New Delhi, The Delhi High Court has held that mere acquittal of a person in a criminal case cannot be a ground for granting divorce and dismissed a man's plea seeking a decree of divorce in his favour, claiming that his wife committed cruelty on him. A bench of justices <keyword id="20039759" type="General" weightage="20" keywordseo="suresh-kumar-kait" source="keywords">Suresh Kumar Kait</keyword> and <keyword id="19957780" type="General" weightage="20" keywordseo="neena-bansal-krishna" source="keywords">Neena Bansal Krishna</keyword> said the man's acquittal in a criminal case in a trial court does not wash away the cruelty committed by him of being involved with another woman during the subsistence of his marriage with his estranged wife. "<keyword id="20862327" type="General" weightage="20" keywordseo="marital" source="keywords">Marital</keyword> bonds are delicate emotional human relationships and the involvement of any third person could result in a complete collapse of trust, faith and tranquillity. Any sort of influence by a third person can just be a silent destroyer of the bond, leading to prolonged irreconcilable differences," the bench said. It added that such relations eventually become a ticking time bomb, where feelings of anguish, despair, rejection and disappointment get trapped and post explosion, the shrapnel of these suppressed feelings causes injury to everyone involved, whether directly or indirectly. The high court dismissed the man's appeal and upheld the trial court's order denying him divorce on the ground of cruelty. According to the facts of the case, the couple got married in 1982 and had two children. They started living separately in 1994. The man had claimed that his wife was disrespectful and had refused to take care of him and even assaulted him physically. He had alleged that his wife's conduct had shattered his peace of mind and he was compelled to do all the household work, including cooking and taking care of the children, and sought divorce on the ground of cruelty. However, the woman had claimed that her husband was involved in an illicit relationship with a much younger woman and when she came to know about it in 1993, differences cropped up between them. She had further said because of this illegitimate affair, the man had started living in a separate room, ill-treating her and making her life miserable since December 1993. The woman had also got a first information report (FIR) registered against her husband and his family members under sections 498A (cruelty) and 406 (criminal breach of trust) of the <keyword id="19898811" type="General" weightage="20" keywordseo="indian-penal-code" source="keywords">Indian Penal Code</keyword> (<keyword id="19900921" type="General" weightage="20" keywordseo="ipc" source="keywords">IPC</keyword>). While the man's family members were discharged in the case at the stage of framing of charges, he was acquitted in 2013. The man had denied the allegation that he was involved in an illicit relationship but conceded that the other woman did come to live in his house as a governess to his children. The court, however, described it as a "fantastic" and "absurd" explanation, and said this is a case where section 23(1)(a) of the Hindu Marriage Act, which provides that no person can take advantage of his own wrong, comes into play in full force. "We, in the light of the blatant conduct of the appellant (husband) in showing scant regard to his matrimonial relationship, are compelled to observe that despite it being a failed marriage of over 40 years, granting divorce would be adding a premium to the wrong acts of the appellant. "While human emotions know no bounds and rules, but definitely, the human sensibilities emanating from the mind should have prevailed for an educated person like the appellant to have reigned his affections for a third person, with scant regard for the respondent who had reposed complete faith by entering into the vows of marriage with him," the bench said. "We hereby conclude that the additional district judge had rightly concluded that it was the appellant (husband) who was responsible for acts of cruelty towards the respondent (wife) and rejected the divorce petition," it added.

Mere acquittal in cruelty case no ground to grant divorce: Delhi HC

The Delhi government on Friday ordered closure of all malls and haat bazaars in the national capital in view of the coronavirus threat, but exempted grocery stores and pharmacies in them. "In view of the prevailing situation, we are closing down all malls (except grocery, pharmacy and vegetable shops in them)," Delhi Chief Minister Arvind Kejriwal tweeted. An official in the CM's office said that the order comes into force with immediate effect. He also said all non-essential staff are being directed to work from home, while all permanent and contractual employees will be paid for this period. Meanwhile, the chief minister held a meeting with medical superintendents of all Delhi government hospitals. "Had a meeting with MSs of all Delhi govt hospitals. If corona spreads widely in future, our hospitals should be prepared to deal with such situation - all machines should be working, adequate ventilators, adequate medicines and consumables, manpower etc," he tweeted. On Thursday, the total number of coronavirus cases in the national capital rose to 14. According to the Health Ministry data, the COVID-19 cases in India rose to 195 on Friday after 22 fresh cases were reported from various parts of the country. Delhi malls and bazaars shut down to battle Coronavirus threat

Government calls for a sixth round of talks with protesting farmers organisations on December 30

New Delhi, May 4 () Delhi government offices, including those of the transport, tourism and excise departments and the sub-registrar, opened on Monday after over 40 days as authorities implemented the latest lockdown relaxations permitted by the Centre amid the COVID-19 pandemic.However, several employees could not reach their offices due to unavailability of public transport and neighbouring cities sealing their borders with the national capital to contain the spread of the novel coronavirus.Chief Minister Arvind Kejriwal and his deputy Manish Sisodia were those among the cabinet members who went to the Delhi Secretariat. The secretariat building houses offices of several ministers and top bureaucrats.An official said the chief minister held the first Cabinet meeting in the Delhi Secretariat on Monday after government offices were allowed to open after over 40 days.According to the decision, government offices engaged in non-essential services were allowed to open with 33 per cent staff after 40 days. Also, private offices opened with the same strength of staff.Umesh Batra, general secretary of the Delhi Goverment Employees Welfare Association, said that all state-run offices opened on Monday, but several employees could not come due to restrictions on Delhi's borders.In sub-registrar offices in West Delhi, there was no registration of properties while there was also not much activity at offices of the Motor Licensing Officers (MLOs) and other department offices."Several government employees could not attend their offices due to restrictions. Those having their own vehicles attended offices, but those who don't have vehicles faced difficulties in wake of suspension of public transport," Batra said.There are around two lakh employees of the Delhi government. COVID-19 lockdown: Delhi govt offices open after 40 days

