In a setback to <a href="http://www.businessinsider.in/searchresult.cms?query=ola+cabs">Ola cabs</a>, <a href="http://www.businessinsider.in/searchresult.cms?query=delhi+high+court">Delhi High Court</a> dismissed its plea challenging a single-judge order upholding <a href="http://www.businessinsider.in/searchresult.cms?query=delhi+government">Delhi government</a>'s ban on such taxi services. 
 
"Appeal dismissed," a bench of Chief Justice G Rohini and Justice Jayant Nath said. 
 
On July 29, single-judge, in his interim order, had directed Delhi government's transport department and traffic police to "strictly enforce" the January 1 ban. 
 
The single-judge also sought an undertaking from ANI Technologies, which operates under the brand name of Ola that it will comply with the court's order. 
 
On August 4, the division bench had reserved its order after hearing arguments on Ola's plea. Ola accused single-judge of overlooking <a href="http://www.businessinsider.in/searchresult.cms?query=supreme+court">Supreme Court</a>'s orders on the kind of taxis that can run on city's roads. 
 
Ola had argued that other non-app based taxi organisations come under <a href="http://www.businessinsider.in/searchresult.cms?query=radio+taxi+scheme">Radio Taxi Scheme</a> and Ola does not own the vehicles that run under their brand and only connects the taxis with customers. 
 
The company released an official statement stating, "We respect the Honorable Divisional Bench's order on commercial diesel vehicles on all aggregator platforms in the state of New Delhi, as well as on those plying independently. We are working closely with the authorities to help and support the thousands of driver entrepreneurs and lakhs of citizens in the state, who use the Ola app." 
 
The Delhi government had said the All India Tourist Permit (AITP) vehicles that operate under Ola brand are meant for tourist destinations and not point-to-point service in city. 
 
In this regard, the single-judge admonished Ola for not complying with the ban imposed on it by Delhi government on January 01 this year and refused to grant it any interim relief. 
 
The single-judge had refused to provide any relief to Ola. 
 
The court had earlier questioned how Ola was operating in Delhi when the city government's order banning them had not been stayed and warned of a shutdown if it thought it was above the law.

Currently legal provisions only allow buses to pick up other passengers along the route and make multiple stops. Experts believe that one of the reasons is the focus on ride-sharing. The ban could either be good for the companies if customers shift to solo rides. Or, bad if customers choose to shift to public transport altogether or find other alternative means of transportation. Other issues on the table In reviewing the regulations for cabs in the Indian national capital, the committee is also discussing the issue of green fuels and permits. Possible outcomes include enforcing that cabs only use fuels like CNG or LPG and providing proof of parking before applying for a permit. The biggest development to come is probably the tracking of cabs. Currently, cabs in the city aren’t monitored as they pick up and drop passengers. But the committee is considering adding GPS monitoring to the roster, not only for cabs in Delhi but for cabs that are registered in other states while operating within the city. For actual customers, the issues of greater relevance are the ‘panic’ button that will soon become a mandatory feature in cabs and putting a cap on the maximum fare that companies can charge from customers. If the scheme also goes through with its plan of limiting the number of cabs that can be put on call by a cab operator, the demand-supply disparity might even increase the overall prices in the market. The committee, that includes the transport minister Kailash Gahlot and Satyender Jain, a minister at the Public Works Department, is currently reviewing the City Taxi Scheme 2017, Licensing and Regulation of App-based Cab Aggregator Rules 2017 and app-based premium bus services. Sources have told Times of <keyword id="3658" type="COUNTRY" weightage="20" keywordseo="India">India</keyword> that this the committee is unlikely to rule in the favour of companies being allowed to operate ride-sharing in Delhi. They were originally supposed to come to a decision on Monday, but that has now be deferred to a date that is yet to be decided.

	According to an ET report, the transport authorities in the national capital had started penalizing cabs that were operating under Ola and Uber after the Delhi government issued ban orders imposed in December. The ban was issued after a 25 year old woman accused Uber driver of rape. 
	 It should be noted that the <keyword id="6355014" type="ORGANIZATION" weightage="20" keywordseo="Delhi-High-Court">Delhi High Court</keyword> asserted that the government's ban was not valid and could not be the sole basis to reject the taxi operators’ application to operate its taxis in the city. 
	 
	The court also directed the transport authorities to provide Ola with all details required for a licence within 10 days. Uber too has followed suit.

rejects ban on taxi operator, Uber to follow suit

Couple of days back Delhi, the capital of India faced another rape incident. Unlike most instances, this case has been embroiled under the controversy of taxi-centric app called Uber. While many people are shouting at the top of their lungs that such apps should be banned (and the government heard them and banned Uber Delhi), but we seriously think this incident has not everything just related to the app. It is actually a wakeup call for all of us—it’s time when we should remind ourselves that technology has to be used wisely if we really want it to be a boon (not bane). Here is our take on what we think the government should really do to prevent such mishaps. 
 
