Declaring that "<keyword id="22950053" type="General" weightage="20" keywordseo="enough-is-enough" source="keywords">enough is enough</keyword>", President Droupadi Murmu on Wednesday said it is time for <keyword id="19895063" type="General" weightage="20" keywordseo="India" source="keywords" meta.keywordsubtype="org" meta.entityname="India" meta.hostid="261" meta.entityid="India">India</keyword> to wake up to the "perversion" of <keyword id="20177429" type="General" weightage="100" keywordseo="crimes-against-women" source="keywords">crimes against women</keyword> and counter the mindset that sees women as "less powerful, less capable, less intelligent". "Those who share such views then go further and see the female as an object... We owe it to our daughters to remove the hurdles from their path of winning the freedom from fear," Murmu said in an exclusive signed article for PTI. Referring to the August 9 <keyword id="19907938" type="General" weightage="20" keywordseo="rape" source="keywords">rape</keyword> and murder of a junior doctor in a <keyword id="19896626" type="General" weightage="20" keywordseo="kolkata" source="keywords">Kolkata</keyword> hospital, a "dismayed and horrified" president said what is even more depressing is that it is part of a series of <keyword id="20177429" type="General" weightage="100" keywordseo="crimes-against-women" source="keywords">crimes against women</keyword>. Murmu said no civilised society can allow daughters and sisters to be subjected to such atrocities. "The nation is bound to be outraged, and so am I," she wrote. The hard-hitting and personalised article, titled "<keyword id="19996463" type="General" weightage="20" keywordseo="womens-safety" source="keywords">Women's Safety</keyword>: <keyword id="22950053" type="General" weightage="20" keywordseo="enough-is-enough" source="keywords">Enough is Enough</keyword>", is the first time the president has articulated her views on the August 9 <keyword id="19896626" type="General" weightage="20" keywordseo="kolkata" source="keywords">Kolkata</keyword> incident that has once again shaken the conscience of the nation and led to widespread, continuing protests. The president gave the article after a detailed conversation on topical issues with a team of PTI senior editors, who called on her at Rashtrapati Bhavan to mark the 77th anniversary of the news agency's founding on August 27, 1947. "Even as students, doctors and citizens were protesting in Kolkata, criminals remained on the prowl elsewhere. The victims include even kindergarten girls," Murmu said. During the interaction, she recalled her recent meeting with a group of schoolchildren on Raksha Bandhan. "They asked me innocently if they could be assured that there would be no recurrence of the Nirbhaya-type incident in future," the president said, referring to the brutal <keyword id="19907938" type="General" weightage="20" keywordseo="rape" source="keywords">rape</keyword> and murder of a physiotherapy intern in Delhi in December 2012. She noted that an outraged nation then made plans and devised strategies, and the initiatives did make some difference. In the 12 years since, there have been countless tragedies of similar nature though only few drew nationwide attention, Murmu said. "Did we learn our lessons? As <keyword id="22950054" type="General" weightage="20" keywordseo="social-protests" source="keywords">social protests</keyword> petered out, these incidents got buried into a deep and inaccessible recess of social memory, to be recalled only when another heinous crime takes place," she said. Taking a macro view of the rights of women, she said they have had to fight for every inch of ground they have won. Social prejudices as well as some customs and practices have always opposed the expansion of women's rights, Murmu added. "This is a rather deplorable mindset... This mindset sees the female as a lesser human being, less powerful, less capable, less intelligent," she wrote. In her view, it is the objectification of women by a few that is behind the crimes against women. "It is ingrained deeply in the minds of such people," the president said, stressing that countering this mindset is a task for both the State and society. Acknowledging that there have been laws and social campaigns, she said, "Yet, there is something that continues to come in the way and to torment us." History, the president said, "often hurts" and societies scared to face history resort to "collective amnesia" to bury their heads in the sand like the proverbial ostrich. "Now the time has come not only to face history squarely but also to search within our souls and probe the pathology of crimes against women," she said in her impassioned appeal. "Let us deal with this perversion in a comprehensive manner so as to curb it right at the beginning. We can do this only if we honour the memory of the victims by cultivating a social culture of remembering them to remind us of our failures in the past and prepare us to be more vigilant in future," Murmu said. The society needs honest, unbiased self-introspection, and ask itself some difficult questions, the president said. "Where have we erred? And what can we do to remove the errors? Without finding out the answer to that question, the half of our population cannot live as freely as the other half," she said.

