Start-ups from all over the world will now be able to register their patents in India at a faster rate and for much lower costs, thanks to a 'tatkal (instant)' option that the government is offering under its latest amended patent rules. 
 
These benefits will also be available to entities who would be filing their first application in India. 
 
As reported yesterday, India has changed the rules for patent registration, also including the definition of 'start-up' in the patent rules so that special benefits can be passed on to the start-ups. As per the amended rules, the time period for granting patents has been reduced from 5-7 years to 2.5 years immediately and would further be reduced to 1.5 years by March 2018. 
 
"We want to encourage domestic filings," said Rajiv Aggarwal, joint secretary of DIPP. 
 
Talking of start-ups, they have been qualified as "individual persons" rather than companies, so that patent fees can come down and make them eligible for 80% rebate, according to the start-up action plan. 
 
For ‘tatkal’ scheme, start-ups will have to pay Rs 8,000 while for companies it is about Rs 60,000. 
 
Not only this, amended rules also hint at refund of patent fees for the first time. When an application is withdrawn and there is no need for the request for examination, 90% of the amount would be reimbursed.

Prime Minister <keyword id="6354477" type="PERSON" weightage="100" keywordseo="Narendra-Modi">Narendra Modi</keyword> had launched the <keyword id="3208839" type="UNKNOWN" weightage="100" keywordseo="Startup-Action-Plan">Startup Action Plan</keyword> in January this year amidst a lot of hullabaloo, and if reports are to be believed, the Indian government is busy reviewing the plan so that it can be aware whether or not the plan is moving in the right direction.

 As per reports, <keyword id="6391107" type="ORGANIZATION" weightage="100" keywordseo="DIPP">DIPP</keyword> is collating the progress that has been made on the plan so far, and the report it prepares will be shared with <a href="http://www.businessinsider.in/Niti-Aayog-India-renewable-energy/articleshow/52359002.cms">Niti Aayog</a>, the government’s think tank. 
 
DIPP recently revised the patent rules so that start-ups can get a conducive environment, after which it has now put together a group of 280 experts, including lawyers and consultants, who would be assisting these start-ups in filing their patent applications.

As per the amended patent rules, patents can be <a href="http://www.businessinsider.in/Like-railway-tickets-and-passports-patent-applications-will-also-get-Tatkal-windows-for-faster-clearance/articleshow/52311055.cms">registered faster than before</a>, and companies who follow the definition of 'start-up' also stand eligible for special benefits. Other than this, the government also wants to open <a href="http://www.businessinsider.in/Start-ups-will-now-get-incubation-hubs-in-every-state-thanks-to-the-Industry-Ministry/articleshow/51976871.cms">incubation centres all across India</a> so that the start-up movement can be spread to tier-II and III cities, with an increased focus on the north eastern states.

Government is keeping a close eye on how well the startup action plan is shaping up

<keyword id="3209160" type="ORGANIZATION" weightage="20" keywordseo="DIPP-secretary-amitabh-kant">DIPP Secretary Amitabh Kant</keyword> says India will reduce its massive backlog of patent patency in coming 18 months and will bring down to US, Japan levels. 
 Addressing a jam-packed audience at <keyword id="3003094" type="UNKNOWN" weightage="20" keywordseo="Startup-India">Startup India</keyword> event at Vigyan Bhawan in New Delhi, Kant said <keyword id="388837" type="UNKNOWN" weightage="20" keywordseo="intellectual-property">Intellectual Property</keyword> Rights applications will be processed as around 1,000 patent examiners have been hired and the work has also been outsourced to IITs. 
 
"In 18 months time we will bring our patent pendency to exactly the same level as in the US and Japan. And in about a year's time we will bring the trade mark pendency down to zero level," said Kant. 
 
About 2.46 lakh patent applications and 5.32 lakh trademark registrations were pending (as on November 1, 2015) due to shortage of manpower. On the other hand, the pendency level is quite low in developed countries like the US and Japan. 
 
When asked what will be done to ensure that Startups are not limited to cities like Bengaluru and Gurgaon, HRD Secretary V S Oberoi said his ministry will provide the backup, handholding and other helps to young entrepreneurs. 
 
"Our effort is to spread this across India...In the next few months I would see a strong element of support that incidentally is not metro or big city oriented. It is really out there (other parts of the country) we hope to concentrate," he added.

Overall, Indians account for only 17%-18% of total registrations. The country marks seventh for the patent filing office in the world. The DIPP plans to cut down on the time incurred while examining and granting patents. To accelerate the patent granting process, the department is also looking to increase its headcount with more hirings and evolving with the growing technology. At present, the process takes 5-7 years including filing an application, the publication involved, examining the patent and finally granting it to the group. But, the DIPP is bidding to trim it to 18 months by March, 2020.