All cabs need to be supremely governed 
Technology is there for our disposal, then why not use it. Implement GPS-trackers and track down cab drivers activity every single second. All cab service providers, be it private firms or public brands need to understand the importance of having a GPS tracker on the cars. If you’ve seen various cases of speed-car chase in the US, then it’s easy for car companies to keep a track of the driver and his position. Merely by installing an iPhone and relying thoroughly on its positioning service is just not done. The cost of GPS technology has come down, Internet infrastructure can also be relied upon—all that is required is that can service providers get the gear in place. 
 
Uber-like cases should be governed under law 
So, when the media approached Uber for its statement on the recent incident, the company basically stated that it does not have to comply with laws of a taxi-service company, as they never were one of those. Yes, it’s just an app that acts like a mediator between the taxi vendor and the nearest car available to the consumer. But surely, some laws can be implemented to make sure companies like Uber cannot evade the judicial governance. Make them accountable for their actions; put them through paces for cyber law and any other possible measures that can be taken. 
 
Driver IDs need full proof e-governance support 
If Narendra Modi has been serious about implementing e-governance in the country, then Driver’s ID mechanism could hugely get benefitted. Our country, sadly, is known for being the most corrupted, so why not take that reasoning out of equation by diverting the driver’s credentials, to a newer and complex set of database. This way, any driver plying on with the cab providers will be tested and judged for their professional experience only with information about any criminal record, work profile all included. Easier said than done. To get the house in order, some major steps are dearly needed from the government. 
 
More traffic and street CCTVs can help 
The importance of close-circuit camera TV has never been understood by the security forces in India. If fitted on street or traffic lights, they can easily capture the offender or even the offense in some cases which can help the law force prevent mishaps, even before it happens. `More than any help of technology, the society needs to change its mindset and not take law for granted. Cab-taking customers will never feel comfortable unless they get the right kind of support from all possible avenues.

We Can Learn From Uber’s Delhi Rape Incident

Commuters in Delhi-NCR are breathing relief as <keyword id="6354720" type="PERSON" weightage="20" keywordseo="Ola">Ola</keyword> and <keyword id="1042120" type="PERSON" weightage="20" keywordseo="Uber">Uber</keyword> apps are showing availability of cabs with lesser waiting time than earlier. 
 Thousands of drivers are on strike since February 10 in Delhi-NCR demanding an increase in fares from the existing Rs. 6 per km and also want the 25 % commission the app-based aggregators charge on every booking to be discontinued. Though <keyword id="4191690" type="UNKNOWN" weightage="20" keywordseo="sarvodaya-drivers-association-of-delhi">Sarvodaya Drivers Association of Delhi</keyword> (SDAD), the major force behind the strike refused to accept that the strike is off, around 70% of cabs plied yesterday morning. 
 
Neither the cab aggregators nor the government have communicated anything new for addressing the issue of cab drivers. 
 
However, passengers complained that surge pricing is still on and some people had to shell out almost double their normal fares.

The Delhi High Court will today hear the appeal of <keyword id="1042120" type="PERSON" weightage="100" keywordseo="Uber">Uber</keyword> and <keyword id="6362049" type="UNKNOWN" weightage="100" keywordseo="Ola-Cabs">Ola Cabs</keyword> against the ban imposed on them by Delhi’s <keyword id="62110" type="ORGANIZATION" weightage="60" keywordseo="transport-department">Transport Department</keyword>. On January 1, the Transport Department had refused to lift the ban, saying “there are no grounds to review the ban imposed.” 
 
The Delhi government had banned all web-based taxi operators in December last year after a taxi driver working with Uber allegedly raped a woman. Uber and Ola had approached the Delhi High Court requesting quashing of the ban orders. 
 
The Transport Department had said in its order: "They (web-based taxi operators) provide a simple taxi service by transporting people from one point to another through a vehicle driven by a driver for a fee, which is collected by the petitioner company directly from the passenger. Being a taxi service provider they are required to follow the law of the land and by using an AITP (All India Tourist Permit) taxi for local point to point drop, as in the present case, the petitioner has violated the prevailing law of the land and as it was not registered, which again was a violation.”

