<keyword id="19901201" type="General" weightage="20" keywordseo="Sebi" source="keywords">SEBI</keyword> has proposed that registered <keyword id="21253972" type="General" weightage="100" keywordseo="investment-advisers" source="keywords">Investment Advisers</keyword> (IAs) and <keyword id="21511721" type="General" weightage="20" keywordseo="research-analysts" source="keywords">Research Analysts</keyword> (RAs) who employ artificial intelligence (AI) tools in their services must disclose the extent of their usage to clients, emphasizing the importance of strong security measures to avoid unintended data exposure. This transparency is crucial for clients to understand how <keyword id="20096338" type="General" weightage="20" keywordseo="AI-tools" source="keywords">AI tools</keyword> contribute to their investment decisions and to make informed choices about their advisory services. "The possibility of unintended data exposure highlights the need for strong security measures and clear disclosure to clients about the extent of AI tool usage", Trivesh D, COO at Tradejini, a stock trading platform, told PTI. The Securities and Exchange Board of India (SEBI), in its consultation paper earlier this month, highlighted the growing usage of AI tools in Investment Adviser (IA) and Research Analyst (RA) services. With technological innovations and advancements, many AI tools are currently available in chatbot form such as OpenAI's ChatGPT, Google's Gemini, etc. AI-based tools allow one to have human-like conversations and receive human-like responses with the chatbot. These tools assist various tasks such as summarising and analysing data and may help in improving efficiency and productivity. "These AI tools, however, may not adequately safeguard sensitive data shared during conversations, potentially leading to unintended data exposure and concerns related to <keyword id="19900735" type="General" weightage="20" keywordseo="data-security" source="keywords">data security</keyword>," SEBI said in its consultation paper issued last week. Feroze Azeez, Deputy CEO, Anand Rathi Wealth Ltd said "while embracing this innovation, we must be mindful of its implications and responsibilities". IAs provide personalised services according to client-specific requirements, based on <keyword id="22797015" type="General" weightage="20" keywordseo="risk-profiling" source="keywords">risk profiling</keyword> and suitability. Similarly, RAs provide recommendations based on certain parameters and methodology adopted and are required to keep records of the research report, research recommendations and rationale for arriving at research recommendations. While AI tools can provide significant assistance in the work of IAs and RAs, they may not always give meaningful outputs that are expected to be based on the understanding of complex security-specific or client-specific scenarios/ requirements such as personal/ financial conditions or goals, SEBI stated. Further, such tools may not always provide all the information based on which output/ recommendation has been generated. For example, AI tools may not bring out whether the requirements of risk profiling and suitability have been complied with by IA, it added. "An IA/RA who uses AI tools for servicing its clients must provide complete disclosure of the extent of use of such tools to its prospective clients, to enable them to take informed decisions of continuance or otherwise with the IA/RA," SEBI suggested in the consultation paper. Considering that the investment advice/ research services provided by IA/RA based on AI tools would affect the investment decision of clients, SEBI said, the responsibility of data security, compliance with the regulatory provisions governing investment advisory services/research services lies solely with the IA/ RA, irrespective of the scale and scenario of IA/ RA using AI tools. Trivesh believes that <keyword id="19901571" type="General" weightage="20" keywordseo="technology" source="keywords">technology</keyword> can significantly enhance the efficiency and reach of investment advisory service, but it should be used as a complementary tool, rather than a complete replacement for human judgment and expertise. "The dynamic and culturally diverse nature of India's financial landscape demands personalized investment advice that AI alone cannot provide. Since AI will undoubtedly continue to change the <keyword id="19976433" type="General" weightage="20" keywordseo="financial-services" source="keywords">financial services</keyword> sector, efforts to integrate it into IA and RA services should be pursued with a balanced approach, leveraging its strengths while addressing its limitations," he added. Additionally, SEBI is also looking to create a closed ecosystem for fee collection by registered investment advisers and research analysts through a separate mechanism in order to help investors ensure that their payments are reaching only registered IAs and RAs and help them identify, isolate and avoid unregistered entities, who would be unable to access this closed ecosystem.

