the prosecution to investigate the matter further cannot be denied but the same comes into picture on discovery of additional evidence during the investigation and also once a complete chargesheet is filed complete in aspect of all the allegations levelled in the FIR and information of which has been given to the investigating agency. According to the FIR, based on a complaint made by <keyword id="63524" type="General" weightage="50" keywordseo="union-bank-of-india" source="Orion">Union Bank of India</keyword> it was alleged that Dewan Housing Finance Corporation Ltd. (DHFL), Kapil Wadhawan, the then CMD, Dheeraj Wadhwan, the then Director, both of DHFL and other accused persons entered into a criminal conspiracy to cheat the Consortium of 17 banks led by Union Bank of India and in pursuance of the said criminal conspiracy the said accused Kapil Wadhwan and others induced the consortium banks to sanction huge loans. Much of this amount was allegedly siphoned off and misappropriated by alleged falsification of the books of the DHFL and dishonest default in repayment of the legitimate dues of the said consortium banks. The complainant alleged that a wrongful loss of Rs 34,615 crore was caused to the consortium banks in as much as such was the quantification of the outstanding dues as on July 31, 2020, as per the CBI.

Trust me I am pushing my daughter to start learning coding, and do IIT JEE preparations with you guys, but she is just not willing to do so. Kids these days don't listen to their parents. She just wants to be an artist. So, please stop calling me to sell these plans/devices," Prashant <keyword id="445" type="General" weightage="50" keywordseo="sharma" source="Orion">Sharma</keyword>, who is into business development and a consultant with a penchant for storytelling, posted on LinkedIn. His post led to a barrage of similar situation being faced by parents all over the country, who are fed by constant aggressive selling of courses by the edtech representatives. <keyword id="14487485" type="General" weightage="50" keywordseo="srikant-ganesh" source="Orion">Srikant Ganesh</keyword>, Vice President at Dentsu Creative India, posted that he can totally relate to Sharma's experience. "My 9 year old son's into chess, plays the keyboard and is into speed-cubing and has no inclination towards computers / coding as such. I believe BYJU's and WhiteHat's of the world realise that there's more to kids these days than just learning to code and yes! They have a mind of their own and no one can push them into something they are not inclined towards. This false sense of FOMO being created by such brands should stop and so should the calls," Ganesh lamented. After the Centre took serious note of mis-selling of courses to parents by edtech firms, self-regulatory organisation IEC said it is committed to protecting consumer interest and has resolved 100 per cent complaints received till June. However, fresh complaints surfaced on social media platforms this month, indicating that the problem has not been addressed in totality. "This happened to me. The sales representatives of #Byju's need to be trained to handle a 'No'. I have personally experienced this when a representative called my wife and she said that we don't want to enroll. He kept calling and then I had to intervene. He kept insisting that your child had been registered on their site, so how could we say No! He didn't seem to understand and finally I had to explain to him by activating my desi side. I registered my complaint on their site but it was removed the next day," posted Dheeraj Grover, Senior Manager, HR, at VVDN Technologies. Thangarathnavel M., Head of Business Development-South Asia at German company Covestro, said on LinkedIn that he could fully relate to it too. "I had enrolled my son 2 years back but it was not much of any use. Few months back I started receiving calls from them again to enrol my son for the physical classes. But even after saying no, the calls never stopped. Once I gave a piece of my mind to one of the callers and asked him to share the mobile number of Mr. BYJU. Now the calls have stopped coming. Hope they stop this forever," he described his plight. Earlier this month, the Centre warned edtech companies against unfair trade practices. In a meeting with the IEC, Consumer Affairs Secretary, Rohit <keyword id="255172" type="General" weightage="50" keywordseo="kumar-singh" source="Orion">Kumar Singh</keyword>, said that if self-regulation does not curb unfair trade practices, then stringent guidelines would be formulated for ensuring transparency. The meeting was attended by representatives of the IAMAI, along with IEC member companies including upGrad, BYJU'S, Unacademy, Vedantu, Great Learning, WhiteHat Jr, and Sunstone. A recent study by two <a href="http://www.businessinsider.in/searchresult.cms?query=IIM-A&amp;sortorder=effectivedate">IIM-A</a> professors has confirmed that controlled temperatures at workplaces can boost employee <keyword id="23080" type="COMPANY" weightage="60" keywordseo="productivity">productivity</keyword>. 
 The study, titled ‘Heat <keyword id="23666" type="UNKNOWN" weightage="80" keywordseo="stress">Stress</keyword> and its effect on Psychological Aspects of Workers in India’ by <keyword id="1146906" type="PERSON" weightage="60" keywordseo="Dheeraj-Sharma">Dheeraj Sharma</keyword> and <keyword id="3467142" type="PERSON" weightage="60" keywordseo="rajesh-chandwani">Rajesh Chandwani</keyword> of <a href="http://www.businessinsider.in/searchresult.cms?query=IIM-A&amp;sortorder=effectivedate">IIM-A</a> pointed out that there is a direct relation between the temperature at a particular workplace and its effect on productivity of the employees. Comforting work environment can actually improve productivity by up to 12%. 
 