'Enough is enough': anguished President Murmu asks nation to wake up, end crimes against women

The <keyword id="19895344" type="General" weightage="20" keywordseo="Enforcement-Directorate" source="keywords">Enforcement Directorate</keyword> alleged Saturday that the CPI(M) in <keyword id="19896018" type="General" weightage="20" keywordseo="Kerala" source="keywords">Kerala</keyword> was holding proceeds of <keyword id="19899231" type="General" weightage="20" keywordseo="money-laundering" source="keywords">money laundering</keyword>, as it attached a land parcel and <keyword id="20202062" type="General" weightage="20" keywordseo="bank-deposits" source="keywords">bank deposits</keyword> worth Rs 73 lakh of the political party in a <keyword id="19913348" type="General" weightage="20" keywordseo="probe" source="keywords">probe</keyword> linked to the Karuvannur Service Cooperative Bank "scam". Assets worth Rs 28.65 crore of various individuals and entities linked to the case have also been attached by the federal agency after a provisional order under the <keyword id="19912399" type="General" weightage="20" keywordseo="prevention-of-money-laundering-act" source="keywords">Prevention of Money Laundering Act</keyword> (PMLA) was issued. Official sources said the party may be nam<keyword id="19956083" type="General" weightage="20" keywordseo="ED" source="keywords">ed</keyword> as an accused in the next supplementary chargesheet to be filed in this case. If so, it will be the second political party to be arraigned as accused in a money laundering investigation after the Aam Aadmi Party. AAP has recently been named by the ED in the Delhi excise policy case. The CPI(M) vehemently denied the charges of wrongdoing and money laundering. The attached assets include 18 immovable properties, valued at Rs 28.65 crore, consisting of lands and buildings in Kerala of the beneficiaries of the "scam", including an immovable property worth Rs 10 lakh registered in the name of a district secretary of the Communist Party of India (Marxist) for a party office, the ED said in a statement. The attachment also includes eight movable properties, including a credit balance of Rs 63.62 lakh in eight "undisclosed" bank accounts of the CPI(M) local area committees in Thrissur, it added. The agency claimed that the CPI(M) received these funds from the beneficiaries as donations through the governing body and the party is "in possession of proceeds of crime" which has been invested in the purchase of immovable properties and credited to its five bank accounts in the Karuvannur Service Cooperative Bank Ltd. The bank is promoted by the party. The CPI(M) rejected the ED charges, saying it would legally and politically fight any move by the agency to arraign it in the case linked to the alleged multi-crore Karuvannur bank scam. Party state secretary M V Govindan alleged that the ED was trying to make opposition parties and their leaders accused in various cases due to political reasons. He also accused the central agency of attempting to create a smokescreen as it had failed to collect any evidence against the party. The ED believes that the land parcel attached by it was meant for the CPI(M) party office and was purchased using alleged kickbacks from the loanees or beneficiaries of the loans sanctioned by the Karuvannur Service Cooperative Bank. The agency has relied on the "confessional" statements of at least two accused in this case who claimed in their statements recorded before a judicial magistrate that the purported irregularities in the bank were orchestrated at the behest of CPI(M) Thrissur district committee leaders. The ED alleged that "bogus loans" were sanctioned by the Karuvannur Service Cooperative Bank on the same property multiple times without the knowledge of members of the society. "Investigation found benami loans were sanctioned to non-members against inflated property valuations in the names of other members and such loan funds were siphoned off and laundered by the accused beneficiaries," it said, adding that the loan amounts were disbursed in cash to avoid a money trail. "Such benami and illegal loans were sanctioned at the behest of the secretary and the governing body of the society in connivance with the then-bank manager, at the behest of the Thrissur district committee, CPI(M). "In return, the Thrissur district committee, CPI(M), collected money in the form of donations and salary cut from the beneficiaries and society committee members into their undisclosed and illegally opened bank accounts in the same society," the