Investment Advisers, Research Analysts should disclose AI tools usage to clients, notes SEBI

The Delhi <keyword id="19900812" type="General" weightage="20" keywordseo="high-court" source="keywords">High Court</keyword> has refused to set aside the Central government's order blocking open-source messaging application '<keyword id="22332861" type="General" weightage="100" keywordseo="Briar" source="keywords">Briar</keyword>' in <keyword id="19900657" type="General" weightage="20" keywordseo="Jammu-and-Kashmir" source="keywords">Jammu and Kashmir</keyword> as it is suspected to be used by <keyword id="19900658" type="General" weightage="20" keywordseo="terrorists" source="keywords">terrorists</keyword> and could be a potential <keyword id="19968363" type="General" weightage="20" keywordseo="threat" source="keywords">threat</keyword> to <keyword id="19896999" type="General" weightage="20" keywordseo="national-security" source="keywords">national security</keyword>. The high court observed that in the matters of national security, principles of natural justice can be given a go-by. "The interim order has been reviewed by the committee constituted under Section 7 of the Blocking Rules and as stated earlier, the committee consists of top officials of the Government of India. The blocking orders have been passed for 14 applications/ softwares, including the software/ application of the petitioner herein as it was being used by the terrorists and their supporters to disturb the security and sovereignty of the country. "The application of the petitioner has been blocked only in Jammu and <keyword id="19896255" type="General" weightage="20" keywordseo="kashmir" source="keywords">Kashmir</keyword> and the same can be used in all other parts of the country. In view of the above, this court is not inclined to entertain the present writ petition. Accordingly, the writ petition is dismissed," Justice Subramonium Prasad said. Sublime Software Ltd, the petitioner, sought direction to the Centre to produce and publish the order passed by it under Section 69A of the Information <keyword id="19901571" type="General" weightage="20" keywordseo="technology" source="keywords">Technology</keyword> Act, blocking its open-source messaging application 'Briar' and also prayed for setting aside that order. It was stated that Briar operates on a technology in which a person can directly send a message to another person even when there is no internet connectivity. It added that the technology is crucial in times of emergency, natural calamities and catastrophic disasters in providing emergency healthcare and disaster management as it enables smooth communication between persons and authorities during times of distress. On the other hand, the Centre's counsel submitted that the software, which can work even when there is no internet connection, is suspected to be used by terrorists in Jammu and Kashmir. The application can be misused and can definitely be a potential threat to the national security, sovereignty and integrity of India, the Centre's counsel said. The high court in its order noted that rule 16 of the Blocking Rules provides that strict confidentiality shall be maintained regarding all the requests and complaints received and actions taken thereof. "This court can take judicial notice of the fact that decisions taken at the highest level and for the benefit of the security and sovereignty of the country can be kept confidential," it said.

And the situation is unlikely to improve until the end of the year, analysts say. Amid the ongoing weakness in the sector, foreign portfolio investors (FPIs) have also sold their stakes in IT companies. FPIs turned bearish on the IT and oil and gas sector in March – between these two sectors, they <a href="https://www.businessinsider.in/stock-market/news/fpis-offload-it-oil-gas-stocks-worth-13734-crore-in-march/articleshow/99375107.cms">sold equities worth ₹13,734 crore. </a> Analysts expect pain to continue till end of 2023 Considering the macro economic challenges like high inflation, interest rates and banking crisis in the US and European regions, analysts expect it will be a watchful few quarters for the IT sector. "The biggest issue in the IT sector is growth slowdown and possibility of recession. So, as long as the slowdown persists and global growth remains uncertain, the market will expect lesser