Delhi High Court To Hear Uber And Ola Cabs Appeals Today

It’s good news for the aam aadmi. Internet service providers (ISPs) have written to Department of Telecom (DoT) that they will not be able to block the websites of these cab providers. The DoT on May 12, had asked ISPs to block the websites of these app-based taxi operators such as <keyword id="6354720" type="PERSON" weightage="20" keywordseo="Ola">Ola</keyword> and <keyword id="1042120" type="PERSON" weightage="20" keywordseo="Uber">Uber</keyword> following a request by the Delhi government. 
	 According to an ET report, Rajesh Chharia, the president of <keyword id="128627" type="ORGANIZATION" weightage="20" keywordseo="Internet-Service-Providers-Association-of-India">Internet Service Providers Association of India</keyword> said that ISPs can only block http sites and not https sites. “https sites have higher encryption code. 
	 
	The report also quoted an ISP service provider which noted that cab companies such as Ola and Uber could not be blocked as they were https sites while TaxiforSure could be as it was a http site. 
	 
	"We can only block http sites and not the https sites as the latter have higher encryption codes," Rajesh Chharia, the president of the Internet Service Providers Association of India (ISPAI) said. According to an ISP service provider, Uber and Ola are https sites, but TaxiForSure could be blocked as it is an http site. 
	 
	In a separate development, the Road Transport ministry on Thursday said that these cab companies will be regulated by states under the Motor Vehicles Act. The directive came following a telecom department query that sought clarity regarding the regulation of the internet-based cab operators. According to the report by ET, there has been confusion as it was not clear if these taxi providers are regulated by the Information technology Act or the Motor Vehicles Act. 
	 
	The road ministry will now send a formal communication to direct all states to regulate apps of these cabs on Friday.

DoT orders not followed? Know why Ola, Uber websites cannot be blocked

After guidelines issued by the <keyword id="168381" type="ORGANIZATION" weightage="20" keywordseo="ministry-of-road-transport">Ministry of Road Transport</keyword> appeared to impact the business of the US-based taxi-hailing firm <keyword id="1042120" type="PERSON" weightage="20" keywordseo="Uber">Uber</keyword> in India, the company has now decided to take help of social media and online petitions. 
 Known as the <keyword id="3114129" type="UNKNOWN" weightage="20" keywordseo="City-Taxi-Scheme-2015">City Taxi Scheme 2015</keyword>, Uber has launched this campaign against Maharashtra’s draft rules for cab services. The campaign also looks forward to officially communicate its views to the government on the proposed rules. 
 
Shailesh Sawlani, Uber's general manager for Mumbai, says, "We feel it is critical for the people of Maharashtra, who have for years suffered in silence with poor quality transportation, to stand up against these regressive regulations and make their voices heard." 
 
Ola, on the other hand, prefers to directly get in touch with the government officials to resolve stalemates, according to some reports. Earlier, Ola had stated that "We work with authorities at all levels, be it central and state to resolve issues.” 
 
Uber, in the past as well, has taken help of online platform to fix issues with the government. In a similar move, Uber launched a campaign in January this year after the Delhi government banned its services following an alleged rape of a passenger by one of its driver partners. 
 
The company ran a campaign on social networking platform twitter with hash-tag #BringBackUber. Moreover, it also launched online petitions that received nearly 8,000 applications. The case, however, is now in court. 
 
Up until now, the petition in Mumbai has received around 24,000 online signatures. 
 
According to the draft rule issued by the Department of Home under Maharashtra government, a cab service licensee should have a fleet of 1,000 taxis to 4,000 taxis. Additionally, fare charged by the cabbies would be prescribed by the state transport authority. 
 
The conditions are not acceptable to Uber along with a proposal that asks its taxi drivers to maintain a feedback register and receipt printers. 
 
Sawlani also added that “The proposed scheme is a clampdown on consumer choice and freedom. It is equally important for commuters to let the government know that this scheme does not have smart solutions nor their interests at heart.” 
 
Turning down such online campaigns, a Delhi-based lobbyist for transport firms says, "The online petition in Delhi was not very effective mainly because of the timing, as it was done after the rape case. And second, there was a petition to change an existing law, unlike in Mumbai where comments are invited. Cab companies should work with authorities. It is not possible to settle all issues through the judiciary."

Here’s what Uber is doing to challenge the government’s guidelines

Trouble seems to be mounting on cab aggregators with the protests by <keyword id="6354720" type="PERSON" weightage="20" keywordseo="Ola">Ola</keyword>, Uber drivers in Delhi-NCR gathering more steam as it enters its fifth day today. 
 What’s more worrying is that <keyword id="4159125" type="UNKNOWN" weightage="20" keywordseo="sarvodaya-driver-association-of-delhi">Sarvodaya Driver Association of Delhi</keyword>, one of the groups leading the protests, has reiterated that the indefinite strike will continue until all demands are addressed by the app-based cab aggregators or the Delhi government. The Union claims to be representing the plight of 1.5 lakh of drivers in Delhi, Noida, Ghaziabad, Faridabad, Gurugram and other cities.