Even as the <keyword id="66" type="COMPANY" weightage="80" keywordseo="Delhi">Delhi</keyword> government told the High Court that it may extend the odd-even vehicle scheme beyond 15 days, it’s fate will be decided on January 11 by the <keyword id="6355014" type="ORGANIZATION" weightage="80" keywordseo="Delhi-High-Court">Delhi High Court</keyword> which today reserved its order on various pleas challenging the AAP government's ambitious pilot project which will continue till then. 
 
A bench of Chief Justice G Rohini and Justice Jayant Nath reserved the order after the Delhi government informed it that the pollution level of particulate matter across the national capital showed a declining trend due to implementation of the scheme which began on January 1. 
 
The AAP government's response came after the bench had on January 6 questioned the impact of the odd-even operation on pollution and asked it to consider restricting it to a week. 
 
Senior advocate Harish Salve, appearing for the Delhi government, submitted that the capital is piloting its first- ever emergency action to reduce peak pollution levels. 
 
"This is consistent with global best practice. Vehicles that are second highest emitters in the in the city are responsible for very high exposure and health impacts. 
 
"The first few days of the programme have already demonstrated that peak pollution levels are lower than the normal smog peaks of the season despite the adverse weather conditions," Salve said. 
 
He said that the scheme is to reduce congestion on the capital's roads that has further contributed towards lowering of pollution. 
 
"Emissions from vehicles caught in the congestion increase two times due to idling and frequent accelaration and deceleration," Salve submitted. 
 
He also said, "The Delhi government must be permitted to continue with the odd-even vehicle rationing scheme and if these adverse weather conditions continue, then our recommendation is that the programme should also be continued beyond 15 days." 
 
The Delhi government told the bench that particulate and nitrogen oxide load from cars have come down during odd-even programme by as much as 40 per cent and higher share of pollution benefits have come from reduction in diesel cars. 
 
However, this submission was opposed by the petitioners who said the AAP government has carried out a pick and choose policy against car owners whereas 46 per cent pollution is caused by trucks. 
 
The Delhi High Court Bar Association (DHCBA) President Rajiv Khosla, one of the petitioners who has challenged the Delhi government's December 28, 2015 notification that brought the formula, said the data submitted by the government is not correct. 
 
During the hearing, Salve, who was accompanied by Transport Minister Gopal Rai, other AAP leaders and the Delhi government's Senior Standing Counsel Rahul Mehra, submitted that the scheme was for the benefit of the people. 
 
The bench, which was hearing 12 petitions challenging the odd-even formula, had on January 6 asked the AAP government to consider if it can be restricted to a week instead of a fortnight as it was causing inconvenience to the public. 
It had also sought data related to changes in pollution level between January 1-7 and said though it does not interfere with the policies, the government must think about it as the people were complaining about inconvenience being caused to them due to insufficient public transport. 
 
The petitions have been filed by various individuals, including lawyers, who have challenged the AAP goverment's December 28, 2015 notification bringing into force the scheme which allows private cars having odd registration numbers to ply on odd dates and those with even numbers on even dates.

We have entered politics to change this and are asking for one chance to bring a change," Palekar said soon after accepting the mantle. "I was a victim of scams. Despite being a state ranker, because my father had no money I didn't get a government job. And I decided that one day I will fight against this injustice. AAP announces Amit Palekar as CM face for Goa polls

New Delhi, May 3 () Chief Minister Arvind Kejriwal on Sunday said the Delhi government will implement the centre's latest guidelines on lockdown relaxation and allow government and private offices to open from Monday but the suspension of travel by flight, metro and bus will continue. Addressing an online media briefing, Kejriwal said delivery of essential goods through e-commerce portals will continue in the national capital. The survey for the 7th Economic Census is being conducted nationwide through common services centres (CSCs) and was expected to be completed by March 2020. "It will take about a month from the date when lockdown ends to complete the economic census survey," CSC e-Goverance Services India CEO Dinesh Tyagi told . The Ministry of Statistics and Programme Implementation (MoSPI) has tied up with CSC e-Governance Service for the 7th Economic Census.Over 1.5 lakh trained enumerators have been deployed for the nationwide survey who will visit 35 crore establishments and households to carry out the CensusStarted in 1977, only six economic censuses have been done so far due to massive work involving in-depth survey and data compilation.This is the first time economic census is being done using digital platform which has reduced time for survey to 6 months from 2 years earlier.  Entering a market that is already highly competitive with players like <keyword id="1042120" type="PERSON" weightage="100" keywordseo="Uber">Uber</keyword>, <keyword id="6354720" type="PERSON" weightage="100" keywordseo="Ola">Ola</keyword>, Meru and many more carpooling start-ups coming up in the last 2 years, BlaBlaCar plays the game a little bit differently from the others. 
 
“Cheaper service and availability are the main business strategies in India. In Europe we have already made our mark as the cheapest ride sharing service for long distances too, in India it is more about the availability than the price,” said Raghav, India country manager of BlaBla car. 
 
He added that the main challenge is explaining to people what this is, as it is a new concept. But their numbers speak a different truth. During the odd-even rule in Delhi, they had a 65% increase in their services. 
 
“We will start integrating Goverment ID to authentic the identity in the platform soon,” he said.