order flow, slower execution and pricing challenges. All these three factors will lead to IT companies suffering and valuations may also not expand. Investors will have to remain watchful for one to two quarters till there is some clarity on the global growth scenario," Deepak Jasani, head of retail research at HDFC Securities told Business Insider India. The IT majors’ recently-posted fourth-quarter results and FY24 growth predictions tell their own story about the sector’s ongoing struggles. For FY23, IT major Infosys reported a growth of 15.4% in constant currency terms, lower than the guidance of 16-16.5% that it had given <a href="https://www.businessinsider.in/business/corporates/news/infosys-results-q3-fy23-infosys-raises-revenue-guidance-for-fy23-to-16-16-5/articleshow/96941824.cms">at the end of Q3</a>. Besides, it guided for a 4-7% revenue growth in FY24. This is the first time since FY16 that Infosys has guided for single-digit revenue growth in constant currency terms. Bigger rival Tata Consultancy Services (TCS) reported a 11-quarter low constant currency revenue growth at $7.2 billion in Q4. TCS’ outgoing chief executive officer Rajesh Gopinathan said in a post-earnings conference that the company is seeing stress in one of its largest markets, North America. The recovery that the company had expected had not yet materialised. According to Sanjeev Hota, vice president, head of research at Sharekhan BNP Paribas, told Business Insider India, the macro uncertainty faced by the sector is unlikely to get better before 2-3 quarters. “(For) the entire calendar year, things look dicey and the industry may witness some kind of stability by the fag end of this year. US, North America, which are among the biggest markets for the sector, are not expected to improve in the near term." Banking crisis could impact June-quarter earnings The global growth slowdown has worked its way into the stock market performance of these companies with shares of the entire IT pack being beaten down significantly in 2023. The Nifty IT index is down 30% so far this year compared to a 3% fall in the broader Nifty50 index. The IT companies in India faced the heat after the banking crisis in the US and Europe erupted in March, triggered by the collapse of Silicon Valley Bank and Signature Bank in the US and the turmoil at Swiss lender Credit Suisse. IT majors like TCS, Infosys and Wipro have also neared their 52-week low since March considering IT companies’ exposure to US banks amid the banking sector crisis. BFSI clients are among the Indian IT companies’ largest clients. "Most of the price damage in the IT stocks has already been done. However, outperformance of the sector from the current level seems restricted till global macro headwinds stabilises. The sector valuation multiple is driven by earnings growth and if growth tapers off, there are little chances of the (IT) stocks outperforming the broader market indices,” added Hota. He, however, recommends staggered buying in TCS among the large caps and Persistent Systems from the mid-cap stocks, for long-term investors. The lower-than-expected growth in March quarter for sector leaders Tata Consultancy Services (TCS), Infosys and HCL Technologies have underlined the ongoing slowdown. And analysts see this spilling over to the next quarter as well. “The banking crisis in US regional banks and European banks in March 2023 has induced greater caution and could impact the June 2023 quarter. We would not be surprised by a weak US performance across companies that are likely to report in the coming days,” said a report by Kotak Institutional Equities. Analysts at JP Morgan have also highlighted the weakness in banking, financial services and insurance (BFSI) and telecom verticals, which would impact Tech Mahindra and Mphasis as they have high exposure to these verticals. India’s IT sector likely to face macro headwinds until end 2023, say analysts