agency said. These funds, according to the ED, were utilised for the purchase of land worth Rs 10 lakh by the secretary of the Thrissur district committee of the CPI(M) for the construction of the party office, which has now been attached as proceeds of crime. Govindan said it has been a decades-long practice of registering the office and other assets of party units in the name of the respective district committees. What role does the party have in the office constructed by one of its local committees, he asked. But the ED is now trying to tarnish the image of the CPI(M) in the name of the assets of one such party unit, Govindan claimed. "We will fight it legally and politically. We haven't got any notice in this regard so far," he told reporters. The ED filed a chargesheet in this case against 55 accused entities in November last year. The money laundering case stems from 16 FIRs registered by the <keyword id="20086884" type="General" weightage="20" keywordseo="kerala-police" source="keywords">Kerala Police</keyword> (<keyword id="20146853" type="General" weightage="20" keywordseo="crime-branch" source="keywords">Crime Branch</keyword>) in Thrissur in 2010. Four people have been arrested by the ED in this case so far.

After AAP, ED attaches land, bank deposits of CPI(M); says party holding proceeds of money laundering

Union Home Minister <keyword id="19899491" type="General" weightage="20" keywordseo="Amit-Shah" source="keywords">Amit Shah</keyword> on Monday stated that the first case filed under new <keyword id="19917982" type="General" weightage="20" keywordseo="criminal-justice-laws" source="keywords">criminal justice laws</keyword> was about a motorcyle theft registered in <keyword id="20161263" type="General" weightage="20" keywordseo="Gwalior" source="keywords">Gwalior</keyword> in <keyword id="19898705" type="General" weightage="20" keywordseo="Madhya-Pradesh" source="keywords">Madhya Pradesh</keyword> at 10 minutes past midnight. "...The first case (under the new laws) was registered at a Police station in <keyword id="20161263" type="General" weightage="20" keywordseo="Gwalior" source="keywords">Gwalior</keyword>. It was a case of theft, someone's motorcycle was stolen. The case was registered at 12.10 am...As far as the case against a vendor (registered at a Police Station in Delhi) is concerned, there were provisions for the same earlier too and it is not a new provision. Police used the provision to review it and dismissed that case," Shah said while addressing a press conference here. Shah's clarification came in response to a media query about the first first case lodged under the new laws that have come into force beginning from today. Delhi Police had registered a case at Kamla Market Police Station in the national capital against a street vendor under the new laws. "If the date of crime is before July 1, 2024, then it will be tried under old laws, if it is later, it will be tried under new laws," Shah said at the press conference today. The three new criminal laws- the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA), came into effect today. Under this the Indian Penal Code (IPC) has been replaced with the Bharatiya Nyaya Sanhita, the CrPC with Nagarik Suraksha Sanhita and the Indian Evidence Act has been replaced with the Bharatiya Sakshya Adhiniyam. These laws had recieved the assent by President Droupadi Murmu on December 25, 2023. Detailing the new laws, the Union Minister said, "...First of all, I would like to congratulate the people of the country that about 77 years after independence, our criminal justice system is becoming completely 'Swadeshi'. This will function on Indian ethos. After 75 years, these laws were contemplated upon and when these laws are in effect from today, colonial laws have been scrapped and laws made in the Indian Parliament are being brought into practice. Instead of 'Dand', it is now 'Nyay'. Instead of delay, there will be speedy trial and speedy justice. Earlier, only the rights of the Police were protected but now, vicitms' and complainants' rights will be protected too." The <keyword id="6355392" type="General" weightage="20" keywordseo="high-court" source="Orion">high court</keyword>, which was dealing with a case of dowry death of a woman after being allegedly harassed by her husband and in-laws for bringing insufficient dowry and giving birth to two daughters, said in contemporary times, the idea of a woman's worth being tied to material considerations contradicts the principles of equality and dignity. "The persistent prevalence of regressive mindsets