Earlier last week, thousands of drivers gathered at Janpath in the national capital for their indefinite strike against "unfair low fares fixed by companies" and "lack of basic amenities” from Ola and Uber. They alleged that as against Rs 30,000 they had been taking home monthly when they started driving the cabs, they are only able to make Rs 4,000 monthly for themselves and that too, despite working 18-20 hours. 
Several protesters angrily accused the cab aggregators of falsely luring them to buy cars by making financing easy and convincing them that they would earn more money than they have been from their existing sources of income. 
 
Hailing from economically weak backgrounds, several drivers sold off their property or jewelry and other assets to arrange the money for down payment. However, after the cab aggregators 
recently fixed the price at Rs 6/km (25% commission of which goes to Ola and Uber), the drivers alleged they get approximately Rs 4/km. A few drivers from the Union also alleged that despite being in the same area, Ola and Uber’s own fleet of cars have been getting more bookings than them as a result of which it has become difficult for them to meet their targets.

With Rs 4,000 left in hand, drivers say they are unable to meet all their family expenses. There isn’t enough money to repay loans and owing to bouncing cheques, the situation has worsened with financers even confiscating cars. 
 
At Janpath, one of the protesters alleged, “We were better off before becoming Ola, Uber drivers. We had some arrangements even then. We were surviving and meeting our daily needs. Now, we are left with nothing. Where should we go? We will continue the strike till our demands are met.”

Due to the protests, commuters have been left worst affected with no cabs in their vicinity. While on Ola's app, there were no cabs available at times during evening peak hours, Uber's app showed taxis with inflated fares on a few routes. Meanwhile, the companies have been resorting to surge pricing during peak hours in both morning and evening since the strike has begun. 
 
What Ola, Uber have to say 
Ola said that they’re doing their best to get more taxis on the road and working closely with local authorities to end the strike. 
“Offering a seamless mobility experience has always been our priority. We are concerned about the inconvenience being caused to some of our customers across Delhi-NCR over the last few days. We’d like to reassure them that we are working closely with the local authorities to resolve the issue at the earliest," an Ola spokesperson said. 
Meanwhile, Uber also claimed it is also working closely with the government and trying to make sure that their driver partners are safe while they are on the road. 
 
“We welcome this court order, which prohibits unions, their leaders and anybody else from obstructing the activities of Uber driver partners as they go about their business. We hope it will enable drivers to get back behind the wheel, something many have been telling us they wish to do. We're sorry that our service has been disrupted and for any inconvenience, this has caused to our customers” a spokesperson from Uber said.

Even as the strikes may have left Ola and Uber in a fix, quite predictably, they are concerned about retaining their customer base. Drivers meanwhile have been left in a lurch, knocking on every door possible to get justice. It remains to be seen whether this long-standing impasse between drivers and cab aggregators will see a logical conclusion anytime soon.

Cabby, the cab aggregator app to be launched today, has been developed by Sahil Arora, a seventeen-year-old school dropout from Gurgaon. The app will have 25,000 operational cabs in NCR, following which it would move to <a href="http://www.businessinsider.in/bengaluru-feel-relieved-as-ola-anduber-drivers-call-off-strike/articleshow/57221582.cms">Bengaluru</a>.

 Cabby would charge a base fare of Rs 37.50 for the first 2 km, followed by Rs 12.5 per km. Arora told ET that this is actually very competitive, and the fare would be lesser than what <keyword id="6354720" type="PERSON" weightage="100" keywordseo="Ola">Ola</keyword> and Uber charge.

The second cab-aggregator app to be launched today is from 74 BC Technologies, operational from <a href="http://www.businessinsider.in/UberMOTO-enters-Gurgaon/articleshow/51603369.cms">Gurgaon</a> where it is known for the bike taxi aggregator Baxi. 
 
Baxi is now launching cab services in seven cities including Delhi, Ghaziabad, Gurgaon, Mumbai, Pune, Chennai and Bengaluru. Acting as a technology provider for the app, it will be available free of cost for cab drivers. 
 
"Baxi will not take any commission from the drivers to use their technology platform," said Ashutosh Johri, co-founder of Baxi and an IIT Delhi alumnus. It would charge a base fare of Rs 50, followed by Rs 9 per km. Having around 1,000 cabs in its fleet, it would also have Re 1/minute wait charges.