The company also announced that it would layoff 3500 employees as it sees revenues slowing further in 2023. The Nasdaq-listed company’s March quarter net profit grew 3% on year to $580 million. Meanwhile, its revenue declined 0.3% on year to $4.8 billion during the quarter. The company follows a January to December accounting year. Adding to the woes, Cognizant says full year guidance of 2023 is expected to be $19.2 - $19.6 billion, which would mean a decline of 1.2%. The next quarter revenue is expected to be at $4.83 - $4.88 billion, showing a decline of 0.6% to 1.6%, or a decline of 1.0% to flat in constant currency. Cognizant reported an operating margin of 14.6% for March quarter, which is lower than Indian IT giants TCS, Infosys, HCL Technologies and Tech Mahindra. For the full year 2023, the company has guided for adjusted operating margin to be in the range of 14.2%-14.7%. Following the peer IT major’s mixed bag of earnings which expects a decline in 2023 revenues, shares of most Indian IT companies were trading lower. It attributed the move to its NextGen program through which it expects to simplify its operating model and optimise corporate functions. “In the second quarter of 2023, we initiated the NextGen program aimed at simplifying our operating model, optimizing corporate functions and consolidating and realigning office space to reflect the post-pandemic hybrid work environment. Our drive for simplification will include operating with fewer layers in an effort to enhance agility and enable faster decision making,” the company said in a statement. Cognizant has a total headcount of 3.51 lakh in the March quarter, which is a decrease of 3,800 from the previous quarter. Its voluntary attrition rate declined to 23% in Q1 FY23 from 30% in Q1 FY22. "Our accelerated bookings growth in the quarter, which included several large deals and a healthy mix of new and expansion work, reflects the strengths of our services, our brand, and the longstanding relationships we have with our clients. Cognizant braces for slow year ahead, to cut 3,500 jobs and slash office spaces

New Delhi, The inter-ministerial board of approval, on request of a developer of an IT/ITeS sector special economic zone, can permit demarcation of non-processing area of that zone, according to an official notification. The inter-ministerial Board of Approval is the highest decision making body on <keyword id="69055" type="General" weightage="20" keywordseo="special-economic-zones" source="Orion">special economic zones</keyword> (SEZs). It is chaired by the commerce secretary. The <keyword id="6365809" type="General" weightage="20" keywordseo="commerce-ministry" source="Orion">commerce ministry</keyword>'s notification said that a non-processing area under such SEZs can be used for setting up and operation of businesses engaged in Information Technology (IT) or Information Technology Enabled services (ITeS) sector. For this, the ministry has amended the Special Economic Zones (Fifth Amendment) Rules, 2023. Inserting a new rule, the notification said: "...the Board of Approval, on request of a developer of an IT or ITeS SEZs, may permit demarcation of a portion of the built-up area of an IT or ITeS SEZ as a non-processing area of the IT or ITeS SEZ to be called a non-processing area." In the processing area, units are located for manufacturing of goods or rendering of services. Non-processing areas are where supporting infrastructure is created. It also said that the board would permit the demarcation "only" after repayment, without interest, by the developer. "Demarcation of a non-processing area shall not be allowed if it results in decreasing the processing area to less than fifty per cent of the total area...," it added. The notification also said that the businesses engaged in these zones in a non-processing area would not avail any rights or facilities available to SEZ units. It added that no tax benefits shall be available on operation and maintenance of common infrastructure and facilities of such an IT/ITeS zone. Welcoming the move, Sanjay Dutt, MD &amp; CEO, <keyword id="672851" type="General" weightage="50" keywordseo="tata-realty-and-infrastructure-ltd" source="Orion">Tata Realty and Infrastructure Ltd</keyword>, said that this revised policy not only facilitates the expansion of companies' office spaces but also extends the benefits of SEZ areas to non-SEZ entities. "It's a proactive move by the government, optimizing the utilization of real estate resources," he said, adding, "presently, the country boasts around 170 million square feet of ready IT SEZ office space in the top 6 cities, with nearly 20 per cent (over 30 million square feet) lying vacant. Additionally, about 10 million square feet of SEZ spaces are under construction and set to be completed within the next 2 years."