and instances exemplified by cases involving insatiable demands for dowry underscores a broader societal concern. It highlights the challenges faced by married women, whose intrinsic value and dignity should not be contingent upon their parents' ability to meet the insatiable financial demands from their in-laws," Justice Swarana Kanta Sharma said. The <keyword id="6355392" type="General" weightage="20" keywordseo="high-court" source="Orion">high court</keyword> said it is disturbing to witness a scenario where parents wish for the well-being of their daughter and her comfort after she leaves her paternal house and tries to settle in the matrimonial home but instead of providing her love and support, the new bride is met with unrelenting greed and harassment from in-laws family. It said the trauma is multiplied and becomes lifelong when the victim of a dowry-related offence gives up her life due to constant torture and harassment, especially when the two daughters she has given birth to and loved also become a ground to harass and traumatise her as if she is solely responsible for the <keyword id="20152579" type="General" weightage="20" keywordseo="childs-gender" source="Orion">child's gender</keyword>. "Surprisingly, the genetic science in this regard is ignored according to which, the genetic determination of gender of the unborn child when the child is conceived, involves the combination of X and Y chromosomes, with females possessing two X chromosomes (XX) and males having one X and one Y chromosome (XY)." "According to <keyword id="20139732" type="General" weightage="20" keywordseo="encyclopedia-britannica" source="keywords">Encyclopedia Britannica</keyword>, the outcome of fertilisation depends on whether an unfertilised egg fuses with a sperm carrying an X or Y chromosome, resulting in the birth of a girl or boy, respectively," the high court said. It said the court had dealt with numerous cases of harassment, nagging and suicide or dowry deaths due to the victim being victimised for giving birth to daughters after being constantly harassed over not being able to fulfil her husband and in-laws' desire of "preserving the family tree". Justice Sharma said the court is "constrained to observe that such people need to be educated that it is their son and not their daughter-in-law whose chromosomes through the union of a married couple will decide the gender of their child. "Even if this judgement becomes the birthplace of such enlightenment, it will go a long way to change the mindsets of perpetrators of such crimes and save lives of innocent married women, by using principles of science through principles of law," she said. The high court made the observations while denying bail to the husband in a dowry death case. The allegations against the accused were that he along with his family members used to torture his wife for dowry leading to her committing suicide. It has been alleged by the complainant, father of the deceased woman, that the accused and his family pressured his daughter for additional dowry and financial demands, causing significant distress. It has also been alleged by him that she was taunted and mistreated for giving birth to two daughters. The high court, in its order, said prima facie at this stage, a woman has lost her life for giving birth to daughters, which should be unacceptable to a conscientious society and such offences have to be considered grave and serious when the trial is yet to begin. "In view of the above facts and circumstances, and since the allegations against the present applicant/accused are grave and serious in nature, the charges are yet to be framed and the material witnesses are yet to be examined, this court is not inclined to enlarge him on bail," it said. The court further opined that in a society that emphasises equality and strives for equal progress of women and women empowerment, incidents like this are etched as disheartening markers on the path of equal societal advancement for women. It said the notion that a woman's value diminishes if her parents cannot fulfil dowry expectations of her husband and in-laws reflects a deep-seated bias and discrimination against women. Such expectations not only violate the principles of gender equality but also contribute to an environment where women are objectified and reduced to mere transactions, the court said while acknowledging the profound distress experienced by parents, who in the earnest pursuit of their daughter's happiness, bestowed everything they had to allegedly fulfil the dowry demands of her in-laws.