“Little attention has been devoted to the effect of increasing temperatures on worker productivity and health. Our study attempts to quantify the improvement in productivity that can be gained through establishment of cooling solutions at indoor workplaces. Indeed, according to our study, worker productivity can be enhanced up to 12%, by increasing the level of thermal comfort at the workplace,” said Sharma. 
In the research, the psychological aspect was considered more than physiological effect heat can have on the human body and its work productivity. 
 
“Our study attempts to quantify the improvement in productivity that can be gained through establishment of cooling solutions at indoor workplaces,” he added. 
 
According to this study, tropical countries like India are likely to suffer the most from health hazards and losses in productivity due to the heat. 
 
“Though there is substantial evidence that extreme temperatures in the workplace can adversely affect performance, there is little consensus regarding an ideal temperature at workplace. The optimal temperature for worker performance may vary. However, in the tropical countries, most of the studies have found that the optimal range of ambient temperature for enhanced worker productivity is about 25- 30 degrees Celsius,” said Chandwani. 
 
He added that companies should offer drinking water and other hydrating solutions to ensure appropriate clothing to prevent heat related health hazards like dehydration.

PhonePe's latest campaign with Aamir Khan aims to bust myths about buying gold online before the festive season

In the run up to <keyword id="6422463" type="UNKNOWN" weightage="20" keywordseo="US-presidential-elections">US Presidential elections</keyword>, when candidate <a href="http://www.businessinsider.in/Donald-Trump-accuses-IBM-of-moving-jobs-to-India-says-will-slap-35-tax-if-elected/articleshow/55291489.cms">Donald Trump was catching everyone's attention</a> with his bizarre comments in public, and media and social media surveys were busy predicting his defeat, Professor Dheeraj Sharma, a marketing faculty member at IIM-A, had already declared him a winner. 
 He had predicted <keyword id="6354484" type="PERSON" weightage="100" keywordseo="Donald-Trump">Donald Trump</keyword> would be the next <keyword id="15548" type="POSITION" weightage="20" keywordseo="US-President">US president</keyword>, on September 26th. His judgment, however, was based not on gut feeling, but data. 
 
Sharma had conducted a survey of 590 people in five US states — Florida, Michigan, Pennsylvania, Georgia and Virginia — to know who would be the president of the USA. 
 His analysis was based on four major criteria including people's liking, trust, distrust and hate along with the content of speeches by the two candidates <keyword id="3043" type="PERSON" weightage="20" keywordseo="Hillary-Clinton">Hillary Clinton</keyword> and <a href="http://www.businessinsider.in/TRUMP-Fidel-Castro-is-dead/articleshow/55638606.cms">Donald Trump</a>. 
 
The outcome of the survey showed that even as Clinton was better than Trump on political knowledge and expertise in functional competency, but both were identical in managerial ability. 
 
It also noted that Trump was a better motivator than Clinton. 
 
"Trump was able to provide a vision for us (US citizens) which resonated best with the average American," noted the survey, based on the views of the surveyed American people. 
 
Sharma said Trump used 24% more abstract communication in his speeches compared to Clinton. 
 
"Hillary focused more on data and figures in her speeches, but Trump used to deliver speeches that attracts popular sentiment, which resulted in his capturing people's support," he said.