Infosys ADR stock, which trades on the US stock market, slipped 14% in previous 5 sessions because of weak earnings at a time when Indian markets were closed due to holidays. “Infosys' 4Q (March quarter) results missed estimates mainly due to muted growth of 1.2% on quarter constant currency. However, its 13-15% revenue growth guidance for FY23 and all-time high net additions reflect a strong demand outlook,” said analysts at Jefferies. After considering the seasonal weakness in the Jan-Mar quarter, Infosys result was still disappointing. “Infosys' growth in 4Q disappointed even considering the seasonal weakness. Muted growth in its top-2 verticals (BFSI and Retail) and top markets (North America and Europe) and a sharp decline in Life Sciences vertical possibly due to one-off contractual issues resulted in the subdued growth performance,” said a report by Jefferies. <div type="image" title="infosys 2" height="900" width="1200" msid="90906620" hostid="261"></div> Besides, Infosys’ attrition worsened more in the March quarter reaching at 27.7% from 25.5% in the previous quarter. Moreover, it expects the attrition rate to decline gradually as it also kicks off hikes from April 1. Infosys slides 9% on poor March quarter earnings, other IT stocks follow suit

As the <keyword id="6357808" type="General" weightage="50" keywordseo="enforcement-directorate" source="Orion">Enforcement Directorate</keyword> (ED) continued searches at the premises of <keyword id="36918" type="General" weightage="20" keywordseo="chinese" source="Orion">Chinese</keyword> companies, including smartphone maker <keyword id="215177" type="General" weightage="100" keywordseo="vivo" source="Orion">Vivo</keyword>, at 44 locations in 22 states on Wednesday, the directors of one of the companies associated with Vivo have fled <keyword id="3658" type="General" weightage="50" keywordseo="india" source="Orion">India</keyword>. According to sources, two of the Chinese directors of Solan, Himachal Pradesh-based company, that was associated with Vivo, have likely fled India, as ED registered a prevention of <keyword id="6355008" type="General" weightage="20" keywordseo="money-laundering" source="Orion">money laundering</keyword> case. The Chinese nationals were made directors in the Indian entities with fake documents. The enforcement agency has so far received information about money laundering worth Rs 10,000 crore during the raids, according to ED sources. More details will emerge later in the case, the sources added. The <keyword id="6354572" type="General" weightage="50" keywordseo="cbi" source="Orion">CBI</keyword> has also been probing the case and lodged a separate first information report. In a statement to IANS, Vivo had said that it is cooperating with the authorities to provide them with all required information. Vivo ED raids: Two Chinese directors of a related company flee

Hyderabad, Despite the economic slowdown caused by the Covid-19 pandemic, <keyword id="68884" type="PERSON" weightage="20" keywordseo="Telangana">Telangana</keyword> is focusing on the expansion of the <keyword id="617811" type="PERSON" weightage="20" keywordseo="information-technology-sector">information technology sector</keyword> to further strengthen its standing as a leading global technology destination. It is not only setting up <keyword id="763883" type="PERSON" weightage="20" keywordseo="IT-parks">IT parks</keyword> in tier-II cities but within Hyderabad, it is taking up initiatives to ensure the expansion of the sector in all corners of the city. For over two decades, the IT presence in Hyderabad was confined to Madhapur and Gachibowli clusters in the western part of the city and it is only in recent years that few companies started their operations in the east. The state government has now drawn up ambitious plans to take the IT growth to all corners of the city. Under the GRID (Growth in Dispersion) policy of the state government, as many as 11 industrial parks within Outer Ring Road (ORR) limits will soon be converted into IT parks. This week, the authorities issued detailed guidelines pertaining to the zones, incentives, and <keyword id="1088961" type="PERSON" weightage="20" keywordseo="government-support">government support</keyword> for the conversion. The IT towers will come up in industrial parks at Balanagar, Kukatpally, Moula Ali, Mallapur, Patancheru, Katedan, and Sanatnagar, covering all corners of the city excluding the west. This followed the government's order to all polluting industries within the ORR to shift outside it. Non-polluting industries were also given the option to shift. Officials say the conversion of industrial parks into IT Parks will improve the elevation and the quality of living in the city. Home to 1,500 IT/ITES companies including global majors Microsoft, Google, Facebook, Apple, <keyword id="18635" type="COMPANY" weightage="20" keywordseo="Amazon">Amazon</keyword>, and nearly six lakh employees, Hyderabad is recognized as one of the leading Information Technology hubs globally. The new initiatives including GRID are expected to help achieve the state government's vision to increase the IT exports to $25 billion (₹1,87,000 crore) by 2025. The officials said the government embarked on dispersion as there is a resurgence of interest among the global investor's community, due to the state's investor-friendly and proactive policy measures. It is estimated that about 30% of the IT talent pool resides in the eastern part of the city and commutes to western IT Corridor on a daily basis. Similarly, a large part of the IT workforce resides in the northern parts of the city including Kompally, Bahadurpally, Bachupally, and Dundigal. This has led to overall city congestion and an increase in commuting time for IT employees. Dispersing the IT sector will not only decongest the western corridor and reduce the infrastructural burden but also makes it convenient for the IT workforce to commute to work and reduce the transportation burden on the IT companies. This is part of the objective to make Hyderabad the most preferred technology investment destination in the country and to attract niche segments that are fast emerging and evolving new verticals in technology sectors. The IT, Electronics and Communications Department has announced various incentives for units, anchors, developers, infrastructure development and institutional measures, and branding and promotional activities. The IT and ITeS units coming up in the industrial parks would be eligible for GRID benefits like an additional power subsidy of ₹2 per unit on the industrial power tariff on a reimbursement basis for a period of five years, with the total incentive for the unit not exceeding ₹5 lakh per year. According to the Government Order, the units will also get a lease rental subsidy of 30% for a period of five years with the total subsidy for the unit not exceeding Rs 10 lakh per year. The department announced concessions on land conversion for industrial lands under the Telangana State <keyword id="418609" type="DOMAIN" weightage="20" keywordseo="Industrial-Infrastructure">Industrial Infrastructure</keyword> Corporation (TSIIC) or industrial area local authorities that are converted to IT or ITES use. The developer has to utilize a minimum of 50 of the total built-up area for IT purposes. The remaining 50% can be utilized for non-IT use including commercial and residential use. In addition to converting industrial parks into IT parks, the government will also build an IT park at Kompally in the northern part of the city and another facility at Kollur or Osmannagar in the north-western part of the city. The government chose the areas for creating IT parks based on representations from various players. The eastern part of the city already has NSL IT Park, Genpact, Infosys, and others. Minister for Information Technology and Industry K. T. Rama Rao in July announced that the government permitted the conversion of five industrial parks into IT parks in east Hyderabad. In these five parks, IT firms will be set in about 25 lakh square feet which will create employment opportunities to 30,000 employees. He handed over conversion letters to the five companies. Hyderabad Distilleries and Wineries Limited's IT park will come up at IDA-Uppal over 12.40 acres. Minacto Chem will set up another park in the same area over 2.66 acres. Swamy Soaps and Oils Pvt Limited's park will also come up in IDA-Uppal over 2 acres. Gokuldas Exports Ltd's Mini Textile Park will set up an IT park in Nacharam over 8.93 acres while Bakelite Hylam Limited's facility will come up at IDA, Nacharam over 8 acres. The minister says that Hyderabad has no geographical hurdles and has the scope to develop in all the corners. Telangana clocked over Rs 1.28 lakh crore of IT exports during 2019-20, a growth of nearly 18% over the previous year. The growth rate was more than double the national average of 8.09% and more than two-and-a-half times the rest of the nation's average of 6.92%. The share of Telangana in overall IT exports from India went up from 10.61% to 11.58%. The number of jobs in the IT sector in the state went up from 5,43,033 to 5,82,126, a growth of 7.20% compared to the national average of 4.93%. This growth was registered despite the onset of the Covid-19 during the last quarter of 2019-2020. The Compounded Annual Growth Rate (CAGR) for IT exports for the last six years is 14.46%. In a report, <keyword id="46909" type="General" weightage="100" keywordseo="icici-securities" source="Orion">ICICI Securities</keyword> said the year 2022 has been marked by volatility on account of a wide variety of global new flows ranging from geopolitical issues, higher inflation (mainly food and energy), and hawkish action of central banks. This has led to a decline in global equities, mainly in the US and <keyword id="28249" type="General" weightage="50" keywordseo="europe" source="Orion">Europe</keyword>. However, India has relatively outperformed global peers in terms of all economic parameters (capex spend, discretionary consumption, robust pick-up in banking activity, etc), the report notes. The same is reflected across Indian equity markets. "Going ahead, we believe Corporate India will likely deliver earnings growth in excess of 15 per cent over the next two years given the current economic milieu and provide a plethora of investing opportunities in Indian markets," ICICI Securities said. However, sticky global inflation will keep central banks hawkish and India will be no exception. Similar implications for global liquidity flows may create medium-term volatility in Indian markets. However, if such a scenario materialises, then the same will be a strong opportunity to take exposure to Indian equities, the report said.
